Roe v Wade related. What is a person?
Hobbes (16th century) stated a person is
1. A word
2. An action
3. Representation
A fetus cannot speak.
A fetus can move but actions are ...actionable. Something that causes damages
Representation? A fetus cannot sign a power of attorney.
But a fetus is capable of inheriting. And therefore a fetus is capable of owning things. Ownership has generally provided motive for murder
Where is it established that a fetus can inherit? The Rule Against Perpetuities. The maximum length of any contract is LIFETIME + 25 years + 9 months for gestation. Beyond this period of time only charitable trusts can continue existence.
Law permis a guy to have sex on his deathbed and allows his contracts to be valid for 25 years and 9 months. This is only possible if a fetus is a person at conception.
