From July 15 to September 6 (http://grprofessionals.org/wp-content/uploads/2015/11/2016-Senate-Schedule.pdf), the Senate will be in recess. If they don't confirm a justice by then, Obama will make a recess appointment.

Before it comes up, the SCOTUS (https://www.oyez.org/cases/2013/12-1281) held in 2014 that the president has a right to make appointments during any recess 10 days or longer.

To remain in effect, a recess appointment must be approved by the Senate by the end of the next session of Congress, or the position becomes vacant again; in current practice this means that a recess appointment must be approved by roughly the end of the next calendar year.

But they'll play tricks by holding a 2 minute bs day like they had been to get around that power before. Exactly what Harry Reid did in 2007.

Historically it has never taken more than like 3 months, though - it would have to take almost 4 times longer than even his last two appointments.


Time taken from nomination by president to confirmation by senate:
Kagan: 3 months
Sotomayor: 2 months
Alito: 2 months
Meirs: withdrawn same month
Roberts: 2 months (well, two attempts at one month each)
Breyer: 2 months
Ginsburg: 2 months
Thomas: 3 months

Kennedy: 3 months
Bork: 3 months (rejected 1987)
Scalia: 3 months
Rehnquist: 3 months
...
Iredel: 2 days (1790)
So, modern times are all around 2-3 months.


Longest time from nomination to resolution was 125 days. Obama has 342 left in office.

EL PASO -- An El Paso source close to Justice Antonin Scalia tells ABC-7 that the 79-year-old died in his sleep last night after a day of quail hunting at Cibolo Creek Ranch outside of Marfa, Texas.

The Justice did not report feeling ill and retired to his room after dinner. The source, who was traveling with Scalia, told ABC-7 an El Paso priest has been called to Marfa.

Scalia was the longest-serving current Justice on the Supreme Court. He was appointed by President Ronald Reagan in 1986.

Texas Governor Greg Abbott released the following statement:

"Justice Antonin Scalia was a man of God, a patriot, and an unwavering defender of the written Constitution and the Rule of Law. He was the solid rock who turned away so many attempts to depart from and distort the Constitution. His fierce loyalty to the Constitution set an unmatched example, not just for judges and lawyers, but for all Americans. We mourn his passing, and we pray that his successor on the Supreme Court will take his place as a champion for the written Constitution and the Rule of Law. Cecilia and I extend our deepest condolences to his family, and we will keep them in our thoughts and prayers."

WASHINGTON (Reuters) - Conservative U.S. Supreme Court Justice Antonin Scalia has died, setting up a major political showdown between President Barack Obama and the Republican-controlled Senate over who will replace him just months before a presidential election.

"On behalf of the court and retired justices, I am saddened to report that our colleague Justice Antonin Scalia has passed away," Chief Justice John Roberts said in a statement on Saturday, calling Scalia, 79, an "extraordinary individual and jurist."

Scalia's death was first reported by the San Antonio News-Express, who said he had apparently died of natural causes while visiting a luxury resort in West Texas.

Obama, who is traveling in California, extended his condolences, and the White House said he would have more to say about Scalia's death later on Saturday. The Supreme Court lowered its U.S. flag in honor of Scalia on Saturday.

The U.S. president will face a stiff battle to win confirmation of a nominee to replace the dead jurist, with Republicans likely to delay in the hope that one of their own wins the November election.

"The American people‎ should have a voice in the selection of their next Supreme Court justice. Therefore, this vacancy should not be filled until we have a new president," said Senate Majority Leader Mitch McConnell, a Republican who currently controls if and when the Senate would vote on a nominee.

But Senate Minority Leader Harry Reid, a Democrat, said Obama should send the Senate a nominee "right away."

Obama could tilt the balance of the nation's highest court, which now consists of four conservatives and four liberals, if he tries to and is successful in pushing his nominee through the Senate confirmation process. Conservative Justice Anthony Kennedy sometimes joins with the liberals on high profile issues, including gay rights and the death penalty.

"Justice Scalia was an American hero. We owe it to him, and the nation, for the Senate to ensure that the next president names his replacement," Senator Ted Cruz of Texas, a Republican presidential candidate, said on Twitter.

The question of replacing Scalia is likely to come up when six of the Republican White House hopefuls participate in a televised debate Saturday evening in South Carolina, which holds its Republican nominating contest on Feb. 20.

POSSIBLE REPLACEMENTS

Appointed to the top U.S. court in 1986 by President Ronald Reagan, Scalia was known for his strident conservative views and theatrical flair in the courtroom.

Scalia's replacement would be Obama's third appointment to the nine-justice court, which is set to decide its first major abortion case in nearly 10 years as well as key cases on voting rights, affirmative action and immigration.

Obama's first two appointments to the court, liberals Sonia Sotomayor in 2009 and Elena Kagan in 2010, both experienced relatively smooth confirmation hearings in the Senate, which was then controlled by Democrats.

This nomination will be different, with Republicans now in charge of the Senate and keen to exert their influence over the process. Obama is likely to be forced into picking a moderate with little or no history of advocating for liberal causes.

Other factors the White House is likely to consider is whether to nominate a woman or a member of a minority group, or someone who fits into both categories.

Among those mentioned within legal circles as potential nominees are Sri Srinivasan, an Indian-American judge who has served on the U.S. Court of Appeals for the District of Columbia Circuit since May 2013, and Jacqueline Nguyen, a Vietnamese-American who has been a judge on the San Francisco-based 9th U.S. Circuit Court of Appeals since May 2012.

Paul Watford, a black judge on the 9th U.S. Circuit Court of Appeals who was appointed in May 2012, and Jane Kelly, a white woman and former public defender who has served on the St. Louis, Missouri-based 8th U.S. Circuit Court of Appeals since April 2013, also have been touted as possible nominees.

Quail hunting? I guess it's possible. It was pretty mild today in Texas.

But somehow it seems sinister. Scalia was the most staunchly conservative on the Court.

Obama will now add another carpet muncher and we can expect a flurry of new decisions; the key one being a reversal of Heller, with the updated interpretation that the 2nd Amendment applies only to the National Guard.

A pillar of the court's conservative wing for nearly 30 years, Scalia's sharply worded opinions anchored originalist legal thought on topics as varied as abortion, same-sex marriage, gun control, eminent domain, voting rights and government regulation. He leaves behind a court sharply divided, with four liberal-leaning justices and three reliable conservatives, with center-right Justice Anthony Kennedy, like Scalia an appointee of President Ronald Reagan, in the middle.
Given the high stakes that come with Scalia's replacement — and the likelihood that any successor would serve for decades to come — there's already an emerging assumption that President Barack Obama is unlikely to have an appointee confirmed before his term ends 11 months from now.
Minutes after Scalia's death was confirmed Saturday afternoon, Conn Carroll, the communications director for Sen. Mike Lee (R-Utah), a member of the Judiciary Committee, tweeted that there was "zero" chance the Republican-controlled Senate would move forward with any Obama appointee:

Well before Scalia's death, Democrats have made the Court's future a 2016 rallying cry. Should a justice who is in favor of abortion rights replace Scalia, the court would have a six to three majority in support of some degree of abortion rights.
But if Scalia's sudden passing bolsters Clinton's argument about the stakes of the election, it's also likely to boost Republican turnout, with conservative voters determined not to let a President Hillary Clinton or Bernie Sanders replace a rock-ribbed conservative with a liberal justice.
Michael McConnell, a law professor at Stanford University and a former federal appeals judge, lamented the rapid focus on the political implications of Scalia's death.
"This is a sad day for the country, for Justice Scalia's family, and for his many friends and colleagues," McConnell told Mic. "Let's not get into the politics of it quite so immediately."
But with one fewer conservative vote in upcoming rulings on hot-button issues like voting rights, labor unions, affirmative action and the Affordable Care Act's contraceptive mandate, it was inevitable that both liberals and conservatives would quickly turn to the question of what comes next.
The answer to that question almost certainly hinges on the outcome of the election, in which the court is now slated to play an even larger-than-expected role.

