Ok, I remember Panlini and 7thTrump stating that an abatement needs to be sent within 72 hours.
Can I get a hand in writing up an abatement? Or point me in the direction of where I can go to read up on it for my state? (Indiana)

I'd read about this in theory. This will be a good chance to see it demonstrated in real life. Keep us informed.
Midnightrambler is another bog proponent BTW.

You got me to looking Ares.
I was looking @ this site about demand abatement (http://educationcenter2000.com/abatement_page.htm).
They have this petition (http://educationcenter2000.com/petition_for_abatement.doc) at the bottom of the page its a word file. It was filed in Virginia, though.
What state are you in?
I ask, because it has everything to do with how the courts work.
FWIW,
I was listening to Ron MacDonald on RBN a few months back.
He stated something that he had used in court to get out of a traffic ticket in California. Apparently, unless the State Supreme Court of California certifies a law, it is not constitutional and therefore invalid, but another step may have needed to be brought up to get to that stage. Something along those lines.

Here's what I found about Abatements (http://www.hobbleknot.com/EYR/Abatement.html)
Looks interesting. I'm still researching his definitions and court cases. But so far (about 40% of the document has been looked through by me.)

I certainly hope you can win this case Ares, I have tried fighting tickets and the IRS but to no avail, the odds are stacked against you and the court is only going to listen to the officer, I fought them and the time and paperwork was just ridiculous and in the end they won. bastards..... so now I just pay the man and go on my way.
good luck to you!

I hear that, they make it incredibly difficult to not pay a traffic citation. I'm looking a going through the Abatement stradegy by having them PROVE jurisdiction. That is, if the wife wants to go with it and try to fight it, or if she wants to just pay the fine. I'm leaving that decision up to her. But I'll keep researching just incase.

You may just want to pay the fine here Ares.
Your down to what, 2-1/2 days left to learn a whole lot of legalize unless something fool proof comes along.
Go for it if you want to, but I would research for the next time.
I'm not trying to discourage, but so you make sure you have all your ducks in a row before tackling the beast.
If your on the western(edit) side IN, I would drive over to watch.

Ares, I found that video posted over at http://www.suijurisclub.net .
SuiJuris can be an awesome resource for stuff like this.
And the video I posted is pretty good (although I'd do a few things differently - but overall the video contained a good line of questioning). Marc Stevens also has some really good stuff out.
It is FUN to get in a courtroom and ask questions... it scares the sh*t outta them!
;D
A lot of times, judges (or in the case of traffic court, "traffic commissioners") will enjoy bantering back and forth with people like us because it is different from their same ole, same ole, boring routine. Sometimes those black-robed attorneys will actually try to help you out by the things they say, the way they say/word the things they say, and the things they don't say. You have to be mindful of what's going on, and watch for subtle hints and "outs" from the "judge".

Here a citation is merely a promise to appear. Meet that criteria in a timely fashion, like the next day, and you're done. I've a friend who's perfected beating them on a technicality every time, however the locals finally got a clue and that no longer works for him with that particular crew (a verified complaint is required, and there's never a verified complaint until one triggers the process by entering a plea [without seeing the magistrate]). The trick is to immediately show up to see the magistrate and not be tricked into entering a plea (they will always lie and say the magistrate is not available, busy, out of the office, etc. and try to con you into entering a plea PRIOR to seeing the magistrate).

Ares,
I don't know you, but I wouldn't recommend that you play lawyer with your wife's license on the line. You are setting yourself up for some serious grief.
I have played this game, and it has cost me dearly. I will soon share all the documentation of my case, which now is going through appeal.
What I can tell you is that I have spent time at the county jail, and have to put my hard earned credits to bail me out because the "judge" decided he could put me there.
If she has a license and are planning to not plead guilty, please do your homework and see if you can get the case dismissed for administrative errors. If you plan to fight because of your right to travel vs. driving argument, get ready for some nasty tricks being pulled on you by the court and prosecutor, that includes withholding exculpatory evidence, fabrication of evidence, false testimony and other criminal act on their part.
Best of luck and wish you a safe resolution.

Why I'm trying to get my wife to decide QUICKLY if she's going to fight the ticket or if she's just going to pay the fine. As time is of the essence in matters like this.
If she goes forward, does she need to file the abatement by certified mail? Or deliver it to the clerk herself as fortunately enough as her place of employment is about 4 blocks from the traffic court.

I would say it's best for her to do it in person if possible.
She will need to take THREE copies of the document she intends to file.
Instruct the clerk to stamp ALL THREE of them "received" and get two copies back from the clerk, having the clerk file the 3rd copy for the casefile.
Take one of the copies to the prosecutor's office and serve them, and keep the other copy for herself.
The clerks shouldn't give her any problems as long as she is firm and not rude. I've had to practically hold my clerk's hand to walk them through what I needed them to do. I don't know if they play dumb or are dumb, but sometimes they are like:
"What? You want me to file something? People don't usually do that. Why don't you just pay the fine? ATMs are right over there."

LOL no, no youngun waiting. But interesting observation.
It sounds like she just wants to pay the fine and not fight. Says it's "too much of a hassle." If that's what she wants to do, I'll obviously respect her decision, but eh, I tried. LOL

Since your wife likely traded her labor for those 'FRN's', it would be silly to say that they are 'worthless'. Unless your wife's labor is worthless.
And since they will not accept Gold and Silver coin, her offer to pay will be declined, and the debt is then discharged. If offer for payment is tendered, and refused by the other party, it is discharged.....

While I agree, you and I both know that's not how it'll play out. They'll say no attempt was made at payment and suspend the license.
