When Prime Minister Justin Trudeau unveiled his election platform on Sept. 1, he made a promise to employers: “we’ll protect businesses that mandate vaccinations from unjustified lawsuits.”

Now, employment lawyers say lawsuits from fired unvaccinated workers are beginning to pile up — and the federal government’s protections are nowhere to be seen.

“We are seeing a huge amount of cases, claims, lawsuits involving terminations resulting from an individual’s vaccine status,” said Lior Samfiru, a Toronto employment lawyer and co-founder of Samfiru Tumarkin LLP.

“In fact, in my 20 years of practising law, I have not seen so many cases dealing with the same issue over such a short period of time.”

It’s a weird thing to do at this stage of the pandemic , given that many health authorities are now explicitly telling Canadians not to bother isolating if they’re asymptomatic. With Omicron spreading so widely, epidemiologists are generally working from the premise that almost everyone has been exposed to COVID-19 at some point, and to take precautions only in special circumstances. Ontario’s official public health guidelines advise people in Trudeau’s situation to continue living their lives, but to avoid “high-risk settings” such as senior’s homes. Trudeau claims he is following the guidelines of Ottawa Health, but the health authority’s public guidelines only advise a five day isolation period in the case that someone is unvaccinated. Not only is Trudeau thrice-vaccinated, but a rapid test that he took after the alleged exposure turned up negative.

A night with the untouchables

I live in downtown Ottawa, right in the middle of the trucker convoy protest. They are literally camped out below my bedroom window. My new neighbours moved in on Friday and they seem determined to stay. I have read a lot about what my new neighbours are supposedly like, mostly from reporters and columnists who write from distant vantage points somewhere in the media heartland of Canada. Apparently the people who inhabit the patch of asphalt next to my bedroom are white supremacists, racists, hatemongers, pseudo-Trumpian grifters, and even QAnon-style nutters. I have a perfect view down Kent Street – the absolute ground zero of the convoy. In the morning, I see some protesters emerge from their trucks to stretch their legs, but mostly throughout the day they remain in their cabs honking their horns. At night I see small groups huddled in quiet conversations in their new found companionship. There is no honking at night. What I haven’t noticed, not even once, are reporters from any of Canada’s news agencies walking among the trucks to find out who these people are. So last night, I decided to do just that – I introduced myself to my new neighbours.

At 10pm I started my walk along – and in – Kent Street. I felt nervous. Would these people shout at me? My clothes, my demeanour, even the way I walk screamed that I’m an outsider. All the trucks were aglow in the late evening mist, idling to maintain warmth, but all with ominously dark interiors. Standing in the middle of the convoy, I felt completely alone as though these giant monsters weren’t piloted by people but were instead autonomous transformer robots from some science fiction universe that had gone into recharging mode for the night. As I moved along I started to notice smatterings of people grouped together between the cabs sharing cigarettes or enjoying light laughs. I kept quiet and moved on. Nearby, I spotted a heavy duty pickup truck, and seeing the silhouette of a person in the driver’s seat, I waved. A young man, probably in his mid 20s, rolled down the window, said hello and I introduced myself. His girlfriend was reclined against the passenger side door with a pillow to proper her up as she watched a movie on her phone. I could easily tell it’s been an uncomfortable few nights. I asked how they felt and I told them I lived across the street. Immediate surprise washed over the young man’s face. He said, “You must hate us. But no one honks past 6pm!” That’s true. As someone who lives right on top of the convoy, there is no noise at night. I said, “No, I don’t hate anyone, but I wanted to find out about you.” The two were from Sudbury Ontario, having arrived on Friday with the bulk of the truckers. I ask what they hoped to achieve, and what they wanted. The young woman in the passenger seat moved forward, excited to share. They said that they didn’t want a country that forced people to get medical treatments such as vaccines. There was no hint of conspiracy theories in their conversation with me, not a hint of racist overtones or hateful demagoguery. I didn’t ask them if they had taken the vaccine, but they were adamant that they were not anti-vaxers.

The next man I ran into was standing in front of the big trucks at the head of the intersection. Past middle age and slightly rotund, he had a face that suggests a lifetime of working outdoors. I introduced myself and he told me we was from Cochrane, Ontario. He also proudly pointed out that he was the block captain who helped maintain order. I thought, oh no, he might be the one person keeping a lid on things; is it all that precarious? I delicately asked how hard his job was to keep the peace but I quickly learned that’s not really what he did. He organized the garbage collection among the cabs, put together snow removal crews to shovel the sidewalks and clear the snow that accumulates on the road. He even has a salting crew for the sidewalks. He proudly bellowed in an irrepressible laugh “We’re taking care of the roads and sidewalks better than the city.” I waved goodbye and continued to the next block.

My next encounter was with a man dressed in dark blue shop-floor coveralls. A wiry man of upper middle age, he seemed taciturn and stood a bit separated from the small crowd that formed behind his cab for a late night smoke. He hailed from the Annapolis Valley, Nova Scotia. He owned his own rig, but he only drove truck occasionally, his main job being a self-employed heavy duty mechanic. He closed his shop to drive to Ottawa, because he said, “I don’t want my new granddaughter to live in a country that would strip the livelihood from someone for not getting vaccinated.” He introduced me to the group beside us. A younger crowd, I can remember their bearded faces, from Athabasca, Alberta, and Swift Current Saskatchewan. The weather had warmed, and it began to rain slightly, but they too were excited to tell me why they came to Ottawa. They felt that they needed to stand up to a government that doesn’t understand what their lives are like. To be honest, I don’t know what their lives are like either – a group of young men who work outside all day with tools that they don’t even own. Vaccine mandates are a bridge too far for them. But again, not a hint of anti-vax conspiracy theories or deranged ideology.

