ATLANTA -- A 911 operator fired after sending an ambulance to the wrong address, is now suing the Fulton County government, its former 911 director, and three other employees for $10.5 million.

Gina Conteh said the county made her a scapegoat when Johns Creek resident Darlene Dukes died after waiting an hour for that ambulance.

"The Fulton County director, and other upper management team members clearly knew she was not capable of handling that position," said Conteh's attorney Rory Starkey.

The lawsuit claims "discipline in this case was political" and "intense media scrutiny called for a termination."

An audit revealed systemic problems in the 911 center and then director, Rocky Moore, quit after a Channel 2 Action News investigation exposed that at the time of the incident, Conteh was working a more complicated dispatcher job, for which managers had deemed her unqualified and refused her a promotion.

Channel 2’s Jodie Fleischer obtained Conteh's time sheet for that week, which showed that she'd already worked 62 hours, with back-to-back double shifts in the days before the incident.

"To have a person in that position who's responsible for lives, not to be properly managed, to be working out of class, to be working the overtime my client and other 911 operators were working, is irresponsible," said Starkey.

He admitted that Conteh made mistakes when she misunderstood the caller's street address, and sent the ambulance to Sandy Springs instead of Johns Creek. The county's procedure for dispatching ambulances had changed the day before the incident, and records showed several dispatchers had problems in the first few days. The county audit criticized the 911 center's management, training, equipment, and staffing.

"It was of some concern. However as a result of all of this we've made some significant changes and things are a lot better," said County Commissioner Robb Pitts.

The new director has already filled staffing vacancies and made equipment changes. A new report released earlier this year commended the center on its improvement.

The lawsuit claims Conteh was improperly fired and that the county wrongly denied her unemployment benefits. She later won them back in court.

Pitts said the county plans to fight the suit vigorously.

"It's my understanding that we the county, the personnel department in particular, followed all of our procedures to the letter of the law," he said.

But Starkey contests that claim.

A Georgia 911 dispatcher accused of a series of mistakes that misdirected emergency crews and delayed an ambulance 45 minutes to a dying woman has appealed her firing. Atlanta lawyer Rory Starkey confirmed he had filed an appeal of the termination of Gina Conteh.

Conteh was fired Aug. 6 for her actions four days earlier. The 12-year veteran 911 operator took a call from Darlene Dukes who was gasping for breath from a blood clot in her lung. Conteh mistakenly sent help to southwest Atlanta when Dukes had called from Johns Creek in north Fulton.

The first help for Dukes, fire and police didn’t arrive for more than 30 minutes. Conteh failed to send an ambulance when she dispatched fire and police. So, Rural Metro Ambulance service didn’t arrive until an hour after Duke’s call came in.

Conteh is entitled to appeal any action taken against her. That group can overturn or amend any action and they often shorten suspensions or reduce proposed firings to time off without pay. That has often frustrated department heads, political officials and others who routinely complain that it’s too difficult to rid of problem employees.

It’s a process Conteh is familiar with. She’s been repeatedly cited for mistakes in routing emergency crews, fights with co-workers, chronic tardiness and problems staying awake to handle emergency calls.

Her personnel record covers 2,100 pages. She’s been suspended repeatedly and filed a series of grievances against others. At least twice in the past four years, Conteh’s supervisors pushed to fire her. One of those attempts was because Conteh repeatedly fell asleep when she should have been answering emergency calls. The other was for failure to respond to test calls from a supervisor. Both times she avoided termination.

Four years ago, Conteh’s supervisors were threatening to pull her off dispatching ambulances. A shows supervisor Latisha Lester felt Conteh “was not grasping the radio” after nearly eight years on the job. Lester went on to say Conteh “appears to be having a retention problem as well as multi-tasking issues, especially when calls are coming back to back.” She reported that Conteh “loses focus and that leaves her radio in total chaos.”

Conteh was still dispatching on Aug. 2 when Dukes called in gasping for breath from a blood clot in her lung. Conteh handled multiple calls while she was misdirecting help that might have saved Dukes life. Twenty five minutes elapsed before she realized the error and sent police and fire units to Dukes’ apartment. Even then, Conteh delayed another 20 minutes before dispatching an ambulance. Dukes, a mother of two, was proclaimed dead an hour later.

Since then, Fulton officials have fired Conteh and reassigned longtime 911 Director “Rocky” Moore. They have also pledged to rush through both an internal and external audit of the 911 center to assure Fulton’s nearly 1 million residents that help will come when you dial 911. An hour?

Even the best make mistakes, but really, WTF?

Another one should have been rolling immediately upon notice of the error, while the first one tried to get their first.

Two possible reasons:

1) her supervisors were fellow Niqqers.
2) her supervisors were Whites deathly afraid of the career-ending charge of "racism."

The two articles say she was working back to back shifts. How long was a shift? Was it a full 8 hours? Was she working 16 hour days and for how long was this going on? Why? Cost cutting measures? It would be cheaper to double shift someone than have a whole other person with full medical insurance, SS insurance etc.

Who was it that said repeated double shifts were ok for emergency services people? She may not be a front line responder but the role is still critical, as we have seen. I think something is not right here. If she is not capable for what ever reason then it should have been dealt with. I wonder if the relatives of the dead party had any claim?

Especially if the safety of others hinges upon you doing your job in an efficient manner?
