Reports: Trump campaign manager charged with battery

Donald Trump’s campaign manager was charged Tuesday with misdemeanor battery over allegations he grabbed the arm of then-Breitbart reporter Michelle Fields.

The incident occurred after a March 8 press conference at the Trump National Golf Club in Jupiter, Fla., where Corey Lewandowski was accused by Fields of grabbing her arm as she asked the Republican front-runner a question.

Lewandowski initially denied the incident had taken place, telling Fields over Twitter he had never even met her.
However, the Jupiter Police Department obtained video from the ball room that it says corroborates Field’s version of events, and subsequently charged Lewandowski.

In most states, battery is defined as intentional offensive or harmful touching of another person without their consent.
The Trump campaign issued a statement Tuesday calling Lewandowski “absolutely innocent.”

“Mr. Lewandowski was issued a notice to appear and was given a court date. He was not arrested. Mr. Lewandowski is absolutely innocent of this charge,” spokeswoman Hope Hicks said in a statement. “He will enter a plea of not guilty and looks forward to his day in court. He is completely confident that he will be exonerated.”

Fields resigned from her job at Breitbart shortly after the incident, claiming that the organization had not stood by her. Editor-at-large Ben Shapiro also stepped down over Breitbart’s handling of the alleged assault.

Just another scam to attack Trump.

There must be 10's of thousands of organized stop Trump people working Wisconsin over...TV, radio, news papers, paid disruptors for rallies. Can Trump overcome this massive attack?

I think Trump needs to pull out all the stops this week and expose these corrupt dirt bags in the republican party for what they are, power hungry opportunists that care nothing about this country or the people...they only want to keep their power.

He should also expose Heidi Cruz.
He could do that in a second person way, regarding the back and forth between slimy Ted, saying my wife Melania does not work for Goldman Sachs, she does not sit one the CFR board, she did not work for George Bush and Condi Rice, while Ted was a legal policy adviser to the Bush-Cheney campaign in 2000, then as part of the recount team in Florida. He was the Department of Justice coordinator for the Bush-Cheney transition team and then spent six months as Associate Deputy Attorney General at the DOJ. But his longest stretch of work for Bush was at the Federal Trade Commission, before he departed to become the Solicitor General of Texas.

Furthermore, no one has ever found Melania on the side of a freeway having a mental breakdown, which I suspect, could have been because of possible affairs Ted was having?

That being said...talk about being the ultimate 'establishment insider candidate'! Do the people really want more of the same corruption in government?

Battery

At common law, an intentional unpermitted act causing harmful or offensive contact with the "person" of another.

Battery is concerned with the right to have one's body left alone by others.
Battery is both a tort and a crime. Its essential element, harmful or offensive contact, is the same in both areas of the law. The main distinction between the two categories lies in the penalty imposed. A defendant sued for a tort is civilly liable to the plaintiff for damages. The punishment for criminal battery is a fine, imprisonment, or both. Usually battery is prosecuted as a crime only in cases involving serious harm to the victim.

Elements

The following elements must be proven to establish a case for battery: (1) an act by a defendant; (2) an intent to cause harmful or offensive contact on the part of the defendant; and (3) harmful or offensive contact to the plaintiff.

The Act The act must result in one of two forms of contact. Causing any physical harm or injury to the victim—such as a cut, a burn, or a bullet wound—could constitute battery, but actual injury is not required. Even though there is no apparent bruise following harmful contact, the defendant can still be guilty of battery; occurrence of a physical illness subsequent to the contact may also be actionable. The second type of contact that may constitute battery causes no actual physical harm but is, instead, offensive or insulting to the victim. Examples include spitting in someone's face or offensively touching someone against his or her will.

Touching the person of someone is defined as including not only contacts with the body, but also with anything closely connected with the body, such as clothing or an item carried in the person's hand. For example, a battery may be committed by intentionally knocking a hat off someone's head or knocking a glass out of some-one's hand.

Intent Although the contact must be intended, there is no requirement that the defendant intend to harm or injure the victim. In Tort Law (http://legal-dictionary.thefreedictionary.com/Tort+Law), the intent must be either specific intent—the contact was specifically intended—or general intent—the defendant was substantially certain that the act would cause the contact. The intent element is satisfied in Criminal Law (http://legal-dictionary.thefreedictionary.com/Criminal+Law) when the act is done with an intent to injure or with criminal negligence—failure to use care to avoid criminal consequences. The intent for criminal law is also present when the defendant's conduct is unlawful even though it does not amount to criminal negligence.

