Federal Judge Halts Enforcement of Trump's Travel Ban Nationwide

A federal judge in Seattle brought the Trump administration’s executive order on immigration to a halt nationwide Friday, issuing a temporary restraining order (http://www.foxnews.com/politics/2017/02/03/federal-judge-in-seattle-temporarily-halts-trump-s-immigration-order-nationwide.html) in U.S. District Court until further hearings can be held.

The hearing came about after the Attorneys General of Washington and Minnesota filed a lawsuit seeking to halt President Donald Trump’s executive order that restricted immigration to the United States from seven countries.

Washington Gov. Jay Inslee (D), who supports the lawsuit, called in to "Tucker Carlson Tonight" and explained that U.S. District Judge James Robart determined there was a high probability that Trump's executive order was illegal and unconstitutional.

Inslee argued that the order is essentially a disguised "Muslim ban."

He explained that the order says that religious minorities in seven Muslim-majority countries - Iraq, Syria, Sudan, Iran, Somalia, Libya and Yemen - will have priority in being accepted as refugees in the U.S.

Inslee said that means that non-Muslims will be given highly sought after refugee spots ahead of Muslims, which essentially amounts to a "religious test."

"This executive order contains an unconstitutional test of what religion is affected and how they are affected," Inslee said. "And it differentiates in a clear intent by this president to not treat this part of the world with respect, and it damages our national security."

Washington (CNN)BREAKING NEWS: The White House called Friday night's court order temporarily halting President Donald Trump's executive order on immigration "outrageous," saying the Justice Department will file an emergency request to stop it.

"At the earliest possible time, the Department of Justice intends to file an emergency stay of this outrageous order and defend the executive order of the President, which we believe is lawful and appropriate. The president's order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people," White House press secretary Sean Spicer said in a statement.

He continued: "As the law states, 'Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or non-immigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.' "

The White House immediately released another statement that had the same wording but removed the word "outrageous."
ORIGINAL STORY: A federal judge temporarily halted President Donald Trump's immigration executive order effective nationwide Friday, a significant setback for the controversial travel ban.

Federal Judge James Robart, who presides in Washington state and was appointed by former President George W. Bush, orally granted the temporary restraining order. A written order was issued later in the evening, and Customs and Border Protection alerted airlines it would begin reinstating visas quickly.

"The court concludes that the circumstances brought before it today are such that it must intervene to fulfill its constitutional role in our tripartite government," Robart wrote in the order.

Trump's executive order that he signed last week suspended immigration from seven Muslim-majority countries for 90 days, the US refugee program for 120 days and indefinitely halted Syrian refugees from entering the US.

"This is exactly what we were looking for," Washington Attorney General Bob Ferguson told CNN's Anderson Cooper shortly after Robart's order, adding that "we have a bucket of Constitutional claims."

"It's Keystone Cops, the way that thing (the order) was put together," added Ferguson, who said he was prepared to take his case all the way to the Supreme Court if necessary.

This suit was brought by the states of Washington and Minnesota against the travel ban enacted by Trump's executive order.

A Customs and Border Protection spokesman told CNN the agency will review the order and comply with all court orders. Asked for response, a Justice Department spokesperson would only say, "The department looks forward to reviewing the court's written order and will determine next steps."

The State Department is working with the Department of Homeland Security to determine the effect of the stay, a State Department official said.

Senate Minority Leader Chuck Schumer immediately hailed Robart's order.

"This ruling is a victory for the Constitution and for all of us who believe this un-American executive order will not make us safer," Schumer said in a statement. "President Trump should heed this ruling and he ought to back off and repeal the executive order once and for all."

Earlier Friday, a federal judge in Boston declined to renew a temporary restraining order affecting Massachusetts that prohibited the detention or removal of foreign travelers legally authorized to come to the US.
Visa complications

The seven affected Muslim-majority countries are Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen.

CBP told major US airlines Friday night that the government is reinstating visas and is "back to business as usual" prior to the situation that was in place before last week's executive order, an airline executive told CNN. Airlines are expected as soon as Friday night to start removing travel alerts from their websites and getting messages out to customers to alert them about the change.

It is possible there will be more court activity and an appeal before anyone could act on getting a visa, and it's unclear how long it would take to obtain one.

US airlines use an automated system connected to the CBP database to scan passports and visas to get an instant determination if the passenger can board or not. Unless the government reinstates visas and the airlines get a "board" status, the airlines still will not allow such passengers to board.

“The Constitution prevailed today,” Washington Attorney General Bob Ferguson said after the ruling. “No one is above the law — not even the president.”

"I'll tell you where there's been confusion - the President's executive order," Ferguson said. "That's what's caused confusion. I'm sorry, but there's no other way to put it - it's been Keystone Cops. It really is. That's not just me speaking, that's Republican members of Congress."

U.S. District Court Judge James L. Robart, a Seattle native who is an appointee of President George W. Bush, said the state of Washington proved that local economy and citizens have suffered irreparable harm and an injunction should be applied.

"What the judge ruled today is that the president's executive order does not apply -- does not apply," Ferguson said after the hearing.

"I'm sure the president won't like this decision, but it's his obligation to honor the law and I'll make sure he does," Ferguson told reporters.

Robart is no stranger to high-profile cases - he is also the federal judge in charge of overseeing the reform of the Seattle Police Department.

Executive Orders typically leave themselves open to judicial attack, almost as if they are bait and designed that way.

If he wanted to act he might have the power to declare military martial law at any International entry points/airports.

If Trump backs down on this, it will seal his fate.

He needs to hold fast, no matter what the Ninth Circus Court of Appeals "rules" on this. His EO is 100% lawful per the Constitution and the United States Code. Any "judge" that tries to override it commits treason.

I hear the invaders are preparing to flood back in. Trump must issue orders to DHS to quarantine them upon arrival.

My guess is that something more important comes up within the next 90 days for the admin. and this is swept under the carpet. As any method to "vet" has no chance for improvement. Or some other congressional action is approved that prohibits or requires more immigration papers and docs.

Unnecessary. Current USC - 8 USC 1182 - already gives the President complete authority on this matter, and this "judge" knows it:

News 2 in Hawaii reported (http://khon2.com/2017/03/13/former-president-obama-makes-unannounced-visit-to-oahu/) that Obama played golf on Tuesday, then took a 40 minute drive to eat at Noi Thai Restaurant on the other side of the island. Obama reportedly ate with “friends” in a private room.
But check this out: Judge Derrick Watson, Obama’s Harvard classmate and the Judge who blocked Trump’s order, lives just 5 minutes from that restaurant!

Are we supposed to be all surprised at this? Are we expected to be shocked that the other side is no longer trying to hide their goings on? They already are mentally in a civil war. Their heads are already thinking about strategy and tactics. We, on the other hand are reading articles like this and asking ourselves "When are they going to stop this?" Well, define 'they'? 'They' aren't going to stop anything. 'They' either have too much to lose, not enough to gain or are simply cowards. 'They' are playing a game with the rest of us, running interference, while the left is fighting a war against us!!
