Germany has agreed to provide restitution payments to an additional 80,000 Jews in what Claims Conference officials are describing as a historic breakthrough.

The agreement, which was reached Monday in negotiations between German officials and Claims Conference representatives, is likely to result in additional payments of approximately $300 million. Most of the money will go to Nazi victims in the former Soviet Union who have never before qualified for pensions or payments from German restitution money.

“This is the last group of people who have never received any compensation,” Greg Schneider, the executive vice president of the Claims Conference, told JTA in a telephone interview from Washington, where the negotiations took place.

“For people who suffered during the time of the Shoah, recognition from Germany is vital. To be able to do that at this stage, 60 years after the first restitution agreement, for 80,000 people, is tremendous,” he said. “For a survivor now in their old age to finally get acknowledgment from Germany is critically important.”

Most of the money will come from the Hardship Fund, which grants one-time payouts of 2,556 euro – approximately $3,150 – to Jews who fled the Nazis as they swept eastward through Europe. Until now, those payments were not available to Jews in Ukraine, Russia and other non-European Union countries in Eastern Europe. Applications for the fund will be available starting Nov. 1.

In many of those countries, the lump sum could amount to four years of regular pension payments, according to Schneider.

In Monday’s negotiations, Germany also agreed to equalize the monthly pensions it sends to survivors around the world, correcting what until now had been a disparity that saw survivors living in western countries receiving more than those in eastern countries. All survivors will now receive the equivalent of approximately $370 per month.

Germany also agreed to relax the eligibility rules for those who receive restitution payments for being forced into hiding during the Nazi era. Until now, only those who went into hiding for at least 12 months were eligible; now the eligibility threshold will be six months.

John Friend is a horrible heartless antisemite. My 80 year old neighbor Shlomo survived the Nazi death camps. He was at Auschwitz, Trebinka, Sobibor and others and he saw the Nazis killing Jews. He was moved from camp to camp because he was an expert in untangling bodies after gassing with Zyclon-B and was mysteriously immune to the effects of hydrogen cyanide gas. He thinks that this because he ate blintzes and chopped liver as a child. He saw the Nazis pile dead adult male Jew bodies for burning. He said they used the bodies of women and children as kindling as the men's bodies were hard to burn. All the lampshades at the camp were made from Jewish skin because Jewish skin has a natural glow and because of the rationing of cotton and hemp. He was able to survive when others starved by eating a single loaf of bread for an entire year by slicing it extremely thin with a razor blade. He showed me the gold watch which he hid from the Nazis by swallowing it, defecating it and reswallowing it over a 3 year period. If the holocaust never happened, like the mean heartless deniers claim, then how do you explain the existence of this gold watch, which I saw with my own two eyes?

The genocide of hundreds of indigenous societies, the murder and enslavement of vast #'s of blacks and colonial crimes too numerous for any but the devil to remember, are just dry history. The Shoah was to be our bedtime story, given to us in the gravest tones by a group who's stock in trade is the false narrative. This accomplishment, great as it was, pales when compared to the great coming out of the Jew who now demands to direct non-jews as a human resource in their husbandry of planet Earth. My comment boils down to, if the Jews be faultless as judged by natural justice they go up and on, however if unjust, the hell to pay will make previous bedtime stories one dimensional. The German government agreed to significantly expand its funding of home care for infirm Holocaust survivors and relax eligibility criteria for restitution programs to include Jews who spent time in so-called open ghettos.


The agreement, reached after negotiations in Israel with the Claims Conference, will result in approximately $800 million in new funding for home care for Holocaust survivors from 2014 to 2017. This is in addition to $182 million for 2014 that already has been committed.


In 2015, the amount will rise by 45 percent, to approximately $266 million, and then to $273 million in 2016 and $280 million in 2017. Because the sums are set in euro, the actual amounts may change depending on currency fluctuations.