Intent is not negated if the aim of the contact was a joke. As with all torts, however, consent is a defense. Under certain circumstances consent to a battery is assumed. A person who walks in a crowded area impliedly consents to a degree of contact that is inevitable and reasonable. Consent may also be assumed if the parties had a prior relationship unless the victim gave the defendant a previous warning.

There is no requirement that the plaintiff be aware of a battery at the time it is committed. The gist of the action is the lack of consent to contact. It is no defense that the victim was sleeping or unconscious at the time.

Harmful or Offensive Conduct It is not necessary for the defendant's wrongful act to result in direct contact with the victim. It is sufficient if the act sets in motion a force that results in the contact. A defendant who whipped a horse on which a plaintiff was riding, causing the plaintiff to fall and be injured, was found guilty of battery. Provided all other elements of the offense are present, the offense may also be committed by causing the victim to harm himself. A defendant who fails to act when he or she has a duty to do so is guilty—as where a nurse fails to warn a blind patient that he is headed toward an open window, causing him to fall and injure himself.

Aggravated Battery

When a battery is committed with intent to do serious harm or murder, or when it is done with a dangerous weapon, it is described as aggravated. A weapon is considered dangerous whenever the purpose for using it is to cause death or serious harm. State statutes define aggravated battery in various ways—such as assault with intent to kill. Under such statutes, assault means both battery and assault. It is punishable as a felony in all states.
Punishment

In a civil action for tortious battery, the penalty is damages. A jury determines the amount to be awarded, which in most cases is based on the harm done to the plaintiff. Even though a plaintiff suffers no actual injury, nominal damages (a small sum) may still be awarded on the theory that there has been an invasion of a right. Criminal battery is punishable by a fine, imprisonment, or both. If it is considered aggravated the penalties are greater.

4. First. As a salutary mode of correction. For example: a parent may correct his child, a master his apprentice, a schoolmaster his scholar; 24 Edw. 11. Secondly. A battery may be justified in the exercise of an office. 1. A constable may freshly arrest one who, in, his view, has committed a breach of the peace, and carry him before a magistrate. But if an offence has been committed out of the constable's sight, he cannot arrest, unless it amounts to a felony; 1 Brownl. 198 or a felony is likely to ensue. Cro. Eliz. 375.
12. - 2. A justice of the peace may generally do all acts which a constable has authority to perform hence he may freshly arrest one who, in his view has broken the peace; or he may order a constable at the moment to take him up. Kielw. 41.
13. Thirdly. A battery may be justified under the process of a court of justice, or of a magistrate having competent jurisdiction. See 16 Mass. 450; 13 Mass. 342.
14. Fourthly. A battery may be justified in aid of an authority in law. Every person is empowered to restrain breaches of the peace, by virtue of the authority vested in him by the law.
15. Lastly. A battery may be justified as a necessary means of defence. 1. Against the plaintiffs assaults in the following instances: In defence of himself, his wife, 3 Salk. 46, his child, and his servant. Ow. 150; sed vide 1 Salk. 407. So, likewise, the wife may justify a battery in defending her husband; Ld. Raym. 62; the child its parent; 3 Salk. 46; and the servant his master. In these situations, the party need not wait until a blow has been given, for then he might come too late, and be disabled from warding off a second stroke, or from protecting the person assailed. Care, however, must be taken, that the battery do not exceed the bounds of necessary defence and protection; for it is only permitted as a means to avert an impending evil, which might otherwise overwhelm the party, and not as a punishment or retaliation for the injurious attempt. Str. 953. The degree of force necessary to repel an assault will naturally depend upon, and be proportioned to, the violence of the assailant; but with this limitation any degree is justifiable. Ld. 16. - 2. A battery may likewise be justified in the necessary defence of one's property; if the plaintiff is in the act of entering peaceably upon the defendant's land, or having entered, is discovered, not committing violence, a request to depart is necessary in the first instance; 2 Salk. 641; and if the plaintiff refuses, the defendant may then, and not till then, gently lay hands upon the plaintiff to remove him from the close and for this purpose may use, if necessary, any degree of force short of striking the plaintiff, as by thrusting him off. Donald Trump played fact checker at Tuesday's CNN Town Hall. He even brought notes.