I made my way back through the trucks, my next stop leading me to a man of East Indian descent in conversation with a young man from Sylvan Lake, Alberta. They told me how they were following the news of O’Toole’s departure from the Conservative leadership and that they didn’t like how in government so much power has pooled into so few hands.

The rain began to get harder; I moved quickly through the intersection to the next block. This time I waved at a driver in one of the big rigs. Through the rain it was hard to see him, but he introduced himself, an older man, he had driven up from New Brunswick to lend his support. Just behind him some young men from Gaspésie, Quebec introduced themselves to me in their best English. At that time people started to notice me – this man from Ottawa who lives across the street – just having honest conversations with the convoy. Many felt a deep sense of abuse by a powerful government and that no one thinks they matter.

Behind the crowd from Gaspésie sat a stretch van, the kind you often see associated with industrial cleaners. I could see the shadow of a man leaning out from the back as he placed a small charcoal BBQ on the sidewalk next to his vehicle. He introduced himself and told me he was from one of the reservations on Manitoulin Island. Here I was in conversation with an Indigenous man who was fiercely proud to be part of the convoy. He showed me his medicine wheel and he pointed to its colours, red, black, white, and yellow. He said there is a message of healing in there for all the human races, that we can come together because we are all human. He said, “If you ever find yourself on Manitoulin Island, come to my reserve, I would love to show you my community.” I realized that I was witnessing something profound; I don’t know how to fully express it.

As the night wore on and the rain turned to snow, those conversations repeated themselves. The man from Newfoundland with his bullmastiff, a young couple from British Columbia, the group from Winnipeg that together form what they call “Manitoba Corner ” all of them with similar stories. At Manitoba Corner a boisterous heavily tattooed man spoke to me from the cab of his dually pickup truck – a man who had a look that would have fit right in on the set of some motorcycle movie – pointed out that there are no symbols of hate in the convoy. He said, “Yes there was some clown with a Nazi flag on the weekend, and we don’t know where he’s from, but I’ll tell you what, if we see anyone with a Nazi flag or a Confederate flag, we’ll kick his fucking teeth in. No one’s a Nazi here.” Manitoba Corner all gave a shout out to that.

As I finally made my way back home, after talking to dozens of truckers into the night, I realized I met someone from every province except PEI. They all have a deep love for this country. They believe in it. They believe in Canadians. These are the people that Canada relies on to build its infrastructure, deliver its goods, and fill the ranks of its military in times of war. The overwhelming concern they have is that the vaccine mandates are creating an untouchable class of Canadians. They didn’t make high-falutin arguments from Plato’s Republic, Locke’s treatises, or Bagehot’s interpretation of Westminster parliamentary systems. Instead, they see their government willing to push a class of people outside the boundaries of society, deny them a livelihood, and deny them full membership in the most welcoming country in the world; and they said enough. Last night I learned my new neighbours are not a monstrous faceless occupying mob. They are our moral conscience reminding us – with every blow of their horns – what we should have never forgotten: We are not a country that makes an untouchable class out of our citizens.

How interesting. I didn't follow the link but in thinking about it, there are many ramifications. For one, if they can't get the tow truck drivers to do their bidding, how can they expect the fuel delivery trucks to keep the government supplied? I can see this whole thing spiralling on and on. This is a show down. The people against an out of control government. It is about time to get things sorted out. I hope the truckers stand firm and solidarity reigns. I hope the Canadian people keep their resolve. They will bear the brunt of the shortages that entail.

As of this writing, GoFundMe has cut off (stolen) $9 million from the Canadian Trucker Convoy.

The money was donated by thousands of individuals to support the truckers, who are demanding the Canadian government cancel vaccine mandates, vaccine passports, and brutal COVID restrictions.


After a major backlash from the enraged public, GoFundMe has stated it will automatically refund all $9 million to the individual donors.


Regardless, GoFundMe will not forward the money to the group it was intended for: the truckers.


All right: here come the dots—


A venture capital firm, Accel, and Technology Crossover Ventures, own the majority stake in GoFundMe.


The big infusion of cash that sent Mark Zuckerberg and his fledgling college enterprise on their way came from Accel, in 2004.


Jim Breyer, head of Accel, attached a $13 million rocket to Facebook, and nothing has ever been the same. (Breyer—billionaire, CFR, World Economic Forum, major fund investor in China.)


Earlier in 2004, a man named Gilman Louie joined the board of the National Venture Capital Association of America (NVCA). The chairman of NVCA? Jim Breyer. Gilman Louie happened to be the first CEO of the important CIA start-up, In-Q-Tel.


In-Q-Tel was founded in 1999, with the express purpose of funding companies that could develop technology the CIA would use to “gather data.”


That’s not the only connection between Facebook funder and Accel’s Jim Breyer and the CIA’s man, Gilman Louie. In 2004, Louie went to work for BBN Technologies, headed up by Breyer. Dr. Anita Jones also joined BBN at that time. Jones had worked for the CIA’s In-Q-Tel and was an adviser to DARPA, the Pentagon’s technology department that helped develop the Internet.

With these CIA/DARPA connections, it’s no surprise that Jim Breyer’s jackpot investment in Facebook is not part of the popular mythology of Mark Zuckerberg. Better to omit it. Who can fail to realize that Facebook, with its endless stream of personal data, and its tracking capability, is an ideal CIA asset?


Accel co-owns the majority stake in GoFundMe. Accel has a history of rubbing shoulders with the CIA. Accel helped launch Facebook, the largest profiling and data-mining company in the world.


Given all this, it might be more surprising if GoFundMe DIDN’T cut off the Canadian truckers’ $9 million.


