The former State Department IT specialist who set up Hillary Clinton’s private server ignored a subpoena to appear Tuesday before a House committee hearing, while other tech experts who helped maintain the system asserted their Fifth Amendment right not to testify – frustrating Republican lawmakers trying to dig deeper into the former secretary of state’s email setup.

House oversight committee Chairman Jason Chaffetz, R-Utah, said he’ll now consider a “full range of options” to address IT aide Bryan Pagliano’s “failure” to attend.

“He should be here. … It is not optional,” Chaffetz said. “His attendance is required here.”

Pagliano is considered a vital witness in the Clinton email case. He spoke previously to the FBI under immunity, telling the bureau there were no successful security breaches of the server. Pagliano also refused to answer questions last year before a House panel investigating the deadly 2012 attacks in Benghazi, Libya. His lawyers said at the time that Pagliano did not want to relinquish his rights under the U.S. Constitution's Fifth Amendment against self-incrimination.

Republicans on Tuesday questioned why Pagliano would avoid the latest hearing if he had immunity, though Democrats pushed back. According to Rep. Elijah Cummings, D-Md., Pagliano’s lawyer said the request was an “abuse of process.”

Two other officials from Platte River Networks, Bill Thornton and Paul Combetta, did comply with subpoenas to appear. However, when it came time to answer questions, they pleaded the Fifth. The Denver-based technology company maintained Clinton’s server when it was moved from her Chappaqua, New York, home to a data center in northern New Jersey.

Combetta took the Fifth six times and Thornton took the Fifth four times, before both witnesses were excused.

After each question, they recited a variation of the line: “On the advice of counsel, I respectfully decline to answer and assert my Fifth Amendment constitutional privilege.”

Cummings said he could “understand” why they were not addressing questions.

But Chaffetz voiced frustration when Thornton declined to even answer whether he’d been questioned by the FBI. GOP lawmakers have wanted to question tech officials on the deletion of email records and other alleged attempts to destroy devices.

Chaffetz also said there will be consequences for Pagliano's refusal to appear and for "thumbing his nose at Congress." He didn't specify what the penalties would be but said, "We're not letting go of this."

A letter from Pagliano's attorney released by the committee says Pagliano will continue to assert his constitutional right not to testify.

The only witness remaining after the unfruitful initial questioning was Bill Clinton aide Justin Cooper, who answered lawmakers’ questions.

During that process, he confirmed that he had access to the Clinton server but did not hold a security clearance.

The email issue has shadowed Clinton's candidacy, and Republicans have been steadfast in focusing on her use of a private server for government business, with several high-profile hearings leading up to the election. Democrats insist the sole purpose of the hearings is to undermine Clinton's bid for the presidency.

Chaffetz on Monday escalated the GOP's battle with the FBI after its decision in July not to recommend criminal charges against Clinton for her use of the private email system by serving a top FBI official with a subpoena for the full case file. Chaffetz and other Republicans on the panel said the bureau has withheld summaries of interviews with witnesses and unnecessarily blacked out material from documents sent last month.

“We are entitled to the full file," he said.

Dismissing the "emergency" hearing held late on a Monday, Cummings said: "As far as I can tell, the only `emergency' is that the election is less than two months away."

Chaffetz issued the subpoena to Jason Herring, the acting assistant FBI director for congressional affairs. Herring and six other Obama administration officials appeared before the committee to discuss the investigative files. The witnesses on several occasions said they could not answer the questions from lawmakers in an open forum.

WASHINGTON (AP) — President Barack Obama will hit the campaign trail Tuesday to rally support for Democratic presidential nominee Hillary Clinton in Pennsylvania, a state that has served as a firewall for her party in the past six general elections but is now viewed as competitive.
Obama is scheduled to appear without the candidate herself. Clinton was scheduled to make a fundraising swing to California, but will take a couple of days off from the campaign trail after being diagnosed with pneumonia.

Obama will seek to generate momentum for Clinton in a race that has become uncomfortably close for many Democratic supporters. The latest poll by Quinnipiac University found her with a 5 percentage point edge over Republican Donald Trump in Pennsylvania. Obama will speak at a plaza in front of the Philadelphia Museum of Art. He'll also attend a fundraiser for the Democratic National Committee in Philadelphia and then fly to New York City for a Democratic Congressional Campaign Committee fundraiser.

As Obama flew to Philadelphia, the White House said he'd both make the case for Clinton and reiterate his view of why Trump is unfit for the Oval Office.

