Monique Hernandez was pulled over in February of 2012 by Beaumont police officer, Enoch Clark. When Clark attempted to subdue Hernandez, he said she ‘resisted.’
Although the dashcam footage tells a different tale, Clark said that in order to get her in handcuffs, he had to use his department-issued JPX gunpowder-propelled pepper spray weapon and fire it less than a foot away from her face.
The gunpowder powered JPX Pepper Gun (http://jpxpeppergun.net/) launches OC (pepper spray) at 405 mph.

The results from firing the gun at such a close proximity were catastrophic.
The blast of pepper gel sliced her right eye in half, fractured her right orbital bone and severed the optic nerve in her left eye.
Clark was indicted on four felony counts of assault by a police officer and causing great bodily injury.

The jury is expected to begin deliberations today over whether or not Clark used excessive force in Hernandez’s arrest.
According to the Press Enterprise,

Deputy District Attorney Michael Carney on Tuesday during closing arguments showed the jury a police dashcam video in which Hernandez was seen with her hands behind her back while Clark asked about her blood alcohol concentration. Clark told her to stop resisting or he would “JPX” her. Hernandez told Clark she wasn’t resisting.

As Clark attempted to handcuff Hernandez, the video shows Clark shining a laser toward her face and firing a double-barrel charge of pepper spray.

Hernandez’s family audibly gasped in the courtroom. Hernandez sat in the second row of the courtroom and had to be escorted in and out of court.

Clark no longer works for the city of Beaumont or the Police Department. Hernandez has filed a lawsuit for damages against Clark and the Police Department. That lawsuit, being heard in Los Angeles, is separate from the criminal trial.



“Every single day, she goes to bed at night, dreaming of a time when she used to be able to see,” Carney said. “When Monique Hernandez wakes up, the world is still dark because her sight was violently taken from here. Her eyeballs were literally blown into pieces, and the person who did this was a police officer.”

Enoch Clark, 38, could face more than 20 years in prison if convicted of the disabling assault.

The trial for Beaumont police officer accused of blinding a local woman with pepper spray was pushed to Sept. 5 on Tuesday.
Both Officer Enoch Clark and Monique Hernandez, the woman he’s accused of assaulting, appeared in the Riverside County Courthouse Thursday morning, said John Hall, spokesman for the Riverside County District Attorney's Office.

Milton Grimes, the family attorney for Hernandez that his client will be at every hearing Clark is at.

“Every time he comes to court, we will be here,” Grimes told Patch outside the courtroom on May 29. “Because we want to show that we’re concerned and want to see justice, and we don’t want anything happening and we not be here to witness it.”
Clark is free on $50,000 bail.

On April 26, Clark was arraigned on four counts: assault under the color or authority, assault with a less lethal weapon, use of force causing serious bodily injury, and assault with force likely to cause great bodily injury. There is also an enhancement that he personally inflicted great bodily injury.

The officer remains on administrative leave from the Beaumont Police Department.

On February 21, Clark conducted a traffic stop involving Hernandez, who was suspected of drunk driving. When Clark attempted to handcuff her, Hernandez resisted. The officer responded by using a JPX device – a weapon that uses a gunpowder charge to fire a stream of pepper spray at roughly 400 miles an hour.

The JPX weapon is designed for use at a distance of 6 to 15 feet, and training presentations depict it being used against aggressive, armed assailants. Promotional literature for the JPX weapon – which isn’t categorized as a firearm, because it doesn’t fire a projectile – boasts of “devastating stopping power.”

The payload of weaponized OC spray is propelled over the prescribed distance at less than three one-hundredths of a second, making it “too fast to avoid…. The effect is immediate; there is no chance to resist.”

Clark’s attorney insists that the officer’s attack was justified in order “to gain compliance and in defense of his person.” The JPX is not designed to induce “compliance,” but rather to incapacitate an aggressor at a distance. Clark – who was armed and wearing body armor — fired it into Hernandez’s temple from a distance of roughly ten inches, blowing apart her right eye and leaving the left with severe, irreparable damage.

Anyone who had undergone rudimentary training with the JPX would understand that the weapon should not be fired directly into the head or face of a non-violent suspect. Clark’s actions suggest that his intention was not to gain “compliance,” but rather to inflict summary street punishment for “contempt of cop.”

Hernandez was taken to the hospital and never charged. Interestingly, the law firm representing Clark in his criminal trial is involving in a union lawsuit against Beaumont Police Chief Frank Coe, claiming that the chief retaliated against critics on in the department by denying them promotions, thereby leaving several positions vacant.

Tragically, the blinding of Monique Hernandez arose out of a domestic disturbance that led to a 911 call. Two officers responded to the call, one of whom reportedly witnessed the assault while speaking with Hernandez’s family.

It should be remembered that any time someone calls for police “assistance,” he’s inviting the intervention of people who consider themselves licensed to inflict potentially lethal violence as punishment for non-compliance. It should be assumed that if the police get involved, somebody is going to injured or killed – generally without just cause.

The outcome speaks for itself. At best it is criminal negligence. Yet.... he is on ADMINISTRATIVE LEAVE. Should be held in jail. If they can keep delaying the trial, it might go away.

On the other hand, if that were my wife or sister or cousin, he would never make it to trial.

I have never even heard of this new weapon. I surely hope it's not used anymore. This trend of new crazy police defense weapons is really disturbing. The regular OC spray works too well, imo. I believe if a cop wants to carry a self defense weapon he must experience it on himself. I doubt this cop was shot in the face with his JPX weapon.

A week? That's much too short of a paid administrative vacation for a cop. Though, he didn't actually kill the woman. If he had killed her,
maybe he'd have received a good 6 months to enjoy at a beautiful tropical ocean front resort, fishing and frolicking in the waves. :)

Good Lord. Unfortunately, the American people love their police, they are heroes to them and can do no wrong, so I bet the guy gets off with a slap on the wrist. No way he's going to jail for this, after all he is a "hero".

I think he should do time but he won't get 10 years. My guess is he will get 3-5 years.

Theres always two sides to every story people....take in all the facts and keep your emotion separate from any truthful conclusion..
Usually the higher the crime rate the more police brutality.
I don't know....would you use more force to over take a tribe of poorly armed Africans that arent trained in modern warfare over say....a formidable force such as a bunch of marines?
Around here the west end of town is a rough part of town where the SAME police debt doesnt give much for leeway compared to the north and east parts of town.

This happened in California, not Texas. Beaumont is rural horse country with rolling grass hills and some golf courses with I10 passing through. Theres nothing really out there. You drive through in a minute or two.

The outrage expressed without doing homework on the story, is just totally normal here! Hell was looking for this story from the texas city, and zip!. But cali bingo!...

I wonder how many actually look to see if any story's posted here are real, just a simple web search with right wording. But hot button topics , everyone piles on without first checking if the story can hold water, in some ways that reminds me of a northern critter called a lemming, they follow what everyone else does and does not check facts.

I think he wanted to try his new toy, but did not know how it works, so to him it was simple pepper spray, so he puts it right up to her face and pulls the trigger and before he knows it, her eyeballs are torn to shreds.

Why do you need gunpowder propelled pepper spray anyway? To pepper spray someone from 50 feet away?
