No legal fiction survives the Rule Against Perpetuities unless it acts as a charitable trust. The Articles of Confederation declared itself a perpetuity but the word does not appear in the U.S. Constitution. The Articles are defunct while too many people hold the belief that the U.S. they know and love is the same one that is over 99 years old.

The question is not what form the government takes but rather whether our status is that of a beneficiary or fiduciary of the charitable trust. In TRUST LAND there are only these two statuses. Fiduciaries vote and get sent to prison for violating the trust. Beneficiaries are largely ignored. I personally don't find much of a benefit in prison time so I try to hang out on the beneficiary side of the discussion.

If government doesn't pass the Rule Against Perpetuities test as a charitable trust then it passes as a coup d'ét at war with a charitable trust.
