Parents Accuse Hospital of Killing Son to Harvest Organs

PITTSBURGH, PA, March 5, 2009 (LifeSiteNews.com) - An Ohio couple filed a lawsuit Wednesday accusing doctors of removing a breathing tube from their 18-year-old son, who had suffered a brain injury while skiing, in order to harvest his organs.

Michael and Teresa Jacobs of Bellevue, Ohio, parents of Gregory Jacobs, maintain that their son's death was caused, not by his injury, but by doctors removing his breathing tube and administering unspecified medication in preparation for organ removal.

The charges were filed against Pittsburgh's Hamot Medical Center doctors and a representative of the Center For Organ Recovery and Education (CORE).

The parents also say the CORE representative directed that Jacobs' organs be removed in the absence of a valid consent.

"But for the intentional trauma or asphyxiation of Gregory Jacobs, he would have lived, or, at the very least, his life would have been prolonged," says the lawsuit. "Gregory was alive before defendants started surgery and suffocated him in order to harvest his organs," which included his heart, liver and kidneys.

The suit maintains that Jacobs "experienced neither a cessation of cardiac activity nor a cessation of brain activities when surgeons began the procedures for removing his vital organs."

The parents filed the suit in the U. S. District Court in Pittsburgh seeking more than $5 million for their son's pain and suffering, medical bills, funeral expenses, and punitive damages.

The lawsuit comes only weeks after neurologist Dr. Cicero Coimbra told a Rome "brain death" conference that, "Diagnostic protocols for brain death actually induce death in patients who could recover to normal life by receiving timely and scientifically based therapies." Coimbra referred to the so-called "apnea test," whereby living patients who cannot breathe on their own have their ventilator removed, and are deemed "brain dead" if after ten minutes patients do not resume breathing. The problem with the test, said Coimbra, is that otherwise treatable patients sustain irreversible brain damage by oxygen deprivation during that ten minutes.

TT (may we call you Titty?:D): You recently fathered one, maybe 2 kids? Hospital births? Boys/girls? if boy, what was your experience in fighting off the foreskin snatchers? And whether boy or girl, how about the placenta/u-cord?

While I wouldn't circumcise (genitally mutilate) a boy for so many reasons (http://gold-silver.us/forum/showthread.php?59961-Clif-High-s-latest-wujo-grand-circumcision-conspiracy), if they're also profiting off the placenta/u-cord, while I'd consider selling these to them, I'd not voluntarily give them away for free.

Same as the larger "organ donor" question, as you said above. Their "giving the GIFT of life" emotion-tugger campaign is cute and all, but once THEY get their grubby hands on the live organ, THEY sure don't give it away as a GIFT, nor do they pay the DONOR's family.

And as the guests in the OP explain, the organ in question is only LIVE when the patient is alive- IE respiration, circulation, an (3rd one I forgot now?!)- and when they grab that beating heart or whatever- that marks the end of the donor's life.

I cringe to think about what goes on in those rolling donor-mobiles in China, where they take live & presumably healthy "condemned prisoners", murder them in route whilst snatching their organs. Anesthetic? or just some paralysis-inducing treatment, where they still feel pain?

Smokers' lungs better than no transplant: study
Patients who need new lungs are better off getting donated organs from smokers than none at all, even though they probably won't live as long as those who get a lung transplant from a non-smoker, a new study has found.
Researchers say patients will survive longer if they are willing to accept lungs from anyone, including smokers.

In Britain, that's a key issue because about 40 per cent of donated lungs come from people who have smoked.
Yet in recent years, several cases of British patients dying after getting lungs from smokers have sparked calls for the policy to be overhauled.
Doctors behind the new study said changing the UK transplant system would be wrong and lead to a spike in the number of people dying while waiting for donated lungs.
"That could deny patients the opportunity to get help," said Dr James Neuberger, associate medical director of the Queen Elizabeth Hospital in Birmingham and one of the study's authors.
Dr Neuberger and colleagues analysed information from the UK Transplant Registry and the Office of National Statistics on the survival rates of 2181 adult British patients waiting for lung transplants between 1999 and 2010. About two in five of those transplants came from smokers.
They found that patients who got lungs from smokers were about 46 per cent more likely to die within three years after getting the replacement lungs compared to patients who got the organs from non-smokers. But they had a 21 per cent lower chance of dying versus people who were still on the waiting list. The research was published today in the journal Lancet.