It’s also worth mentioning that Accel has invested in Spotify, the platform whose number-one star is Joe Rogan. As the Trucker Convoy begins its third week, Ottawa police have mobilized in full force to crackdown on the protesters.

On Friday, police set up a perimeter around the protest zone and moved in to begin making mass arrests.

Access to Parliament Hill was blocked off overnight and a large number of police and armored vehicles arrived on the scene.

Their numbers grew throughout the morning.

Once the officers had gathered, they began their descent into the protest zone. A massive line of Police clashed with protesters as they methodically pushed forward to corral the convoy.

Dozens of brave protesters, many of which were veterans, stood their ground and refused to budge as the line of officers continued to bear down on them.

The police were making arrests as they went, forcefully grabbing individuals who had been separated from their groups.

In one video, officers can be seen forcing a protester to the ground and kicking him once he is down.

Bystanders attempt to intervene, but the officers form a barricade around the man to block their action from view.

Officers then made their way into the convoy itself, where all of the vehicles are blockading the streets.

Some people willingly got out of their vehicles when they were surrounded by officers, but others reportedly had their windows smashed out as they were forcibly removed.

One man, who has been at the protests for over a week, was removed after officers broke 3 of his windows to get him out of his vehicle.

It’s no wonder the Ottawa Police are keeping journalists out of the area by threatening them with jail time, this is getting ugly – and fast.

This is what happens with a tin pot, two-faced tyrant like Trudeau is in charge. It’s Canada’s Tiananmen Square moment.

The guy in this clip is saying the cops handcuff the people, take them about 15 or 20 minutes away and release them in the middle of nowhere because they can't charge them for standing peaceably in a public area.

Ottawa Police horses trampled two individuals during Ottawa protests, one being an elderly indigenous woman who was taken to the hospital.
Interim police chief Steve Bell maintains that a bicycle was thrown and protesters were getting aggressive.

As the horses trotted in, an elderly indigenous woman was knocked off her walking scooter and hit the ground. Another man was trampled by the horse. Police claim there was a bicycle thrown at the horses which caused them to to trip. As an eye witness, there was no bicycle anywhere, only her walking scooter, and nothing was thrown...

Ottawa police chief Steve Bell stated,
“Almost immediately there [were] tweets, there [were] pictures that had been photoshopped, out on social media that indicated people had died, that the horses had run over someone with a walker in the crowd.”

Bell went on to say he would “check” into the idea that it was not a bicycle and get back to people. So far, even though the video and photo evidence is clear, the Ottawa Police have said nothing.

Has there been a massive exodus of capital out of the Canadian financial system?
A few obscure but interesting data-points seem to indicate Justin Trudeau’s unprecedented use of the federal government and intelligence apparatus to target the bank accounts of Canadian citizens has just created a serious problem for their financial institutions.

If I was a betting person, I would bet half my stake that something very serious is happening in the background of the Canadian financial system, and it appears the leaders inside government, as well as leaders in the international financial community, are reacting and trying to keep things quiet...

If the government can work with the RCMP to target people based on an arbitrary political decree, and then control your bank account while simultaneously giving financial institutions liability protection for their participation, the confidence in the banking system is immediately undermined.

What might seem like a great tool for political punishment has long term consequences, especially if people start withdrawing their money and/or shifting the placement of their investments to more secure locations away from the reach of the Canadian government.

Public Safety Minister Marco Mendicino says the federal government will be in a position to act should law enforcement detect nefarious financial support of the “Freedom Convoy.”

Emergency Preparedness Minister Bill Blair added that it is necessary to cast a light on the sources of funding who are endorsing “illegal activity.”

“I think when [Canadians] understand the source of some of this funding, it helps them understand the motivation of this protest – who is actually behind it – and I think it also reveals some of the false nature of claims being made and the positions being put forward,” he said on Monday.

MPs on the House of Commons Public Safety and National Security Committee have called GoFundMe to testify about the funds raised.

“Important questions remain about how such a huge sum of money could be raised by anonymous donors and what their motivations were. People are rightly worried about American interference and what sort of standard is applied when donations are accepted,” reads a statement from the NDP’s public safety critic Alistair MacGregor.

An Ontario judge ruled Monday that the previous judge who denied Lich bail made errors in law. The Alberta resident was released on $25,000 in bonds and must leave Ottawa within 24 hours and Ontario within 72 hours.

Lich was arrested Feb. 17 and remained in custody after initially being denied bail. Lich spearheaded a GoFundMe campaign to raise money for the convoy, which was shut down after raising more than $10 million. The Medicine Hat, Alta. native is charged with counselling to commit mischief.

Justice John Johnston said in his decision that in denying Lich bail two weeks ago, Justice Julie Bourgeous erred when weighing the seriousness of Lich's charges by comparing them to the seriousness of the impact of the "Freedom Convoy" and not to other criminal code offences.

Lich, 49, Johnston noted, had lived a "pro-social" life prior to these charges and had no criminal record, suggesting that these factors may be grounds for a lighter sentence, should Lich be convicted. Johnston was concerned that Lich could spend more time in pre-trial custody than a sentence might deliver...

Lich is also prohibited from accessing or using social media, or having anyone use it on her behalf. She also cannot attend or engage in any future protests of COVID-19 mandates. Lich's surety must have easy and regular access to her electronic devices to ensure this. She is also prohibited from being in contact with several other organizers or leaders of the convoy movement.

During last week's bail review, an argument was put forward in regard to the previous judge who denied Lich bail. Lich argued that had she known of Justice Julie Bourgeois's unsuccessful run as a federal Liberal Party candidate in 2011, she would have asked Bourgeois recuse herself because the "Freedom Convoy" was a protest against the current Liberal government.

The RCMP told MPs Monday that it only gave the names of people directly involved in Ottawa protests to banks to freeze their accounts, and not supporters who donated to the so-called Freedom Convoy.