The Washington Post has reported that Supreme Court Justice Antonin Scalia's body has already been embalmed, even while a Texan justice of the peace said she would have "ordered" an autopsy. The Post wrote that Juanita Bishop, a justice of the peace in Presidio, Texas would have demanded an autopsy because if it had been her, she would "want to know," further adding that "they said he [Scalia] was good one minute and the next minute he’s dead."

NPR has reported that it was Judge Juanita Bishop who would have had jurisdiction over Scalia's autopsy, but she was indisposed because of a "work-related event."

Abreu Report was the first to break the news yesterday that Scalia was the victim of foul play, a claim which can now never be confirmed nor denied. If it's one thing our readers can deduce from our years of publishing, it's that we don't take risks with news that can be debunked.

Those FBI plans have now been fully thwarted, and the killers of Justice Scalia will be able to walk with impunity, knowing that all evidence of their crime against the people of the United States has been destroyed.

Justice of the peace Cinderella Guevara is a woman with a problematic history, who believes that "powerful Anglos" don't take "kindly to Mexican-Americans seeking social and political change;" and she has now become the facilitator in the most significant political assassination to take place in America this century.

This is not the first time that Judge Guevara has been implicated in hampering an investigation into the death of a respectable American.

In 2014 she was asked, by the parents of Melaney, a girl thought to have committed suicide, if she was even aware of what she had done to hamper an investigation into her death. Her parents asked: "with all due respect, Judge, how do you know she wasn't already dead when she was hit by the train?"


The Daily Kos reported in regards to the investigation obstructed by Judge Guevara that Melaney's parents were told by Union Pacific Railroad that the company would have paid for her autopsy "if they had known an autopsy had not been ordered."

Melaney's parents, not knowing that an autopsy had not been demanded, told the Daily Kos that they also would have paid for one if they had been aware one was not ordered despite overwhelming evidence that Melaney was not suicidal.

Melaney's parents wrote a letter to Big Bend News, telling the Texan paper that Judge Guevara had defended her hampering of the investigation into their daughter's death in saying:

"I told you I asked God to give me an answer in the video as to whether this was suicide or not. I told you He didn’t give me that answer. But He did give me another answer, and that was that, yes, this was a tragedy, but the true tragedy was that she died without accepting Jesus Christ as her savior."

In the past, Ms. Guevara has said that "to some of the ranching people, Mexicans were no more valuable than cattle" and that she knows this from talking to her husband.

It's pretty clear that Judge Guevara is a conflicted woman who is willing to destroy investigations into the death of individuals; she was chosen for a reason. According to USA Today, "embalming is required by Texas law before a body can be transported out of state," and Judge Guevara declared Justice Scalia dead over the phone, making the place ideal for poisoning a controversial political figure.

Judge Guevara declared Justice Scalia dead over the phone at the behest of Sheriff Danny Dominguez, whose office has a history of harassment and could have been easily blackmailed. Justice Scalia was found with a pillow over his head! The man had a pillow over his head and a judge accepted over the phone that it was natural causes.

One thing is certain in this whole affair: only someone with extreme influence in Texas could have caused all this to happen. We can safely say that something is "rotten in the state of Texas."

MARFA — A first-time guest to the Cibolo Creek Creek Ranch, U.S. Supreme Court Justice Antonin Scalia was animated and engaged during dinner Friday night, as one of three dozen invitees to an event that had nothing to do with law or politics, according to the ranch owner.

Just hours later, he would be found dead of apparent natural causes, which media outlets were reporting Sunday was a heart attack.

"He was seated near me and I had a chance to observe him. He was very entertaining. But about 9 p.m. he said, 'it's been a long day and a long week, I want to get some sleep," recalled Houston businessman John Poindexter, who owns the 30,000-acre luxury ranch.

When Poindexter tried to awaken Scalia about 8:30 the next morning, the judge's door was locked and he did not answer. Three hours later, Poindexter returned after an outing, with a friend of Scalia who had come from Washington with him.

"We discovered the judge in bed, a pillow over his head. His bed clothes were unwrinkled," said Poindexter.

"He was lying very restfully. It looked like he had not quite awakened from a nap," he said.
Scalia,79, did not have a pulse and his body was cold, and after consulting with a doctor at a hospital in Alpine, Poindexter concluded resuscitation would have been futile, He then contacted federal authorities, at first encountering a series of answering services because he was calling on a weekend.

"Ultimately they became available and handled it t superbly. They flew in by helicopter. They told me to secure the ranch, which I did until this morning," he said.

Scalia was just the latest newsworthy guest to visit the celebrity hideaway that covers 30,000 acres near the Chinati Mountains. Mick Jagger, Julia Roberts and Tommy Lee Jones have also partaken of its scenic vistas and luxury accomodations.

Established in 1857 by Milton Faver, known as the first Texas cattle baron west of the Pecos, the ranch retains 19th Century constructions, including "El Fortin de Cibolo," a primitive fort designed to protect settlers from Apaches.

In a special guest package offered last month, rooms went for $545 to $565 a night for two people, with a meal package and ranch tour included. Other activities include hiking, horseback riding, bird-watching and ATV tours.

Scalia, who was scheduled to return to Washington on Sunday, had little time to avail himself of the ranch's offerings. Poindexter said he had only met Scalia once before briefly, in Washington. Scalia came to the ranch because he was friends another guest.
Poindexter said he knew the other guests.

"All the guests were friends of mine, I paid for all of them. There were no politics, no jurisprudence in the slightest," he said.

"This was strictly a group of friends that the judge decided to join. He was coming with his son who had to drop out for reasons I don't' know.

"It was an honor to have him. He was widely admired. There were no speeches. He wasn't asked any hard questions, it was all about the outdoors and Texas, and what it's like to being a Supreme Court Justice," he said.

Scalia's personal financial disclosures show no previous trips to the ranch. The disclosures, posted on OpenSecrets.Org show that the justice made several trips to Texas since 2005 to speak at colleges and universities, including St. Mary's University in 2008.

Poindexter, 71, said Scalia's sudden death was both a "personal tragedy" for those at the ranch, and for the nation.

"All of us here saw him as a stalwart defender of our way of life in Texas, in a real sense," he said.
"It's a great loss. Having made that statement, if it was his time to go, he was surrounded by friends, in fairly nice setting, with a full tummy too. He said he was very happy to be invited so it could have been in worse circumstances," he said.

"It's caused all of us here to stop and think about life, how precious it is, and how it is so unexpectedly lost," he added.

The body of the Supreme Court justice was moved to an El Paso funeral home early Sunday.
The body was driven from Marfa and arrived around 2:30 a.m. at Sunset Funeral Homes, according to spokesman Chris Lujan.

Lujan said the funeral home was chosen by family of the justice, and at the advice of a family friend.
The El Paso County medical examiner's office said they hadn't received any infomration regarding the possibility of performing an autopsy.

MARFA, Tex. — In the cloistered chambers of the Supreme Court, Justice Antonin Scalia’s days were highly regulated and predictable. He met with clerks, wrote opinions and appeared for arguments in the august courtroom on a schedule set months in advance.

