no you are one. Count em . 1. That's all you can count on. Numerically as a populous many. Philosophically and politically only 1. Until the mind of ALL many changes on this situation the ALL many is divided by itself resulting in 1. We all know the principle of ANTS. Until the weakness of the Grasshoppers is displayed to every 1 of the ALL many the Grasshoppers will reign supreme. And most of the ALL many like the having the Grasshoppers reigning supreme, so long as they are left in PEACE to get through and die and damn the future. Best not to think about it. Think pleasant thoughts rainbows and unicorns, fun and games. Life is all about enjoying every moment right?
Of course there could be counted another many who are ready for the fray but being divided into one - You and Him and Her and Them. But who can be sure of success? You might find yourself the one 1 in the fray and what success will that yield. It's a difficult situation. How to rally the ALL many to be sure of success?
It brings to mind a question: "Would you like to play THE game?". How to counter? By doing the same in reverse? Can it be done? Is it the only path? I'm coming to the conclusion that it may be. They took a long slow path, bit by bit, piece by piece. Hard and Slow a path that is it, we might not see the end of it, but so long as the path back from where we came is being trodden and becoming ever more crowded eventually it could reverse.

Most people don't want to see. The minority who do are usually bought off someway, or they have not become disillusioned enough to be willing to risk their families or some other aspect of value.
The world manipulators learned that violent, rapid revolutions, ala the Bolshevik kind, are detrimental. Much better is the slow infiltration format. Keep things balanced and gradual.

An FBI agent has been indicted on federal accusations that he lied about firing at Robert “LaVoy” Finicum last year as police arrested the leaders of the Malheur National Wildlife Refuge occupation.
The agent will face allegations of making a false statement with intent to obstruct justice, according to sources familiar with the case.
The indictment stems from a more than yearlong investigation by the inspector general of the U.S. Department of Justice. The agent will be identified when he’s summoned to appear in U.S. District Court in Portland at 1:30 p.m. Wednesday.
Investigators said a member of the FBI’s elite Hostage Rescue Team fired at Finicum as his 2015 Dodge pickup truck crashed into a snow bank at a roadblock on U.S. 395. Finicum had just sped away from a surprise traffic stop on the rural highway as the occupation leaders traveled off the refuge to a community meeting Jan. 26, 2016.

The agent's bullets didn't hit Finicum, 54, an Arizona rancher who was the spokesman for the armed takeover of the federal sanctuary near Burns in Harney County. Moments later, state police troopers shot Finicum three times after he emerged from his white truck and reached for his inner jacket pocket, where police said he had a loaded 9mm handgun. One bullet pierced his heart, an autopsy found.
Assistant U.S. Attorney Charles Gorder Jr. revealed in court papers last June that a grand jury was reviewing the FBI actions. Gorder was explaining the government's desire to keep its memorandum about the inspector general's investigation out of the hands of defense lawyers representing other occupation leaders on federal conspiracy charges.
The FBI and state police had moved in on Ammon Bundy and other key figures as they were driving in two vehicles from the refuge to a meeting in John Day. Finicum initially stopped but then raced off from police, and less than a minute later swerved into the snow to avoid the roadblock set up by FBI and state police.
As Finicum left his truck, an FBI agent shot twice at Finicum, though none of the hostage team members admitted to discharging their firearms, the Deschutes County sheriff alleged. The county sheriff's office was tasked with investigating the Finicum shooting.

