BAD News For Baltimore State’s Attorney, But You Might Like ItLast week, the State’s Attorney in Baltimore announced that her office would be filing charges, including second-degree murder, against the six officers involved in the arrest of suspect Freddy Gray, which many people thought was hastily done and politically-motivated. As it turns out, that decision may come around full circle and smack her, hard.

The basis of the case against the officers, according to Marilyn Mosby as she read the explanation of the charges, is that they partook in an illegal arrest since the prosecutor’s office claims his knife wasn’t illegal. Many have stated that Mosby bringing charges so quickly was an “egregious rush to judgement” and accused her of using her authority for “crowd control” to quell the insurrection spreading across Baltimore.

One particular person who took issue with Mosby’s apparent lack of regard for the justice system is Page Croyder. Many of you probably have never heard that name, but it is an important one as she herself used to work at the Baltimore State’s Attorney’s Office, and she seems to think that Mosby didn’t just open herself up to a civil suit from the officers being charged, but that she could also face criminal charges as well for an “illegal arrest.”

That’s right, Croyder believes that the State’s Attorney’s Office is falsifying evidence to justify their charges against the officers, and if it’s the case, Mosby could face prosecution. In a scathing blog post, Croyder made her compelling case against the acting State’s Attorney, and should she prove to be right, Mosby could be in some hot water.

…Mosby has undermined the cause of justice rather than promoted it with her haste. She has created an expectation of guilt and conviction. But her own charging documents do not even support the most sensational charge of second degree murder, and they raise multiple points of doubt about other charges. If no convictions occur, many will blame the system as unfair or unjust, when it may have been Mosby’s own lack of competence and/or ambition in bringing charges so quickly. However much her performance raises her to star status, she will have dealt a blow to the justice system.

And she has created a new expectation in the city: that police officers who arrest without what she considers to be probable cause (an often subjective standard) are subject not just to civil action (the current norm) but criminal action. Mere mistakes, or judgments exercised under duress, can land them in the pokey.

How about Mosby’s own mistake? Her case against the two arresting officers rests upon an “illegal” arrest. She says the knife that Freddie Gray was carrying was legal. But according to the Baltimore Sun, the police task force examined it and said the officers were indeed correct, the knife was spring-assisted and therefore prohibited. If so, it was Mosby who made the “illegal” arrest, and could be charged under her own theory of “false imprisonment.” And sued to boot, since she forfeited her immunity from civil action by doing the charging herself.

If I were a Baltimore police officer, I’d be looking for another job immediately. And as a Baltimore citizen, I may start looking for someplace else to live. When the police cannot depend upon the state’s attorney to be as thorough, competent, non-political, and fair with them as she is supposed to be with all citizens, none of us will be safe.

Yikes, that’s not going to be good, especially with one of the officers being charged with second-degree murder. Yeah, and apparently that officer was volunteering to cover a shift for someone else. Can you imagine?

It will be interesting to see how this plays out, especially since I saw a report which stated that the officer charged with murder is requesting a second look at the weapon Gray was carrying when he was arrested, so they can determine just how accurate Mosby’s charges are. However, as more information comes to light, it appears as if Mosby isn’t holding herself to the same burden of proof as she did the six officers involved with Gray’s arrest, which in itself isn’t too surprising, all things considered.

Let’s just hope that if it turns out this was purely political, she pays the price like anybody else would have to.

What happens exactly? Hard to tell what the context is with only a photo. And when does it happen? Before or after getting elected?