Yet as details of Scalia’s sudden death trickled in Sunday, it appeared that the hours afterward were anything but orderly. The man known for his elegant legal opinions and profound intellect was found dead in his room at a hunting resort by the resort’s owner, who grew worried when Scalia didn’t appear at breakfast Saturday morning.

It then took hours for authorities in remote West Texas to find a justice of the peace, officials said Sunday. When they did, Presidio County Judge Cinderela Guevara pronounced Scalia dead of natural causes without seeing the body — which is permissible under Texas law — and without ordering an autopsy.

As official Washington tried to process what his demise means for politics and the law, some details of Scalia’s final hours remained opaque. As late as Sunday afternoon, for example, there were conflicting reports about whether an autopsy should have been performed. A manager at the El Paso funeral home where Scalia’s body was taken said that his family made it clear they did not want one.

One of two other officials who were called but couldn’t get to Scalia’s body in time said that she would have made a different decision on the autopsy.

“If it had been me . . . I would want to know,” Juanita Bishop, a justice of the peace in Presidio, Tex., said in an interview Sunday of the chaotic hours after Scalia’s death at the Cibolo Creek Ranch, a luxury compound less than an hour from the Mexican border and about 40 miles south of Marfa.

Meanwhile, Guevara acknowledged that she pronounced Scalia dead by phone, without seeing his body. Instead, she spoke to law enforcement officials at the scene — who assured her “there were no signs of foul play” — and Scalia’s physician in Washington, who said that the 79-year-old justice suffered from a host of chronic conditions.

“He was having health issues,’’ Guevara said, adding that she is awaiting a statement from Scalia’s doctor that will be added to his death certificate when it is issued later this week.

Guevara also rebutted a report by a Dallas TV station that quoted her as saying that Scalia had died of “myocardial infarction.” In an interview with The Washington Post, she said she meant only that his heart had stopped.

“It wasn’t a heart attack,” Guevara said. “He died of natural causes.”

In a statement Sunday, the U.S. Marshals Service, which provides security for Supreme Court justices, said that Scalia had declined a security detail while at the ranch, so marshals were not present when he died. “Deputy U.S. Marshals from the Western District of Texas responded immediately upon notification of Justice Scalia’s passing,” the statement said.

One thing was clear: Scalia died in his element, doing what he loved, at a luxury resort that has played host to movie stars and European royalty, and is famous for bird hunts and bigger game such as bison and mountain lions.

Antonin Scalia, the influential and most provocative member of the Supreme Court, has died. He was 79.

“Other than being with his family or in church, there’s no place he’d rather be than on a hunt,” said Houston lawyer Mark Lanier, who took Scalia hunting for wild boar, deer and even alligators. Lanier said he first learned of Scalia’s love for hunting through former Supreme Court justice Sandra Day O’Connor. “He’ll do anything if you take him hunting,” Lanier recalled O’Connor saying.

Scalia had recently returned from a trip to Asia, where his last public event was a book signing in Hong Kong. John Poindexter, the Houston businessman who owns the Cibolo Creek Ranch, said Sunday that Scalia and a friend arrived Friday by chartered aircraft, traveling through Houston. At the ranch, Scalia joined about 35 other people invited by Poindexter, who declined to name the other guests.

Later that day, Scalia went out with the group to hunt blue quail. But “he did not exert himself,” Poindexter said. “He got out of the hunting vehicle and walked around some.’’

Law enforcement officials said Scalia attended a private party that night with the other guests and left to go to bed early. But Poindexter said that didn’t seem unusual: All of the guests were tired from traveling to the remote ranch, as well as the day’s other activities. Everyone was in bed by 10 p.m., he said.

Scalia’s behavior, Poindexter said, “was entirely natural and normal.’’

The next morning, Scalia did not show up for breakfast. Poindexter at first thought he might be sleeping late, but eventually he grew concerned. Late Saturday morning, he and one other person knocked on the door to Scalia’s room, an expansive suite called the “El Presidente.” When there was no answer, they went inside.

“Everything was in perfect order. He was in his pajamas, peacefully, in bed,” Poindexter said.

Emergency personnel and officials from the U.S. Marshals Service were called to the scene, then two local judges who also serve as justices of the peace, Guevara said. Both were out of town, she said — not unusual in a remote region where municipalities are miles apart.

Guevara also was out of town, but she said she agreed to declare Scalia dead based on the information from law enforcement officials and Scalia’s doctor, citing Texas laws that permit a justice of the peace to declare someone dead without seeing the body.

On Saturday evening, Scalia’s body was loaded into a hearse and escorted to the Sunset Funeral Home in El Paso by a procession of about 20 law enforcement officers. It arrived there about 2:30 a.m. Sunday, according to funeral home manager Chris Lujan. The funeral home is about 31/2 hours from the ranch where Scalia died.

About 3:30 a.m. Sunday, Scalia’s family declined to have an autopsy performed, Lujan said, so the body was being prepared for Scalia’s funeral and was expected to be transported to Washington on Monday. Late Sunday, it was under guard by six law enforcement officials, including U.S. marshals and Texas state troopers, he said.

Funeral arrangements for Scalia — a devoted Catholic who was given the last rites by a Catholic priest — were unclear Sunday.

The Role of the Supreme Court
The Supreme Court has a special role to play in the United States system of government. The Constitution gives it the power to check, if necessary, the actions of the President and Congress.
It can tell a President that his actions are not allowed by the Constitution. It can tell Congress that a law it passed violated the U.S. Constitution and is, therefore, no longer a law.
It can also tell the government of a state that one of its laws breaks a rule in the Constitution.
The Supreme Court is the final judge in all cases involving laws of Congress, and the highest law of all — the Constitution.

Presidio County Judge Cinderela Guevara, who pronounced Scalia dead, said the death certificate will say the cause of death was natural and that he died of a heart attack.

She said she decided not to order an autopsy after Sheriff Danny Dominguez concluded there were no signs of foul play, reported WFAA News in Dallas. The Scalia family concurred.

“As part of my investigation, one of the things I did ask the sheriff and the U.S. Marshal: ‘Were there any signs of foul play?’ And they said, ‘absolutely not.’ At that time, I still wanted to be careful, and asked them if [Scalia’s] physician would call me,” Guevara said.

According to Guevara, Scalia told his group Friday at dinner he was not feeling well and went to his room early. He then missed breakfast and lunch Saturday and was found unresponsive in his bed.

The owner of the Texas ranch and resort said Scalia died peacefully.

As late as Sunday afternoon, there were conflicting reports about whether an autopsy would be performed, though officials later said Scalia’s body was being embalmed and there would be no autopsy. One report, by WFAA-TV in Dallas, said the death certificate would show the cause of the death was a heart attack.

U.S. Supreme Court Justice Antonin Scalia died of natural causes and no autopsy was necessary, a judge has told The Associated Press.

Chris Lujan, a manager for Sunset Funeral Homes in Texas, said the 79-year-old jurist's body was taken from the El Paso facility late Sunday afternoon and was to be flown to Virginia, although he had no details. Scalia's family didn't think a private autopsy was necessary and requested that his remains be returned to Washington as soon as possible, Lujan said.

Terry Sharpe, assistant director for operations at El Paso International Airport, said a private plane carrying Scalia's body departed around 8 p.m. EST Sunday. Scalia's body was accompanied to the airport by U.S. marshals, he said. The body was returned to Virginia late Sunday.

Obama and the leaders of 11 other nations signed the TPP earlier this month (http://www.kesq.com/news/people-to-protest-obamas-proposed-transpacific-partnership-trade-agreement-during-summitt/37941102). Obama was granted Fast Track authority, but the corporate bill of rights passing as a “trade deal” will still have to be approved by the senate in an up or down vote. It will pass and Obama will sign it leaving just one obstacle: it will certainly be challenged in the Supreme Court on the grounds that it is not constitutional.

