Lawmakers file bill making some drivers immune to civil liability if protesters injured

A Tennessee Senator has filed legislation which would make the driver of a vehicle immune to civil liability if they hit a protester.
SB944 (http://www.capitol.tn.gov/Bills/110/Bill/SB0944.pdf) was filed by Sen. Bill Ketron (http://www.capitol.tn.gov/senate/members/s13.html) (R-Murfreesboro) on Thursday in the Senate. In the House, Rep. Matthew Hill (http://www.capitol.tn.gov/house/members/H7.html)filed the same legislation as sponsor.
The bill states: "A person driving an automobile who is exercising due care and injures another person who is participating in a protest or demonstration and is blocking traffic in a public right-of-way is immune from civil liability for such injury."
The bill then adds: "a person shall not be immune from civil liability if the actions leading to the injury were willful or wanton."
Ketron and Hill provided the following statement regarding the bill:
"I think it's a little bit ridiculous, is my initial reaction," said local resident Joanne Wesner.
If passed, the bill would take effect July,1 2017.

Witnesses said the car drove through a line of safety workers in orange vests near West End and Murphy Road. MNPD said the driver of the car is a 68-year-old man.
The driver told police the protesters blocked him and hit his car. He said while he was driving through them, the protesters jumped on the hood of his car. Protesters said the driver hit the subjects.

If you're a wholesome mother of young kids trying to get your children to soccer practice on time, cruising the highway at 75+ mph, and unbeknownst to you, some protestor with a sign runs into the left lane of the highway, and you ram them with your minivan, turning them into pizza toppings, hell yeah it's their fault and you shouldn't be charged!! I support this bill!

NO It says:
a) A person driving an automobile who is exercising due care and injures another person who is participating in a protest or demonstration and is blocking traffic in a public right of way is immune from civil liability for such injury.
(b) A person shall not be immune from civil liability if the actions leading to the injury were willful or wanton.

has the bill passed? article doesnt say that. there are all kinds of crazy state bills that are pure posturing, with zero chance of passing

NO It says:
a) A person driving an automobile who is exercising due care and injures another person who is participating in a protest or demonstration and is blocking traffic in a public right of way is immune from civil liability for such injury.
(b) A person shall not be immune from civil liability if the actions leading to the injury were willful or wanton.
It really is a great bill. I think Trump should make an executive order to pass this as a federal law. I really like the vagueness of "exercising due care". I thought about swerving, or even hitting the brakes...but others could be harmed...so "due care" I plowed into the protestor who jumped in front of my truck.

The only thing missing from this bill that needs to be addressed, is whether you have to stop after hitting a protester. I think stopping puts you in significant risk. They need to add that you have 2 hours afterwards to call in the accident. That gives you time after you hit the protestor to get home safe, eat a meal, hug your family, whatever.

What is ridiculous is the idea that detaining people on the public streets and highways, forcing them to hear your "message," is, somehow, legitimate protest.
I'm sorry: you willfully wander onto a public street or highway, all liability for your well-being shifts to you. This legislation needs to be national, to protect the actual victims (drivers) from the shysters working for the "protestors."

If you hit one of these scumbags, drive to a safe distance, and call 9-1-1. "I was afraid for my life." If the cops want to interview you, tell them you will drive to their station, and you expect armed staff to come out when you arrive.
Unfortunately I've been hanging out in Oakland a bit too much...but this is good advise. You don't stop and "try to help". Get safe, and call it in.