Investigators find evidence that an FBI agent fired at Finicum, but later denied it. His bullets didn't hit Finicum or contribute to his death. The investigation found two state troopers were justified in shooting the occupation spokesman three times in the back.
The Oregon investigators concluded that one agent fired at Finicum's truck, hitting it in the roof and missing on the second shot. A state trooper later described to investigators seeing two rifle casings in the area where the FBI agents were posted. But detectives called to investigate didn't find the casings, police reports indicated.
Federal law prohibits "knowingly and willfully'' making any false, fictitious or fraudulent statement or representation or concealing information.
Less than two months after the shooting, the FBI acknowledged that a federal agent was under investigation for firing shots and four other members of his FBI team were under investigation for covering up the gunshots. The status of the investigation into the four other FBI team member is unclear.
At a news conference in March 2016, Portland's-then FBI Special Agent in Charge Greg Bretzing told reporters, "The question of who fired these shots has not been resolved.''
It's unclear if the indicted agent is on leave or has been dismissed from his job. The hostage team is part of the FBI's Critical Incident Response Group, based out of Quantico, Virginia.
Oregon's U.S. Attorney Billy J. Williams has scheduled a news conference later Wednesday afternoon at the federal courthouse. His spokesman Kevin Sonoff declined any comment, and Portland's FBI spokeswoman Jennifer Adams said she was unaware of the matter.
The indictment follows two federal trials against refuge occupiers accused of conspiring to impede U.S. Fish & Wildlife Service and U.S. Bureau of Land Management employees from doing their work at the refuge through intimidation, threat or force.
Ammon Bundy, older brother Ryan Bundy and five other defendants were acquitted last fall of conspiracy and weapons charges. A second trial of four other occupiers resulted in split verdicts earlier this year, with defendants Jason Patrick and Darryl Thorn convicted of conspiracy and others convicted of damaging government property and misdemeanor charges, including trespass.

No, three counts of false statement for hiding the fact that he fired two shots at LaVoy then lied about it. Two more charges for obstructing justice. He'll probably get slapped on the wrist and maybe a small fine and time off without pay or some horseshit like that. He deserves to be charged with attempted murder.

“Specifically, Astarita (http://gold-silver.us/forum/safari-reader://www.washingtontimes.com/topics/w-joseph-astarita/) falsely stated he had not fired his weapon during the attempted arrest of Mr. Finicum when he knew he had in fact fired his weapon,” said a statement by the U.S. Attorney’s Office in Oregon.
“Astarita (http://gold-silver.us/forum/safari-reader://www.washingtontimes.com/topics/w-joseph-astarita/) also knowingly engaged in misleading conduct toward Oregon State Police officers by failing to disclose that he had fired two rounds during the attempted arrest,” said the statement.
Mr. Finicum, 54, was shot and killed Jan. 26, 2016, by the Oregon State Police when he appeared to reach for his jacket, which held a handgun. He and others had taken over a vacant building at the Malheur National Wildlife Refuge in a protest against federal lands policy.

The charges “do not in any way call into question the findings of the major incident team’s investigation of OSP’s use of deadly force,” said Mr. Williams. “OSP’s actions were justified and necessary in protecting officer safety.”
Outside the courthouse, Finicum family friend Kelli Stewart said the agent should have been charged with more serious offenses, including conspiracy and attempted murder.

“If I fired a weapon at somebody else and lied about it and hid the evidence as he did, just even as a civilian, I’d be facing a lot of charges, and I’d be in handcuffs,” said Ms. Stewart, adding that “justice has not been served today.”

Okay, we are talkin and have a question. Since we now know Lavoy Finicum was left all night in the snow, who was the second victim taken to the hospital? Weren't there two taken at the time of arrests? Didn't Bosworth get the guns from the refuge and isnt the timing now giving rise to new facts.
We were attacked by kate clark, emt, she made a point that she worked on Lavoy that night. She claimed to work on him in the ambulance? Really? Doesnt seem likely to be true now does it? Who did she work on that night in the ambulance then? Was somebody shot with friendly fire? Kate would not let up on the cowboy, she was insisting she worked on Lavoy that night herself...hmmm...we are just asking, lets put the puzzle peaces together.