From the Archive: The death of U.S. Supreme Court Justice Scalia has prompted fawning eulogies about his legal brilliance and his heart-felt faith in constitutional “originalism,” but the reality is that he twisted the Framers’ thoughts into whatever was political convenient, as Robert Parry noted in 2011.

U.S. Supreme Court Justice Antonin Scalia unintentionally revealed the hypocrisy of the Right’s rhetoric about “originalist” interpretations of the U.S. Constitution with his comments about how the Fourteenth Amendment’s guarantee of “equal protection under the law” doesn’t mean equal rights for women.
“In 1868, when the 39th Congress was debating and ultimately proposing the 14th Amendment, I don’t think anybody would have thought that equal protection applied to sex discrimination, or certainly not to sexual orientation,” Scalia said in an interview (http://www.callawyer.com/story.cfm?eid=913358&evid=1) with the legal magazine California Lawyer.

“So does that mean that we’ve gone off in error by applying the Fourteenth Amendment to both? Yes, yes. Sorry, to tell you that.”
However, if the “original intent” of the amendment’s drafters was so determinative – that the Fourteenth Amendment supposedly was only meant to apply to black men at the end of slavery – it might be safe to assume that the drafters weren’t thinking about protecting a white man like George W. Bush from possibly losing an election in Florida in 2000.
Yet, the Fourteenth Amendment was precisely what Scalia and four other partisan Republicans on the Supreme Court cited to justify shutting down the Florida recount and handing the White House to Bush, despite the fact that he lost the national popular vote and apparently would have come out on the short end of the Florida recount if all legally cast ballots were counted.
To justify their ruling, the five Republican justices cited the Fourteenth Amendment’s “equal protection” clause in claiming that Florida’s electoral precincts had failed to apply common standards for counting votes. Then, rather than giving the state time to rectify the situation, the justices set a deadline of two hours, effectively assuring Bush’s “victory.”
In other words, Scalia and other right-wing justices operate with a situational ethic when it comes to “originalism” and “strict construction.” If their partisan and ideological interests require the abandoning of those precepts, the principles are dumped overboard.
That is what most of us would call hypocrisy or dishonesty. But Scalia, like many on the Right, operates with a curious sense of false righteousness, at least when his “principles” match up with his ideology and partisan interests.
In the interview, Scalia packaged his assessment of “originalist” intent on the Fourteenth Amendment as a tough-minded recognition of the facts. Scalia claimed that the amendment’s provisions should only relate to the “original” intent of extending legal rights to black men.
He framed his argument as an invitation to state legislatures to grant women, gays and other groups equal rights. But that also suggests that the states would be free to deny these Americans their rights, if the legislatures saw fit.
“If indeed the current society has come to different views [regarding equal rights for women and gays], that’s fine,” Scalia said. “You do not need the Constitution to reflect the wishes of the current society. Certainly the Constitution does not require discrimination on the basis of sex.
“The only issue is whether it prohibits it. It doesn’t. Nobody ever thought that that’s what it meant. Nobody ever voted for that. If the current society wants to outlaw discrimination by sex, hey we have things called legislatures, and they enact things called laws. You don’t need a constitution to keep things up-to-date. All you need is a legislature and a ballot box.”
Defending White Plutocrats
Nevertheless, when the power to appoint future Supreme Court justices was at stake – in Election 2000 – Scalia signed off on a fully unanticipated application of the “equal protection” language.
In the Bush v. Gore case, Scalia joined in a ruling that blocked the Florida Supreme Court from interpreting statutes passed by the state legislature regarding standards for legally cast votes. Scalia and four other Republican justices stopped Florida’s canvassing boards from assessing whether rejected ballots had indeed reflected the clear intent of the voters.
In effect, Scalia and the four other partisan Republicans – Justices William Rehnquist, Clarence Thomas, Anthony Kennedy and Sandra Day O’Connor – were citing the Fourteenth Amendment to overturn a state law regarding how elections should be conducted.
They did so with the expressed intent of protecting the “rights” of George W. Bush – and without any concern that the Congress in 1868 never expressed any intent for the amendment to be used as a device to overturn the will of the voters and put a white plutocrat in the White House.
But as the saying goes, necessity is the mother of invention. And Scalia and his cohorts were willing to invent – or ignore – “originalism” as needed to achieve their partisan ends. They were acting as what they like to condemn, “activist judges.”
By the way, the relevant part of the Fourteenth Amendment doesn’t make any reference to race or to gender, only to “citizens” and “any person.”
It states: “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States, nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
Four decades ago – before Scalia’s arrival on the scene – the U.S. Supreme Court ruled that those provisions do apply to women. More recently, some federal judges have ruled that the language also would prohibit discriminatory laws against gays.
Bush v. Gore
As painful as it might be to some, it’s worth reviewing — in the context of Scalia’s statement — how the Bush v. Gore ruling came to pass.
The behind-the-scenes court drama began on Dec. 8, 2000. Bush was clinging to an official lead of only a few hundred votes out of six million cast in Florida when the Bush forces were dealt a crushing blow. A divided Florida Supreme Court ordered a statewide review of ballots that had been kicked out by antiquated counting machines.
The recount began on the morning of Dec. 9. Immediately, the canvassers began finding scores of legitimate votes that the machines had rejected.
Despite a supposed reverence for states’ rights and a disdain for federal interference, Bush’s lawyers raced to the U.S. Appeals Court in Atlanta to stop the count. Though dominated by Republican conservatives, the appeals court held to established precedents and refused to intervene to stop the recount.
A frantic Bush then turned to the U.S. Supreme Court in Washington. There, in the late afternoon, the high court took the unprecedented step of issuing an injunction to stop the counting of votes cast by American citizens.
In the injunction, Justice Scalia made clear that the purpose of the court’s action was to prevent Bush from falling behind in the tally and thus raising questions about his legitimacy should the Supreme Court later declare him the winner.
That outcome would “cast a cloud” over the “legitimacy” of an eventual Bush presidency, explained Scalia. “Count first, and rule upon the legality afterwards, is not a recipe for producing election results that have the public acceptance democratic stability requires,” Scalia wrote.
Trusting the Law
Nevertheless, on Dec. 11, 2000, Gore and his lawyers voiced confidence that the rule of law would prevail – that the U.S. Supreme Court would rise above any partisan concerns and would insist that the votes be counted and the will of the voters be respected.
Gore was particularly confident that Justice O’Connor would reject partisanship and apply the law fairly. However, on that same day, reporter Mollie Dickenson wrote for Consortiumnews.com (http://www.consortiumnews.com/2000/121100a.html) that O’Connor, a supposed “swing vote” was “firmly on board for George W. Bush’s victory.”
Dickenson wrote that “according to a knowledgeable source, O’Connor was visibly upset – indeed furious – when the networks called Florida for Vice President Al Gore on Election Night. ‘This is terrible,’ she said, giving the impression that she desperately wanted Bush to win.
“Some have heard that one reason why O’Connor was so upset was that the O’Connors want to retire home to Arizona, but will not do so if Gore wins. In that case, O’Connor will remain on the court to deny Gore the opportunity to replace her.” (As it turned out, O’Connor did retire with Bush in office, enabling him to appoint right-wing Justice Samuel Alito, who became part of Scalia’s faction on the court.)
Yet, the Gore team apparently went before the court not knowing that whatever they argued, the five Republican partisans were determined to make Bush the next president.
The evidence is now clear that the five Republican partisans decided on the outcome first and worked out the rationale second. Indeed, their legal logic flipped from the start of their deliberations to the end, but their pro-Bush verdict remained steadfast.

