This poor guy was defending his family, now he may have a bigger problem then the law?
Hopefully he doesn't get charged.

Long Island Man Arrested For Defending Home With AK-47

UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got a high powered AK-47 and pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested. John Lewis is Grier’s attorney.

“What he’s initially charged with – A D felony reckless endangerment — requires a depraved indifference to human life, creating a risk that someone’s going to die. Shooting into a lawn doesn’t create a risk of anybody dying,” Lewis said.

Grier said he knew Nassau County Police employ the hi-tech “ShotSpotter” technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.

Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.

“They’re probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis,” Mulraine said.

You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.

Also of note, just an FYI, theres only 2 counties on Long Island, so Nassau makes up half of the entire Island. Does half of the entire island have this so caleld "shot spotter"? Its not like the whole island is a massive city like New York. Its mostly suburbs.....

The lesson here is if the perps aren't there to tell their side of the story, that your story is that one of them pulled a gun on you but they all scattered when you fired.

When a gang of criminals trespasses on your property and tells you they will kill your babies...that's all you need to justify defending your family. In Texas, we now have the Castle Doctrine...and this situation is just what it is for. He could have taken out all of them...no liability.

You can never afford to be stupid. This guy was stupid to live where laws are against homeowners, stupid to brandish his weapon before he needed to use it, stupid to fire it without effect. A firearm is for disabling people, not scaring them. Your legal situation is much simpler if you are the only survivor. And it's best to live where this just doesn't happen.

Tumbleweed? good video.........is like the time when I had a wife and was working at the LA Airport..........someone tried to break into the apartment and when I came home I found three holes in the front door and my wife sitting on the bead reading with the 38 next to her..........no one called the cops hahahahahahahah, not even her.

The only issue with that thing is if the cocking handle ever came back on your hand while aiming, it would shatter your hand. Impressive amount of power none the less.

Quoted for truth and accuracy. I asked my wife what she would do if someone were breaking into the house, and she gave me the "warning shot" answer. This had to be corrected. I told her that if she is going to brandish a firearm at someone, be prepared to immediately put a round (or 15 since the M1 carbine is her rifle) in them center mass. Warning shots are only for Hollywood movies.

Exactly.
Telling anyone that you fired a warning shot is the same as saying that you weren't actually in fear for your life.
To use a gun is to use deadly force. Matters not if you hit your target or miss.
If you intentionally miss, or admit to having shot to only wound, the police can easily say that based uponyour own statements that the situation obviously didn't rise to the level of needing to use deadly force.
...and then off to jail you just might go.


As far as the unfortunate situation in the OP, it sounds to me as though he didn't have a full understanding of the gun laws in the area he chose to live.
IMHO, if you're going to own a gun, please study the law in your area regarding their use.

Because it doesn't do any good to "defend" yourself, or your property if it only serves to make you into a bigger criminal in the eyes of the law than the ones you defended against.

Not always. Depends on the State.
In some States deadly force is justified in the defense of third parties, and even the defense of property at certain times.

So if you feel the need to go help defend a neighbor, or keep your car from being stolen, you'd kinda have to go outside with a gun and you'd be justified in doing so, too.

In other States that may not apply.

This is the part that concerns me - since he wasn't "dealt with" the first time you can bet he will be the next time. No one is ever targeted once and let go, especially after showing them you have an AK47 and don't plan on shooting anyone with it.

I remember when they installed the shot spotters around my town when I was in HS, well over 10 years ago. They put them in supermarket areas and other populated places. Using a type of sound mapping triangulation (IIRC) they cover a large area. Nassau is densely populated and covers a small land area, so it really doesn't take much to grid out the area. At its thickest point Long Island is only 20 miles north-south and Nassau is about 20 miles or so wide. The entire Island is about 120 miles long, the vast majority of it being Suffolk county.

Long Island used to be a great place to raise children before it was sold out. 30 years ago most of Suffolk county was farmland.

Im not the biggest fan of new york, particularly long islan. Most my entire family on my moms side lives in Suffolk County. The only ones I like are my moms sister and her husband, and their kids (Who are older than me). The rest of em I cant stand. I live in south east florida, its like a little long island. I hate it, too.

BUT, I dont totaly blame anyone for not leaving. Some people dont know, some people LIKE that kind of suburban life. Not everyone is a prepper or a homesteader. I think to assume everyone should be is silly. We are not, and have not ever been, a total agrarian society. For many of us here, it works and its a great life, but its not for everyone.

My Cousins husband works in the City. He worked across the street from the world trade centers for years (even before 9/11). That dude lives a very comfortable life. He makes well over 200k a year, though now is living in new jersey (divorce) had a very nice home in a small little suburb on long island close to all his family and my cousins parents were right down the road.

I dont blame people for not wanting to be a 100% self sustaining homesteader. Long island isnt for me, but I can see why it hasnt been totaly abandoned yet.


The whole thing with the shot spotter just kinda struck me. Having the entire county under shot spotter watch is just a little orwellian to me. Its akin to having it all under CCTV. I dont doubt we may have some here, but I've never heard of em. And they claim they only have a 35 foot radius (which I call BS on, personaly, as I know the miltiary ones have hundreds of yards of range, and its the same exact concept). Its just a little creepy is all.

I tried to put together several ventures that would afforded me the money to GTFO of dodge but they all failed for one reason or the next.

Seems that the Fates are telling me when the hammer falls I will be serving in the Northern Resistence.

I will do my best to pepare in the interim.

I dont doubt we may have some here, but I've never heard of em. Its just a little creepy is all.


I feel the same way. I believe the shot spotter technology may be the same that's being used in my area. They are like microphones, that capture the sound of the shot, and use triangulation to determine the exact location. Hence, there needs to be at least three that capture the sound. You can see them if you look closely, they are mounted on telephone poles throughout the city.

This guys mistake was not shooting at the grass....he should have shot at the shot spotter. If he took it out, they may have not triangulated his position.


We can all learn from his mistake. Shoot the shot spotter first. ;)
