Yes, he's onto something, but the problem is that he's caught up in partisan politics thinking that Mittens isn't going to do the bidding of the same bunch who call the shots for Barry.

Notice he never says that if Obama does this, it would be COMPLETELY LAWFUL for citizens to resist with lethal force. He is only concerned with himslef and his officers, but he clearly is not concerned with the well being of the citizens and their Republic.

Kinda like jury nullification.

You may be thinking this is a 'regular' judge, he's actually the Judge on the County Commissioners' Court, more like county administrators (as opposed to a judge who works 'in chambers' or in a regular courtroom).