USA Today disclosed this inside story in an article about the strains that the Bush v. Gore ruling created within the court. Though the article was sympathetic to the pro-Bush justices, it disclosed an important fact: that the five were planning to rule for Bush after oral arguments on Dec. 11. The court even sent out for Chinese food for the clerks, so work could be completed that night. At that point, the legal rationale for stopping the Florida recount was to have been that the Florida Supreme Court had made “new law” when it referenced the state constitution in an initial recount decision – rather than simply interpreting state statutes.
Even though this basis for giving Bush the White House was highly technical, the rationale at least conformed with conservative principles, which are supposedly hostile to judicial “activism.” But the Florida Supreme Court threw a wrench into the plan.
On the evening of Dec. 11, the state court submitted a revised ruling that deleted the passing reference to the state constitution. The revised ruling based its reasoning entirely on state statutes, which permitted recounts in close elections.
This modified state ruling opened a split among the five conservatives. Justices O’Connor and Kennedy no longer felt they could agree with the “new law” rationale for blocking the recount, though Justices Rehnquist, Scalia and Thomas were prepared to stick with the old thinking even though its foundation had been removed.
Finding a Reason
The plans for finishing up the formal opinion on the evening of Dec. 11 were scrapped as O’Connor and Kennedy veered off in a very different direction.
Through the day on Dec. 12, they worked on an opinion arguing that the Florida Supreme Court had failed to set consistent standards for the recount and that the disparate county-by-county standards constituted a violation of the “equal protection” rules of the Fourteenth Amendment.
The logic of this argument was quite thin and Kennedy reportedly had trouble committing it to writing. To anyone who had followed the Florida election, it was obvious that varied standards already had been applied throughout the state.
Wealthier precincts benefited from optical voting machines that were simple to use and eliminated nearly all errors, while poorer precincts with many African-Americans and retired Jews were stuck with outmoded punch-card systems with far higher error rates. Some counties had conducted manual recounts, too, and those totals already were part of the tallies giving Bush a tiny lead.
The statewide recount – ordered by the Florida Supreme Court – was designed to reduce those disparities and thus bring the results closer to equality. Applying the “equal protection” provision, as planned by O’Connor and Kennedy, turned the Fourteenth Amendment on its head, guaranteeing less equality than would have occurred by letting the recount go forward.
Indeed, if one were to follow the “logic” of the O’Connor-Kennedy position, the only “fair” conclusion would have been to throw out Florida’s presidential election in total. After all, the U.S. Supreme Court was effectively judging Florida’s disparate standards to be unconstitutional. But that would have left Gore with a majority of the remaining electoral votes.
Or, more rationally, the U.S. Supreme Court could have given Florida more time to conduct the fuller recount that the O’Connor-Kennedy position envisioned, bringing in not only so-called “under-votes” in which a choice was hard to detect but “over-votes” in which citizens both punched the hole for their choice and wrote his name in.
However, Gore stood to benefit from either approach and that went against the pre-determined outcome to put Bush in the White House, whatever the legal excuse had to be.
Even more telling than the stretched logic of the O’Connor-Kennedy faction was the readiness of Rehnquist, Scalia and Thomas to sign on to a ruling that was almost completely at odds with their initial legal rationale for blocking the recount — and in violation of their supposedly “strict constructionist” beliefs.
On the night of Dec. 11, that trio was ready to bar the recount because the Florida Supreme Court had created “new law.” On Dec. 12, the same three justices were voting to block the recount because the Florida Supreme Court had not created “new law” – by establishing precise statewide recount standards.
The five conservatives had devised their own Catch-22. If the Florida Supreme Court set clearer standards, that would be struck down as creating “new law.” If the state court didn’t set clearer standards, that would be struck down as violating the “equal protection” principle. Heads Bush wins; tails Gore loses.
There was one other clever twist to the conservative majority’s maneuvering. When the ruling was issued at around 10 p.m. on Dec. 12, the Republican majority’s rationale asserted that the Fourteenth Amendment required a recount with equal standards applied statewide, but then gave Florida only two hours to complete the process before a deadline of midnight.
Because this two-hour window was absurdly unrealistic, the result of the ruling was to give Bush the White House based on a 537-vote lead in the “official” Florida results, as overseen by the state administration of his brother, Gov. Jeb Bush.
Denying Politics
After the court’s ruling and Gore’s gracious-but-pained concession speech the next day, Justice Thomas told a group of high school students that partisan considerations played “zero” part in the court’s decisions. Later, asked whether Thomas’s assessment was accurate, Rehnquist answered, “Absolutely.”
In later comments about the court’s role in the case, Rehnquist seemed unfazed by the inconsistency of the court’s logic. His overriding rationale seemed to be that he viewed Bush’s election as good for the country – whether most voters thought so or not.
In a speech on Jan. 7, 2001, Rehnquist said sometimes the U.S. Supreme Court needed to intervene in politics to extricate the nation from a crisis. His remarks were made in the context of the Hayes-Tilden race in 1876, when another popular vote loser, Rutherford B. Hayes, was awarded the presidency after justices participated in a special election commission.
“The political processes of the country had worked, admittedly in a rather unusual way, to avoid a serious crisis,” Rehnquist said. Scholars interpreted Rehnquist’s remarks as shedding light on his thinking during the Bush v. Gore case as well.

“He’s making a rather clear statement of what he thought the primary job of our governmental process was,” said Michael Les Benedict, a history professor at Ohio State University. “That was to make sure the conflict is resolved peacefully, with no violence.” [Washington Post, Jan. 19, 2001]But where were the threats of violence and acts of disruption in the 2000 election? Gore had reined in his supporters, urging them to avoid confrontations and to trust in the “rule of law.” The only violence had come from the Bush side, when the Bush campaign flew protesters from Washington to Miami to put pressure on local election boards.
On Nov. 22, 2000, as the Miami-Dade canvassing board was preparing to examine ballots, a well-dressed mob of Republican operatives charged the office, roughed up some Democrats and pounded on the walls. The canvassing board promptly reversed itself and decided to forego the recount.
The next night, the Bush-Cheney campaign feted the rioters at a hotel party in Fort Lauderdale. Starring at the event was crooner Wayne Newton singing “Danke Schoen,” but the highlight for the operatives was a thank-you call from George W. Bush and his running mate, Dick Cheney, both of whom joked about the Miami-Dade incident, the Wall Street Journal reported.

The Journal noted that “behind the rowdy rallies in South Florida this past weekend was a well-organized effort by Republican operatives to entice supporters to South Florida,” with House Majority Whip Tom DeLay’s Capitol Hill office taking charge of the recruitment. In other less violent ways, Bush-Cheney operatives signaled that they would not accept an unfavorable vote total in Florida. In the chance that Gore pulled ahead, the Republican-controlled state legislature was preparing to void the results. In Washington, the Republican congressional leadership also was threatening to force a constitutional crisis if Gore prevailed in Florida.
If one takes Rehnquist’s “good-for-the-country” rationale seriously, that means the U.S. Supreme Court was ready to award the presidency to the side most willing to use violence and other anti-democratic means to overturn the will of the voters.
Rehnquist’s approach suggested that since Gore and his supporters were less likely to resort to violence – while Bush and his backers were ready to provoke a crisis if they didn’t get their way – that the high court should give the presidency to the side most committed to disruption.
A far more democratic – and rational – approach would have been for the Supreme Court to accept the O’Connor-Kennedy logic and simply extend the deadline for Florida to turn in its results. The court could have ordered the fullest and fairest possible recount with the winner being whichever candidate ended up with the most votes.
However, if that had occurred, the almost certain winner would have been Gore. When a group of news organizations conducted an unofficial recount of Florida’s disputed ballots in 2001, Gore came out narrowly on top regardless of what standards were applied to the famous chads – dimpled, hanging or punched-through.