The lists of protesters given to banks included personal details from the police database, such as whether protesters had been suspected of other crimes, had witnessed crimes or had other “dealings” with the police, as well as personal information such as age and height.

RCMP Supt. Denis Beaudoin told the House of Commons finance committee that banks, building societies and other institutions were sent “different types of information” from the police database on protesters, depending on what was in their files...

Angelina Mason of the Canadian Bankers Association said the RCMP, when it identified people involved in the protests, gave the banks “a high-level description of what they thought the activities were” in Ottawa.

The RCMP told the committee that around 257 accounts of people and businesses involved in the protests had been frozen by financial institutions.

Assistant RCMP Commissioner Michel Arcand said the accounts were frozen to encourage protesters in Ottawa to leave and to discourage others from joining the protests.

He said the special measures in the Emergencies Act freezing accounts were useful and “did encourage people to leave.”..

The Emergencies Act was in force from Feb. 15 to 23. It was invoked by Prime Minister Justin Trudeau for the first time in Canada’s history to deal with the protests.

The act imposed a legal obligation on banks to freeze the accounts of protesters named by the RCMP.

All those who had their accounts frozen under the emergency laws have now had them unfrozen, according to Mason, though some related to court orders may still be frozen.

She said that banks were likely to retain information in their files that an individual’s account had been frozen. However, it was up to individual banks how to deal with their customers.

As the city continues to grapple with the ongoing demonstrations, businesses have been at the brunt of the impact.

That's because some of those downtown businesses, especially, were forced to close its doors for nearly a week, according to Chair of Ottawa Coalition of BIAs, Michelle Groulx.

Groulx explained to The Sam Laprade Show on Monday, February 7, that many businesses have also been fearful of opening since restrictions have eased on January 31, when the protest was in its third day.

"We're seeing a lot more closures directly because of the protests, whether it'd be fear of safety, noise, and then also obstruction," she explained. "We're seeing a lot of business closed, a lot businesses had to send staff home and so you have a lot of people who haven't really been working for the past week."

Enrico and Deborah Kuhn, the husband and wife owners of the Iconic Cafe, ignored Ottawa Mayor Jim Watson’s request that businesses around the protest zone close while the Freedom Convoy was in the city. They both knew the truckers posed no danger to them and they desperately needed the business the truckers brought due to the past two years of restrictions and lockdowns affecting their cafe.

By staying open the Iconic Cafe showed the narrative about the truckers being “extremists” keeping small businesses from opening was an entirely false narrative created by the city government and pushed by the legacy media.

It is unclear whether the landlord is voluntarily forcing them out or if the City of Ottawa put pressure on them to evict the Iconic Cafe.

"Whether their ability to do that was there, whether their understanding of how to do that was realistic, is actually irrelevant to what they wanted to do," Jody Thomas said. "I think we have to think about it from that lens."

Thomas, the former deputy minister of national defence, became one of Justin Trudeau's top advisers almost two months ago.

Speaking at the Ottawa Conference on Security and Defence Thursday, Thomas said the Emergency Act is meant for extreme situations and the so-called 'freedom convoy' met that bar...

Prime Minister Justin Trudeau’s national security and intelligence adviser Jody Thomas spoke out about the use of the Emergencies Act, which was invoked for the first time in Canadian history by Prime Minister Trudeau last month, to end the weeks-long Freedom Convoy protests in Ottawa.

“The occupation of Ottawa in and of itself was enough,” Thomas insisted at the Ottawa Conference on Security and Defence earlier this week.

“The occupation of Ottawa was dug in. They had supply chains. They had organization. They had funding coming in from across Canada but also other countries,” Thomas continued, alleging that “The people who organized that protest – and there were several factions … there is no doubt – came to overthrow the government,” according to a Globe and Mail newspaper report.

Thomas went on to claim that while the border blockades in Ontario, Manitoba, and Alberta had ended along with the protest in downtown Ottawa, the government needed to address issues relating to ideological extremism.

“Domestic, ideologically motivated extremism is here and it is here to stay. We have lived in the splendid, naïve sort of superiority that this was not our problem in Canada – that this was a south-of-border problem,” she said.

Despite the claims of Ms Thomas, none of the Freedom Convoy protestors stormed the Canadian parliament or any other government building during the weeks of protests, and media were forced to admit the demonstrations had been almost entirely peaceful.

The firm Abacus Data sampled the views of 1,500 Canadians back in May and what it discovered is both alarming and disquieting to say the least.

For example, 52 per cent said that “official government accounts of events can’t be trusted.” And 44 per cent said “much of the information we receive from news organizations is false.”

So roughly half the population do not trust two key pillars of established society – government and the news media...

More than one-third – 37 per cent – said they “think there is a group of people in this country who are trying to replace native-born Canadians with immigrants who agree with their political views.” This is known as “replacement theory”, a racist view commonly cited by white supremacists (including the 18-year-old killer of 10 black people in Buffalo in May).

Then there is the finding that millions of Canadians are conspiracy theorists: 16 per cent think the last U.S. election was “stolen” from Donald Trump, 18 per cent think the Royal Family killed Princess Diana (a further 35 per cent think the idea is “plausible”) and 20 per cent think the World Economic Forum has a secret strategy to control the world.

What this poll shows is that Canada is not radically different than the United States when it comes to being home to millions of people who hold unorthodox views...

Indeed, this poll shows why that odious trucker convoy that occupied downtown Ottawa in January and February seemed to attract a not-insignificant amount of support.

Two businessmen taking the Canadian federal government to court over its vaccine mandate for travel have defeated an attempt by the attorney general (AG) to remove from the record portions of their affidavits in support of their position.