Federal prosecutor Billy Williams' recent KOIN interview continues the lies surrounding LaVoy's murder. What people like Williams don't realize is that lies persist. Only truth will wash everything away.
Perhaps many are not aware that on 3 January 2016, the FBI interrogated Butch Eaton in his home specifically about LaVoy's presence at the Refuge. The FBI indicated to Butch that they were not interested in either Ammon nor Ryan Bundy. Their only interest was in LaVoy.
Listen to this 48 minute interview of Butch, starting at the 39 min 45 sec mark. This is proof that LaVoy's murder was premeditated by at least 23 days. This interview with Trent Loos took place on 15 March 2016, but was not released until 7 April, three weeks later.
Butch is a Harney County resident, who accompanied Ammon, Ryan, LaVoy and others from Burns to the Malheur Refuge on 2 January. He stayed at the Refuge only a short time. Not wanting to be part of what was taking place, Butch decided to walk home. He was interrogated by the FBI the next day at his home.
Butch was later called as a witness for the prosecution in the first Portland trial. However, his testimony was more beneficial to the defense than to the prosecution, as Butch's sympathies were and are with those at the Refuge, even though he did not wish to take part at the time.

Federal prosecutor Billy Williams' recent KOIN interview continues the lies surrounding LaVoy's murder. What people like Williams don't realize is that lies persist. Only truth will wash everything away.
Perhaps many are not aware that on 3 January 2016, the FBI interrogated Butch Eaton in his home specifically about LaVoy's presence at the Refuge. The FBI indicated to Butch that they were not interested in either Ammon nor Ryan Bundy. Their only interest was in LaVoy.
Listen to this 48 minute interview of Butch, starting at the 39 min 45 sec mark. This is proof that LaVoy's murder was premeditated by at least 23 days. This interview with Trent Loos took place on 15 March 2016, but was not released until 7 April, three weeks later.
Butch is a Harney County resident, who accompanied Ammon, Ryan, LaVoy and others from Burns to the Malheur Refuge on 2 January. He stayed at the Refuge only a short time. Not wanting to be part of what was taking place, Butch decided to walk home. He was interrogated by the FBI the next day at his home.
Butch was later called as a witness for the prosecution in the first Portland trial. However, his testimony was more beneficial to the defense than to the prosecution, as Butch's sympathies were and are with those at the Refuge, even though he did not wish to take part at the time.

