Monsanto Prevails In Suit Brought By Organic Growers

A federal judge has ruled in favor of global seed giant Monsanto Co, dismissing a lawsuit brought by a consortium of U.S. organic farmers and seed dealers who said their industry is at risk from Monsanto's growing market strength.

U.S. District Court Judge Naomi Buchwald, for the Southern District of New York, threw out the case brought by the Organic Seed Growers and Trade Association (OSGATA) and dozens of other plaintiff growers and organizations, criticizing the groups for a "transparent effort to create a controversy where none exists."

The Public Patent Foundation (PUBPAT) filed the suit last March on behalf of more than 50 organizations challenging the agricultural giant's patents on its genetically modified seeds. The group wanted a ruling that would prohibit Monsanto from suing the farmers or dealers if their organic seed becomes contaminated with Monsanto's patented biotech seed germplasm.

But Judge Buchwald said Monsanto had not sued or even started the process of suing anyone of the plaintiffs or anyone in "similar stead."

Who owns Monsanto? It could very well be you.
Its become clear and well covered over the years that Monsanto is attempting to own the food supply, utilizing various strategies such as plant patents, contractual arrangements with farmers, transportation and water infrastructure and has even moved to patent the pig (http://www.youtube.com/watch?v=4-ouf_gmA5o&feature=related). But who owns Monsanto? The answer appears to be we do, at least those of us who have pensions, insurance and/or saving accounts. Like an unruly mob, where the individual is swept up in the anonymity of the numbers, responsibility and conscience is muted when it comes to investments and pension funds. The system of shareholder capitalism, where massive powerful corporations have huge numbers of shareholders, including all kinds of mutual fund holders, capital managers, insurance companies, etc., makes it easy to be anonymous and check ones ethics at the door. Monsanto insiders own less than 10 % of the corporation, the remainder is controlled by money managers and mutual funds. With the dumbing down of our time, the bloody trail and fascist consequences of our money is concealed by the illusion that we have no power to effect change. Sad outcome but this statement is true. No one with standing to make the case.

Santa, your comments are interesting. In Australia people "bash" the banks. Then there are the others who say if it wasn't for the banks they would have a small or no pension. And others who are saying get on the band wagon of the stocks paying dividends because no one else is paying out. It's ok what these despicable companies do because they are my retirement income.

It's like people saying, "stuff the kids, I'm spending their inheritance". It's like a mantra.

I would imagine that the ruling then can go both ways. That organic farmers can sue Monsanto for pollution of their heirloom seeds. It is pretty obvious they are not heirloom seeds when they have been pollenized with Monsanto genes!

their value has been reduced because they can not be sold into the European market.

if i wanted to farm commercially and take on Monsanto, i would grow something for export to Euro-Land.

then i could make a reasonable argument that Monsanto GMO pollution has hurt me financially, when that Monsanto pollen gets to my crops.

of course i would need a good affordable attorney too.

Did any farmers in Europe actually burn down monsanto fields? I haven't heard of any.

If you burn someone's fields, a farmer will lose his paycheque. I'm sure farm insurance will cover something like that. Monsanto won't lose, a regular guy will.
