Administrators with the University of Texas at San Antonio filmed themselves telling student protesters that under an executive order signed by Governor Greg Abbott they’ll be reported to law enforcement for criminal “antisemitic” speech if they chant “From the River to the Sea.”

Gov. Abbott, a Republican, signed an Executive Order in March to require “all higher education institutions in Texas” to “review their free speech policies” to “establish appropriate punishments for antisemitic rhetoric.”

Abbott said the EO was needed to make campuses a “safe space” for Jewish students.

Student groups sue Texas Gov. Abbott over executive order they claim stifles free speech

Three organizations have filed a federal lawsuit against Texas Gov. Greg Abbott and several public university officials, alleging that the governor's recent executive order addressing antisemitism on college campuses violates their First Amendment rights.

The complaint, filed Thursday, claims that Executive Order GA 44 and related university policies amount to illegal viewpoint discrimination by attempting to suppress criticism of Israel. The plaintiffs are Students for Justice in Palestine chapters at the University of Houston and University of Texas at Dallas, and the Democratic Socialists of America.

Abbott issued the executive order on March 27, directing Texas public universities to review and update their free speech policies "to address the sharp rise in antisemitic speech and acts on university campuses." It singles out groups like Students for Justice in Palestine and calls for them to be disciplined for using phrases such as "from the river to the sea, Palestine will be free."

The lawsuit alleges the order and subsequent university actions, such as incorporating a broad definition of antisemitism into campus policies, unconstitutionally restrict the plaintiffs' ability to engage in pro-Palestinian activism and criticism of Israel.

"Governor Abbott has made repeatedly clear he views persons and groups like Plaintiffs and their members as legitimate targets of suppression," the lawsuit states. It points to Abbott's previous legislative efforts targeting boycotts of Israel and his use of state troopers to break up pro-Palestinian protests on campuses this spring.

In announcing the executive order, Abbott said "antisemitism and the harassment of Jewish students have no place on Texas university campuses and will not be tolerated by my administration."

The plaintiffs argue that peaceful campus protests and calls for boycotts constitute protected political speech under the First Amendment. They say phrases like "from the river to the sea" reflect an "aspiration for peace and dignity for all people" rather than antisemitism.

"The First Amendment is a better guide for our public discussions than Governor Abbott's whims," the complaint states. It asks the court to find the executive order and related policies unconstitutional and block the defendants from taking any enforcement actions.
