In a chilling show of militaristic thuggery, police in Oregon arrested a man for attempting to video record them blasting their way into a neighbor’s home as they served a search warrant.

The Gresham Police Department, which serves a city of just over 100,000, rumbled down a residential street at 4 a.m. Tuesday with several armored vehicles, blasting flash grenades into a home, jolting the entire neighborhood awake.

One man, who goes by Skylow Production on Youtube, said he was sleeping in his girlfriend’s apartment when he was awaken by all the ruckus. He grabbed his iPad and ran outside, standing across the street as the cops surrounded the home dressed like soldiers, issuing orders through a megaphone.

When they spotted him, they accused him of “interfering” and ordered him back inside. When he asserted his right to be there, he was arrested.

He said he was jailed for interfering and resisting arrest, two bogus contempt-of-cop charges.

According to his Youtube description:

Gresham OR 9/2/14 4:00am I was laying in my apartment sleeping an I heard multiple bombs blasting and glass breaking and my entire apartment shook repeatedly. I grabbed my Ipad and ran outside as fast as I could to see what was going on There were 5 or more Tank/Military Trucks just cruising through my neighborhood. 503 Gresham/Portland Oregon right across the street from Mt.Hood Community College. I was assaulted multiple times and I feel like it was Gresham Police Abuse and my rights were violated. I now owe $5000 and i am charged with 2 crimes. 2 CRIMES! At first I was scared to post this video but now I dont care because the Gresham Police Department has already made a copy of it as proof of my crimes. I feel more like this is proof of their crimes or am i crazy?

Update: The man’s name is Fred Marlow and he is a 27-year-old Gresham resident who needs to find an attorney to prepare for his upcoming hearing, which is scheduled for September 30.

In a telephone interview with Photography is Not a Crime, Marlow said the officer body slammed him before handcuffing him.

The officer, who he identifies as Sgt. McGowan, also insinuated in his report of being drunk.

“He wrote in his report that I was probably drunk because I was walking funny,” Marlow said.

“But I was walking funny because I have a titanium rod in my leg.”

Marlow said the titanium rod stems for a traffic accident at the age of 18. He also said he told the cop to give him a breathalyzer, but the cop refused.

After he was thrown in the back of the car, his girlfriend stepped out of the apartment looking for him, but was ordered back inside under threat of arrest.

Marlow is not sure what prompted the raid on his neighbors but said he read reports in the local media that the police department had been conducting drug raids during that time.

He has launched a fundraiser to raise money for his legal defense fund.

GRESHAM, Ore. (KOIN 6) — Flash bang grenades went off early Tuesday morning as part of a SWAT mission in Gresham, police confirm.

Lt. Claudio Grandjean, a spokesman with the Gresham Police Department, said the mission was part of an ongoing drug investigation being conducted by the Special Enforcement Team. The warrant was executed around 3 a.m., Grandjean said.

Grandjean did not immediately know how many people were taken into custody, but said no one at the home caused any problems during their arrest.

There were no injuries reported.

Detectives will be at the residence, in the 2800 block of Northeast 23rd, until 6 a.m.

Must have been a very dangerous terrorist in there to send in the US military.

It's called playin' cowboy and indians, which many folks played when growing up. This is the adult version for those who never grew up, never matured appropriately and are not well adjusted. FYI, the indians always lost (it's how the game is played).

I wonder why those who record the cops aren't more discreet about it. Why not just set the camera down and get / stay out of sight?

Whats a lawful order? I know I have asked this before and never get any real replies.

The guy was standing on his lawn as far as I can tell. If anything the police came onto his property illegally and if I were him I would tell them that I am giveng them a lawful order to to leave my property......

Anyway, shouldnt a lawful order be backed by law? Where is the law that says you cant stand on your own property and film whats going on around you?

But back to my original question, What is a lawful order? Is it anything the cop says lawfuL?

He stops you when your walking down the street and says to show him ID. IS he giving you a lawful order?

Bottom line is if the cop is going to shout that he is giving a lawful order and it in fact was an illegal order then he should be held liable for issuing commands under color of law and abuse of authority

Absolutely not.

You have to know the difference between legal and lawful.

There exists at present no courts of law that I am aware of. If you ever show up in one that purports to be such all you have to do is ask the judicial actor how he gets paid. If he receives FRNs he has no ability or authority to adjudicate any case at law.

Funny thing is all he has to get from the state/county is $1 in substance annually to be able to defeat this line of reasoning.

In the same manner ... if the cop receives payment that is not lawful as a paycheck then he is incapable of lawful acts in general. However they don't know the difference between law and legal and I wouldn't care to be the one (in range) to fill in this hole in their education.

Lawful officers are called 'de jure' (under law) while others are 'de facto'. The acts of a de facto officer are valid but if they are not lawful can be countered (should you be able to find a court of law).