Case management judge Mireille Tabib dismissed the AG motion on May 25 in the case of Shaun Rickard and Karl Harrison against Transport Canada and the AG.

The case represents one of four lawsuits against the federal mandate that will be jointly heard by the court in September. The other separate lawsuits have been filed by PPC Leader Maxime Bernier, former Newfoundland premier Brian Peckford along with five applicants, and Quebec lawyer Nabil Belkacem.

Toronto civil litigation lawyer Sam Presvelos, who represents Rickard and Harrison, told The Epoch Times that the AG sought to remove parts of his clients’ affidavits that explain what information they reviewed before choosing not to get a COVID-19 vaccine.

Presvelos said that among the documents the AG wanted removed were official government information and statements from public health officials that were contradictory at times, such as on the usefulness of masks or on border closures. The AG also wanted to remove information that said unvaccinated and vaccinated individuals can carry the same amount of viral load.

“We believe the government didn’t like this information in the record—they took the position that the Applicants were masquerading as doctors/experts and that the evidence was hearsay because they did not publish the data, [so] they cannot opine on the data given their lay background,” Presvelos wrote in an email on May 27.

Presvelos says he argued against the motion by telling the court that the applicants’ affidavits had not been submitted as expert testimonies but rather as a way for the judge to understand the applicants’ “state of mind” and that they could be “relevant to a Charter analysis.”

Justice Jocelyne Gagné published a short decision that didn’t explain her rationale, saying it would come at a later date.

Gagné ruled in favour of a mootness motion brought forward by the attorney general (AG) on June 28, eight days after the federal government lifted its domestic vaccine mandate for planes, trains, and some marine vessels.

Millions of unvaccinated Canadians were unable to use these means of transportation starting October 2021, or to leave the country given U.S. border restrictions.

The AG’s motion argued (https://www.theepochtimes.com/challengers-to-travel-vaccine-mandate-ask-court-to-hear-their-case-as-ag-seeks-dismissal_4656342.html) that since the mandate had expired, it did not exist as law and hence a court ruling on the matter would have “no practical effect.”

Challengers to the mandate pleaded that dismissing their case would allow the government to impose controversial measures and argue mootness to avoid accountability.

The challengers have four different lawsuits. One includes businessmen Karl Harrison and Shaun Rickard, and another former Newfoundland Premier Brian Peckford and co-applicants. PPC Leader Maxime Bernier also filed, along with Quebec lawyer Nabil Belkacem.

Gagné heard arguments from all the parties during an in-person hearing on Sept. 21. With the delay in providing her decision and the court hearings slated to begin on Oct. 31, it gave hope to some of the applicants that the hearing would go ahead.

Rickard earlier on Oct. 20 was encouraging supporters to sign up on the federal court website to watch the hearing, but his mood changed later when the ruling came down.

“We were totally blindsided,” Rickard told The Epoch Times.

Like all witnesses appearing before the commission David Vigneault, the director of the Canadian Security Intelligence Service (CSIS), sat for an interview with the inquiry's lawyers over the summer.

A summary of that conversation was shared with journalists Monday.

"Mr. Vigneault stated that at no point did the service assess that the protests in Ottawa or elsewhere [those referred to as the "Freedom Convoy" and related protests and blockades in January-February 2022] constituted a threat to security of Canada as defined by section 2 of the CSIS Act and that CSIS cannot investigate actively constituting lawful protest," reads the document...

In order to declare a public order emergency, the Emergencies Act requires that there be "an emergency that arises from threats to the security of Canada that are so serious as to be a national emergency" and defers to CSIS's definition of "threats to the security of Canada."

Vigneault told the commission lawyers he learned the Emergencies Act cited the CSIS Act once the government began to seriously consider invoking the legislation around Feb. 10-13.

"He requested that the service prepare a threat assessment on the risks associated with the invocation of the Emergencies Act," said Vigneault's interview summary.

"He felt an obligation to clearly convey the service's position that there did not exist a threat to the security of Canada as defined by the service's legal mandate."..

In his interview with commission lawyers, Vigneault also said that the threshold imposed by the CSIS Act is very specific.

"For example, the determination that something may not constitute a threat to national security under section 2 of the act does not preclude a determination that a national security threat under a broader definition, or from the perspective of the public, does exist," says the summary of Vigneault's interview...

"The cabinet is making that decision and their interpretation of the law is what governs here and the advice they get," said [ former deputy minister of Public Safety Rob] Stewart, who has since moved to another government department.

"And their decision was, evidently, the threshold was met."...

The day after the act was triggered, Public Safety Minister Marco Mendicino defended his government's decision on national security grounds, saying that several of the individuals involved in the blockade at the border crossing in Coutts, Alta. had "strong ties to a far-right extreme organization with leaders who are in Ottawa."

"You have the RCMP, you have CSIS, you have the entire intelligence apparatus in the federal government and none of them said that this threshold was met, did they?" Miller asked Stewart.

"They weren't asked," Stewart said...

"CSIS did not assess that any foreign states supported the protests through funding; that foreign states deployed covert or overt disinformation techniques; or that any foreign state actors attempted to enter into Canada to support the protests," said the summary of the inquiry's interviews with Vigneault and Tessier...

Stewart told the commission's lawyers that invoking the Emergencies Act became a real option around Feb. 11, before the blockades at border crossings in Windsor, Ont. and Coutts, Alta. were cleared.

CSIS Director David Vigneault testified before the Public Order Emergency Commission Monday and sat for an in-camera session on Nov. 5. A summary of that behind-closed-doors hearing was entered into evidence at the inquiry.

"All of these elements of unpredictability, based on my experience, having been around national security issues for quite a few years now, led me to believe that the regular tools were just not enough to address the situation." ...

