SARATOGA SPRINGS - Adam Rupeka came to this city and gave the finger to the first cop he saw.

The 35-year-old Troy man flipped off Officer Nathan Baker Saturday afternoon, and just a few seconds later, Baker was pulling him over.


Rupeka had two cameras. One mounted on the dash of his Chrysler Sebring, the other he placed on the dash as Officer Baker approached.



After asking Rupeka for his license and registration, and not getting them, Baker is heard saying, "Okay, step out of the vehicle. You're under arrest for disorderly conduct. Step out of the vehicle." Then Baker sprays Rupeka in the face with a can of pepper spray he pulls from his belt.

Could be any hand signals might be construed as an offer to CONTRACT?

So we have OFFER and ACCEPTANCE (pepper spray and charge) or possibly instead of ACCEPTANCE the cop has proffered a counter-offer more likely to result in a paid vacation for himself?
