Laura Eimiller, a spokesperson for the Federal Bureau of Investigation's Los Angeles office, confirmed Wednesday that "we are aware of the situation. We are reviewing it for a potential civil rights investigation."

Steve Peterson, hired by Kephart's parents to conduct an independent investigation of the May 10 death of their 43-year-old son, said Tuesday he has received more than 120 leads to investigate after a sign requesting information on Kephart's death was posted at the Valero station in Rimforest.
The incident will also be the focus of a short video produced by Reason TV, examining whether deputies may have overreacted when subduing the 350-pound Kephart and shooting him repeatedly with electric stun guns.

POSTED SIGN

That sign directing people with information about the incident to call Peterson is posted on the eastern edge of the Valero property. It stands at the spot where Kephart parked his car after a sheriff's deputy had reportedly pursued him for allegedly running a stop sign at Highway 189 and Daley Canyon Road.
Peterson said he has been contacted by FBI agents who want to meet with him about what he has learned about Kephart's death, but that no such meeting has yet been set up.

Explaining how the FBI became involved, Eimiller said that when the bureau receives a request for a civil-rights investigation, "if we decide to look into it, and we have, we will take the information developed to the Department of Justice's Civil Rights Division."

Then it will be determined, she said, whether a full investigation is warranted and if a criminal prosecution is justified.

"There's no time frame," she said concerning how long the FBI might take to complete its investigation. "It takes as long as it takes."
Eimiller said the FBI does not normally confirm its investigations, but that allegations of civil-rights violations are an exception.

REVIEW COMPLETED

Meanwhile, sheriff's homicide detectives have completed their review of the incident, a department spokesman said Tuesday.

Sgt. Brad Toms, who has overseen the department's inquiry into the events culminating in Kephart's death, declined to comment on its outcome, but said it will be forwarded to the office of District Attorney Michael A. Ramos for review once the results of Kephart's autopsy are available.

Toms said it is departmental policy not to send the two reports forward separately. Asked when he expects the findings of the autopsy-performed by the Riverside County coroner's office-to be available, he said he had expected they would have been completed two weeks ago.

However, for reasons Toms said are unclear, that timetable was not met, and the autopsy findings are still being awaited.

Criticism continues to be leveled at the San Bernardino County Sheriff's Department over the incident and the way it has been handled. A short video entitled "Cops Kill Allen Kephart" has been posted on YouTube. It includes text accusing sheriff's spokespersons of lying about the circumstances surrounding Kephart's death.

It also features a filmed car trip from the intersection of Daley Canyon Road and Highway 18 to the Valero station, and seems to suggest there were no places Kephart could have safely pulled over before reaching the Valero Depot.
However, the video does not include the first leg of the pursuit of Kephart, after he reportedly ran a stop sign at Daley Canyon and Highway 189.
The Reason TV video is currently being wrapped up and should be available for viewing on YouTube in about two weeks, said Paul Detrick, one of its producers.

Detrick said Reason TV, which is affiliated with the Reason Foundation, a Libertarian organization, does five- to 10-minute Internet videos on a wide range of topics.

The Kephart video, he said, will focus on whether Kephart died as a result of excessive use of force by deputies.

I've said it before, I was questioning a self-admitted CHP sergeant on another forum and his response (condensed) was ; "If you run (and in this case not stopping your car) you're fair game, you've earned yourself a beating,tasing or a GSW"....I followed up from the angle of the punishment over-bearing the crime, but it didn't matter....something has to give....

I am surprised those cops are still alive... and on duty too. When the government is not responsive to the people, the people will take things in their own hands. At some point the sheep will grow fangs and feed on the wolves.