The $84 million increase in funding between 2014 and 2015 will represent the largest year-over-year increase since the program began with 30 million euro (approximately $36.6 million) in 2004, though a bigger percentage increase took place in 2010, when funding doubled from 55 million euro ($68 million) to 110 million euro ($136 million).


“With this new agreement, the Claims Conference will be able to both increase the number of beneficiaries, thus eliminating waiting lists of survivors for home care, as well as increase the number of hours per person to a minimum level of dignity,” Claims Conference board chairman Julius Berman wrote in a letter to the board.


Some 56,000 survivors are now receiving home care through the Claims Conference.


The announcement of new funding comes amid controversy for the Claims Conference (http://www.jta.org/2013/05/23/news-opinion/world/after-botched-probe-claims-conference-chairman-julius-berman-addresses-accountability) over revelations related to bungled investigations in 2001 that failed to detect a broad fraud at the Holocaust restitution organization. A document obtained last week by JTA showed that top Claims Conference officials were involved in the botched probes (http://www.jta.org/2013/05/21/news-opinion/world/top-claims-conference-officials-carried-out-own-botched-probe-of-2001-fraud), including then-executive vice president Gideon Taylor and Berman, who in 2001 served as outside counsel to the Claims Conference.


Claims Conference employee Semen Domnitser, a director of two restitution funds who was at the center of the 2001 inquiries, was found guilty earlier this month in federal court of masterminding the scheme, which ran up more than $57 million in fraudulent claims from 1993 until 2009. The cost of the fraud was borne entirely by Germany.


In his letter to the Claims Conference’s board announcing the result of the latest negotiations, former U.S. ambassador Stuart Eizenstat, who leads negotiations with Germany for the Claims Conference, hailed the work of executive vice president Greg Schneider, who along with a senior Claims Conference staffer discovered and stopped the fraud scheme in 2009.


“The lives of tens of thousands of Holocaust victims will be made easier in their old age due to Greg’s skill and vision,” Eizenstat wrote in his message to the board.


“This unprecedented amount of funding means that we can give Nazi victims around the world the aid that they desperately need as they grow more frail,” he said. “That the agreement encompasses funding through 2017 underscores the German government’s ongoing commitment to Holocaust survivors. It is all the more impressive because it comes at a time of budget austerity in Germany.”


In last week’s negotiations, which took place in Israel, Germany also agreed to relax eligibility criteria for the Central and Eastern European Fund and Article 2 Fund, through which the German government gives pension payments of approximately $411 per month to needy Nazi victims who spent significant time in a concentration camp, in a Jewish ghetto in hiding or living under a false identity to avoid the Nazis.


Until now, only those who were interned in closed-off ghettos were eligible for pensions. As of Jan. 1, 2014, pensions will be available also to those forced to live in any of 300 specific open ghettos, such as those in Czernowitz, Romania, where Jews lived under curfew, lost their jobs and were subject to persecution.


Germany in negotiations to take place this fall also agreed to discuss possible special aid for child survivors.


The session that just concluded was the first time since restitution negotiations with Germany began in Luxembourg in 1951 that talks were held in Israel. For decades, the negotiations were held only in the German capital. In recent years, sessions also were held in New York and Washington.


Before they began negotiating last week, German representatives met with survivors in Tel Aviv, Bnei Brak and Jerusalem, visiting private homes where survivors are receiving home care, a senior day center and a soup kitchen. They also took a guided tour of the Yad Vashem Holocaust memorial and museum in Jerusalem. The negotiations were held in a classroom at Yad Vashem.

KOBLENZ, Germany —Sixty-eight years after the end of the Holocaust, Germany is asking itself what it still owes its Jews.


The answer, as measured by a vote in this small southwestern city, is very little.

In a decision that leaders said was about their future not the past, the cash-strapped city government opted to sell the site of an old synagogue to an investor, disregarding the desires of the Jewish community to buy back its pre-Holocaust home. The property in the city’s center will be turned into a restaurant and apartments.

