His camera was an accessory to the crime I guess is the cops reasoning. So the cop was wrong so what? Can the biker sue him for it? I doubt it but that would be justice.

Accessory to what crime? The cops never did identify any crime. Oh yeah - obscured license plate and mouthing off to the cop. Any smart and hungry lawyer will find plenty to sue the cop and his department for.
