This is the report that Pima County Sheriff Clarence Dupnik has been dreading since the tragic event on Saturday January 8.
The sheriff has been editorializing and politicizing the event since he took the podium to report on the incident. His blaming of radio personalities and bloggers is a pre-emptive strike because Mr. Dupnik knows this tragedy lays at his feet and his office. Six people died on his watch and he could have prevented it. He needs to step up and start apologizing to the families of the victims instead of spinning this event to serve his own political agenda.
Jared Loughner, pronounced by the Sheriff as Lock-ner, saying it was the Polish pronunciation. Of course he meant Scott or Irish but that isn’t the point. The point is he and his office have had previous contact with the alleged assailant in the past and that is how he knows how to pronounce the name.
Jared Loughner has been making death threats by phone to many people in Pima County including staff of Pima Community College, radio personalities and local bloggers. When Pima County Sheriff’s Office was informed, his deputies assured the victims that he was being well managed by the mental health system. It was also suggested that further pressing of charges would be unnecessary and probably cause more problems than it solved as Jared Loughner has a family member that works for Pima County. Amy Loughner is a Natural Resource specialist for the Pima County Parks and Recreation. My sympathies and my heart goes out to her and the rest of Mr. Loughner’s family. This tragedy must be tearing them up inside wondering if they had done the right things in trying to manage Jared’s obvious mental instability.
Every victim of his threats previously must also be wondering if this tragedy could have been prevented if they had been more aggressive in pursuing charges against Mr. Loughner. Perhaps with a felony conviction he would never have been able to lawfully by the Glock 9mm Model 19 that he used to strike down the lives of six people and decimate 14 more.
This was not an act of politics. This was an act of a mentally disturbed young man hell bent on getting his 15 minutes of infamy. The Pima County Sheriff’s Department was aware of his violent nature and they failed to act appropriately. This tragedy leads right back to Sherriff Dupnik and all the spin in the world is not going to change that fact.

This is about the best write up I've read on the dude. He was mentally F'd from the git go, everyone knew it, especially the law and they are surely at fault. I know that the shooter is ultimately to blame but dayum, his kinda crazy ain't easy to hide. I guess the cops had more lucrative criminals to attend to.

That's nothing, I personally know someone who had roughly 40% of the top of his skull removed after a blunt force injury and was walking around like that for four months before a prosthesis was put in place, and having only spent 8 days in the hospital. Pretty weird looking to see someone's scalp sunken into their head with ragged edges of skull visible. This was 30 years ago.
So what you're calling amazing is really not that big of a deal.

This statement is not entirely accurate. If the defendant has a SSN the state has access to federal funds through use of Miller Act Bid, Performance and Payment bonds. Do a search for Jean Keating for a thorough discussion. One of the benefits of social security would seem to be to pay for your incarceration whether in a mental facility or "fed max".

On Saturday afternoon, with his friend Gabby Giffords in surgery fighting for her life, Pima County Sheriff Clarence Dupnik railed against the tense partisan politics - "the anger, the hatred, the bigotry" - that prompted the mass murders outside Tucson, in his view.
And, jarring as such claims may be, we understood. Or tried to understand, despite the spectacle of a lawman - an official whose very job it is to dispassionately gather facts and to maintain order and calm - tying the attack on Rep. Giffords and others to political speech in Arizona, which he considers prejudiced and bigoted. There is no evidence that the state's politics in any way contributed to this atrocity.
Was Dupnik unnecessarily inflammatory? It seemed so. But it came mere hours following a horrific, bloody mass murder. If you weren't on edge, you weren't being human. But then, on Sunday, the venting continued anew. And a horrified nation began paying closer attention to the Pima County sheriff.
The world's eyes, once again, focused on Arizona for the worst of reasons. And Dupnik stood before the cameras interpreting the shootings as politically motivated, despite an increasing weight of evidence depicting the shooting suspect, Jared Loughner, as a mentally ill young man who rambled incoherently about pervasive bad grammar and other apolitical obsessions. Even Dupnik has observed that Loughner had made death threats against others and that they had been investigated by police.
Still, Dupnik used the opportunities to blame Arizona's lax, new gun laws and, again, the angry "rhetoric" of talk radio. The shootings were spurred, he suggested, by "the rhetoric about hatred, about mistrust of government, about paranoia of how government operates."
Dupnik took up his cause again on Monday. And, in response, we have to say at last . . . enough. Enough attacks, sheriff. Enough vitriol. It is well past time for the sheriff of Pima County to get a grip on his emotions and remember his duty.
With each passing hour, we learn more about the 22-year-old suspect. And everything we learn adds to the profile of a deeply troubled young man detached from reality. There is nothing to date that suggests any partisan motivation for his crimes, whether right-wing or left.
Dupnik needs to recall that he is elected to be a lawman. With each additional comment, the Democratic sheriff of Pima County is revealing his agenda as partisan, and, as such, every bit as recklessly antagonistic as the talk-show hosts and politicians he chooses to decry.

