http://english.aljazeera.net/mritems/Images/2011/7/20/2011720712313734_20.jpgCanadian Prime Minister Stephen Harper, a staunch supporter of Israeli policy, has described criticism of Israeli as a form of 'new anti-Semitism' [EPA]Nearly two years after the first hearings were held in Ottawa, the Canadian Parliamentary Coalition fto Combat Anti-Semitism (CPCCA) released a detailed report (http://www.cpcca.ca/conference_files/CPCCA_Final_Report_English.pdf) on July 7 that found that anti-Semitism is on the rise in Canada, especially on university campuses.
While the CPCCA's final report does contain some cases of real anti-Semitism, the committee has provided little evidence that anti-Semitism has actually increased in Canada in recent years. Instead, it has focused a disproportionate amount of effort and resources on what it calls a so-called "new anti-Semitism": criticism of Israel.
Indeed, the real purpose of the CPCCA coalition seems to be to stifle critiques of Israeli policy and disrupt pro-Palestinian solidarity organizing in Canada, including, most notably, Israeli Apartheid Week events. Many of the CPCCA's findings, therefore, must be rejected as both an attack on freedom of speech and freedom of protest, and as recklessly undermining the fight against real instances of anti-Semitism.
The CPCCA and its findings
The Canadian Parliamentary Coalition to Combat Anti-Semitism (CPCCA) was born out of a conference held in London in February 2009 by the Inter-Parliamentary Committee for Combating Anti-Semitism. Formed in March 2009 and not directly linked to the Canadian government, or to any NGO or advocacy group, the CPCCA included 22 Canadian Parliament members from across party lines. Former Liberal MP Mario Silva chaired the Inquiry Panel and Conservative MP Scott Reid led the Steering Committee.
Between November 2009 and January 2010, the CPCCA held ten separate hearings during which time representatives of various non-governmental organizations, religious institutions, police departments and Canadian and Israeli universities presented papers meant to assess the level of anti-Semitism in Canada. While groups critical of Israel were denied the chance to address the committee, major Zionist organizations like B'nai Brith Canada, Friends of the Simon Wiesenthal Center for Holocaust Studies, and the Canadian Jewish Congress were welcomed.
"Much of today's anti-Semitism manifests in anti-Israel agitation around boycotts, divestment and sanctions," said Avi Benlolo, President and CEO of the Friends of the Simon Wiesenthal Center for Holocaust Studies, during a hearing in November 2009. "It deploys an unfair double standard against the Jewish state, singling out of Israel alone for one-sided, harsh criticism and calls for punitive actions."
Throughout the consultation process, the CPCCA regularly focused on Canadian university campuses, which were routinely described as hotbeds of anti-Semitism, where Jewish students or students with pro-Israel leanings are often intimidated and threatened. This accusation was made repeatedly, and included in the CPCCA's final report, despite the fact that Dr. Fred Lowy, President Emeritus of Concordia University in Montreal, stated in his address to the CPCCA that, "by and large, Canadian campuses are safe and are not hotbeds of anti-Semitism of any kind".
In its final report (http://www.cpcca.ca/conference_files/CPCCA_Final_Report_English.pdf), the CPCCA made about two dozen recommendations on how best to fight anti-Semitism in Canada. While the report states that "criticism of Israel is not anti-Semitic, and saying so is wrong", it also found that "singling Israel out for selective condemnation and opprobrium … is discriminatory and hateful" and many of its recommendations deal with combating this "new anti-Semitism".
A major recommendation issued by the CPCCA was that the Canadian government should promote the working definition of anti-Semitism used by The European Union Monitoring Centre on Racism and Xenophobia (EUMC). This definition categorizes "applying double standards by requiring of [Israel] a behavior not expected or demanded of any other democratic nation" as anti-Semitic.
In other words, the CPCCA is supporting a definition whereby individuals who focus their attention on Israeli human rights violations, yet don't level an equal amount of condemnation on other states for their human rights violations, can be labeled as anti-Semitic. This is obviously problematic since Palestine solidarity activists - like any other people - have commitments that make it impossible to engage with every issue they are otherwise interested in. They shouldn't be labeled as anti-Semitic due to their inability to participate in every single human rights struggle happening around the world.
Another dangerous recommendation made by the CPCCA (http://www.cpcca.ca/conference_files/CPCCA_Final_Report_English.pdf) was that Canadian university administrators should condemn "discourse, events and speakers which are untrue, harmful, or not in the interest of academic discourse, including Israeli Apartheid Week". Even the use of the word "apartheid" in relation to Israel is anti-Semitic, the CPCCA found, since it amounts to the "denial of the Jewish people their right to self- determination ... by claiming that the existence of a State of Israel is a racist endeavor".
This clearly violates freedom of speech and an open exchange of ideas at Canadian universities, and also unfairly and inaccurate labels Israeli Apartheid Week (IAW) as anti-Semitic. In reality, IAW has since 2005 brought together respected activists, academics, journalists and cultural figures from around the world, including Judith Butler, Ronnie Kasrils, Noam Chomsky and Ali Abunimah, among others, to openly discuss ideas related to Israel/Palestine.
