Sessions signals immigration crackdown: 'This is the Trump era'
The attorney general wants the Justice Department to make immigration enforcement a priority.

Attorney General Jeff Sessions sent a warning Tuesday to people who break the nation’s immigration laws: If you cross the border illegally, you risk prosecution under the full force of the law.

Speaking from a border port of entry in Nogales, Arizona, Sessions used stark language to announce measures the Justice Department will take to deter illegal immigration, including vigorous enforcement of human smuggling and identity fraud laws.

“For those that continue to seek improper and illegal entry into this country, be forewarned,” Sessions said in remarks prepared for delivery. “This is a new era. This is the Trump era.”

He continued: “The lawlessness, the abdication of the duty to enforce our immigration laws, and the catch and release practices of old are over.”

A memo Sessions issued Tuesday calls for federal attorneys to consider prosecution of anyone who harbors undocumented immigrants, with a priority given to violent cases or those that involve transporting or shielding three or more undocumented immigrants. Sessions also instructed the Justice Department to pursue felony charges when applicable for immigrants who try to enter the U.S. illegally on multiple occasions.

In a policy move that could have broad implications, the attorney general asked prosecutors to consider charges for identity fraud and document theft “to the extent practicable.” The department’s attorneys also should consider felony prosecutions in cases of fraudulent marriages to obtain legal immigration status, the memo said.

The border trip and call for stiffer immigration enforcement come as the Trump administration struggles to carry out his campaign promises in the first 100 days in office. Major initiatives have floundered: an attempt at health care reform fell flat amid a lack of support from Republicans, and the administration’s ties to Russia continue to dog the president and his advisers.

On immigration, one of Trump's signature campaign issues, a travel ban that targets six majority-Muslim nations and suspends the refugee resettlement program largely remains frozen by litigation in federal courts from Hawaii to Virginia. And even as Sessions announced an immigration crackdown from the border, Trump's campaign promise of a “big, beautiful” wall appeared to be on the verge of collapse.

In March, the administration asked Congress to help kick-start construction with $1.4 billion in a must-pass spending bill due by April 28, but House Speaker Paul Ryan has signaled he won’t deal with additional border spending until next year. Democrats view the border wall as a “poison pill” that would kill their support for the legislation and trigger a government shutdown.

Sessions’ trip to the border Tuesday brings the focus back to immigration, even if the border wall remains more rhetoric than reality. In his Nogales speech, Sessions stressed the dangers of criminal gangs, whose members “turn cities and suburbs into warzones,” “rape and kill innocent citizens” and — perhaps most relevant to his message — profit from the trafficking of people across the border.

“Depravity and violence are their calling cards, including brutal machete attacks and beheadings,” he said. “It is here, on this sliver of land, where we first take our stand against this filth.”

Sessions avoided mention of the torrent of Central American unaccompanied children and families who have arrived at the southern border in recent years, fleeing gangs and poverty in their homelands. Instead, he highlighted U.S. Customs and Border Protection personnel, who he said risk their lives to regulate immigration, and local ranchers who “work the land to make an honest living.” As part of the motivation for his immigration push, Sessions referenced Kate Steinle and Grant Ronnebeck, both of whom are believed to have been killed by undocumented immigrants.

The attorney general also announced that he would streamline procedures for hiring new immigration judges to better process cases at the border. In addition to the intensified enforcement actions announced Tuesday, Trump has mandated the detention of immigration violators arrested at the border, which could place a further strain on already overburdened immigration courts, which fall under the purview of the Justice Department.

Sessions said 25 judges had already been sent to detention centers along the border. He said 50 more judges would be “on the bench” this year, a figure that matches the number of judges already in the hiring pipeline. Next year, he said the courts would add 75 judges, the same number requested in Trump’s budget blueprint for fiscal year 2018, at a cost of $80 million.

Sessions said the new hiring plan “requires just as much vetting as before, but reduces the timeline, reflecting the dire need to reduce the backlogs in our immigration courts.”