What's your response to this Mr. Dupnik? A bit of truth comes out, eh? Exactly how many felonies did you decline to investigate and prosecute? Are you going to slink away from the white-hot light of truth or will you "man up" and admit that your scurrilous allegations were disseminated simply to try to save your own hide from the entirely-appropriate wrath at the ballot box that is certain to ensue come next election?
The suspect didn't just post one threat on an Internet forum and there wasn't "just one" incident - it's alleged here that he made multiple death threats against the staff of the college he was ejected from, radio personalities and local bloggers.
Each and every one of those threats was an offense and had just one of them been prosecuted it would have resulted in the suspect being blacklisted in the NICS database - and thus he would not have been able to buy the gun he shot the people in Tuscon with.
And before you go off on this guy and his blog being some sort of nut, here's the credentials from his page:

Does Arizona have a recall process for so-called "elected officials" who behave like this and refuse to accept responsibility for their conduct - including but not limited to blaming others for their own failures that result in the death of innocent people? How about some sort of impeachment procedure? If you don't, you need both - right now.

Just hours after Rep. Gabrielle Giffords, an Arizona Democrat, was shot in the head by a crazed gunman, Pima County Sheriff Clarence W. Dupnik — addressing the media for the first time — made headlines for saying that “vitriolic political rhetoric” heard on the radio and TV caused Jared Loughner to go on a bloody killing spree that left six dead and 14 wounded.
"When the rhetoric about hatred, about mistrust of government, about paranoia of how government operates, and to try to inflame the public on a daily basis, 24 hours a day, 7 days a week, it has impact on people especially who are unbalanced personalities," Dupnik said Saturday night.
The sheriff, a Democrat who has served as the county's top cop for 31 years, angered many with the remarks — including some of his friends, who felt his editorializing had no part in a news conference, typically reserved for impersonal facts and details.
Sheriff Larry Dever of Arizona's Cochise County, which borders Dupnik's, says he considers Dupnik a close friend and mentor but can't understand what drove his latest comments.
But Dever added that he knows that Dupnik is very angry about the shootings and was close friends with the federal judge killed and with Giffords.
"He’s offered me wise counsel over the years. He's not only a friend but someone I’ve looked up to," Dever told FoxNews.com. "But I cannot explain nor can I defend his comments on this."
Rep. Trent Franks, R-Ariz., told Fox News: "I’m especially disappointed in the sheriff because we were looking to him for straight facts and he politicized this. I don’t want to be unkind but I was disappointed."
"The sheriff is supposed to investigate, not pontificate," Brad Blakeman, former assistant to President George W. Bush told Fox News on Monday. "This guy should be fired."
But this isn't the first time Dupnik has offered his brazen opinion on controversial topics, such as Arizona's controversial immigration law, the Tea Party and campaign finance.
— He called Arizona's immigration law "racist," "disgusting" and "just a stupid law" in an interview with Tucson's KGUN9-TV on Apr. 27, 2010.
In May 2010, Dupnik wrote in an opinion piece in the Wall Street Journal about SB1070 calling it unconstitutional: "I have argued from the moment that this bill was signed that it is unnecessary, that it is a travesty, and most significantly, that it is unconstitutional.”
— On the Tea Party, according to the Arizona Star newspaper, he said at a local immigration forum in September: "I think it brings out the worst in America. Instead of sitting down and getting both parties to work together, they are part of a movement designed to stop Obama from accomplishing anything.”
— On gun laws, at a press conference following the mass shooting: "Well, I think we're the Tombstone of the United States of America," he said, adding, "I have never been a proponent of letting everybody in this state carry weapons under any circumstances that they want, and that's almost where we are."
— On Jan 9, 2010, Dupnik said of campaign finance reform to Fox News's Megyn Kelly: "When millions of dollars are filtered into this country to buy very vitriolic ads and they don't have to be identified to the people that are donating money to them, I think we need to take a look at it."
Critics say the sheriff needs to be the protector of the people, not a source of instigation and divisiveness.
Sheriff Paul Babeu of Pinal County, Ariz., told Fox News that Dupnik's comments only helped to fuel unsubstantiated rumors that were rampant in the hours after the shooting, including that the shooting suspect had served in Afghanistan and was a member of the Tea Party.
“All of these have been debunked," Babeu said. "I wish that everybody would take a moment and try to calm this down and that's our job. It's not to insert our opinion but find out the facts and what's truly happened.”
Dupnik himself later conceded on Fox News that his blaming vitriol was his opinion, not fact. And despite his critics he isn't backing down from his statements.
"I think differences of opinion is what makes the world go round and round but it's irresponsible for us not a some point to address this kind of behavior and try to put a stop to it," Dupnik told Fox News' Kelly.
But others say the sheriff should just stick to his job.
“To ascribe political motives and then launch a political assault naming elected leaders in America and saying this is connected when there is no basis in fact does nothing to help at a time when people's hearts are broken and really trying to assess what happened here," Babeu said.
"And you and all Americans look to law enforcement to find out the facts of truly what happened and not to give an opinion. But the sheriff is an elected sheriff."

