It shall be unlawful for any person employed by or associated with any enterprise engaged in, or the activities of which affect, interstate or foreign commerce, to conduct or participate, directly or indirectly, in the conduct of such enterprise’s affairs through a pattern of racketeering activity or collection of unlawful debt.

(1) “racketeering activity” means (A) any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion
REMEMBER what TSA is doing isn't LAW, it's THEIR POLICY. So in essence when they stop you from travel that's KIDNAPPING, and when they threaten you with a $10,000 fine that's EXTORTION.
Any thoughts?

Yes it's definatetly policy. They have been quoted as saying that a lot. Their fines are prosecuted under civil processes making them non-criminal. That makes them claims of contractural breach.
Does anyone have a copy of the TSA policy? I am reading 'Public Law 107-71 (http://www.tsa.gov/assets/pdf/Aviation_and_Transportation_Security_Act_ATSA_Publ ic_Law_107_1771.pdf).
It says that the TSA is to be administered by the Under Secretary of Transportation for Security. Is Pistole that person? He is listed as the TSA Administrator (http://www.tsa.gov/who_we_are/people/bios/john_s_pistole_bio.shtm). So who is the Under Secretary?
I thought this was interesting
Section 114 Part L 3
The Under Secretary may waive requirements for an
analysis that estimates the number of lives that will be saved
by the regulation and the monetary value of such lives if
the Under Secretary determines that it is not feasible to make
such an estimate.