But Jewish leaders say that they are part of the future, too. Reduced to a handful after the Holocaust, Jews in Koblenz now number 977 — more than before Hitler came to power in 1933. They have outgrown their modest postwar synagogue on the outskirts of town. The city’s decision to sell their old home to someone else has infuriated some in the community.

China and South Korea are very angry with Japanese Prime Minister Shinzo Abe because he visited the Yosukuni Shrine in Tokyo honoring some 2.5 million Japanese – both military and civilian – who died in war.


Many are irate with Mr Abe because, amongst those honored in the 19th Century Yosukuni Shrine, are Japanese World War II heroes, branded as “war criminals” by US occupation forces. The list numbers fourteen “Class-A criminals” involved in “planning the war”, including war-time leader General Hideki Tojo executed by the US in 1948.


Official history


Sad but true: when a country wins a war, not only does it automatically acquire full territorial rights over the vanquished nation, but also full and arbitrary control over cities, land, population, resources, plants, patents, military gear, international rights, etc.


It also acquires the “right” to (re)write the history of the conflict that led them to war in the first place. It acquires the right to impose its own views and reasons as “the truth”, accusing the vanquished country of being “false, evil, wrong, criminal, ambitious,” etc.


It’s as old as mankind: “we’re the good guys; the others are the bad guys.” “Our boys are heroes; the others are devils that deserve to be killed, right down to the last 2-year old toddler.” As 70 years of post-World War Two propaganda has clearly shown, the 20th and 21st centuries are no different.


Japan sticks to its guns

Yes, and they should be admired for that. Compare this to ever self-effacing Germany asking for the world’s forgiveness again and again and again, even though she knows quite well that no matter how many apologies are made, those who run today’s world call the shots in the media, publishing houses and education, will never ever forgive Germany.


Rather than commit historical hara-kiri as the Germans do, Japan prefers to keep a stiff upper lip, stand tall and continue to bear the consequences of military defeat, without descending into moral defeat.


Sure, the Allied Victor’s International Military Tribunal for the East – a Nuremberg-like court aka the “Tokyo Trials” – branded many of Japan’s top military and political leaders “Class A” criminals. However, as far back as in October 2006, Mr Abe’s ideas were voiced in The Japan Times: “[The] 14 Class-A war criminals honored at Yasukuni Shrine are not war criminals under Japanese law, but the country had to accept the outcome of the Tokyo Tribunal to become an independent nation. Abe told the Lower House that because the relatives of the convicted men receive war pensions and one of them - wartime Foreign Minister Mamoru Shigemitsu - received a first class award from the post-war government, "they are not war criminals under domestic laws." The International Military Tribunal, which the Allies conducted between May 1946 and November 1948, put 28 political and military leaders on trial as Class-A war criminals, 14 of whom are now enshrined in Tokyo's Yasukuni Shrine. Abe said they stood trial for crimes against peace and humanity, which were concepts, created by the allies after the war and not enshrined in law.”


Bravo, Japan! If we sincerely wish to punish the war crimes committed by all countries – winners and losers - then we would need a heck of a large International Military and Political Tribunal, free of double-standards and censorship.


Double standards (again!)

Talk about “war crimes” what are we to make, for example, of Britain’s World War II Royal Air Force Commander Arthur Harris (aka, “Bomber Harris” and “Butcher Harris”) who invented and imposed “area bombing” over precision bombing, euphemistically calling it “strategic bombing”; which was just another way of saying, if “it moves on enemy territory just bomb it out of existence!”


Bomber Harris was very successful in unleashing fire storms over Hamburg, Germany in July 1943 (“Operation Gomorrah”) that were later repeated over all major German cites. In Harris’s own words, “the aim of the Combined Bomber Offensive...should be unambiguously stated [as] the destruction of German cities, the killing of German workers, and the disruption of civilized life throughout Germany. ... the destruction of houses, public utilities, transport and lives, the creation of a refugee problem on an unprecedented scale, and the breakdown of morale both at home and at the battle fronts by fear of extended and intensified bombing, are accepted and intended aims of our bombing policy. They are not by-products of attempts to hit factories.”