Vigneault said his understanding that the Emergencies Act's definition of a "threat to the security of Canada" was broader than the one in the CSIS Act came about after he asked the federal Department of Justice for a legal interpretation.

A lawyer for the federal government said the government has not waived solicitor-client privilege over the invocation of the act.

"This, I think, is the crux of the issue," Vigneault said during testimony Monday. "In the context of the Emergencies Act, there was to be separate interpretation based on the confines of that act."

The Canadian Civil Liberties Association questioned the broader definition of threats to the security of Canada.

"The government's argument appears to be that the Emergencies Act doesn't mean what it says," CCLA director Cara Zwibel said in a media statement Monday.

"It is relying on this novel interpretation to justify its decision to invoke."

Testifying again Monday, this time publicly, Vigneault explained that he made his recommendation based on a legal interpretation from the Justice Department that the act’s definition of a threat to the security of Canada was broader than the one it refers to in the CSIS Act.

Many government witnesses, including the prime minister’s national security adviser Jody Thomas, have referred to that legal interpretation when arguing that cabinet could invoke the act because of a broader “national crisis” caused by Freedom Convoy blockades and protests.

That legal interpretation has not been made public because it is covered by solicitor-client privilege...

Vigneault said CSIS was not “investigating the convoy,” but was monitoring individuals it already had under surveillance who may have been attending, as well as new “potential threats” who could be radicalized and emerge through the protests...

Emergency Preparedness Minister Bill Blair became the first cabinet minister to testify at the inquiry Monday. He testified the government was extremely reluctant to invoke the Emergencies Act, but he felt in particular when border crossings were being closed, they had no choice but to act.

“That escalation I viewed as a significant escalation, because it did result in significant disruption to critical supply lines,” he said. “It was hugely impacted, and I believe that it had risen to the level of a national emergency.”

Blair said closing off the border points at the Ambassador Bridge and in Coutts, Alta., amounted to an attack on critical infrastructure in his mind.

“You don’t have to blow everything up to render it unusable.”

"The panel explained that security threats have evolved in the 40-year period since the enactment of the Emergencies Act," says a summary of that conversation...

"The panel concluded that the reference to a threat to the security of Canada as defined by section 2 of the CSIS Act in section 16 of the Emergencies Act should be reconsidered."

The act was passed in 1988 as a replacement for the War Measures Act. It had never been used before February of this year and is widely considered a measure of last resort.

[Jody] Thomas [PM's national security advisor] told the commission she was aware CSIS concluded the protests did not meet the threshold to declare a national emergency, but she felt the intelligence agency's mandate was too narrow.

The interview summary said some CSIS targets were present at the protests but they would have to escalate from rhetoric to inciting or carrying out serious violence to meet the service's legal threshold for declaring a national emergency...

"They did not know how long it would go on or how much larger it could get," said the interview summary.

"Once a tipping point of violence was reached, it would be too late, even with the police presence available."

Thomas also said [RCMP commissioner Brenda] Lucki never gave notice to the federal cabinet that police had firmed up an operational plan to end the blockades.

"There was no evidence there was a plan," said Thomas. "We had been told there was a plan multiple times."...

The commission heard earlier this week that Thomas asked for an urgent threat assessment just before noon on Feb. 14 — the day the federal government invoked the act.

"The characters involved. The weapons. The motivation. Clearly this isn't just COVID and is a threat to democracy and rule of law," Thomas wrote at the time...

Thomas said she and Vigneault met with deputy ministers on Feb. 14 and discussed how to define the threat posed by the protests.

She questioned whether events like the one that unfolded in Washington, D.C. on Jan. 6, 2021 — when demonstrators protesting the results of the presidential election stormed the Capitol building — should be the benchmark for defining something as a violent protest.

"Or is the violence that people of Ottawa were experiencing on the streets, the inability of people in Windsor to conduct their lives, the inability of town of Coutts to function, is that a line?" Thomas testified Thursday.

"I don't have an answer for it."

The false claims of potentially violent weapons present at the non-violent demonstration came from a police memo citing a rumor sourced from unspecified “intelligence information.”

On February 14 – the day Prime Minister Justin Trudeau invoked the EA – the memo stated: “Intelligence information also suggests that convoy protesters are beginning to weaponize themselves.”

Despite the so-called “intelligence information,” no weapons of any kind were found in any of the trucks that were part of the massive convoy.

This, however, did not stop Trudeau’s Public Safety Minister Marco Mendicino and the widely-distributed Toronto Star from perpetuating the false claim.

Jody Thomas, national security advisor to Prime Minister Justin Trudeau, yesterday pointed to protesters’ tweets in justifying her claim the Freedom Convoy was a “threat to national interest.” Thomas was appointed as $306,000-a year security advisor last Jan. 11, just two weeks before protesters arrived on Parliament Hill.

“There were people preparing to be violent,” Thomas testified at the Public Order Emergency Commission. “We saw it on social media.”

“There was certainly anti-government sentiment throughout,” said Thomas, a former Coast Guard Commissioner. “The threat, the confidence in government institutions, the rhetoric, we have to look more broadly,” she added.

“As national security and intelligence advisor to the prime minister, when I see social media posts growing in number and aggressiveness of language that says somebody should kill the prime minister or someone should kill the deputy prime minister, I have reason to be concerned,” said Thomas, who was cross-examined by Freedom Convoy lawyer Brendan Miller:

Internal records released by the judicial inquiry indicate Thomas concluded the convoy represented a national emergency only minutes after Trudeau raised the issue with premiers on Feb. 14, the day cabinet invoked the Emergencies Act.

At 10:15 am that day Trudeau convened a premiers’ teleconference to announce he would invoke the Act. All but three provinces – British Columbia, Ontario and Newfoundland and Labrador – opposed the measure.

