Check out the 'common sense' in this statement -

(I'm just) Josh(in') Earnest: "Well Peter, we're still learning of the precise motives of the individuals who carried out this heinous act of violence yesterday. One thing we do know, is the four fire arms they were wielding we're (sic) legally purchased under the laws in place now. That's a fact. So, that might lead some to conclude that we should have made it a little harder for them*. Would that have changed the entire outcome? We're still investigating the situation but I guess the question is, why wouldn't we? Why wouldn't we make it harder for them? What's the explanation for that?"

*and there you have it, gotta make it 'a little harder' for ANYONE (who can pass the 'stringent' NICS) to get a gun (ANY gun)

I never considered the plan to deny guns to people arbitrarily placed on the "terror watch list" as a violation of the 5th amendment, but it most certainly is. Thanks for the link.

Yes, it is a violation of due process. The recent California gun law is as well.

You can't just take a person's right (any right) away without due process. Due process means that there is a requirement of evidence equivalent to that needed for a criminal conviction.

The recent California law does indeed require evidence and a judge to sign off on it. However the type of evidence required is not as stringent as would be for a criminal case. The most strict to the most lax types of evidence are: beyond reasonable doubt, clear and convincing evidence, and preponderance of the evidence. The first one is required for criminal conviction, but only the second one is required for the California law to be used. My knowledge in this area is not that much, but this is my understanding.
