There are no public officers. There must be a bond. The bond must be in gold or silver. The oath must be subscribed on the back of the bond. Lacking this all public offices are vacant (including the top office of chief magistrate). This makes all office holders de facto. The acts of a de facto officer are valid except where there is no office. Because the acts are valid a bill may be sent to the state. The bond limits the liability of someone occupying a de jure office. The de facto agent has no limits to his/her liability for his/her acts. He/she assumes all risk as does the state they represent.
