A federal judge in Florida has struck down as unconstitutional key parts of the sweeping health care reform bill championed by President Barack Obama. Officials in Florida and 25 other states are challenging sections of the Patient Protection and Affordable Care Act, including the "individual mandate" requiring most Americans to purchase health insurance in four years or face stiff penalties.

A U.S. district judge ruled Monday that the health care law unconstitutional because it violates the Commerce Clause

Judge Roger Vinson said as a result of the unconstitutionality of the "individual mandate" that requires people to buy insurance, the entire law must be thrown out.

"I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system. The health care market is more than one sixth of the national economy, and without doubt Congress has the power to reform and
regulate this market. That has not been disputed in this case. The principal dispute
has been about how Congress chose to exercise that power here," Vinson wrote.

"Because the individual mandate is unconstitutional and not severable, the entire act must be declared void," he wrote.

alot of states are waiting for this info . all states know they can not pay the bill for the health care an no one should have to pay for something they dont want

And should this the SCOTUS decide to take that case I wouldn't be surprised if it is ruled constitutional 5-4.

I'd be very happy if most, if not all, of them upheld the true meaning of the commerce clause but that would significantly hinder the power of the control freaks in the federal government.

Let's hope that something good comes from this.

It's a requirement by the U.S. federal government in the passed 2009 U.S. health care "reform" bill which requires all U.S. citizens to purchase health insurance or face a fee.

The whole concept is nothing but a sham to subsidize the health-insurance corporations and it's being justified as constitutional due to a distortion of the commerce clause in the U.S. Constitution which allows for the "regulation" of interstate commerce--the original meaning which was intended to promote free trade of commerce between U.S. states not to grant the federal government power to regulate anything it wants.
