Update: After this story was published, NYC Department of Consumer Affairs wrote back to Gothamist to explain that there's no legal issue with the Thompson Chemist promotion, as there isn't a prohibition on price discrimination for goods. It is illegal, however, to discriminate in the pricing of services.

NYC Department of Consumer Affairs wrote back to Gothamist to explain that there's no legal issue with the Thompson Chemist promotion, as there isn't a prohibition on price discrimination for goodsWow, this could be used in so many different ways. I hope someone sets up similar price discrimination for a non-PC reason (i.e. Jews are subject to a special Jew tax), ha ha.

Better, shop elsewhere.I agree. I just wouldn't patronize that shop. Yet, I support her right to levy any tax she chooses on whatever basis. In a true free market, it's her enterprise to nurture or destroy. Let her manage it her way. In time, the market will instruct her on the economic impact of her decision.

In a normal world, this is true. However, on craigslist, if you sell the same type of dildo more than once, it becomes a service. This makes perfect sense to the craigslist moderators who obviously are economic nit wits.