At 11:44 am Advisor Thomas emailed the Privy Council Office: “I need an assessment about the threat of these blockades, the characters involved, the weapons, the motivation. Clearly this isn’t just COVID and it is a threat to democracy and rule of law.”

At 12:05 pm Advisor Thomas without receiving any Privy Council report emailed the Department of Public Safety: “This is about a national threat to national interest and institutions by people who do not care about or understand democracy, who are preparing to be violent, who are motivated by anti-government sentiment.”

Thomas’ views seemed to contradict advice from law enforcement agencies. The RCMP, Canadian Security Intelligence Service and Ontario Provincial Police in memos and emails concluded “there was no serious violence in Ottawa,” the convoy “was not an extremist movement” and never “constituted a threat to the security of Canada,” “the actual leaders are not violent extremists” and there was “no intelligence to indicate these individuals would be armed.”

OTTAWA - Provincial officials in Saskatchewan and Alberta got a Valentine's Day surprise from the prime minister this year when he called to say he was considering invoking the Emergencies Act, a public inquiry heard Thursday.Lawyers representing the two provinces were before the Public Order Emergency Commission, which is looking into the federal government's use of emergency powers to end to weeks of protests at border crossings and in downtown Ottawa.

“The call (on Feb. 14) was not so much about consulting, it was about telling,” said Saskatchewan government lawyer Mike Morris.

“That phone call was the first time the federal government told the government of Saskatchewan that it was considering invoking the Emergencies Act and declaring a public order emergency.”...

Saskatchewan and Alberta say they objected to its use and believe the law did not need to be applied across the country.

Alberta's lawyer, Mandy England, described in her opening statement before the commission how existing laws and police resources successfully ended a protest at the border in Coutts, Alta...

“None of the powers that were created under the federal Emergencies Act were necessary, nor were any of them used in Alberta to resolve the Coutts blockade,” she said.

The federal government is planning to argue the opposite. Robert MacKinnon, representing Justice Canada, said the Emergencies Act was “reasonable and necessary” given the circumstances across the country.

I’ve had several text exchanges with Brendan over the past few weeks, starting about the time he went off the rails, risking his reputation in my opinion, accusing people of flying Confederate and Nazi flags, and then again when he did something totally out of character for a scrappy, in-your-face litigator, choosing not to cross-examine Prime Minister Justin Trudeau on the final day of the inquiry. That really got my attention.

“What were you thinking?”

...As to why he left Ottawa early and didn’t cross-examine Trudeau, Brendan’s explanation is jarring. He was getting threats, serious ones, to the point where his team hired a security detail to protect him.

Canada's low unemployment rate is not sustainable and is contributing to decades-high inflation, Bank of Canada governor Tiff Macklem said during a speech in downtown Toronto Thursday.Speaking before students and researchers at Toronto Metropolitan University, the governor said the Canadian labour market needs to be rebalanced to stabilize inflation.

Macklem said businesses struggling to find workers can't keep up with demand for goods and services in the economy.

"The tightness in the labour market is a symptom of the general imbalance between demand and supply that is fueling inflation and hurting all Canadians," he said...

Macklem said policies that increase the number of workers available to work would help ease inflation.

Increasing immigration is one of them, he said...

Other polices such as the expansion of universal childcare will help increase the proportion of women in the workforce, he said, but noted it will take time.

39:20 [Re: Trudeau's Emergency Act Inquiry] There are different types of inquiries in our political and legal system. The first one is legislative inquiries, where the legislative body itself conducts the inquiry Those inquiries the rules are set by legislator house, not by the executive, not by the president, not by the prime minister, they are bi-partisan. Different parties have a right to participate in those inquiries. Then you have two other types of inquiries, which are inquiries under the various inquires act, where a condition of inquiry is chosen and you have royal commissions. They are very similar. And the important thing about those, as opposed to a legislative inquiry is that they are struck by the executive. Not only is the commissioner or the commission members chosen by the executive, the government, but the terms of the inquiry are not free ranging, they are set by the government and they cannot exceed the terms of the inquiry. So its the government that not only sets the terms of the inquiry, but also chooses the person who is going to conduct the inquiry. They are not as democratic as the legislative inquiry. So for instance right now in the US, Japan, and a few other countries they have struck legislative inquiries on the harm the vaccines have caused. The third type of inquiry that exists is a good old fashioned police investigation and that is more impartial than any of the other two (three rather) that are political in nature.

So here is the problem: Dealing with executive struck public inquiries, its been my view, my strong view as a constitutional lawyer, as an observer, of the inquiries over the thirty-four years I've been practicing law, that virtually most government inquiries serve two purposes. One is to whitewash the wrongdoing of government officials, and to ignore actually dealing with the problem of the wrongdoing of the officials. And two, more sinister is that by issuing subpoenas to these government wrongdoers, they are immunized from criminal prosecution, from any of the evidence they give or any of the derivative evidence coming from the evidence they gave. So if you are a smart witness who has done something wrong you admit to it at the inquiry because they can't prosecute it for you. And the reason for that is section 13 of the charter. Section 13 of the charter says:

"Self incrimination; A witness who testifies in any proceeding has the right to not have any incriminating evidence so given, used to incriminate that witness in any other proceeding, except in a prosecution for perjury."

So that means if somebody goes up there and says "Yeah, yeah I broke the criminal code, yeah I committed criminal offences" in a public inquiry under subpoena, they cannot be criminally charged for that offence. You got it? So that's why we have these public inquiries. And moreover the really cynical idea of striking a public inquiry as a smoke and mirror to give the misimpression that your actually doing something about the problem...

So that is the problem with public inquiries. I have no time or need for them. They don't do anything...
A citizen's inquiry is no more than a podcast.

