WTF? Let's see what they're after.

EU Declares Peppermint a Controllable Herb
The madness knows no bounds! Access to humble peppermint may be at risk in the EU.

12 November 2010

In its ongoing efforts to make absolutely certain that every aspect of every person's life is controlled in the minutest detail, the European Union is examining every herb to determine whether there's even the slightest hint of a chance it might be either harmful or useful. To this end, peppermint has been classified as a controllable medicinal herb.(1)

That sounds like the start of a farce, of an article meant to be a joke. It isn't. It has really happened. The EU has listed Mentha x piperita, common peppermint, for regulation as a medicinal herb. The only thing that could make this worse would be for someone to claim that it can be of benefit in a serious disease.

Oops! We may have a problem. Peppermint is known to be beneficial in irritable bowel syndrome and spastic conditions of the bile duct, both of which might be considered serious conditions. Conveniently, the EU has not defined the term "serious condition", so we can't yet be sure.

If either irritable bowel syndrome or spastic condition of the bile duct is seen as a serious condition, then peppermint could be banned. The EU's Traditional Medicinal Herbal Products Directive (THMPD) will not allow herbs to be sold for "serious" conditions.

Once existing stocks have been sold after 30 April next*, the EU may not allow its sale as a beneficial herb. At a minimum, EU citizens will not be able to purchase it in a form intended for medicinal use for any serious condition or for any minor condition unless each manufacturer goes through a prohibitively expensive and draconian procedure to prove that their particular version is both safe and efficacious.

The individual who grows peppermint—or any other herb—and sells it in any form will be breaking the law, unless that person is exceedingly wealthy and able to jump through the hoops that the Medicines and Healthcare Products Regulatory Agency (MHRA) require.

If the procedure is too complicated to understand, then you can purchase documentation on how to negotiate the process for a mere £250 or $395.

After 30 April 2011*, if you grow herbs in the garden, then process them into oils or teas or simply sell the dried leaves, you will be breaking the law...unless you have the finances and will to submit to the MHRA rules. THERE IT IS. You'll probably need a license ($$$) and submitting to MHRA rules is addition ($$$). It's always about the MONEY

Official Journal L 080 , 26/03/2010 P. 0052 - 0054

Commission Decision of 25 March 2010

on amending Decision 2008/911/EC establishing a list of herbal substances, preparations and combinations thereof for use in traditional herbal medicinal products

(notified under document C(2010) 1867)

(Text with EEA relevance)

(2010/180/EU)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on European Union and the Treaty on the Functioning of the European Union,

Having regard to Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use [1], and in particular Article 16f thereof,

Having regard to the opinion of the European Medicines Agency, formulated on 6 November 2008 by the Committee for Herbal Medicinal Products,

Whereas:

(1) Mentha x piperita L. can be considered as a herbal substance, a herbal preparation or a combination thereof within the meaning of Directive 2001/83/EC and complies with the requirements set out in that Directive.

(2) It is therefore appropriate to include Mentha x piperita L. in the list of herbal substances, preparations and combinations thereof for use in traditional herbal medicinal products established by Commission Decision 2008/911/EC [2].

(3) In order to avoid duplications and possible contradictions between the Annexes and Articles 1 and 2 of Decision 2008/911/EC, it is appropriate to remove the references to single substances in those Articles.

(4) Decision 2008/911/EC should therefore be amended accordingly.

(5) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Medicinal Products for Human Use ...

You might want to check to see what their definition of 'human' actually is. Man-like is not the same as being "Man". In the U.S. all food and drug (FDA) rules and crimes related are based on "man or other animals". This comes with an automatic religious exemption. However, if you choose to fit the category of an animal then the government will be happy to oblige.

Sounds kind of like Pot. If it grows in the ground it's God's gift to us to use as every man sees fit for himself.