IAW provides an educational space for understanding Israel's apartheid policies - as evidenced, for example, through the separate legal systems used by Israelis and Palestinians living in the occupied West Bank or the discriminatory land ownership laws operating inside Israel - and supports the growing campaign for boycott, divestment and sanctions (BDS), which aims to non-violently pressure Israel to respect international law. It is far from the "uniformly well-organized, aggressive [campaign] designed to make the Jewish state and its supporters pariahs" the CPCCA report makes it out to be (http://www.cpcca.ca/conference_files/CPCCA_Final_Report_English.pdf).
The CPCCA also recommended that the Canadian Committee of Foreign Affairs undertake a study on the United Nations Human Rights Council, "particularly regarding its over-emphasis of alleged human rights abuses by Israel, while ignoring flagrant human rights abuses of other member states".
This clearly demonstrates how the committee has confounded anti-Semitism with criticism of Israel, and is prepared to levy dubious suspicions against UN bodies and tarnish Canada's international standing in the process.
In a statement released on July 8, Thomas Woodley, President of Canadians for Justice and Peace in the Middle East (CJPME), said that the CPCCA's recommendations, "if implemented, will inhibit public discussion of Israel's conduct".
"CJPME believes that conclusions and recommendations generated by a process in which the same body - the CPCCA - is prosecutor, jury, and judge, are not credible. Although a few of the witnesses recounted incidents that were indeed indicative of genuine anti-Semitism, many were complaining about merely being exposed to criticism of the Israel's conduct," the CJPME press release stated (http://www.cjpme.org/DisplayDocument.aspx?DocumentID=1666&SaveMode=0).
Independent Jewish Voices (IJV) Canada also criticized the committee, stating that "the CPCCA's goal is to criminalize criticism of Israel and Zionism, not to hold impartial hearings. Therefore, we oppose the CPCCA as an ideologically biased organization with an agenda that will harm free speech and human rights activity in Canada. We oppose the CPCCA's Orwellian distortion of anti-Semitism. It is a danger to both Canadian liberties and to the genuine and necessary fight against anti-Semitism."
Reflection of official Canadian policy
While labeling critics of Israeli policy as anti-Semitic is nothing new, the level at which this accusation is now being used in Canadian discourse must be seen as a reflection of the Canadian government's official and current policy on the Middle East.
"When Israel, the only country in the world whose very existence is under attack, is consistently and conspicuously singled out for condemnation, I believe we are morally obligated to take a stand. Demonization, double standards, de-legitimization, the three D's, it is the responsibility of us all to stand up to them," Canadian Prime Minister Stephen Harper said in 2010 at the Ottawa Conference on Combating Anti-Semitism (http://pm.gc.ca/eng/media.asp?id=3776), which was supported by the CPCCA. Harper added:
"Harnessing disparate anti-American, anti-Semitic and anti-Western ideologies, it targets the Jewish people by targeting the Jewish homeland, Israel, as the source of injustice and conflict in the world and uses, perversely, the language of human rights to do so. We must be relentless in exposing this new anti-Semitism for what it is."
Under Harper, Canada has routinely defended Israeli intransigence and disregard for international law and the human rights of the Palestinian people under its control. In return, trade cooperation and military and security technologies ties have been strengthened between the two states.
In May of this year, it was reported that Harper was adamantly opposed to making any reference to the 1967 borders in a G8 summit statement calling for renewed Israeli-Palestinian negotiations. Far-right Israeli Foreign Minister Avigdor Lieberman thanked Harper for his position (http://www.haaretz.com/news/diplomacy-defense/lieberman-thanks-canada-pm-for-objection-to-1967-borders-at-g8-1.364502), and stated, "Canada is a true friend of Israel".
In 2010, Canada announced it would discontinue its financial contributions to the United Nations Relief and Works Agency (UNRWA), the organization that provides support and resources to approximately 4.7m registered Palestinian refugees in Jordan, Lebanon, Syria and the occupied Palestinian territories, and funnel the money into greater policing and security institutions run by the un-elected and corrupt Palestinian Authority leadership instead.
In January 2009, as the Israeli army continued its disproportionate attack on the besieged civilian population in Gaza that left 1,400 Palestinians dead in the span of three weeks, Canada was the only country out of 47 that voted against a motion at the United Nations Human Rights Council condemning the Israeli violence.
In addition to providing diplomatic cover for Israel, the Canadian government has attacked and cut funding to various non-governmental organizations working on issues related to Israel/Palestine, including Kairos Churches and Alternatives International.
Canadian Minister of Citizenship, Immigration and Multiculturalism Jason Kenney, who led the formation of the Canadian Parliamentary Coalition to Combat Anti-Semitism (CPCCA) and is an ex-officio member, has also repeatedly alleged that the Canadian Arab Federation promotes anti-Semitism and hatred. While Kenney never backed up these claims, the Canadian Arab Federation's contracts with the government - which helped finance language programs for Toronto-area immigrants (the majority of whom are of Chinese origin) - were not renewed in 2009.
Undermining the fight against real anti-Semitism
Anti-Semitism, like all other forms of racism, is appalling and must be strongly and unequivocally condemned.
But by defining legitimate criticism of Israeli policy and pro-Palestinian activism in Canada as anti-Semitic, the CPCCA is not only threatening free speech and freedom of protest, but it is undermining the fight against real cases of anti-Semitism and weakening the seriousness with which such cases should be dealt.
This is something that Canadians, and people everywhere, should be adamantly against.