Wow! Was Bomber Harris ever tried and executed for his crimes?


Not quite. Instead, in 1992 Britain’s Queen Mother personally unveiled a statue honoring him outside St. Clement Danes’ Church in London, whilst many protesters jeered shouting: "Harris was a war criminal!”

The historical truth is that hundreds of thousands of German men, women and children – civilian and military – died or were maimed for life thanks to Bomber Harris’s creative thinking.


And what about “democratic” politicians like US Franklin Roosevelt, Britain’s Winston Churchill and their military leaders who joined forces to destroy the German open city of Dresden in February 1945, when Germany’s defeat was only weeks away and that city had become a meeting point for hundreds of thousands of civilian refugees fleeing the fast-advancing Red Army?


On 13th February 1945, the UK sent a first wave of 244 RAF four-engine Lancaster heavy bombers, followed by a second wave of 529 bombers. The next day, the US dispatched over 300 B17 bombers over Dresden. An estimated 300,000 people – mostly civilians including tens of thousands of children – burned to death.


I know, I know… The US and UK had no choice but to murder millions in Hamburg, Dresden, Berlin, Munich, Hannover, Frankfurt, Cologne, Ulm, Tokyo, Kyoto, Osaka Hiroshima and Nagasaki. It was the only way to end that ghastly war. They did it all in the name of “peace”, right? So, Germans and Japanese: don’t complain and say “Thank you” to the allies.


Interestingly, the destruction of Dresden began 24 hours after Roosevelt and Churchill ended their meeting with Soviet leader, Joseph Stalin, in Yalta, where the coming post-war New World Order was beginning to be mapped out. Might the destruction of Dresden have been on the agenda?


OK. But that was back during World War Two.

Then what about the 1.5 million dead in Iraq since March 2003, after that martyred country was invaded, raped and destroyed by modern history’s worst liars: Baby Bush, Dick Cheney, Donald Rumsfeld, Paul Wolfowitz, Richard Perle, Douglas Feith, Condoleeza Rice and their nice friends at the Project for a New American Century think-tank and AIPAC lobby, all based on the most blatant and obscene political lie ever told: “weapons of mass destruction” that were never there.


And what about, the complacent blood-thirsty “NATO Allies” with the UK’s poodle prime minister – “Tony BLIAR” as many call him in his own country – tagging along?


And what about the daily murder, humiliation, maiming and house demolitions by the “good” Israelis against the “bad” Palestinians? What, no “International Tribunals”?


The West’s logic is really very simple. So simple, that even George W. Bush and Barack Obama can act out their roles as required by the global power masters.


A guide to war for the modern political Tarzan

For the benefit of millions of Western readers, I’d like to briefly flesh out in “basic Tarzan” how this “logic” works in practice; just to make sure they don’t miss the point: when it comes to “good guys” and “bad guys”, it’s all in the eye of the beholder.

This does not mean that Japan should not be more political and understand the bigger picture of its own interest in closing ranks with China and the region as was mentioned in a recent RT article (http://rt.com/op-edge/globalization-us-china-rivalry-478/).


Let’s face it, this is a sensitive issue. The Koreans said PM Abe’s visit to the shrine was a "deplorable" act; Beijing labeled the visit "absolutely unacceptable" and summoned Japan's ambassador. These two countries see the Yasukuni Shrine as a symbol of Japanese militarism during and before World War Two, and it was they who suffered the full impact of the Japanese onslaught.


Shinzo Abe said, "It is not my intention at all to hurt the feelings of the Chinese and Korean people," claiming his visit was an anti-war gesture. He convinced nobody.


He did, however, make it clear that his visit was in a private capacity, not representing the government. He believes the trials that convicted Japan's wartime leaders were "victors' justice". His own grandfather, Nobusuke Kishi, served in the war cabinet and was arrested by the Americans on suspicion of being a Class-A war criminal, although he was later released without charge. Mr Abe is known to be a nationalist and a historical revisionist.