Jeanette Finicum is a very articulate clear communicator.
One of the items I posted in this thread indicated the two shots were fired by FBI agent W. Joseph Astarita and at least one of the shots hit Finicum in the side and that is why it appeared that Finicum was reaching for a gun when he was reaching for his wounded side. That was interesting.
I absolutely cannot figure out the EXACT and FULL sequence of events in that shooting.
We still are a long way from having that.
It was also interesting how Jeanette said her husband would not have been carrying a gun in his pocket, yet she said the gun that was said to be the gun he took out of his pocket was definitely her husband's gun and was a gift to him from his relative. How did that gun get to the scene if Finicum was not carrying it on his person? Finicum probably would not have just had the gun sitting in his car where "law officers" at the scene could have moved it so that it looked like Finicum drew the gun.
The evidence removed I think were the two shells from the two shots Astarita fired.
EVERYTHING about this case STINKS. There does not appear to be any federal, state or local law enforcement entity hell bent on tell the whole truth and nothing but the truth.
i am glad that attorney Larry Klayman of Freedom Watch, formerly of Judicial Watch, has formally requested President Trump look in to this case. He did not do that in a biased way and was not seeking any particular outcome, but simply from a legal standpoint, there are so many anomalies and infraction regarding the procedures by the law in this case that it requires an objective look.
I do not think the American people realize how vitally important the basic issues of this case jeopardize our fundamental freedom and civil rights.
All we can do is expose this mountain of manure as much as we can, as that is what we are commanded to do. So after we continue to do our part, God can step in and do infinitely more than we can ask or imagine.
I am sorry I cannot contribute more to this thread in the way of intelligent exposure as I just am following so many issues now and we appear as a whole to be in total meltdown mode. I am speaking out and posting on several Texas state government and city and county government matters now as well as trying to follow the PizzaGate and PedoGate issue and really do not know this case in detail and probably will never be able to get up to speed. After almost 18 months of investigation, the Grand Jury has indicted one FBI agent (https://redoubtnews.com/2017/06/fbi-privilege-keeps-defendant-jail/), W. Joseph Astarita, for wrongful action related to the January 26, 2016 shooting of LaVoy Finicum. In contrast to this agonizingly long investigation, which is still pending as to the other FBI agents, the Grand Jury speedily indicted the Bundy et al defendants for the Bunkerville protest and the Malheur Refuge occupation. The rapid indictment of the Bundy et al defendants related to the Bunkerville protest, was based on the questionable testimon (https://redoubtnews.com/2017/06/evidence-dan-loves-criminal-conduct/)y of Dan Love, among others.
With the indictment of the FBI agent, it is time to revisit the circumstances surrounding the stopping of the Finicum vehicle and the various evidences of illegal and unethical behavior on the part of government actors, both state and federal.
Deadman Road Blocks
Many people have visited the site of the shooting of LaVoy Finicum. Many have analyzed (https://redoubtnews.com/2017/04/analysis-murder-lavoy-finicum/) and attempted to recreate (https://scannedretina.com/2016/02/18/brad-steffey-dead-mans-roadblock-shocks-the-conscience-not-the-acts-of-a-lawful-government/) the conditions surrounding the location and logistics of the road block placed a couple of miles past the first stop. The results of these analysis’ reveal that the road block was illegal and not normal procedure used by other law enforcement entities across the USA.
Given the configuration of the road block that was used to stop LaVoy Finicum and his passengers, the road block has been designated an illegal (https://www.ncjrs.gov/pdffiles1/Digitization/122025NCJRS.pdf) “deadman road block”.
Here are the reasons for why the road block and the procedures used by the Oregon State Police, the FBI and other government actors, were illegal, unethical, immoral and indefensible.
Roadblocks Banned In Many Jurisdictions
“Violator may be boxed in only if officer reasonably believes there is substantial risk that violator will cause death or serious physical injury to others if apprehension is delayed. Ramming will be used only as last resort after all other reasonable means of stopping violator have failed, and where officer believes violator has committed, has attempted to commit, or is attempting to commit felony which involves use, or threatened use, of deadly force, and there is substantial risk that pursued law violator will cause death or serious physical injury to others if apprehension is delayed. Ramming a vehicle should be considered deadly force. Roadblocks shall not be used to stop violator.”St. Petersburg, FL
Roadblocks are broadly discouraged in most jurisdictions because they have been found to be more dangerous than helpful and because courts have usually found them to be a form of deadly force and a violation of the 4th Amendment unreasonable seizure provision.
Use Of Unmarked Vehicles, Ambush And Surprise
The purpose of a road block, if justified, is not to ambush, surprise, trick, deceive, con, or otherwise inflict bodily harm or property damage. Just the opposite, it is to provide every possible means for detaining individuals with the least amount of risk to the suspects, their passengers and the people who are detaining them.
Law enforcement officials (LEO’s) are required to use every possible method at their disposal to warn the approaching suspects of the road block ahead through the use of bright head lights and flashing lights, flares and warning signs to give the approaching suspects adequate warning to stop.
A review of the overhead aerial video supplied by the LEO will show unmarked cars with no flashing lights, other than a rear vehicle with flashing yellow lights on its camper shell. The front vehicles that are parked in a “V” shape fashion, have no flashing lights nor are the one truck’s headlights easily seen.
Additionally, the road block, located on a curve in the highway, was not easily visible until the vehicle was within seconds of crashing into the road block. The LEO had other options to locate the road block on a long, straight piece of the highway. Finicum was blocked from leaving the highway by deep snow banks so the element of surprise was unnecessary.
The LEO had obviously planned this event well in advance, with ample time to set it up, cut down tree limbs, stage vehicles and make other preparations including the placement of warning signs along the road well in advance of the site of the road block, if they had so chosen. However, no warning signs were placed anywhere in front of the road block. Nor was any mention of the road block made to Finicum by the LEO at the first stop in order to contribute to the warnings being given to him and to aid his decision making process.