Stories like this serve to remind us that just like here in America, our cousins to the north are not represented by their government, and that their government is infested with Zionist sympathizers. Harper is a shallow man and watching him roll over in the name of political correctness is no surprise. Tolerance for criticism is more important to a healthy society than tolerance that is muzzled. And then there is the house brand "anti-Semite" - for most of us that will never pretend Israel is a saintly outpost of virtue the moniker is a tired saw and we could care less.

The prime minister said home-grown Islamic radicals in Canada are "also something that we keep an eye on."

Harper said his government will bring back anti-terrorism clauses that were brought in in 2001 but were sunset in 2007 amid heated political debate.

There were two clauses at the heart of the debate:

One allowed police to arrest suspects without a warrant and detain them for three days without charges if police believed a terrorist act may have been committed.

The other allowed a judge to compel a witness to testify in secret about past associations or perhaps pending acts under penalty of going to jail if the witness didn't comply.

Neither clause was used by police or prosecutors in the five years before they expired.

In October 2006, a parliamentary committee recommended extending the two provisions.

The Conservatives put forward a proposal to keep the measures in place for three more years, but the three opposition parties united to defeat the proposal in February 2007 by a 159-124 vote.

The rest of the legislation remained in force.

When asked by Mansbridge if he would try to bring those laws back, Harper replied: "That is our plan."

"We think those measures are necessary. We think they've been useful," he said. "And as you know … they're applied rarely, but there are times where they're needed."

It appears that a private citizen can call for an Israeli boycott, but if the citizen is connected to the Arab League's (or other body with foreign ties) boycott then fines and/or jail time can be pursued by the gov.

The Commerce Department's Bureau of Industry and Security (BIS) administers U.S. antiboycott regulations, which prohibit U.S. persons from taking actions in support of unsanctioned foreign government boycotts, including the Arab League boycott of Israel. BIS has a long record of aggressive enforcement of the antiboycott regulations, with over $26 million in civil penalties imposed and denials of export privileges where violations have been found.

