The family of a Saratoga Springs, Utah man who was shot by police is now suing the department for violating his Second Amendment, Constitutional right to bear arms.
Darrien Hunt, 22, was described throughout mainstream media as a “sword-wielding man” after he was shot to death by police. But in reality, Hunt was a comic book enthusiast who was dressed as a “cosplay” character. Since he was killed, numerous “manga” style drawings have been found among his belongings: a testimony to the context of his dress.

Now, his family’s civil suit against officers contests the officers’ statements that Hunt had “abruptly and without any apparent provocation” advanced towards the two officers with a “samurai-type sword.”

Hunt’s autopsy report concluded that officers had fired at Hunt six times, including at least one time in the back. Witnesses gave a quite opposite story from that of police, saying that Hunt had been running away from officers when they fired at him.

The Hunt family attorney Robert Sykes said that the federal civil rights lawsuit is seeking $2 million in damages from Saratoga Springs along with the two officers who Hunt’s mother says shot him for racially-motivated reasons.

The lawsuit further claims that Cpl. Matt Schauerhamer and Officer Nicholas Judson violated Hunt’s Second Amendment rights, which not only enshrines Hunt’s right to own or “keep” personal arms such as firearms and swords, but also to carry or “bear” them.

“They demanded that he give up his sword — they had no right to do that. He was causing no harm,” Sykes explained. “They provoked an incident with this peaceful man.”
Hunt further notes that the sword was a deliberately dull replica sword, and that Hunt was dressed in samurai “cosplay” attire to impress managers at a Panda Express, where he had a job interview. That’s quite a difference from what police claimed. When corroborated by eye-witness, third-party testimonies, it looks like the Hunt family has made a good case against the Saratoga Springs Police Department.

Interesting case. I don't like that they're playing the race card, but, the Second Amendment does, indeed, guarantee the right to keep and bear all "arms," not just firearms. The Connecticut Supreme Court recently ruled that the 2A protects blades.