Evidence collected by a worldwide network of doctors shows that traffickers are defying laws intended to curtail their activities and are cashing in on rising international demand for replacement kidneys driven by the increase in diabetes and other diseases.
Patients, many of whom will go to China (http://www.guardian.co.uk/world/china), India (http://www.guardian.co.uk/world/india) or Pakistan (http://www.guardian.co.uk/world/pakistan) for surgery, can pay up to $200,000 (nearly £128,000) for a kidney to gangs who harvest organs from vulnerable, desperate people, sometimes for as little as $5,000.
The vast sums to be made by both traffickers and surgeons have been underlined by the arrest by Israeli police last week of 10 people, including a doctor, suspected of belonging to an international organ trafficking ring and of committing extortion, tax fraud and grievous bodily harm. Other illicit organ trafficking rings have been uncovered in India and Pakistan.
The Guardian contacted an organ broker in China who advertised his services under the slogan, "Donate a kidney, buy the new iPad!" He offered £2,500 for a kidney and said the operation could be performed within 10 days.
The resurgence of trafficking has prompted the WHO to suggest that humanity itself is being undermined by the vast profits involved and the division between poor people who undergo "amputation" for cash and the wealthy sick who sustain the body parts trade.
"The illegal trade worldwide was falling back in about 2006-07 – there was a decrease in 'transplant tourism'," said Luc Noel, a doctor and WHO official who runs a unit monitoring trends in legitimate and underground donations and transplants of human organs. But he added: "The trade may well be increasing again. There have been recent signs that that may well be the case. There is a growing need for transplants and big profits to be made. It's ever growing, it's a constant struggle. The stakes are so big, the profit that can be made so huge, that the temptation is out there."
Lack of law enforcement in some countries, and lack of laws in others, mean that those offering financial incentives to poor people to part with a kidney have it too easy, Noel said.
Kidneys make up 75% of the global illicit trade in organs, Noel estimates. Rising rates of diabetes, high blood pressure and heart problems are causing demand for kidneys to far outstrip supply.
Data from the WHO shows that of the 106,879 solid organs known to have been transplanted in 95 member states in 2010 (legally and illegally), about 73,179 (68.5%) were kidneys. But those 106,879 operations satisfied just 10% of the global need, the WHO said.
The organisation does not know how many cases involved the organ being obtained legitimately from a deceased donor or living donor such as a friend or relative of the recipient.
But Noel believes that one in 10 of those 106,879 organs was probably procured by black marketeers. If so, that would mean that organ gangs profited almost 11,000 times in 2010.
Proof of illegal trafficking is being collected by networks of doctors in various countries known as "custodian groups". The groups work to support the Declaration of Istanbul, the 2008 statement against global organ exploitation that was agreed by almost 100 nations.
Made up of hospital specialists who treat patients with end-stage kidney failure who survive on dialysis, and surgeons who operate on those lucky enough to get a new kidney, the groups monitor reports of black market activity in their own country or involving compatriots abroad.
A medical source with knowledge of the situation said: "While commercial transplantation is now forbidden by law in China, that's difficult to enforce; there's been a resurgence there in the last two or three years.
"Foreigners from the Middle East, Asia and sometimes Europe come and are paying $100,000 to $200,000 for a transplant. Often they are Chinese expats or patients of Chinese descent."
Some of China's army hospitals were believed to be carrying out the transplants, the source added.
The persistence of the trade is embarrassing for China. The health ministry in Beijing has outlawed it and has also promised to stop harvesting organs from executed prisoners by 2017, a practice that has brought international condemnation.
Jim Feehally, a professor of renal medicine at University Hospitals of Leicester NHS trust, said: "Since the Declaration of Istanbul the law on trafficking has been changed in the Philippines – which was one of the centres of transplant tourism – and the Chinese government realises that things have to change." Feehally is also president of the International Society of Nephrology, which represents 10,000 specialist kidney doctors worldwide. "Trafficking is still continuing – it's likely that it is increasing," he said. "We know of countries in Asia, and also in eastern Europe, which provide a market so that people who need a kidney can go there and buy one."
The key issue, Feehally said, was exploitation. "You are exploiting a donor if they are very poor and you are giving them a very small amount of money and no doctor is caring for them afterwards, which is what happens.
"The people who gain are the rich transplant patients who can afford to buy a kidney, the doctors and hospital administrators, and the middlemen, the traffickers. It's absolutely wrong, morally wrong."
Noel wants countries to defeat the traffickers by maximising the supply of organs from deceased and living donors, and encouraging healthy lifestyles to stop people getting conditions such as diabetes in the first place.

I never thought of the angle that donors in poor countries have a major organ cut out of them and there is probably no after care at all. The shock of being one kidney down would be massive. Then trying to heal without any help and keeping infection at bay. I wonder how many people have perished this way?

Of course they are trying to develop techniques to grow new organs. While it sounds like frankenscience, when contrasted with the points in that story, you get a whole new perspective of it. They have skin. I don't know what else. Do they grow corneas or is that a transplant. Bits of bone? Even the faces have been transplants.

Surgeon: Remove Kidneys for Transplant Before Donor's Death
The severe shortage of viable organs for transplantation in the U.S. has led a transplant surgeon to propose harvesting kidneys from people who are not dead yet.