Antiboycott Laws:

During the mid-1970's the United States adopted two laws that seek to counteract the participation of U.S. citizens in other nation's economic boycotts or embargoes. These "antiboycott" laws are the 1977 amendments to the Export Administration Act (EAA) and the Ribicoff Amendment to the 1976 Tax Reform Act (TRA).

Objectives:

The antiboycott laws were adopted to encourage, and in specified cases, require U.S. firms to refuse to participate in foreign boycotts that the United States does not sanction. Primary Impact:

Who Is Covered by the Laws?

These persons are subject to the law when their activities relate to the sale, purchase, or transfer of goods or services (including information) within the United States or between the U.S. and a foreign country. This covers U.S. exports and imports, financing, forwarding and shipping, and certain other transactions that may take place wholly offshore.

Generally, the TRA applies to all U.S. taxpayers (and their related companies). The TRA's reporting requirements apply to taxpayers' "operations" in, with, or related to boycotting countries or their nationals. Its penalties apply to those taxpayers with foreign tax credit, foreign subsidiary deferral, FSC (Foreign Sales Corporation), and IC-DISC (Interest Charge-Domestic International Sales Corporation) benefits.

What do the Laws Prohibit?

Conduct that may be penalized under the TRA and/or prohibited under the EAR includes:

Agreements to refuse or actual refusal to do business with or in Israel or with blacklisted companies.

Agreements to discriminate or actual discrimination against other persons based on race, religion, sex, national origin or nationality.

Agreements to furnish or actual furnishing of information about business relationships with or in Israel or with blacklisted companies.

Agreements to furnish or actual furnishing of information about the race, religion, sex, or national origin of another person.

Implementing letters of credit containing prohibited boycott terms or conditions.

The TRA does not "prohibit" conduct, but denies tax benefits ("penalizes") for certain types of boycott-related agreements.

What Must Be Reported?

The EAR requires U.S. persons to report quarterly requests they have received to take certain actions to comply with, further, or support an unsanctioned foreign boycott.

The TRA requires taxpayers to report "operations" in, with, or related to a boycotting country or its nationals and requests received to participate in or cooperate with an international boycott. The Treasury Department publishes a quarterly list of "boycotting countries."

How To Report:

EAR reports are filed quarterly on form BIS 621-P for single requests or BIS 6051-P for multiple requests available from the Department of Commerce,s Office of Antiboycott Compliance (OAC) in Washington, D.C. To obtain these forms, telephone OAC,s Reports Processing Unit at (202) 482-2448. TRA reports are filed with tax returns on IRS Form 5713. This form is available from local IRS offices.

Penalties:

The EAR prescribe the penalties for violations of the Antiboycott Regulations as well as export control violations. These can include:

Criminal:

The penalties imposed for each "knowing" violation can be a fine of up to $50,000 or five times the value of the exports involved, whichever is greater, and imprisonment of up to five years. During periods when the EAR are continued in effect by an Executive Order issued pursuant to the International Emergency Economic Powers Act, the criminal penalties for each "willful" violation can be a fine of up to $50,000 and imprisonment for up to ten years.

Administrative:

For each violation of the EAR any or all of the following may be imposed:

General denial of export privileges;

The imposition of fines of up to $12,000 per violation; and/or

Exclusion from practice.

Boycott agreements under the TRA involve the denial of all or part of the foreign tax benefits discussed above.

The $10,000 maximum per violation specified in the EAA is adjusted periodically pursuant to law for inflation.

The maximum civil penalty for any violation committed from October 23, 1996 through November 1, 2000 is $11,000 per violation.

The maximum civil penalty for any violation committed after November 1, 2000 is $12,000 per violation.

The Arab boycott of Jewish interests started as early as 1921 - 27 years before the establishment of the state of Israel in 1948. The boycott is still in effect today under the auspices of the Arab League and its Central Boycott Office in Damascus, Syria, and includes not only products produced in Israel, but also companies that do business in or with Israel. The boycott even goes as far as blacklisting ships that have docked in Israeli ports, regardless of the cargo's point of origin or ultimate destination.

