Interesting. Operator of a counting room in Manchester executing his own court. Could be some matter of debt or account he is interested in settling and doesn't trust the local coroner or magistrate.

Is he usurping the power of the local judiciary?
Probate is something worth avoiding and especially not inflicting on your heirs.
In addition to a Last Will and Testament, I have a revocable trust that directly assigns everything of value in my estate to my heirs. They can sell it immediately, and get on with their lives and have good memories of me.
I regard the courts as the equivalent of a wood chipper--with you at the intake, and a bunch of lawyers and other hucksters on the output side. Why subject anyone, especially the people you love to that kind of an experience, if you can avoid it. I set up the revocable trust with Quicken Will Maker. Why should I pay a lawyer to do something I can do with some software and a little due diligence?

Nope. He is notifying the heirs or 'authorized representative' that there was a boat, cargo, crew and expenses to be paid. I suppose property becomes abandoned as easily by dying as any other manner of abandoning it. With the notice he can assume the role of the owner, pay bills and expect reimbursement. Abandoned property is subject to being seized where ever you find it but you have to be careful that theft doesn't become an issue.

Your will is what drags you into probate court. Read the first paragraph or two of the Northwest Ordinance. See if they say anything about probate or splitting the estate with any attorney. As with any court you (or your estate rather) gets volunteered into probate and it ends up paying for the service.
