View Full Version : Got a case management hearing today....

I have been batteling with my mortagage company on and off for 7 years, with more twist and turns then a contortionist

I have some extremeley damaging info but it is not yet compelete ...so i have to impelement a stratagey of circling the wagons.

I have the first of many hearings today and I will be going in Pro Se.

I expect a mixed bag in terms of the outcome because i filed alot of papers prematurely and I am still in the process of fixing it.

As I proceed through the case I will update this thread accordingly as it may be of benefit to others in a similar jam.


I have a nice body of work i am compling and will be able to relay back real time results to stratetgies attempted or implemented.

Awesome, definitely keep us posted. I no longer have a mortgage but info regarding how to fight them in their own turf is always nice to have.

The Biggest advantage of being Pro se?

Is that you are pro se.

Specifically i dont have to worry about "my" attorney speaking or hashing out a deal with council behind my back.

Anything that is offered or known has to be disclosed to me and I can adjust strategy accordingly. As I have several possible scenarios I can run

Like wise council for platifitt has no idea which way i am going to move until i open my mouth.

Now I better understand why courts push so vigorously for you to be represented

Because there are a myriad of strategies to make "your" attorney tip his hand.

I recently had one of those for my FC case, the Judge set timelines for discovery and set a date for pretrial conference, abd that was it, all of 5 minutes.
I am alo going pro se, a great resource is the forums at loansafe.org, look up a poster named acesfull, he seems to be the authority on NJ. I answered the complaint and my defense was that the plaintiff lacked standing, so hopefully the Judge will make them dig up the original note.

I had them on 16 counts of fraud, the judge made it impossible to fight.

All it was today was case managment ...

Which is a nice way of saying it was a formal meet and greet.

Judge explained the process cleary ( i was actually shocked that he took the time)

I basically have a roadmap with dates for completion leading up to trial.

Next time im due back is May 28th.

It definately was a victory because i learned alot and they are none the wiser to what im sitting on.

Well , well well...

Will wonders never cease.

I go to my mailbox and there is a letter from a law firm I know nothing about.

Apparently the plaintiff thought that it was necessary that an additional 2 lawyers are needed for the rest of these proceedings

What that tells me Is several things:











1) Any doubt about the legitimacy of my claims are laid to rest , the retaining of additional council is confirmation that something is grossly wrong I just have to be deligent and find it.

2) My presentation of interogatories and production was so powerful they felt the need to put in a request for additional help

3) now that Im facing not one but 3 lawyers I do beleive in the spirit of " fairness" I may be allowed a greater latitude in the presentation of my defense and attack, of course I have to be judicious about how i exploit that potential possibility.

4) The possibility for error or miscalculation has increased by a factor 10 because its very easy for each of them to assume the other completed a required task. That happens more times then one could imagine.

5) Ego is a fatal flaw and can possibly be turned to adavantage . Each of them will be eagerly persuing the title of being the one who took me down. Everybody wants to be the cheif and not enough Indians.

That is a very important point I want to make.

If you think you can fight alone and pull it off that is utter maddness.


You MUST build a team.

What does that start with?

get a para legal or legal law researcher.

They are worth their weight in Gold.

The abilty to have current case law and professional memoramda drafted in timely fashion is absolutely critical key in your ability effectively argue your case.
