"Rescission may be made good by ratification or by the silence of the parties; and neither of the parties can demand it"
Interesting that ratification and silence both "make good". The problem with silence is it can go on for decades if unrecorded and then an agent decides there is still a contract his estate needs to profit from.
Silence may be recorded. In published public notice or letters have responses sent to your secretary. When no response is received an affidavit from the secretary to that effect is notarized and everything is recorded.
And THAT is the Sound of Silence!!
Silence makes no noise. Normal recording devices (tape or electronic) record silence but imparts no information. Music is known to be the silence between the notes but everyone pays attention to the notes rather than the space between them.
I have held the view that more information is contained in the space between the words rather than the words themselves. A blank paper has more information than all encyclopedia put together.
Rescind your unconsciouble contracts but make the silence heard. Silence does not ratify. Silence rescinds.