The GOP frontrunner knew he would be asked about his embattled campaign manager Corey Lewandowski, who has been charged with simple battery of a reporter (http://www.cnn.com/2016/03/29/politics/trump-campaign-manager-charged-with-simple-battery/index.html?iid=EL), and he responded by offering a point-by-point rebuttal to the accusation.

Trump's display, which worked quite well for him, served to showcase how the reality television star's undaunted self-confidence and knack for stagecraft enable him to overcome the controversies that might threaten to ruin other candidates.

When CNN's Anderson Cooper asked Trump if Lewandowski would remain with his campaign, Trump was unequivocal: "Yes he will." A newly released security video of the incident "exonerates him totally," Trump said.

Lewandowski has been charged with simple battery of former Breitbart News reporter Michelle Fields, who claims that the campaign manager assaulted her after a press conference in Jupiter, Florida, earlier this month.

When Fields first made the accusation, Trump accused her of making it up. Lewandowski claimed that he'd never even met Fields, let alone touched her. The newly released video shows that Lewandowski did grab Fields arm -- which alone could qualify as simple batter in the State of Florida -- though she was not pulled to the ground.

But at Tuesday's Town Hall, it wasn't Trump who was forced to account for his false claim that Fields made up the incident. Rather, it was Fields who got fact-checked by Trump.

"When she found out that there was a security camera, and that they had her on tape, all of a sudden her story changed," Trump said of Fields claims.
When Cooper countered that Fields had claimed her story had remained exactly the same, Trump responded by pulling out notes with Fields' original tweet.

"Oh really? Can I read this to you then?" Trump said to applause. "Here's what she said... That's an exact quote from her prior to seeing the cameras, and now she says, 'Oh I better change my story, I guess.'"

Trump went on to challenge Fields' claims point-by-point: "'I was jolted backwards.' Well, she wasn't. She's standing there," Trump said.

"'Someone had grabbed me tightly by the arm and yanked me down.' She wasn't yanked down, she didn't have any expression... there's no emotion," he continued.

"'I almost fell to the ground.' She didn't almost fall to the ground... And by the way, she was grabbing me. Am I supposed to press charges against her?"

"'Nonetheless I was shaken. Campaign managers aren't supposed to forcefully throw reporters to the ground.' She didn't go to the ground, she didn't even have an expression on her face," Trump concluded.

Trump's fact-checking proved to be a clever tactic: Even Cooper was forced to acknowledge that Fields had not been dragged to the ground, and relatively little time was given to the false statements Trump and Lewandowski had made about Fields.

Trump wrapped up that effort by seeking to cast Lewandowski as the would-be victim, were Trump forced to fire him.

"It would be so easy for me to terminate this man, ruin his life, ruin his family ... and say you are fired. I have fired many people, especially on 'The Apprentice,'" Trump told Cooper. "The problem is everybody dumps people when there is a sign of political incorrectness."

Isn't it funny how so many of these hacks are quick to say he should fire a key guy to Trumps campaign, a personal friend that has a family...before all the facts are presented in a court case.

Cruz and Kasich both said they would have fired their personal friend and destroy him and his family on something so lame as this.
This really says a lot to me about someone's loyalty...that they have no loyalty to anyone but themselves. I have nothing to do with people like that!

Furthermore, it appears there is a law in Florida of no unwanted touching...even if it's in a crowded room. Trump should counter sue for her breaching security and touching him, if need be, before this cunt gets one penny out of this.

*New rules at rallies - everyone in a crowded room MUST remain at over an arms length so no unwanted touching can occur. That is the law!
Maybe seating should be moved to allow an arms length of distance too?

We might see a lot of new "unwanted touching" cases coming soon, if the courts rule against Mr. Lewandowsk.

An article published by the Palm Beach Post on Nov. 17, 2015, has been circulating since Tuesday evening because it lists Palm Beach County State Attorney Dave Aronberg as a member 150-member Florida Leadership Council, which was established by the Democratic Party to promote Hillary Clinton’s presidential candidacy.

The article states that Palm Beach County State Attorney Dave Aronberg and Tax Collector Anne Gannon “are also part of Clinton’s Florida team.”