In response to the Arab boycott of Israel, Congress passed a law creating the Office of Antiboycott Compliance within the Department of Commerce in 1977. The law prohibits U.S. persons from taking certain actions in support of an unsanctioned foreign boycott against a country that is friendly to the United States. Because Israel is an ally of the United States, and our government does not sanction the Arab boycott of Israel, the law prohibits actions that further or support the Arab League boycott of Israel.

Since the year 2000, a divest-from-Israel campaign has been gaining momentum on college campuses across the United States. Boycott Watch (www.boycottwatch.org), an organization that examines boycotts and reports both sides of the story so consumers can decide for themselves what the truth is and also the parent organization of Divestment Watch, researched the anti-boycott laws and concluded that the law does indeed apply to the divest-from-Israel campaign and has challenged the campaign on its merit.

In November 2003, Boycott Watch sent a letter to the Office of Antiboycott Compliance, furnishing evidence that the divest-from-Israel campaign is a direct function of the Palestinian Authority, which is a member of the Arab League and a signatory to the Arab boycott of Israel. Later, Boycott Watch furnished additional information to the Office of Antiboycott Compliance, about the Palestinian Authority's effort to establish an economic blockade of Israel in Malaysia. This would effectively expand the scope of the boycott and the Palestinian Authority's economic warfare against Israel.

Boycott Watch reports on consumer boycotts and violations of US law pertaining to boycotts, including illegal union and foreign boycotts. As a result of the demand for information with its leading role in the legal challenge to the divest-from-Israel campaign, Boycott Watch created Divestment Watch to concentrate on the divestment issue. Boycott Watch is now advising all colleges and universities that divest-from-Israel campaigns on their campuses may be in violation of the U.S. antiboycott law.

Divestment is a form of boycott - It is the boycott of investment dollars. Divestment Watch is actively reporting on the illegal divestment/boycott campaign including campus programs that promote the illegal activity, lobbying for governmental participation in the illegal boycott, as well as business participation.

By understanding case histories and the applicable laws, individuals become empowered to warn potential participants of the illegal nature of the boycott as well as the tools to prevent such activity.

Darrat is the second Canadian to die in Libya this week, according to the Canadian Libyan Council.

Nader Ben Raween, 24, was killed Tuesday after leaving his IT job in Ottawa last March and joining Libyan rebels to fight against Gadhafi's loyalists.

Darrat didn't join the rebels, Hussein said.

A Facebook posting by the CLC says both men "will be greatly missed but their ultimate sacrifice will never be forgotten."

The department of foreign affairs is "aware of reports of the death of a second Canadian citizen in Libya," but couldn't confirm or deny it was Darrat.

The Darrat family lived in the nation's capital for 14 years: from 1984 to 1994, and again from 2004 to 2008.

The brother of the Canadian man killed while fighting alongside rebels in Libya said the 24-year-old IT worker was passionate about the possible liberation of Tripoli but was never expected to take up arms in the cause to overthrow Moammar Gadhafi's regime.

Edmonton-born Nader Benrewin left his information-technology job in Ottawa in March to join the Libyan uprising against Gadhafi and his forces. He was reportedly shot by a sniper in the head while trying to seize the despot's compound in Tripoli.

His older brother, Tarek, told CBC News Thursday that Benrewin had originally gone to Libya to share his IT expertise in blocking surveillance of mobile networks that could threaten the rebels in Benghazi.

"Initially, the purpose of the visit was not to be a fighter or join the freedom fighters," Tarek said, speaking from Cairo. "It was to help pick up and reconfigure the mobile networks and to liberate the cities, because Gadhafi's government had tapped them."


Baird Welcomes New Libyan Diplomat

Foreign Affairs Minister John Baird met the new Libyan chargé d'affaires to Canada on Thursday.

"I am pleased to welcome Abubaker Karmos, appointee of the National Transitional Council (NTC) of Libya, as chargé d'affaires ad interim at the Embassy of Libya in Canada," Baird said in a statement.

The flag of the NTC, the [tribe] opposing Moammar Gadhafi [and highest per capita contributer of al qaeda terrorists], will hang alongside those of the world's nations in the foreign affairs headquarters in Ottawa.

"Canada will interact with the NTC as Libya's government until the Libyan people select for themselves elected representatives," Baird's statement read.