Road Blocks May Slow But Should Not Prevent The Escape Of The Suspects
Ahard stop road block, such as used by LEO against Finicum, is known as a “deadman road block” because there are no means of escape, the only alternative being to crash into it and because it was setup to give as little warning as possible.
Given the height of the snow bank, many drivers may rule that out as an option and crash into the blocking vehicles instead. Furthermore, many drivers don’t have the skill or presence of mind to make the snow bank choice.
LEO’s claim that Finicum had the option to stop before hitting the roadblock. But as noted previously, replications of the conditions shows that he did not have time to stop nor did he have adequate warning.
Jurisdictions like Nassau County, New York recognize that “fixed” road blocks are rarely justified, Nassau County New York: “Fixed roadblocks, which block road to extent that little or no outlet remains are extremely dangerous and are rarely justifiable.”
Experts reason that it is better to allow the suspect to escape and later apprehend them through other means such as tire puncture strips. No tire puncture strips were placed in Finicum’s path that could have been the means for slowing him down and preventing the possible crash with the deadman road block.
“YOU Want My Blood On Your Hands?”
Was the Finicum “deadman” roadblock one of those rare cases where it was justified? Can the LEO make a case for justifying it with Finicum?
Finicum had no previous record of violence or of criminal activity. He never had a speeding ticket. There was no probable cause to believe he was a dangerous criminal on the loose and that a deadman roadblock was the only remedy. At the first stop he gave them two options: 1. Follow him to John Day and sort it out there with the local sheriff or 2. Shoot him. Not once did he say, explicitly nor implicitly, that he would shoot back but declared, “You want my blood on your hands?”. He did not threaten to shed their blood, but for them to shed his blood.
Finicum did not fit, even remotely, the rare justification where a deadman (no outlet) roadblock should be used.

In the Shawna Cox video, Ryan Bundy, disadvantaged by the unmarked vehicles and the plain clothed LEO, rightfully asked, “Who are you?”. LEO use marked vehicles and uniforms as a protection for civilians from impersonators and from vigilantes. Civilians are not required to pull over for an unmarked vehicle even with flashing lights until they are in a well lighted, and public area. People have been assaulted and raped by people with flashing light impersonating LEO.
They had every right to proceed to John Day as proposed by Finicum, to assure their safety and to be in the presence of uniformed LEO.
Even the roadblock ahead had unmarked vehicles and plain clothes personnel, hardly a protection from impersonators.
Road Blocks Are A Violation Of The Fourth Amendment
Abundant case law indicates that road blocks are often found by the court to be a violation of a person’s 4th amendment right to freedom from unreasonable seizure.