54 I think they've [Judges] been corrupted by their own cultural bent and fear. But its not intentional, its not because the government has told them to decide this way or the other way. Its because they are overly conservative... they are acting like a lot of the population out of fear... They are saying 'We don't want to decide pubic health, let the public health people decide it.' Which is very dangerous, in doing so they are ignoring binding jurisprudence from the Supreme Court of Canada and pretending it doesn't exist. That is corruption in the sense that they are breaking their oath as judges, but its not an intentional corruption as we know it. This is not new, when they don't like where the law takes them, some of them, the courts, are dishonest with the law.

57 Judicial notice changed during Covid. The courts are now bypassing the rues and requirement of evidence... What Regina vs Fines said very clearly is you cannot take judicial notice of a scientific fact. And so now with the Covid these courts are getting lazy, and they are outrageously taking, some of them, judicial notice that the vaccine is effective and safe. That's a scientific fact which is belied by the fact that if you can take judicial notice of that, that they are effective and safe, you can take judicial notice that they are not for a good number of people because they have implemented a covid-19 vaccine compensation fund. So the government of Canada has conceded that these vaccines in some people will cause injury or death.

So this is where the courts are going. So for instance you cannot take judicial notice of any scientific fact. Only events. You can take judicial notice that the government has approved that the temporary inoculation is being effective and safe. That doesn't make it so. If your contesting that statement by the government your entitled to call evidence and say not that's not true...

The courts in Covid, mostly in family cases are taking judicial notice. But the irony is in family cases they all make it clear that we're not deciding if the children should be vaccinated or not, we're deciding which parent gets to decide. Which is a fig leaf. So judicial notice in the Covid context has the potential to throw the entire system of law and rule of law out the window. Cause [example] we could then take judicial notice that if x percentage of people in prison are this race then I take judicial notice that you're likely guilty. That kind of shit right?

A majority of Canadians looking at the country they see around them say everything seems to be broken. Concerned about rising costs, the state of health care, affordable housing, jobs and more, half of us are also angry about the way Canada is being run, a national opinion poll says...

Two-thirds of those asked (67 per cent) agreed everything feels broken — [30%] even strongly agreed — while 25 per cent disagreed, only seven per cent strongly.

“I didn’t think it would be that high. I thought maybe it was more a noisy minority as opposed to a prevailing majority opinion,” said Andrew Enns, an executive vice-president at the market research company Leger, and lead researcher for this data.

The numbers are a warning, he said.

“If you’re in government, regardless of what level — federal, provincial, or municipal — these are your customers, the general population. They all interact with you in some form or fashion, and these are their opinions. And they’re basically saying we don’t like how business is running right now.”

Enns said his team heard talk for months about systems seeming to be falling apart or broken. He saw examples of it, too, with enormous waits for passports, frustrating airport delays, fast-rising grocery prices...

“It feels like everything is broken in this country right now,” Conservative Leader Pierre Poilievre said in November. It grabbed a lot of headlines and he’s repeated it since. Last week in a speech to his caucus, he said it again — “everything feels broken,” this time in French...

“When he says Canada is broken,” Trudeau said of Poilievre in a speech, “that’s where we draw the line. This is Canada. And in Canada, better is always possible, but I don’t accept Canadians and politicians that talk down our country.

Conservative MPs Dean Allison, Colin Carrie and Leslyn Lewis were photographed at a restaurant with Christine Anderson, a member of the European Parliament...

He said the Conservative party leadership "should be calling her out loudly."

In a written statement responding to the concerns Friday, Poilievre said Anderson's views are "vile" and that her "racist, hateful views are not welcome here."

"The MPs were not aware of this visiting member of the European Parliament’s opinions, and they regret meeting with her. Frankly, it would be better if Anderson never visited Canada in the first place," the statement said...

The three MPs said in their own statement that it is not uncommon to meet with visiting elected officials from other countries...

The Centre for Israel and Jewish Affairs, which said it had raised its concerns about the MPs visit with Anderson directly with the party, said Friday it appreciates Poilievre's clear rejection of Anderson's views. But it also said MPs must do their "due diligence" before agreeing to such meetings...

"All I can say, I had a lovely time meeting with the members of his party," she said. "At no point do I see where I expressed hateful and racist views, as he puts it."

Some would say 'well no the government has the justification because if it is demonstrably justified they can overrule your Charter of Rights and Freedoms, yeah but it says you have to demonstrably justify in a fair and democratic society. So it has to be your demonstrably justifying the need for this and when you have Doctors and scientists that are speaking out and saying here's the data here's the science, here's the possible treatments that we are finding are working and they are all getting delicensed and they are all getting silenced, is that demonstrably justifying anything?

...There is case law in superseding the Charter.

Section one of the Charter is the section Chris is referring to there, the government can supersede the Charter but there is in 1986 a decision that's come to be known as the Oakes Test (https://ojen.ca/en/resource/in-brief-section-1-of-the-charter-the-oakes-test) which gives four clear definitions that the government must meet in order to supersede Section 1 of the Charter. Now none of these mandates was ever tested before the supreme court. So how can they supersede the Charter is one of the feelings we have as police on guard. It was never done properly through the courts, therefore the mandates were illegal. They were never law to begin with.

There is an egregious lack of ethical leadership within the higher rank and file of policing. They're politicians that are wanting to satisfy their police services boards and those politicians that have any sort of clout over them. And they don't have the spine enough to stand up and say: 'This is my job to hold the oath in high regard and independent office. I do not take direction from you, you do not tell me how to operate, we have a set of rules and guidelines and an oath and we will adhere to it. Get lost.'

But that's not happening.

The biggest positive change that could happen is accountability for those that went against it and to put people in place that actually have that integrity to lead and to lead well.