Gore’s victory would have been assured by the so-called “over-votes” in which a voter both punched through a candidate’s name and wrote it in. Under Florida law, such “over-votes” are legal and they broke heavily in Gore’s favor. However, this startling fact was an unpleasant reality that the mainstream U.S. news media decided to obscure.
The tally wasn’t completed until after the terrorist attacks on 9/11 and the prevailing view among senior news executives became that it would be harmful to the nation’s need for unity if the press reported that Gore was the rightful winner of Election 2000.
So, the major newspapers and TV networks hid their own scoop when the results were published on Nov. 12, 2001. Instead of stating clearly that Florida’s legally cast votes favored Gore, the mainstream media bent over backwards to concoct hypothetical situations in which Bush might still have won the presidency, such as if the recount were limited to only a few counties or if the legal “over-votes” were excluded.
The discovery of Gore’s rightful victory was buried deep in the stories or relegated to charts that accompanied the articles.
Misleading the Readers
Any casual reader would have come away from reading The New York Times or The Washington Post with the conclusion that Bush really had won Florida and thus was the legitimate president after all. The Post’s headline read, “Florida Recounts Would Have Favored Bush.” The Times ran the headline: “Study of Disputed Florida Ballots Finds Justices Did Not Cast the Deciding Vote.”

Some columnists, such as the Post’s media analyst Howard Kurtz, even launched preemptive strikes against anyone who would read the fine print and spot the hidden “lede” of Gore’s victory. Kurtz labeled such people “conspiracy theorists.” [Washington Post, Nov. 12, 2001]
After reading these slanted “Bush Won” stories, I wrote an article for Consortiumnews.com noting that the obvious “lede” should have been that the recount revealed that Gore had won. I suggested that the news judgments of senior editors might have been influenced by a desire to appear patriotic only two months after 9/11. [See Consortiumnews.com’s “Gore’s Victory (http://www.consortiumnews.com/2001/111201a.html).”]My article had been up for only a couple of hours when I received an irate phone call from New York Times media writer Felicity Barringer, who accused me of impugning the journalistic integrity of then-Times executive editor Howell Raines. I got the impression that Barringer had been on the look-out for some deviant story that didn’t accept the pro-Bush conventional wisdom.
Today, the dominant conventional wisdom appears to be that while the Bush v. Gore decision was a case of politicized justice, it’s not something that Americans should get too upset about. There is even a school of thought that asserts that it was encouraging that U.S. citizens did not take to the streets to protest this overturning of their democratic judgment.
In a Sept. 13, 2010, interview with NBC’s Brian Williams, Justice Stephen Breyer, one of the dissenters in the Bush v. Gore ruling, said he still believed the majority was wrong, but added that he found the aftermath remarkable in a positive way.
“That remarkable thing, is even though more than half the public strongly disagreed with it , thought it was really wrong, they followed it,” Breyer said. “And the alternative, using guns, having revolutions, is a worse alternative.
“And it’s taken quite a long time, many, many years, decades and decades for Americans to come to that understanding. And that fact — that America will follow court decisions made by fallible human beings, even when those decisions are very unpopular — has not always been true.”
In other words, Breyer believes it is preferable for Americans to accept an anti-democratic judgment made by five partisans in black robes than to rise up in outrage against a powerful institution that has usurped the role of the voters and overturned the consent of the governed.
Yet, is that acquiescence really preferable to the courageous actions by people all over the world who have staged protests and risked their lives in defense of democracy when autocratic rulers have refused to accept the results of an election?
A decade after the fateful court ruling – with the results of Bush’s presidency now painfully apparent and his appointed justices helping to open the floodgates of special-interest money to further distort the democratic process – Bush v. Gore must be viewed as a moment when the United States started down a very dark road.
It also is a reminder that for Justice Scalia and his cohorts, a stated devotion to “originalism” and “strict construction” is more a propaganda exercise designed to fool the gullible than a bedrock principle that must be followed even when it doesn’t work in favor of a politically desired outcome.

Justice Scalia dying has brought up how really corrupt the Supreme Court is. Everyone is saying just changing one seat can change the outcome for every ruling for the foreseeable future. This tells me the supreme court bench is very biased and corrupt, that they can interpret the constitution so differently to suit a political party agenda. I thought they were supposed to be impartial? Something is very wrong!

When Supreme Court Justice Antonin Scalia died Saturday in Presidio County, it wasn't easy to arrange the inquest, the judicial inquiry into the death.

Jeanette Duer, the judge of neighboring Jeff Davis County, explains how it works.

"Our county has 2,400 square miles. We have about 2,400 people. We have one justice of the peace who does the inquest. If she's not available, it falls to me, as county judge."

The historic ranch dates to the West Texas pioneer days of 1857. The old fort there was meticulously restored by Houston businessman John Poindexter, who has owned the ranch for more than 25 years. The original owner, cattleman Milton Faver, is buried there in a mausoleum on top of a hill.

I was reporting from a candidate forum in neighboring Brewster County. Officials from all three counties were in attendance. David Beebe, the justice of the peace for Precinct 1 in Presidio County, was there, too. Shortly after 1 p.m., he received a request to handle an inquest for "a dead body" back in his county.

The call came from Juanita Bishop, the justice of the peace for Precinct 2, who is nominally closer, but she was at a work-related event more than 120 miles away in Fort Stockton.

Tammy King had organized a film screening that night in Marfa. She was expecting to see the ranch's owner, John Poindexter, but he had cancelled after arranging a hunting trip with about three dozen friends, including Scalia.

"Right now, it's actually a quail trip," said King, "a quail hunting trip that they're having this weekend."

King speaks highly of this luxurious ranch, which is often open to the public. It's a classic getaway, where movie stars can hideout and take advantage of its miles and miles of trails.

Beebe responded he was also far away, too, busy at the political forum. The deceased wasn't identified. Bishop said she would find an alternate. In this border county, sometimes the dead body is an undocumented migrant. Identification can take weeks; death can wait.

Bishop contacted the third choice, Presidio County Judge Cinderella Guevara, who was also unable to make the drive to Cibolo Creek Ranch. Connecting with the county sheriff there, she officially handled the inquest — over the phone — pronouncing Justice Scalia dead just before 2 p.m. The Texas Code of Criminal Procedures allows justices of the peace to pronounce death via phone when deemed reasonable.

It wasn't until after 3 p.m. that the news started to make its way to the local officials at the candidates forum. Phones lit up. People stopped paying attention to the debate on the stage. I was sitting near Judge Beebe, and we rushed out of the school auditorium together. We drove straight to the only funeral home in the area, in Alpine — where there was no answer at the door.

I was still about an hour away from Cibolo Creek Ranch, but checked the gas tank and drove there directly. There was no cell coverage for most of the drive. At the rock gate, one man stood guard, shooing me off the private property. Miraculously, I had a cell signal, and I began feeding information to NPR, The Associated Press and statewide news outlets.

The sun was setting over the Chinati Mountains to the west. On an airstrip to the east, three small planes punctuated the end of the runaway. Few cars passed. One vehicle, from Border Patrol, entered the gates in the hour I waited. The body was sent west, to El Paso.

Justice Scalia, one of the court’s most conservative justices, was officially declared dead by Presidio County Judge Cinderella Guevara, who said she was shopping in a nearby town when she received word of Justice Scalia’s passing from the county sheriff.

