Obama to name Kagan for high court

President Barack Obama will nominate U.S. Solicitor General Elena Kagan to serve as an associate justice on the U.S. Supreme Court, NBC News’ Pete Williams reported late Sunday night.

Kagan, 50, served as the Dean of Harvard Law School from 2003 to 2009. Obama nominated her to serve in her current post as solicitor general early in 2009, and she won Senate confirmation by a vote of 61-31. She is the first woman to serve as solicitor general of the United States.

She was widely viewed as a front-runner when Obama was considering candidates for a Supreme Court opening last year, but the president ultimately chose Sonia Sotomayor for the job.

Some liberal critics have said that Kagan's views on executive power and the treatment of terrorist detainees are too conservative.

If confirmed, Kagan will fill the vacancy left by retiring Justice John Paul Stevens. Stevens, 90, announced his decision to retire on April 9 after nearly 35 years of service on the high court.

Kagan served on the Goldman panel from 2005 through 2008, when she was dean of Harvard Law School, and received a $10,000 stipend for her service in 2008, her disclosure forms show.

What does the Talmud have to say about legal and moral controversies in modern America?

Plenty, according to the creators of the new Washington-based National Institute for Judaic Law (http://judaiclaw.org/news_articles.html), which opened with a lavish Supreme Court dinner last month. http://judaiclaw.org/lectures.html

Some Orthodox activists say they can’t figure out exactly the point of the whole thing. But Noson Gurary, a Lubavitch rabbi who came up with the idea and won backing from some top Jewish legal experts, harbors no doubts.

“It will be an eye opener for judges, scholars and law students,” he told The Jewish Week. “Before you know where you’re going, you have to know where you came from. And Jewish law is the basis of our legal system in America.”

Gurary said that the idea for the institute came in an exchange of letters in which Supreme Court Justice Antonin Scalia, one of the most conservative Justices, expressed his “fascination with Jewish law.”

“And as a teacher of Judaic studies, I began to see the excitement of students who were being exposed to Jewish law for the first time, who now had a better understanding of where Western law come from,” Gurary said.

Gurary, who teaches at the University of Buffalo law school, said his target audience includes judges around the country and law students, not politicians and lawmakers.

According to Gurary, the group, which has hired two researchers to compile reports, will focus initially on the issue of business ethics. Eventually, the goal is to compile a library and database in Washington that will offer Jewish law insights into a host of contemporary issues and to help create courses on the subject at law schools nationwide. The institute will also inaugurate a monthly lunch series for legal machers in Washington.

The Buffalo rabbi is a relative unknown in the Jewish world. Not so some of the participants in the new project, including Harvard Law School professor Alan Dershowitz, former U.S. Solicitor General Seth Waxman and top constitutional lawyer Nathan Lewin and his law-partner/daughter, Alyza.

Alyza Lewin noted that “the idea is to make Jewish law accessible to the public — to jurists, legal scholars, the press, anybody.”

Kagan Invokes Myth-Of-Neutrality, My-Views-Don’t-Effect-My-Viewing View To Avoid Revealing Her View Of Constitution

Supreme Court nominee Elena Kagan, at the time Solicitor General of the United States, said, in a Public Radio interview (12/22/09), when asked about her views re: the U.S. Constitution: “What my constitutional values are are wholly irrelevant to the job, and so neither you nor anyone else will know what they are…What my political views are, what my constitutional views are just doesn’t matter.”

Well, now. The next thing I always want to hear said to a person who says this kind of thing is something like this (with a big smile): “Fine. Wonderful. Congratulations on your ability to compartmentalize! — to be objective!, to approach matters in a totally unbiased manner! I wish I had that talent.

“So, since what you believe is wholly irrelevant to your job you can now tell me what you believe! — no problem! No problem because your beliefs have nothing to do with your job!”

But, of course, Kagan’s views re: the Constitution matter. She knows this. She knows that others know that her views matter. And this is why she has refused to say what her views are.

Kagan’s views on the Constitution mattered when she was Solicitor General representing the U.S. before the Supreme Court. They matter now that she has been nominated to sit on the Supreme Court.

The absurd my-views-don’t-effect-how-I-view—things-view is designed to perpetuate The Myth Of Neutrality. But, no one views anything “neutrally.” There is no view from nowhere. All people view everything from some perspective, according to some presupposition, according to some frame of reference into which they integrate all facts, all that they see and hear.

And it is precisely because presuppositions — “personal views” — determine interpretations that the most important questions Kagan could (but, alas, will not be) asked in her confirmation hearing would be questions about her “personal views,” her presuppositions, her assumptions, her standards, according to which — for good or evil — she judges all things.

Such questions would include such questions about such basics as: Where do you think law originates?; is there an ultimate law-maker?; Does law change?; if so, how can there be a fixed standard of justice?; by what standard would you judge a law to be just or unjust?; in what way, if any, would God’s Law effect your judging?; what is your definition of justice? What is the role of a judge?

I would add that my personal experience has been that when folks like Kagan say what Kagan said in her Public Radio interview it is to cover up views, usually views that are very Liberal, way over on the Left.

— A “Christian” web site has noted, critically, that Kagan once wrote a memo while clerking for the late Supreme Court Justice Thurgood Marshall saying religious organizations that provide care for teen pregnancies shouldn’t get Federal funds because of a strict line separating church and state. True! They should not be Federally funded because such funding is outside God’s limits on civil government; such funding is unConstitutional.

— The conservative Susan B. Anthony List has complained: “Elena Kagan has no judicial record from which to determine her position on Roe v. Wade.” So what? We must ignore Roe. Stop making it the centerpiece of our pro-life concerns. Roe is nothing!

It is just an “opinion;” not law. As pro-lifers, we must concentrate on trying to get abortion prosecuted for what it is — murder.

And what modern Presidential introduction of a Supreme Court nomineee would be complete without the nominator and nominee both demonstrating they are clueless re: the form of government our Founders left us? Once in his introduction of Kagan, President Obama referred to our country as a “democracy.” Kagan referred twice to our country as a “democracy.” Arghhhhhhhhhhhhhhhhhhhhhh!

The Kagan appointment means that we have entered a period in which Jews are equal members, if not actually predominant members, of the American Establishment. Obama's two closest political advisers are Jewish, Rahm Emanuel and David Axelrod, and are said to be his foreign-policy braintrust. The economy is supervised to a large degree by Jewish appointees, Larry Summers and Fed Reserve Board chair Paul Bernanke (Time's man of the year last year, a selection overseen by Rick Stengel, the Time magazine editor, who is also Jewish).

Recently a Jewish friend in the media said, "We're the new WASPs," referring to the patrician class that used to represent the elite in American society.