Dr. Paul Morrissey, an associate professor of surgery at Brown University's Alpert Medical School, wrote in The American Journal of Bioethics that the protocol known as donation after cardiac death -- meaning death as a result of irreversible damage to the cardiovascular system -- has increased the number of organs available for transplant, but has a number of limitations, including the need to wait until the heart stops.

Because of the waiting time, Morrissey said that about one-third of potential donors end up not being able to donate, and many organs turn out to not be viable as a result.

Instead, he argues in favor of procuring kidneys from patients with severe irreversible brain injury whose families consent to kidney removal before their cardiac and respiratory systems stop functioning.

"These individuals, maintained on mechanical ventilation, do not meet the criteria for brain death," he wrote. In these cases, the patient would be removed from life support and kidneys would be harvested while ensuring that the patient receives anesthesia and pain relief during the operation. After that, the patients would be kept comfortable until they have not had a pulse for five minutes, a threshold at which they are declared dead.

"Under this protocol, the donor is alive at the time of kidney recovery, but a determination has been made and confirmed by medical experts that death is imminent," he wrote.

Kidney removal, he stressed, would not cause the death of the donor, which is "instead caused foremost by the original catastrophic injury and secondarily by terminating mechanical ventilation."

In addition to providing more organs usable for transplant, Morrissey said this revised protocol would allow families to grieve in peace, since surgeons wouldn't need to rush the body into the operating room to remove organs. He said they could also take comfort in the knowledge that their loved one's death saved other lives.

A number of experts responded to Morrissey's proposal in commentaries published in the same journal. Some supported his arguments, while others expressed concern that it wouldn't be in the donor's best interests and could potentially violate medical ethics and the law.

Donald Marquis, a professor at the University of Kansas, wrote that Morrissey's argument has some validity.

Removing both kidneys, he said, "will not make the donor worse off than the donor would have been in the absence of the nephrectomy."

"Though not dead yet, they are 'as good as dead' from an ethical perspective," wrote Franklin Miller, a bioethicist at the National Institutes of Health, along with Dr. Robert Truog, a professor of medical ethics, anesthesiology and pediatrics at Harvard Medical School. "No harm or wrong is committed by procuring vital organs prior to stopping life support, provided that valid consent is obtained for donation."

But removing both kidneys from a living donor would not always be in a patient's best interests.

"There is no reason to believe that registering as an organ donor involves the willingness to undergo premortem double nephrectomy," argued bioethicists Maxwell Smith of the University of Toronto, David Rodriguez-Arias of the Spanish National Research Council and Ivan Ortega of Alcala de Henares University.

And Norman Cantor, a distinguished professor of law at Rutgers School of Law, wrote that removing both kidneys before death could be legally risky.

"An organ retrieval intervention poses some hazard of accelerating death, as by hemorrhage or cardiac arrest," he said. "Any medical action potentially accelerating death, even by a few minutes and even for a gravely debilitated patient, demands a legally recognized justification."

Removing one kidney, he said, could be legally defensible, but removing both "would almost certainly be deemed unlawful under the current legal framework."

I almost started a new thread on this one, but I'll just piggyback it here. I did listen to it, and the guest does 95% of the talking, telling the tale of his interfamily conspiracy, mainly by an especially greedy scumbag sister, to commandeer their elderly parents assets for themselves, burning the other sibling(s). Through his story we learn about how perilous this guardianship biz can be, the role of the courts etc, when dealing with unscrupulous actors.

After 34 Years together, Jim and Lon were separated due to the greed and deceit of Jim's adoptive sister.


The past 6 years Jim has suffered from Alzheimer’s Disease. He was hospitalized last year. His estranged sister filed for guardianship.


Jim and Lon had constructed legal instruments, including giving each other power of attorney, (POA) which was never revealed in court. The court was never informed that Lon even existed, that he and Jim had made formal arrangements with each other and Lon was never mentioned nor considered nor notified of the court hearings which gave the sister guardianship and total control over Jim's life and assets.


The result? Carolyn Heath Franks moved quickly and had her brother isolated and held in a nursing home. Visitors, including Lon, are threatened with criminal trespass charges if they attempt to see him. Lon has been physically dragged away from Jim and tossed into the street, and threatened.


All of this done to take the house, take the estate and to profit from the life's work of Jim. And all of this done by a sister who plays the organ at church and paints herself as a pillar of the community.

One thing that put it in my face was, when I was renewing my DL or slave card or w/e they had "facts" about the DMV posted on the backs of the chairs. The one right in front of me stated "FALSE, if I am an organ donor doctors will let me die for my organs".... sure.... the are probably on commission.

I didn't listen to those 2 lastest shows with guest Dr. Byrne which I posted above, coz I'd heard him in the past and "got the idea". but IIRC, you're in the highest danger of hospital murder for organ theft, when you/your organs are younger/healthy... IE you've just had an accident or something. Cheney/Rockefeller/Co aren't walking around with the beating hearts of their elderly peers!