She recounted to WFAA-TV on Sunday:

“He says, ‘Judge, I’m at Cibolo Creek Ranch, and a Supreme Court justice has just passed away, and I need someone here immediately. Both justices of the peace are out of town’.

“I said, ‘Sheriff, what did you say? Which Supreme Court Justice died at Cibolo Creek Ranch?’ And the phone went dead, because our connection was very bad.”

After finally getting back in touch with the county sheriff 20 minutes later, Guevara pronounced Justice Scalia dead over the phone at 1:52 p.m. local time.

Later that evening, Justice Scalia’s remains were examined by his personal physician, where it was determined that there were no signs of foul play involved in the Supreme Court justice’s death.

The unnamed doctor added that Justice Scalia had a shoulder problem as well as several chronic ailments. No autopsy has been ordered at this time, and his death certificate — with the official death listed as a myocardial infarction — will be filed in Presidio County, Texas.

Not the same, but they're very close in age & the TX ranch poindexter also has a military past. They have different middle names. Any familial relationship, I don't know. But I heard O'Bummer gave the TX poindexter some kind of medal of honor a couple years ago... :|~

Thanks to a VC commenter, I discovered that in August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.” Each of President Eisenhower’s SCOTUS appointments had initially been a recess appointment who was later confirmed by the Senate, and the Democrats were apparently concerned that Ike would try to fill any last-minute vacancy that might arise with a recess appointment.

The GOP opposed this, of course. Hypocrisy goes two ways. But the majority won.

Let’s jump right in with quotes from the Washington Post, 2/15, “Conspiracy theories swirl around the death of Antonin Scalia”. The Post published extraordinary statements from the Facebook page of “William O. Ritchie, former head of criminal investigations for D.C. police”:

“As a former homicide commander, I am stunned that no autopsy was ordered for Justice Scalia.”

“You have a Supreme Court Justice who died, not in attendance of a physician. You have a non-homicide trained US Marshal tell the justice of peace that no foul play was observed. You have a justice of the peace pronounce death while not being on the scene and without any medical training opining that the justice died of a heart attack. What medical proof exists of a myocardial Infarction? Why not a cerebral hemorrhage?”

“How can the Marshal say, without a thorough post mortem, that he was not injected with an illegal substance that would simulate a heart attack…”

“Did the US Marshal check for petechial hemorrhage in his eyes or under his lips that would have suggested suffocation? Did the US Marshal smell his breath for any unusual odor that might suggest poisoning? My gut tells me there is something fishy going on in Texas.”

If this isn’t enough, the Post goes on:

“Scalia’s physician, Brian Monahan, is a U.S. Navy rear admiral and the attending physician for the U.S. Congress and Supreme Court. He declined to comment on Scalia’s [prior] health when reached by telephone Monday at his home in Maryland.

“’Patient confidentiality forbids me to make any comment on the subject,’ he said.”

“When asked whether he planned to make public the statement he’s preparing for [Texas Judge] Guevara, Monahan repeated the same statement and hung up on a reporter.”

As long as no law-enforcement investigation of Scalia’s death is launched, the doctor is justified. Confidentiality applies, unless Scalia’s family lifts it. But if such an investigation is opened, all bets are off. Confidentiality no longer applies.

There are reports that, after Scalia’s body was transported from the celebrity ranch in Texas, closely guarded and shielded by a bevy of marshals, it was rapidly embalmed. If so, that would apparently make toxicological tests far more difficult or impossible.

As for a murder motive, try: upsetting the voting balance of the US Supreme Court. Try: a push to appoint a new Justice now, thus ensuring the appointee’s political persuasion, regardless of the outcome of the 2016 Presidential election. Try: attempting to shift the Court’s voting balance in upcoming cases on abortion, immigration, and Obamacare.

Dismiss the comfortable notion that “this couldn’t happen.” JFK couldn’t have been murdered, but he was. High political figures don’t carry special immunity.

Dismiss assurances from incompetents in Texas that Scalia died of natural causes, and dismiss the press repeating these assurances—which add up to: nothing.

Dismiss calls for “propriety in a time of grief.”

Dismiss whatever opinions, pro and con, circulate now about Scalia, his points of view, his decisions, his character, his life. They’re irrelevant to the facts of his death. Those facts are as clear as mud.

Dismiss the typical accusations of “conspiracy theory.” It’s no theory when key facts are unknown and incompetents supplied the current “information.”

In addition to what I’ve cited above, count as relevant the fact that Scalia’s federal protection had been removed while he was at the Texas ranch. We’re told Scalia didn’t want that protection. Maybe yes, maybe no. We’re also told Scalia’s family didn’t want an autopsy. Again, maybe yes, maybe no. The family has been silent. Or if not, their statements aren’t being reported.

Consider, as potentially relevant, the report that Scalia was found with a pillow over his head.

Consider, as relevant, that Judge Guevara, deciding without seeing the body that Scalia died from natural causes, ruled against doing an autopsy—and a counter-opinion, offered unofficially by another Texas judge, Juanita Bishop, that she would have wanted an autopsy. Concerning Judge Guevara, this may or may not be relevant—heavy.com reports, “Judge Cinderela Guevara: 5 Fast Facts You Need to Know”:

“This isn’t the first time Guevara has been the source of controversy. In 2013, Melaney Parker Rayburn was found dead after being hit by a train in Marfa, Texas… Liz Parker, Melaney’s mom, questioned how Guevara handled the investigation of her daughter’s death, The Daily Kos reported [see “Like a dead dog on the tracks: Injustice in small town Texas…”]. Melaney was hit by a Union Pacific Railroad train and, Liz [her mother] wrote, a Union Pacific representative told her that it appeared that her body had been placed on the tracks while she was unconscious. Liz asked the Justice of the Peace and the Sheriff to open the case as a homicide investigation, but they would not. Guevara, who was a Justice of the Peace at the time, did not order a rape kit or an autopsy, Liz wrote, because a doctor at the scene said the cause of death was obvious.

“Liz later wrote a letter to the editor, published on Big Bend Now [see “correspondence, October 14th, 2013”], in which she said that Guevara had asked for God to give her an answer about whether Melaney’s death was suicide. Liz wrote that Guevara told her: ‘Yes, this was a tragedy, but the true tragedy was that she died without accepting Jesus Christ as her savior.’”

Bottom line so far: Any reasonable law-enforcement agency would immediately open an investigation into Scalia’s death. Failing to do so would rate as aiding and abetting a concealment of the truth, whatever that turns out to be.

Walter Nichols Award from the New York University Stern School of Business, an honor conferred annually on a leader who exemplifies the qualities of integrity, enterprise and service. But another quality also set him apart: Among the court’s members, he was the most frequent traveler, to spots around the globe, on trips paid for by private sponsors.

When Justice Scalia died two weeks ago, he was staying, again for free, at a West Texas hunting lodge owned by a businessman whose company had recently had a matter before the Supreme Court.

Though that trip has brought new attention to the justice’s penchant for travel, it was in addition to the 258 subsidized trips that he took from 2004 to 2014. Justice Scalia went on at least 23 privately funded trips in 2014 alone to places like Hawaii, Ireland and Switzerland, giving speeches, participating in moot court events or teaching classes. A few weeks before his death, he was in Singapore and Hong Kong.

The destinations often are luxurious, including the Casa de Campo Resort in the Dominican Republic, where Justice Samuel A. Alito Jr. was listed as a speaker for an event last February, or Zurich, where Justice Scalia traveled at least three times on privately funded trips.

Over roughly a decade, Justice Scalia took 21 trips sponsored by the Federalist Society, to places like Park City, Utah; Napa, Calif.; and Bozeman, Mont. The Federalist Society also paid for trips by Justice Alito during that period, but not for any liberal justices, the disclosure reports show.