The Passengers, The Passengers, The Passengers
As tragic as the murder of Finicum was, it does not eclipse the horrific display by LEO of reckless disregard for the safety and welfare of the passengers. Roadblocks are a tool of last resort, especially when there are passengers.
As the Finicum truck rounded the curve, towards the road block, shots were fired at them. The Shawna Cox video shows that they acknowledged the shots being fired at them but no mention was made of the road block ahead. Finicum barely had time to say, “hang on” before plowing into the snow bank next to the road block.
The fact that the Finicum occupants never mentioned the road block indicates that their attention was distracted by the shots. Experts, who strongly discourage shooting at approaching vehicles, even calling it nonsense, claim that the shots distract the attention of the driver (https://www.themarshallproject.org/2015/06/10/cops-shooting-at-cars-a-really-bad-idea#.g7TvoTnFj) as he may duck below the dashboard, or as a dead or injured driver, cause an even worse crash.
Nassau County flatly prohibits use of firearms in a pursuit. A brief paragraph states both the rule and its rationale:
“Firearms should not be used in an attempt to stop a pursued vehicle. This applies to officers at roadblocks. as well as to pursuing officers. Fortunately, such action is rarely taken, because most officers realize it is extremely dangerous and ineffective. A car traveling at high speed with a wounded or dead person at the controls, would be far more dangerous than the pursuit, and a danger that none of us can justify.”
Under circumstances involving split seconds and with little time to assess a situation, how do officers make sound decisions about firing their guns at vehicles? The solution, says Wexler, executive director of the Police Executive Research Forum, is to never reach that point (https://www.vox.com/policy-and-politics/2017/5/8/15533536/police-shooting-moving-cars-jordan-edwards). Let suspects escape in their cars without confrontation, and “get a warrant.”
Divine Intervention?
In the Finicum case, at least three lethal shots were fired at the truck with passengers inside, including two females, Shawna Cox (https://redoubtnews.com/2016/09/opening-statements-malheur-protest-trial/) and Victoria Sharp. Shawna Cox later told me that she and Victoria were supposed to ride with other people but, at the last minute, caught a ride with Finicum. She feels that, had they not been in the vehicle, Ryan Bundy and Ryan Payne would have also been assassinated.
Even with the females on board, it did not serve as a deterrent to LEO firing lethal rounds at the vehicle. Additionally, the so-called less than lethal rounds from gas rounds or rubber bullets can be lethal or cause serious injury.
Courts have found that innocent passengers who are caught in the crossfire or who are affected by a roadblock, can file a claim under the Fourth Amendment unreasonable seizure provision. Vaughan, 343 F.3d at 1329. 137. See also Jamieson v. Shaw, 772 F.2d 1205, 1209–11 (5th Cir. 1985) (holding a passenger was seized when vehicle collided with police roadblock).
Armed And Dangerous?
LEO has claimed that the passengers were known to be armed and dangerous, justifying the extreme actions they took. Where is the evidence to support that claim? Even after being shot at multiple times, there was no attempt by passengers to reach for, brandish, or touch a weapon in self-defense.
Ryan Bundy had a bullet in his shoulder, but never showed any hint of retaliating. The usual talk among dangerous criminals involves numerous “F bombs”, cursing and cussing, violent threats and ultimatums. But the Shawna Cox video shows none of that except for her reference to them as “A..holes”.
Where Are The Body And Dash Camera Videos?
Conspicuous is the absence of ground level video coverage of the Finicum incident, from the first stop until the body and truck are removed the scene.
The University of Oregon Police Department Operations Manual (http://police.uoregon.edu/sites/police.uoregon.edu/files/UOPD_Operations_Manual_PUBLIC.pdf), which is consistent with and modeled after other Oregon police jurisdictions, contains many pages of instructions devoted to the subject of video and audio recordings.
Where dash cameras are not available, the personal body cameras should be used.
Over and over again, the operations manual stresses the importance of having a video record of the incident, the more serious the incident, the more compelling the need to have it recorded as evidence.
Given that video of police encounters are standard operating practice (SOP) in most jurisdictions, why are there no video recordings made by the dozens of officers and agents at the scene?
Here are some excerpts from the UOPD manual:
446.4.1 REQUIRED ACTIVATION OF MOBILE AUDIO VIDEO (MAV)
The MAV system should be activated in any of the following situations:
(a) All field contacts involving actual or potential criminal conduct within video or audio range:
1. Traffic stops (to include, but not limited to, traffic violations, stranded motorist assistance and all crime interdiction stops)
2. Priority responses
3. Vehicle pursuits
4. Suspicious vehicles
5. Arrests
6. Vehicle searches
7. Physical or verbal confrontations or use of force
8. Pedestrian checks
9. DWI/DUI investigations including field sobriety tests
10. Consensual encounters
11. Crimes in progress
12. Responding to an in-progress call
450.5 ACTIVATION OF THE AUDIO/VIDEO RECORDER Officers should activate the recorder during all enforcement stops and field interview situations when MAV is not used and any other time the member reasonably believes that a recording of an on-duty contact may be useful. Once started, recordings should continue without interruption until the contact ends, if feasible.
814.5.1 COLLECTION OF DIGITAL EVIDENCE Once evidence is recorded it shall not be erased, deleted or altered in any way prior to submission. All photographs taken will be preserved regardless of quality, composition or relevance. Video and audio files will not be altered in any way.
Conclusion
The only explanation for lack of video and audio evidence, contrary to SOP by LEO at the scene, would seem to be intentional and for the purpose of controlling the narrative and escape consequences for their actions.
In the 240 years since a paranoid group of the nation’s founders, highly suspicious and mistrustful of government, gave us the constitution and the Bill of Rights, we have seen a steady erosion of the very principles that they wanted to give us. Government, instead of being a servant, has become a fearful master.
Government has given themselves special treatment, special status, special immunities (https://redoubtnews.com/2017/06/evidence-dan-loves-criminal-conduct/) from prosecution and special exemptions.
They committed all the violations enumerated above…because they can.
Particularly worrisome are the many conflict of interest elements in any kind of federal trial with charges against the government who planned and executed the Finicum incident. Conflict of interest where a federal judge works in unison with federal co-workers: prosecutors, public defenders, law enforcement agents, bureaucrats and officials, all representing the same team and the same interests.
For non-government citizens to get back their rights and even the playing field, non-traditional candidates need to run for office, who are honest and full of integrity, just like our founders were.

