This is all a part of the "disparate impact" campaign being waged by the Justice Department of this administration. DI has manifest itself in the mortgage industry where financial institutions, employing colorblind analysis, have been compelled to make high risk loans on the basis of race. The Justice Dept. has also been putting pressure on employers to dispense with criminal background checks as a part of their hiring protocol as such checks could disparately impact minorities. DI has evolved into an unconstitutional club intended to intimidate and, if necessary, mete out punishment. Schools which discipline unruly students "disparately" have been threatened with funding cuts. No consideration whatsoever has been given to the reality that African American children are two and a half times more likely than whites to be the product of broken homes.

The only silver lining is that the Justice Department has settled cases which otherwise would have been heading to the U.S. Supreme Court. This is a commentary on just how questionable the legality of disparate impact overreach has become. It is only a matter of time before a principled defendant with deep pockets will test the constitutionality of DI before The Supremes.