Ranch owner John Poindexter and C. Allen Foster, a Washington lawyer who traveled to the ranch with Scalia by private plane, hold leadership positions in the order, the Post reported — although the paper noted that Scalia’s connection to the society, if any, is not clear.

Foster, a lawyer with the Washington firm Whiteford, Taylor & Preston, is known for his passion for hunting and is a former spokesman for the hunting group Safari Club, the Post reported.

The Venerable Order of Saint Hubertus, as it was called then, gathered the “greatest noble hunters of the the [sic] 17th century” to enjoy the fruits of those Protestant dispossessions.

The original Order lasted until 1938, when Hermann Goering, commander of the Nazi air force, executed the Order’s leader when he was denied membership, and Adolf Hitler dissolved the group in response to its unwillingness to admit Nazis. The American chapter of the Order was inaugurated at the elite and mysterious Bohemian Grove. But as far as secret societies go, the Order is fairly open. These are rich people who want to hang out with other rich people and follow the order’s motto, “Deum Diligite Animalia Diligentes”—Honor God by Honoring his Creatures. Once you’ve wrangled up your best rich hunter connections and paid your $800 Application Processing and Initiation Fee, you’ll be inducted at the level of “Squire.” Ascension to the rank of “Knight” requires the blessings of Priors and the leader of the national chapter, the Grand Prior. This was not a man you gave orders to, especially not President Obama. It was Justice Antonin Scalia who vacated the long sacrosanct immunity from civil lawsuits, opening the door for a weakened presidency.
Sources say that Scalia was the single actor behind the impeachment of Bill Clinton. President Obama was aware of this and had ordered the FBI to set out traps for Scalia. We will now outline the downfall of Antonin Scalia.
When Scalia left the White House after a meeting with the president just before flying to Texas, the manila envelope he was carrying had printouts from a computer seized by FBI Special Agent Jeff Ross of the Salt Lake City, Utah field office, or so informants tell us.
Scalia left the White House carrying “slam dunk proof” that would lead to the arrest, conviction and, of course, impeachment of a seated Supreme Court Justice, files that contained names of victims and details on sex acts, preferred “types” along with dates and places. All of this was on the seized computer and these files went “up hill” from the FBI to the Department of Justice and directly over to the White House.

There, political advisors leapt on them, seeing a chance to leverage a justice and, in this case, and this is very important, bring down Scalia in such a way that conservatives would be forced to accept virtually any Obama nomination.
When Scalia arrived in Houston and chartered a plane after ditching his US Marshall protection detail, Scalia and his companion, C. Allen Foster. Foster heads the Order of Hubertus and is co-owner with John Poindexter of the Cibolo Creek Ranch, 25,000 plus acres free for anyone to use, according to John Poindexter, “free of charge,” so long as they are a supreme court justice, “A list” celebrity like Mick Jagger or billionaire, others need not apply.
The crux of the story is how they got Scalia. According to sources, Scalia had been providing protection for an international pedophile ring and was murdered by “friends” who he had informed of the nature of his visit with Obama and the doom it signaled for those around Scalia, prosecution, ruin and Citizens United reversed.
The mechanism Scalia used to provide this protection was the Federalist Society which choses the judges throughout the US judiciary system so should any unfortunate pedophile find himself in court, the judge was under Scalia’s control, thus making a successful prosecution difficult to achieve.
The Federalist Society grooms and recruits candidates to become judges at a young age – college age kids; they specifically seek out suitable candidates who have certain moral ambiguities that can be exploited. Thus a stranglehold is placed on the judicial system of the United States by a group which serves the interests of big business – corrupt corporations, big pharma, the oil and coal barons; this is how their interests are, time and again, placed ahead of those of we, the people with the result that our environment and our bodies are polluted by the products of these corporations, be it poisons like aspartame and GMO crops in our food, toxins in our ground water (see Flint, MI) or just plain old exploitation of poor people such as the coal miners of West Virginia and Kentucky.
Scalia met with the Order of Saint Hubertus, the patron saint of million dollar dude ranch hunting. As of yet, no one has identified who was there, it seems that Supreme Court justices are found all the time with pillows over their faces and nobody asks a thing, but this was Texas and they make their own rules down there.
Scalia’s talk in Texas was said to have gone like this: “They have us, we are all going down unless we can give them what they want and they are holding all the cards, they have everything.” There was no negotiation with the White House, instead Scalia got, we are told and multiple sources confirm, a pillow over the face and a heroic funeral, one that President Obama refused to attend. Now we know why.
For a seated president to attend the funeral of a pedophile is unthinkable.

The computer itself belonged to a Stirling David Allen, arrested and charged with child rape and sodomy by the FBI after an investigation that began with a meeting in Rome, Italy. The FBI had known about Allen for some time, had wanted to arrest him since 2014 but had been blocked, they just didn’t know why or who was behind it, not until Justice Scalia died. Within 9 days, Allen was jailed, and the evidence he held began to yield gold.Allen is being held on these charges with bail set at $250,000.
We were shown an email from Allen where he tells of his January 15, 2016 meeting with Agent Ross at which time his computers were seized by the FBI. What we are told was on Allen’s computer and what Allen told agents is astounding. Allen confessed, we are told, not only to his own sex crimes but to being recruited by a powerful international organization that provided him broad protection from prosecution.

High level sources confirm that Supreme Court Justice Antonin Scalia was murdered, that in itself is neither an original claim nor beyond the realm of likelihood based on circumstances allegedly tied to his death. By that, we are speaking of the “pillow over the head” and allegations of a “cover-up autopsy,” well outside legal requirements for someone of Scalia’s position.

We became aware of the case in August 2015 when we were shown correspondence between Allen and representatives of the Keshe Foundation. Allen ran several popular websites on alternative energy and was a popular speaker, often appearing on the Coast to Coast radio show with Detroit native, George Noory.
Increasingly it became obvious that Allen had been using these venues for sexual trafficking of children. It wasn’t hard to figure out, he did it openly spoke of it constantly (as seen in the YouTube above) and lived as though he were above the law. Over the next few months, particularly when confronted by Iranian born physicist MT Keshe, who ordered Allen and those around him banned from all Keshe forums, Allen openly flaunted his criminal activities.
What made this particularly insidious is that it was obvious not only that Allen was not acting alone but that he had broad support not only in his home state of Utah, where he was able to avoid prosecution, but in Belgium as well. There, Allen and associates Hans Bracquene, Dirk Laureyssens and Ad Van den Elshout moved against the Keshe group, securing against Keshe’s wishes technologies with defense related applications and passing them on to MI 5 in Britain.
When Keshe moved against this group and tried to secure his patents, he found himself being chased down the highway, shots fired, his car run off the road. Police arrested and soon “misplaced” the culprits, and soon thereafter, representatives of Belgium’s “royals” told Keshe to leave Belgium or be buried there.
On the European end of the FBI investigation, the trail, all of which is easily followed by the “breadcrumbs” Stirling David Allen has left, leads to the highest and most powerful of the scientific communities where blackmail, kidnapping and torture, threats against families and in particular, threats against children, have placed members of secret societies in positions of power at universities, think tanks, police and counter-terrorism agencies and even the European Space

Just learning of this 'rumor' published to YT Apr 2nd. Host David Zublick apparently loves Scalia, 'great man' yada yada... meanwhile my first guess is Scalia was in the satan club with the rest of them. Host here claims some samples of Scalia's spinal fluid were taken, ocular fluid, and some third fluid I forgot now, but these fluids can still be analyzed.