The purpose of a road block, if justified, is not to ambush, surprise, trick, deceive, con, or otherwise inflict bodily harm or property damage. Just the opposite, it is to provide every possible means for detaining individuals with the least amount of risk to the suspects, their passengers and the people who are detaining them.
Law enforcement officials (LEO’s) are required to use every possible method at their disposal to warn the approaching suspects of the road block ahead through the use of bright head lights and flashing lights, flares and warning signs to give the approaching suspects adequate warning to stop.
A review of the overhead aerial video supplied by the LEO will show unmarked cars with no flashing lights, other than a rear vehicle with flashing yellow lights on its camper shell. The front vehicles that are parked in a “V” shape fashion, have no flashing lights nor are the one truck’s headlights easily seen.
Additionally, the road block, located on a curve in the highway, was not easily visible until the vehicle was within seconds of crashing into the road block. The LEO had other options to locate the road block on a long, straight piece of the highway. Finicum was blocked from leaving the highway by deep snow banks so the element of surprise was unnecessary.
The LEO had obviously planned this event well in advance, with ample time to set it up, cut down tree limbs, stage vehicles and make other preparations including the placement of warning signs along the road well in advance of the site of the road block, if they had so chosen. However, no warning signs were placed anywhere in front of the road block. Nor was any mention of the road block made to Finicum by the LEO at the first stop in order to contribute to the warnings being given to him and to aid his decision making process.

Road Blocks May Slow But Should Not Prevent The Escape Of The Suspects
Ahard stop road block, such as used by LEO against Finicum, is known as a “deadman road block” because there are no means of escape, the only alternative being to crash into it and because it was setup to give as little warning as possible.
Given the height of the snow bank, many drivers may rule that out as an option and crash into the blocking vehicles instead. Furthermore, many drivers don’t have the skill or presence of mind to make the snow bank choice.
LEO’s claim that Finicum had the option to stop before hitting the roadblock. But as noted previously, replications of the conditions shows that he did not have time to stop nor did he have adequate warning.
Jurisdictions like Nassau County, New York recognize that “fixed” road blocks are rarely justified, Nassau County New York: “Fixed roadblocks, which block road to extent that little or no outlet remains are extremely dangerous and are rarely justifiable.”
Experts reason that it is better to allow the suspect to escape and later apprehend them through other means such as tire puncture strips. No tire puncture strips were placed in Finicum’s path that could have been the means for slowing him down and preventing the possible crash with the deadman road block.
“YOU Want My Blood On Your Hands?”
Was the Finicum “deadman” roadblock one of those rare cases where it was justified? Can the LEO make a case for justifying it with Finicum?
Finicum had no previous record of violence or of criminal activity. He never had a speeding ticket. There was no probable cause to believe he was a dangerous criminal on the loose and that a deadman roadblock was the only remedy. At the first stop he gave them two options: 1. Follow him to John Day and sort it out there with the local sheriff or 2. Shoot him. Not once did he say, explicitly nor implicitly, that he would shoot back but declared, “You want my blood on your hands?”. He did not threaten to shed their blood, but for them to shed his blood.
Finicum did not fit, even remotely, the rare justification where a deadman (no outlet) roadblock should be used.