Which ‘history’: Yours or mine?

Revisionism: perhaps here lies the key to a better understanding amongst nations, if we can begin doing away with victors’ “official history” that hides, waters-down, justifies, explains and forgives its own horrendous crimes, whilst at the same time it underlines, over-emphasizes and demonizes the actions of its vanquished enemies. And it often adds two, or maybe even three zeroes here and there as part of its historical genocide cosmetic kit.


There’s certainly irrationality to it all when you consider that this state of affairs assumes as given, that every time there’s war, the good guys (us) always win, whilst the bad guys (them) always lose (otherwise “they” would be in charge, right?): whether it’s World War I, World War 2, Vietnam, Korea, the Middle East, Africa, Central Europe, Latin America…

A concept almost impossible to sustain and swallow, especially since it’s obvious that all wars are won by the more powerful party in the conflict, which are those nations having the greatest fire-power to kill, maim, destroy, blow-up, murder, terrorize, bomb, shoot, torture, and have the will to do it without wavering.


If wars are won by the stronger, more violent side, where does that leave the victors morally? Do they win every war because they “love peace”? I don’t think so.


In addition, demonizing the enemy also serves to sooth one’s own conscious, dark fears and guilt. In order for the citizens of the US, UK or France to sleep tight at night, better for them not to grasp the horror their governments and military have unleashed upon millions of Iraqis, Libyans, Syrians, Palestinians, Koreans, Vietnamese, Latin Americans, Africans, Afghanis, Serbians, Pakistanis over the decades.


It’s so much easier to just say, “Oh, they’re all a bunch of Hitlers. The whole defeated lot got what they deserved: Saddam, Gadhafi, the Taliban, Chavez, Milosevic, Ho Chi Minh, Nasser, Peron etc…”


Now do you see why in some countries – Belgium, France, Austria, Germany, Canada – it’s even illegal to dare to utter revisionist views of certain historical events? They call such revisionism “hate literature”.


In my own native land of Argentina, back in 1982 a very good documentary was produced on the life and times of Evita Perón and her violently-ousted husband, President Juan Domingo Perón. He was the only true statesman that ever came to power in modern Argentina.


The lyrics of that film’s theme song repeated the following phrase (sorry, it rhymes in Spanish though not in English): “If history is written by those who win wars, that means that there’s another history – TRUE HISTORY – Let those who wish to hear, listen-up…”

After $57 million fraud, former board member lends voice to lawsuit blocking settlement distributions from organization.

A former board member of the Conference on Jewish Material Claims Against Germany wrote to a US judge that the organization was ill equipped to prevent fraud, joining a group of American Holocaust survivors aiming to block it from distributing settlement funds.

The declaration, filed in late December as part of a case involving Swiss banks, comes six months after the Claims Conference faced stinging criticism for its inability to identify or stop a fraud scheme in which $57 million was stolen from the organization.

The petition by the board member, Haim Roet, does not introduce new evidence of wrongdoing; however, the case is distinctive because it represents one of the first times the fraud incident has been used against the Claims Conference in separate legal proceedings.

Holocaust Survivors Foundation- USA is challenging the distribution of $1.25 billion from a 1998 settlement with Swiss banks, which had been used by the Nazis. The judge, Edward Korman, allocated a portion of the settlement money to the Claims Conference and the Jewish Joint Distribution Committee to provide services to Holocaust survivors.

The survivors foundation has argued for more than a decade that the formula used to distribute the funds is unfair to American survivors.

It has also asked Korman to prevent both the Claims Conference and the JDC from distributing those funds because of alleged accounting and management problems.

Korman did not respond to a request for comment about a timeline for his ruling.

Roet, a Claims Conference board member between 2009 and 2010, provided more than 60 pages of documents detailing his complaints about the lack of resources devoted to internal audits during his yearlong tenure.