Loughner's dad, Randy, "is a very angry person" who tends to get involved in disputes, said a neighbor, Stephen Woods.
"He's pretty much the neighborhood prick," Woods, 46, said of the elder Loughner, although he added that Jared's mom, Amy, is "just as nice as can be."
"They're like the Addams Family," said Woods, who noted that the clan is well-known for keeping their home dark on Halloween and not putting up Christmas lights or decorations...
Loughner also volunteered at the Pima County Animal Care Center to walk dogs last year, but was asked to leave after he kept walking the animals near a contaminated area, The Wall Street Journal reported.

A spokesman, Jason Ogan, said the details of the calls were being reviewed by legal counsel and would be released as soon as the review was complete.
TRANSLATION: We need to make sure we cover our ass well on this one, so we cannot release any info immediately.
If it suited their purposes, of course they would release the info immediately.

The Sheriff himself is a hack, how can you expect him to put out information or
do his job properly and fairly when he came out in a partisan way and lied to

James Eric Fuller, 63, who was shot in the knee on January 8, objected to comments from Trent Humphries, leader of the conservative Tea Party political movement in Tucson, during taping of a town hall meeting organized for an ABC News special program on the aftermath of the shootings.
Fuller stood, turned and snapped a picture of Humphries, said Pima County Sheriff's Department spokesman Jason Ogan.
"Then he yelled at him and said, 'You're dead,'" Ogan said.
Deputies arrested Fuller on charges of disorderly conduct and making a threat.
After consultation with a doctor, deputies then took Fuller to a local hospital for an involuntary evaluation, Ogan said.
The charges will be filed with the Pima County Attorney's Office, he said.

the one thing about Loughner i've noticed the media doing is highlighting his "truther" beliefs ... Loughner is a 9-11 truther. so they're playing that up - but that's on Rush Limbaugh.
i guess on the radio, in terms of leftist MSM there's Thom Hartmann and Amy Goodman ... neither of whom I can stomach because ... they promote the Official Conspiracy theory re. 9-11.
so i guess i got something in common with Loughner. i know 9-11 was an inside job.
Loughner is pretty young. i don't think he will get the death penalty. dude will be around for a long time.
i wonder how he will fare in prison ? i imagine he will get some "street cred" for "offing the pigs".
but that picture ... Jesus. looks kind of Hollywood. this is Loughner's Hollywood moment.
