...and only gets charged with misdemeanor assault. If any non-cop had done this there would be FELONY charges.

the man has the right to charge the cop also. He will certainly be successful if the cop is convicted of the equitable crime of misdemeanor assault. The man suffered a common law assault and could prosecute as such. Chances are no one knows how to do it, including him. But he could learn and do the whole thing himself. Have the cops house by xmas. Maybe sooner.

He could have easily killed the guy with that stunt. It must be something in the training, because I cannot imagine any decent human being doing that to someone without the intent to cause great bodily harm. Why would anyone want to hurt anyone simply because they don't understand the language? You are right Glass, this guy should be able to sue. If things were equitable, the officer would loose his job and home and be in jail and no taxpayer money would be involved.

In truth, there is no "law" at all, only administrative public policy.

The dude is paralyzed, had to have cranial surgery and bis vertebra fused. The person calling 911 should be charged and sued also, listen to the 911 call: http://www.al.com/news/index.ssf/2015/02/madison_police_fire_and_arrest.html