Mike Cernovich, writing Tuesday in the blog DangerAndPlay.com, cited the Palm Beach Post article in arguing the charges against Lewandowski were politically motivated. He contended “there was no assault,” because reporter Michelle Fields “was heading towards Trump and was brushed away due to security concerns.”

Palm Beach County State Attorney Dave Aronberg’s office hasn’t yet weighed in on what it will do, Bob McGovern reported in the Boston Herald on Wednesday.

“That’s probably because this high-profile case will be tough to prove in court. In Florida, you have to show that Lewandowski ‘actually and intentionally’ touched Fields against her will.”

McGovern wrote that the “ball is in Aronberg’s court now.”

“And even though he’s a well-known Hillary Clinton supporter, those who know Aronberg’s office say there is little reason to believe he’ll try to score political points by throwing the book at Lewandowski.”

The official website for the Office of State Attorney for the 15th Judicial Circuit in Palm Beach County, Florida notes Aronberg, elected state attorney for the 15th Judicial Circuit in November 2012, is a former assistant attorney general, a White House fellow in 2000 and a Florida state senator.

“Dave Aronberg was born in Miami,” the Palm Beach County website continues. “He attended public schools before going on to graduate with honors from Harvard College and Harvard Law School. After graduation, he worked in the litigation department of a large South Florida law firm while also working closely with then-Insurance Commissioner Bill Nelson to investigate European insurance companies that refused to honor World War II-era policies sold to victims of the Holocaust.

“In 2010, Aronberg returned to the Florida Attorney General’s Office as a special prosecutor for prescription drug trafficking,” the website continues. “In his role as the Attorney General’s ‘Drug Czar,’ Aronberg led an anti-pill mill initiative that helped clean up the pain clinic industry and reduced the record number of people dying each day from oxycodone abuse.”

A Newsmax TV interview April 7, 2015, pitted Aronberg against Sid Dinerstein, chairman of the Republican Party of Florida, regarding how the antagonism between President Obama and Prime Minister Benjamin Netanyahu would impact Florida voters.

Former Breitbart reporter Michelle Fields filed assault charges against Lewandowski this week, alleging the campaign manager roughed her to the point of bruising her arm. She claims video of the incident proves she was wrongfully handled.

Trump, meanwhile, has defended Lewandowski, saying the video actually clears his campaign manager of wrongdoing. The candidate suggests Fields is using Florida law – which defines battery as just about any type of unwanted physical contact – for a political or personal agenda.

In a tweet, Trump wrote, as WND previously reported: “Wow, Corey Lewandowski, my campaign manager and a very decent man, was just charged with assaulting a reporter. Look at tapes – nothing there!”

One unnamed Secret Service agent, meanwhile, has given a different version of events, saying in a statement to the London Daily Mail that Fields “crossed in between agents and our protectee after being told not to,” and touched Trump first, WND reported.

Tonight on "Kelly File," one of the letter's signees, Katie Pavlich, said the response wasn't just about the incident, but about how the Trump campaign responded to Fields afterwards.

"We saw libel, defamation, slander, smearing of her reputation, simply for trying to do her job," she said. "This isn't just about simply one reporter. It's a bigger issue of the role of the press in America."

Pavlich said that Fields' character was smeared simply for exercising her First Amendment rights and doing her job.
Sarah Huckabee Sanders, a senior advisor for the Trump campaign, said that the real disagreement comes from the fact that nothing out of the ordinary took place at the event.

Megyn Kelly challenged Sanders on that assertion, saying that it's not common for a campaign manager to cause bruises, and then pressed her to explain how the Trump campaign did not use "intimidation" in the aftermath.

Sanders said that she thought the intimidation was going "both ways" and that Fields was also trying to pressure and intimidate the Trump campaign into admitting something was not true.

I can't see how this is hurting Trump at all. They are pushing an obvious fraudulent story on someone who won't take this shit. I really can't see any downside to Trump on this overall, short or long term, in public opinion...

Trump is hurt this week because of statements he's made on abortion, government, nuclear, his campaign manager and because there's the biggest barrage of attacks by the corrupt RNC and their billionaire friends, the liberal media, liberal Fox News and Bernie and Hillary. Everything is covered to take Trump down.

