Will this tactic work all the time? Meaning, I wouldn't get drug out of the truck.

He asserted his rights without really directly questioning their authority or being confrontational. The cops know they can't force you to answer questions. DUI is a money machine. He didn't appear drunk and therefore not a prospect for profit.

they can demand to see your license under threat of arrest, but you DO NOT have to answer ANY self-incriminating questions or any questions related to what your doing there or where you're going or where you've been.....IF they'd smelled any ETOH (that's one reason they stick their nose in your window) he'd been detained
5 words of Wisdom: "I have nothing to say" and always Remember this: "what you say can and WILL be used against you in a court of law" .....It's Absolutely Disgusting that police try and trick you into giving up your Fifth Amendment Rights by asking self-incriminating questions

My favorite part was:
"Have you had anything to drink tonight?"
"Do I have to answer that question?"
"........ Have you have anything to drink tonight?"
Good for him, but I think that he was very lucky. 99 out of 100 times they are going to make you exit the vehicle (calling for back up and pulling out the tasers/guns) and say that they are going to breath test you. Where I am refusal is automatically a 6 or 12 month suspension and a trip to the station house (+hundreds of dollars in fines).
I think you are right hoarder in saying that he didn't appear drunk so there was no point in pushing it. No chance for corporate profit, and too much work, which is any work.

Kudos to the fellow with the 'nads to do this. More people need to be doing the exact same thing every day in order that the cops get the correct notion they are first and foremost public servants and peace officers, not the king's men with unlimited privileges and immunities while eating out our substance..

I was coming back home late one friday night doing some street preaching and a DUI checkpoint was setup on the road I travel everyday.
They took one look at my face, my clean white shirt, my scripture verses on the car and my Bible on the dashboard.
They didn't even ask me any questions and just kind of moved back as if an unseen force had told them too.
Funny in a way and a benefit of doing what God said. I suspect they thought I might start preaching at them (I would have) and didn't even want to hear it lol

Thats certainly how it works. That's how all criminal activities work. They will always go for the easy target. Unfortunately, as the saying goes, people is so igorint it's like shooting fish in a barrel.

I was at the Laughlin, Nevada motorcycle rally a few years back. Me and a couple of
friends rode across the river and up to the ghost town Oatman, Arizona on old US 66.
Oatman is a popular attraction for the bikers during the Laughlin River Run. On our return
from Oatman to Bullhead City we came upon a DUI check point. The cop asked if we had
anything to drink. I looked him right in the eye and said "yea, I had a couple of cups of coffee
and a coke." The cop got a little testy, but we were free to go.

I went to Oatman once - one of my most memorable days...

Having a video camera rolling is key. Without one you get the same treatment Pastor Steven Anderson recieved.
