Real estate developer Ori Feibush has tried for years to acquire the city-owned lot near where he planned to open a new business, he says. An eyesore filled with trash, weeds, broken glass and other dangerous substances, it was undeniably a deterrent to potential customers.

“Feibush…submitted seven written requests for either owning or leasing the parcel, has called the [redevelopment] authority 24 times and has visited its office four times,” according (http://articles.philly.com/2012-09-14/news/33845122_1_point-breeze-private-developer-property) to the Philadelphia Daily News.

Finally, fed up before the grand opening of his new coffee shop, Feibush decided to clean the lot himself.
Pouring $20,000 into the project, Feibush estimates that he removed 40 tons of debris from the lot. They poured a new sidewalk, and placed a bench and picnic table in the newly-attractive area, ABC reports (http://abcnews.go.com/Business/philadelphia-officials-disapprove-man-paid-20000-clean-vacant/story?id=17254329#.UFnmnESpZhA).
Feibush said parents, children, and dog-walkers are now visiting the property, when before the homeless would sleep behind the nine-foot weeds, ABC relates.
“This was a lot of garbage,” Elaine McGrath said, observing (http://articles.philly.com/2012-09-14/news/33845122_1_point-breeze-private-developer-property) the new plants and benches. “Now it’s gorgeous. I’m excited.”
Feibush said simply: “They promised they would get around to [cleaning it]… I did not believe I could open up a coffee shop when people couldn’t traverse the sidewalk.”

But as soon as the area was once again habitable the city apparently stepped in to say, among other things, that the lot is now a safety hazard.
“You are requested to immediately stop all work and return the j-barriers to the original location,” Paul Chrystie, director of communications for Philadelphia’s Office of Housing and Community Development, allegedly wrote in an email. The barriers are supposedly for the safety of the public, and to prevent trash dumping.

Chrystie added (http://abcnews.go.com/Business/philadelphia-officials-disapprove-man-paid-20000-clean-vacant/story?id=17254329#.UFnXVESpZhA) in a statement: “Like any property owner, [the authority] does not permit unauthorized access to or alteration of its property. This is both on principle (no property owner knowingly allows trespassing) and to limit taxpayer liability.”

The city also claimed Feibush never sought permission to use the lot, saying his action was “not fair” to taxpayers or other potential buyers. In letters and emails, the city reportedly (http://articles.philly.com/2012-09-14/news/33845122_1_point-breeze-private-developer-property) threatened legal action, saying it was “actively reviewing” its options.
Feibush said he was both disappointed that his previous efforts to obtain the lot went unnoticed, and that he was surprised the city appeared to care so much after “ignoring” the lot for decades.

Hmm... One could sit there and sip coffee... But where could one find that? He took advantage of something that wasn't his, got slapped on his fingers, and now he is whining about it...

Dump the crap back and move on, not a friendly city and not one that has any sense, move his shop to somewhere with common sense. He apparently is operating in a no brains zone.

Almost reminds me of my situation a few years ago...

(Long story short) Our lakefront was in drought and the water level went down far enough for me to pick up a good ton of trash that the fishermen had recklessly discarded over the years. I worked so hard to clean it up and make it look nice. I get a "visit" from the state Dept. of Environmental Protection, and the little fema-nazi tells me "It's not fair that my lakefront property looks better than other peoples...".

They are simply the enemy of all they pretend to stand for.

All those letters he wrote ... worth nothing. As he cannot determine who the owner is upon investigation all he had to do was place a legal notice in the paper giving the owner 30 days to clean up the mess or he would do it himself and put a lien on the property.

If you notice that is what cities do all the time ... cause a notice to be published and it is up to the owner to fulfill the task.

In our area every year the county board of supervisors place a notice concerning the obligation of owners to kill noxious weeds. They also describe what is going to happen if these weeds are not taken care of.

What Ori Feibush did to the property is now considered an eyesore to city officials.

It serves as a constant reminder to this inept bunch of over-paid lackey's that collect large salaries/pay-off's while doing nothing for their city...unless you consider the funding these lazy fat bastards provide to the local strip clubs and prostitutes for services rendered.

City officials fear this heinous act by Ori Feibush may gain notoriety on local news stations, showing these deadbeat city officials for what they really are...a worthless drain on public funding.

What exactly are they going to do to him in retribution? Take the property away? He doesn't own it. Sue him for tresspass? What are the damages?

They're just control freaks who get ornery anytime someone else assumes power for themselves. Nobody would honestly request 80,000 pounds of garbage be trucked back in.

All they want is control. They don't give a shit about anything else.

But is it actually a legitimate notice? I mean, if you have a neighbor who has a trashy front yard, can you post a notice in the paper that unless he cleans up his yard in 30 days, you will do it and place a lien on his property so you now own it? Hmm, I'm just not sure that would work.

The man should have contacted city ordinances and reported the property for breaches of municipality regulations or something. Then he could wait the 20 years it would take for the municipality to prosecute the property owner.

Really. What did the guy think was going to happen? He was going to get the key to the muni? They did what they are supposed to do. It's BS for sure but thats how it is.

He should have contacted the property owner and offered to pay for a clean up and got an agreement. Property owners place gets a clean up. The value will go up on the land AND give further potential value opportunities for any future business that might plant itself there if the Other guy can build a thriving business there and draw people to that location regularly.

I'd be looking for a way to take away the muni's standing in the case. Not sure it's possible but it could be.