I have lost faith Trump will win the nomination. Corruption will win.

The question, what can the people do, other then voicing their opinion and not voting ever again?

Once Trump knows the fix has won and he is finished, I hope he uses what's left of his campaign to expose as many corrupt people in the party and government as he can.
He should also make statements to his followers, that the system, the government and Fox news care nothing about this country and the people. They only care about people in power and those who pay their handsome salaries.

A local experience;

I had to get two tires mounted and balanced yesterday. While I was sitting in the office waiting for the car to get finished, CNN was on and they were running this story. I was sitting there with another customer (male in his late 60s), the girl behind the desk (white, early 30s) and a mechanic checking service manuals on the computer (white male, early 30s). When Wolf Blitzer was parroting the usual talking points I noticed the girl's face - noticed an eye roll. I said "can you believe this nonsense, looks like another baseless hit piece against Trump. She responded, can it be any more obvious? The other customer said he thought she just wanted her 15 minutes of fame and the mechanic said that this whole story was just stupid.
From what i can tell, CNN is just showing itself for what it is - a propaganda / joke of a news network. No one is buying their lies and and this effort to discredit Trump and his staff is backfiring on all involved.

At this point, there's still hope...

NEW YORK – Donald Trump’s suggestion in an interview Wednesday that former Breitbart News reporter Michelle Fields pressed battery charges against his campaign manager, Corey Lewandowski, because “she likes it,” echoed his campaign’s initial suggestion that Fields had a history of such allegations against public figures.



Two days after the March 8 incident, Trump campaign spokeswoman Hope Hicks said Fields’ accusation that Lewandowski “grabbed [her] tightly by the arm and yanked [her] down” was “entirely false” and that the staff had “no knowledge” of any confrontation.

“We leave it to others whether this (is) part of a larger pattern of exaggerating incidents, but on multiple occasions she has become part of the news story as opposed to reporting it,” Hicks said March 10. “Recall she also claimed to have been beaten by a New York City police officer with a baton.”

In an interview with NBC’s “Today” show Wednesday, Trump said he believes that even if Lewandowski had apologized to Fields, she would have gone ahead and filed battery charges.

“I think she would have pressed charges anyway, because I think she likes it,” Trump said.

Fields did not respond to WND requests for comment.

The March 8 incident at the Trump National Golf Course in Jupiter, Florida, after a press conference was captured in a video released Tuesday by the city’s police department. It shows Lewandowski reaching for Fields as she moves toward Trump then standing next to the candidate with a pen and phone.

Lewandowski, who plans to plead not guilty, turned himself in to Jupiter police on Tuesday morning and will appear May 4 in Palm Beach County Circuit Court on a misdemeanor battery charge.

In a column published March 10 by Breitbart, Fields said she approached Trump after the news conference to ask him a question.

“Trump acknowledged the question, but before he could answer I was jolted backwards,” Fields said. “Someone had grabbed me tightly by the arm and yanked me down. I almost fell to the ground, but was able to maintain my balance. Nonetheless, I was shaken.”

Trump has argued, however, that the overhead CCTV footage his staff gave to the police department doesn’t show her being yanked down and nearly falling to the ground.

Accused NYPD of assault

The New York City incident referenced by the Trump campaign took place in November 2011 when Fields, then a Daily Caller reporter, claimed she and videographer Direna Cousins “were struck” by NYPD officers as the police tried to clear the street of Occupy Wall Street protesters.

Daily Caller opinion editor J. Arthur Bloom quoted Fields saying: “The police officers were beating the protesters with batons, and were also beating the media. They hit Direna and me with batons. They hit other members of the press in order to get them to move out of the street.”

Bloom wrote that while Fields and Cousins were struck by the NYPD, “neither sustained injuries that required hospitalization.”

Fields said Cousins “had a camera in her hand and I had a microphone, and we were being hit.”

“When I fell to the ground I said at one point, ‘I’m just covering this! I’m covering this!’ And the officer just said, ‘Come on, get up, get up,’ before pulling me up by my jacket.'”

Bloom wrote that “in the crush of the crowd,” Fields and Cousins were unable to get off the street to comply with the NYPD orders, adding that “clear indications” that they were members of the press did not stop what he characterized as “the NYPD beating.”