The candidate Obama hopes will succeed him left a 9/11 ceremony after about 90 minutes Sunday and struggled to stay on her feet while she was helped into a van. Her campaign said she had "overheated," but later revealed that she had been diagnosed Friday with pneumonia. The episode played into Trump's efforts in recent weeks to raise doubts about Clinton's stamina.

A powerful Republican lawmaker abruptly stopped a hearing Monday on Capitol Hill to serve a subpoena demanding the FBI’s full investigative file on the Hillary Clinton email probe to a top official, telling the man “you are hereby served.”

The dramatic moment came as House Oversight Committee Chairman Jason Chaffetz, R-Utah, expressed frustration that the FBI would not guarantee to provide the committee with the full, unedited, unredacted investigative summaries of the federal inquiry into Clinton’s homebrewed server and the Democratic presidential nominee’s potential mishandling of classified information.

“That’s the way a banana republic acts, not the way the United States of America acts,” Chaffetz told FBI acting legislative affairs chief Jason Herring. “I don’t expect to have to issue a subpoena to see unclassified information.”

The FBI could fight the subpoena, though analysts say a resolution could come quickly.

“There are judges sitting in an emergent capacity for applications like this,” Judge Andrew Napolitano said on “Fox & Friends” on Tuesday. “I wouldn’t be surprised if it’s resolved by the end of this week.”

Chaffetz and other Republicans on the panel say the FBI has withheld summaries of interviews with witnesses and unnecessarily blacked out material from documents sent last month.

“We decide what's relevant -- not the Department of Justice, not the FBI,” Chaffetz said. “We are entitled to the full file.”
Democrats on the panel dismissed Chaffetz’s theatrics at the emergency hearing and insisted the sole purpose of the hearing was to undermine Clinton's presidential bid.

“As far as I can tell, the only ‘emergency’ is that the election is less than two months away,” Rep. Elijah Cummings, D-Md., said.

Witnesses at the hearing on several occasions said they could not answer the questions from lawmakers in an open forum and the committee later voted to hold the remainder of the hearing in closed session.

FBI Director James Comey last week defended the decision to forgo criminal charges against Clinton after a lengthy probe into whether then-Secretary of State Clinton mishandled classified information that flowed through the private email system located in her New York home. Comey told bureau employees in an internal memo that it wasn't a close call.

Republicans have assailed Comey's ruling and demanded that the Justice Department open a new investigation into whether Clinton lied during testimony last year before the House panel investigating the deadly 2012 attacks in Benghazi.

The FBI provided portions of the Clinton probe file to Congress last month and warned lawmakers that the documents "contain classified and other sensitive material" and are not to be made public. But Republicans have said the documents "did not constitute a complete investigative file," as many of the records had been substantially blacked out or were missing altogether.

“So here’s what we have heard from people who have seen this stuff: that the FBI is attempting to create a false impression of what they want us to think they found by selectively releasing all information,” Napolitano said on “Fox & Friends.” “If all of it had been released, people could form their own opinions about the wisdom and lawfulness of the FBI’s decision not to prosecute Mrs. Clinton.”

Paul Combetta, an IT specialist who helped Hillary Clinton wipe her server clean of evidence requested from federal authorities, took to online forums to find advice on how to commit the crime.
Combetta cited his Fifth Amendment rights in refusing to answer questions before a congressional committee last week, but was pretty talkative when trying to find out information from fellow IT experts on how to forge Clinton’s e-mails.


Under a posting on 8chan titled (https://8ch.net/pol/res/7541894.html) “Here is clear proof that Hillary sought to destroy evidence,” Combetta can be seen posting under a username he uses multiple times across multiple platforms, ‘stonetear.’

In a screenshot of the discussion, Combetta (or stonetear) can be seen telling others “I need to strip out a VIP’s (VERY VIP) email address from a bunch of archived emails.”
Presumably, that VIP would be Secretary of State Clinton. Continued at link

Hmmm... He was given immunity for testifying, now he refuses to testify. Hillary is off the hook (for now). I say prosecute his ass, what he did was clearly illegal, and he probably will sing if he faces some years in prison...

Most probably! He should realize though that he is least likely to end up on it if he is in solitary confinement vs being in freedom walking and talking, not saying the Clintons couldn't kill him in prison too, but it is probably less likely, especially if Trump is president, which would be the likely outcome if this guy sings...

Poor guy actually, he probably wishes he never met the Clintons...