In an interview on Monday, Roet acknowledged that he hasn’t followed any subsequent Claims Conference reform closely. But he said he does not believe that basic management issues have been resolved.

“It’s unbelievable. I saw it immediately when I was there,” he said, adding that he expressed his “opinion about the need for better internal control, but they didn’t listen.”

The Claims Conference did not publicly respond to the recent filing.

However, Greg Schneider, the Claims Conference executive vice president, wrote in a November filing that “there has never been any independent fraud related to the allocations and distribution of the Looted Assets Class funds that the Claims Conference has received.”

He added that “a record exists for every dollar transferred by the court” to the Claims Conference.

As of July, the Claims Conference distributed $46.5m. to 80 social welfare agencies.

Separately, the conference has distributed more than $262 million from the settlement to Jewish Nazi victims.

With Roet’s filing, the survivors foundation aimed to show that the previous fraud case tainted the reputation of the Claims Conference and should call into question its present role.

“Given the management and accounting catastrophes that have occurred under the Claims Conference regime during the time period for which the US survivors seek an independent investigation, why should any of the reports, audits or invoices that the organization [submitted] during the 1994-2009 period be taken at face value?” Samuel Dubbin, the attorney representing the foundation, wrote to the court.

Menachem Rosensaft, general counsel for the World Jewish Congress and a law professor, said on Monday that the previous fraud case is “utterly, totally and completely irrelevant to whether or not the distribution of [the Swiss bank] funds is being handled appropriately.”

“Over the years, the Claims Conference and the [JDC] have helped and are helping tens of thousands [of] survivors around the world. And that simple fact needs to be taken into any consideration when looking at the organization,” he said.

“To take the criticisms in a vacuum and to focus only on them and to ignore all of the humanitarian work that has been done, and is being done, by these two organizations is disingenuous at best and outrageous at worst,” he added.

The current debate centers around relatively small amounts of money that the court did not anticipate having to dole out. The US Congress’s decision not to subject the fund to income tax and accumulated interest caused the fund to be larger than originally anticipated.

In recent months, the court divided up $50m., with 75 percent of the money going to survivors in the former Soviet Union, and the rest going to other countries, the same formula previously used. About 4% would end up in the hands of US survivors.

Of the total, the Claims Conference was asked to distribute $12.5m.

The survivors foundation said the court’s determination is unfair to American survivors.

“Do you have any empathy at all for the Holocaust survivors in the class who live in the US and who have been suffering every day while millions of dollars recovered from their losses was available to be distributed for their assistance in this court, in the Claims Conference, in the hands of other institutions?” David Schaecter, the foundation’s president, wrote to the judge in May.

But Korman’s position has been consistent for more than a decade.

In 2004, he wrote a 32-page rebuttal to a survivors foundation’s proposal, reiterating that the survivors in the former Soviet Union represent the “neediest” people.

Korman wrote that the survivors foundation’s “proposed distribution scheme is wholly inconsistent with law, morality and most importantly, the settlement of this lawsuit. In sum, these objections are frivolous.”

Dubbin unsuccessfully appealed Korman’s ruling to an appeals court and the US Supreme Court.

While the recent filing focused on the Claims Conference, the survivors foundation also alleged that the JDC provided false information in declarations to the court.

The foundation argued that the JDC was unable to quantify the survivors aided by the specific settlement funds.

In a response filed on January 2, JDC lawyers said “there is no truth to [the] HSF Survivors’ accusations.”

They said that since the settlement funds are included in a larger pool of money, which aids survivors, the specific role of the settlement funds cannot be separated.

The JDC has been transparent about this fact, it said.

Herbert Block, JDC assistant executive vice president, said on Tuesday that “nothing has stopped because of this litigation.”

“Our primary concern is for the needs and care of the elderly Jewish Nazi victims, the survivors in the former Soviet Union who are in great need of care,” he said.

“That has not ceased.”
