An 11-year-old Box Elder student has been suspended from school for bringing a toy gun to school. The superintendant said that the gun was not in working condition when he brought it and that it wasn't any threat or any danger and that you have to use common sense. I am trying to figure out by his comments of using common sense why then they punished him at all and why the maximum of 10 days..... Guess my definition of common sense is different.

If it is a toy, than what difference does it make if it's in "working condition" or not?

you hear of stupid stories like this a lot...absolutely no common sense or judgement; reminds me of this one thats even More assinine, an 8 year old brings a tiny toy gun (looks like it's the size of a half-dollar) to school and gets suspended, I've also heard one; a kid drew a pistol on a piece of paper and they suspended him for that...bunch of stupid people out there...

I suppose it it was one of those super-realistic toys then it was a pretty dumb idea for him to take it to school. 10 days is a long time though...maybe just detention or 1 or 2 days? If the toy even had the ability to scare someone that is....

The superintendant just wanted to look like a hero, get lots of attention, a pat on the back from Home Land Security and be praised for being such a patriotic american. :oo-->

As spelled out in the CA education code (not sure about other states):

48900(m) Possessed an imitation firearm. As used in this section,
"imitation firearm" means a replica of a firearm that is so
substantially similar in physical properties to an existing firearm
as to lead a reasonable person to conclude that the replica is a
firearm.
