*and there you have it, gotta make it 'a little harder' for ANYONE (who can pass the 'stringent' NICS) to get a gun (ANY gun)

Yes, it is a violation of due process. The recent California gun law is as well.

You can't just take a person's right (any right) away without due process. Due process means that there is a requirement of evidence equivalent to that needed for a criminal conviction.

The recent California law does indeed require evidence and a judge to sign off on it. However the type of evidence required is not as stringent as would be for a criminal case. The most strict to the most lax types of evidence are: beyond reasonable doubt, clear and convincing evidence, and preponderance of the evidence. The first one is required for criminal conviction, but only the second one is required for the California law to be used.