“The protesters came up to me right away and asked if I needed any medical assistance. They were actually very kind and helpful. It was the police officers who were very aggressive,” Fields added.

In an interview with C-SPAN’s Brian Lamb after the Occupy Wall Street incident, Fields maintained the NYPD were the aggressors, while she found the Occupy protestors to be “quite kind.”

There is no evidence she ever filed a police report.

On March 10, after the Trump incident, Fields’ friend Jamie Weinstein tweeted a photograph of her with the description: “Michelle getting pushed down by police during the Occupy Wall Street protests. Trump campaign serial liars.”

Accused Allen West

In March 2015, Charles C. Johnson at GotNews.com reported that Fields accused former U.S. congressman Allen West of groping her in front of an elevator while they were colleagues at PJ Media.

But Johnson said that after making the accusation, Fields “repeatedly and emphatically refused comment on the record and asked that I change her earlier confirmation which I have now done.”

On March 10, Lewandowski posted a tweet drawing attention to the GotNews.com report, commenting that Fields “is an attention seeker who once claimed Allen West Groped her but later went silent.”

West joined PJ Media’s Next Generation in TV January 2013 to host a Web show with Fields and Los Angeles radio host John Phillips.

West could not be reached by WND for comment.

As a PJTV reporter, Fields “confronted” actor Leonardo DiCaprio about his lifestyle during a climate-change protest in New York City, and when DiCaprio refused to answer, Fields “was quickly pushed out of the way by a minder,” the Daily Mail in London reported in May 2014.

A PJTV video of the incident archived on YouTube shows Fields persisting in aggressive questioning even after it was apparent DiCaprio had no interest in responding.

In an email to WND, Chicago-based reporter William J. Kelly commented that in Chicago, “what happened during the Lewandowski video would have been called ‘being nice.'”

Kelly writes for the American Spectator and has a monthly column on Newsmax.com.

Laura Grock, Kelly’s publicist, told WND that in Kelly’s reporting of Chicago Mayor Rahm Emanuel, formerly President Obama’s White House chief of staff, “a politician’s staff and security are routinely rough, never fail to make contact and regularly shove, push, hold people up against walls and trip reporters – even those who have never made any physical contact with the politician – a much different case than what happened with Mr. Lewandowski.”

To make the point, Grock forwarded to WND two videos.

In the first example, Emanuel’s staff shoved Kelly out of the way after the mayor didn’t want to answer questions.

There has much ado made about an incident that transpired several weeks ago in which billionaire businessman Donald Trump’s campaign manager Corey Lewandowski was alleged to have grabbed now-former Breitbart reporter Michelle Fields after a Florida news conference.

The ongoing saga involving countless hours of in-depth analysis of multiple videos and still frames from various angles has finally resulted in a criminal battery charge (http://conservativetribune.com/campaign-battery-charge-trump/) being filed against Lewandowski.

After the charge was announced, Trump declared, “I’m not going to let a person’s life be destroyed over somebody that we have on tape. And you just take a look at what people are saying when they see that incident on tape. And no jury, in my opinion, no jury would convict a man and destroy a man over what you had here.”

It would seem that Trump is not alone in his assessment of the merits of the case, as noted legal expert and Fox News host Greta Van Susteren (http://conservativetribune.com/over-30000-people-just-liked/), along with her two legal analyst guests, reached a similar conclusion.

The general consensus was that they would all find it highly difficult to actually win this case in court, and that there were likely political motivations (http://conservativetribune.com/lewandowski-prosecutors-secret/) behind the filing of the charge.

“In my wildest dreams I don’t see how a jury ever convicts on this with all the ambiguity,” Van Susteren stated.

“In fact, it looks like two Secret Service who were protecting Donald Trump are reaching for her,” she continued. “I don’t know whether or not that is what is provoking the bruises or not. That’s the problem. Here’s your reasonable doubt right there.”

Van Susteren makes a valid point in bringing up the issue of “reasonable doubt,” as in all of the aforementioned hours of scouring the various videos and still frames, though contact was certainly possible, not a single shot has appeared that conclusively shows Lewandowski’s hand on Fields’ arm.

It would be nice if the media would simply make a report on the matter and then move along to the more serious issues at hand, such as protecting the country, strengthening the economy, and undoing the destructive agenda that has been foisted upon us over the past eight years.
