that clerk of wherever that refuses to issue licenses to same sex couples and has now elected the benefit of incarceration in a federal facility on a contempt of court charge.

Hopefully you are aware there is no such power of a court of Law to issue something called a contempt of court? Contempt is a power of a court of Chancery (aka EQUITY) and is practically the only power they have. If this is from a court of EQUITY then the black robed actor seated 4 feet above the floor is not a judge as he/she is commonly called. Instead he/she is a CHANCELLOR.

To determine if you are standing in front of a judge of Law or a chancellor of equity you only have to ask one question ... DO YOU GET PAID IN GOLD OR SILVER? For if they are PRETENDING to be a judge but performing the acts of a chancellor then they are bringing fraud into the court. Ask the bailiff to escort them to the nearest jail.

If this seems extreme to anyone another question ... WHAT ELSE CAN YOU DO?

Do as they say or get a bigger gun........after all, the gun is the real law.........and that's why they want to disarm all the citizens.

The gun approach is for those who would choose to inflict more punishment upon themselves than the system is capable of. This is not really a remedy because any wager of battle in which one or both of the litigants expires does not settle the suit.

I prefer the IDIOT route:

Idiots can only appear in court in person by law. They cannot choose to be represented I suppose because they don't have the status to choose a representative. Don't be afraid of the title. The judicial actor knows what you are talking about.

People as a rule generally do the opposite of what they should. When they should stay silent they speak. When they should speak they stay silent. These are the traits of an idiot so just get used to it. The status provides about the only remedy you will find.

There is no law for her to comply with (this is her argument). The Supreme Court does not make laws. Congress makes laws. Congress has not made a law (nor does such a law exist in Kentucky) forcing clerks to marry gay couples.

Equity courts do as the chancellor chooses. Right now this one likes to believe that a clerk has to do as it tells her and if she doesn't she gets assigned contempt. Has absolutely nothing to do with law. Has to do with failure to follow the directives of his court.

She might have followed the orders of the court, made out the license, approved it and then stamp it in big RED letters VOID FOR VIOLATION OF LAW. Had she done this the court would have no beef .. she followed their orders.

Oh ... and the license is not for two gays to get married. It is permission for the minister to join them in marriage. If the minister performs this act without the license he might be the one put into stir.