As part of the Justice Department’s approach to border enforcement, the attorney general said each federal district should designate a “border security coordinator” no later than April 18. The coordinators will oversee the investigation and prosecution of the immigration-related offenses outlined in the memo released Tuesday, as well as collaborate and share information with agencies within the Homeland Security Department.

Cabins that rent for $339/night. A lodge with expansive suites, complete with in-room Keurigs and flat-screen TVs. A restaurant featuring "local wine and artisan-crafted beer." A children's adventure playground, float trip rentals and trails for mountain biking.

This weekend, Missouri will unveil Echo Bluff State Park (http://echobluffstatepark.com/), a new 430-acre state park that boasts $52 million in upgrades and amenities. But old hippies, young partiers and jam band fans of all ages may find the site looks familiar — as Camp Zoe, it was their playground for a half-dozen years.

The park was owned by musician Jimmy Tebeau, who bought it in 2004 and ran a series of wildly popular music festivals there called Schwagstock until the feds put an abrupt end to the fun. Charging that the events on-site amounted to an open-air drug market, they seized the land and charged Tebeau in federal court with "maintaining a drug-involved premises." In the Post-Dispatch story, which was published this afternoon (http://www.stltoday.com/news/local/govt-and-politics/missouri-s-newest-state-park-to-open-on-storied-piece/article_a9201707-0e36-5659-a3ad-05686a93ff57.html?utm_content=buffera2936&utm_medium=social&utm_source=facebook.com&utm_campaign=LEEDCC), Governor Jay Nixon is calling the new park a "key" part of his legacy: "In essence, we turned it from a drug haven to a jewel of our state park system. It's going to pay off huge dividends for a lot of years to come.”

But it's safe to say that for many state residents, the park's legacy is quite a bit more complicated. The Camp Zoe seizure left a bad taste in many people's mouths — you don't have to be a fan of bands like The Schwag to view the government's case against Tebeau with some trepidation.

The RFT detailed the concerns of Tebeau's attorney, Dan Viets, back in 2011 (http://www.riverfronttimes.com/stlouis/schwag-frontman-jimmy-tebeau-says-camp-zoe-is-an-idyllic-campground-for-weekend-hippie-jam-fests-federal-prosecutors-beg-to-differ/Content?oid=2493027):
"It's a terrible thing to think that the government could just march in and take someone's money, take someone's property ... They can't blame the property owner just because some people who are present break the law any more than they can blame the city because crimes take place in city parks. That obviously would be fundamentally unfair."

The government isn't just trying to seize Camp Zoe. The feds also froze Tebeau's assets, including more than $188,000 in a personal bank account.

"They took all of his money," Viets says. "Whether they get to keep it is another matter, but they seized it. It is incredible what the federal government can do to people or a business based merely on allegations with no evidence whatsoever. When they take all your money, it's pretty hard to hire a lawyer. They know that, and they're depriving a citizen or a business owner of his right to counsel."


To the end, Tebeau maintained his innocence — he reluctantly took a plea bargain only because he was facing nine years in prison.

The government possessed overwhelming evidence that he at least tacitly allowed certain drugs to be bought and sold at Schwagstock (marijuana, hallucinogens and ecstasy were allegedly OK, while crack, meth, heroin and others were off-limits) and profited handsomely from the popularity of his festival as a result. The plea agreement explicitly states that the government could not prove Tebeau himself ever bought or sold drugs.

Prosecutors say the circumstances of the case are unique, but civil-liberties advocates warn that targeting a musician and venue owner sets an ominous precedent for festivals and concert sites nationwide. Tebeau is believed to be the first artist or festival organizer ever imprisoned for widespread drug use at a music festival.

"Club owners should be fearful," says Daniel Abrahamson, director of legal affairs for the Drug Policy Alliance, a nonprofit advocacy group working to reform American drug laws. "There is precedent of government overreach with this statute, implicating core First [and Fifth] Amendment concerns."


But hey, at least now Missouri has fancy four-bedroom cabins and another spot for mountain biking and float-tripping?