In the Shawna Cox video, Ryan Bundy, disadvantaged by the unmarked vehicles and the plain clothed LEO, rightfully asked, “Who are you?”. LEO use marked vehicles and uniforms as a protection for civilians from impersonators and from vigilantes. Civilians are not required to pull over for an unmarked vehicle even with flashing lights until they are in a well lighted, and public area. People have been assaulted and raped by people with flashing light impersonating LEO.
They had every right to proceed to John Day as proposed by Finicum, to assure their safety and to be in the presence of uniformed LEO.
Even the roadblock ahead had unmarked vehicles and plain clothes personnel, hardly a protection from impersonators.
Road Blocks Are A Violation Of The Fourth Amendment
Abundant case law indicates that road blocks are often found by the court to be a violation of a person’s 4th amendment right to freedom from unreasonable seizure.

The Passengers, The Passengers, The Passengers
As tragic as the murder of Finicum was, it does not eclipse the horrific display by LEO of reckless disregard for the safety and welfare of the passengers. Roadblocks are a tool of last resort, especially when there are passengers.
As the Finicum truck rounded the curve, towards the road block, shots were fired at them. The Shawna Cox video shows that they acknowledged the shots being fired at them but no mention was made of the road block ahead. Finicum barely had time to say, “hang on” before plowing into the snow bank next to the road block.
The fact that the Finicum occupants never mentioned the road block indicates that their attention was distracted by the shots. Experts, who strongly discourage shooting at approaching vehicles, even calling it nonsense, claim that the shots distract the attention of the driver (https://www.themarshallproject.org/2015/06/10/cops-shooting-at-cars-a-really-bad-idea#.g7TvoTnFj) as he may duck below the dashboard, or as a dead or injured driver, cause an even worse crash.
Nassau County flatly prohibits use of firearms in a pursuit. A brief paragraph states both the rule and its rationale:
“Firearms should not be used in an attempt to stop a pursued vehicle. This applies to officers at roadblocks. as well as to pursuing officers. Fortunately, such action is rarely taken, because most officers realize it is extremely dangerous and ineffective. A car traveling at high speed with a wounded or dead person at the controls, would be far more dangerous than the pursuit, and a danger that none of us can justify.”
Under circumstances involving split seconds and with little time to assess a situation, how do officers make sound decisions about firing their guns at vehicles? The solution, says Wexler, executive director of the Police Executive Research Forum, is to never reach that point (https://www.vox.com/policy-and-politics/2017/5/8/15533536/police-shooting-moving-cars-jordan-edwards). Let suspects escape in their cars without confrontation, and “get a warrant.”
Divine Intervention?
In the Finicum case, at least three lethal shots were fired at the truck with passengers inside, including two females, Shawna Cox (https://redoubtnews.com/2016/09/opening-statements-malheur-protest-trial/) and Victoria Sharp. Shawna Cox later told me that she and Victoria were supposed to ride with other people but, at the last minute, caught a ride with Finicum. She feels that, had they not been in the vehicle, Ryan Bundy and Ryan Payne would have also been assassinated.
Even with the females on board, it did not serve as a deterrent to LEO firing lethal rounds at the vehicle. Additionally, the so-called less than lethal rounds from gas rounds or rubber bullets can be lethal or cause serious injury.
Courts have found that innocent passengers who are caught in the crossfire or who are affected by a roadblock, can file a claim under the Fourth Amendment unreasonable seizure provision. Vaughan, 343 F.3d at 1329. 137. See also Jamieson v. Shaw, 772 F.2d 1205, 1209–11 (5th Cir. 1985) (holding a passenger was seized when vehicle collided with police roadblock).
Armed And Dangerous?
LEO has claimed that the passengers were known to be armed and dangerous, justifying the extreme actions they took. Where is the evidence to support that claim? Even after being shot at multiple times, there was no attempt by passengers to reach for, brandish, or touch a weapon in self-defense.
Ryan Bundy had a bullet in his shoulder, but never showed any hint of retaliating. The usual talk among dangerous criminals involves numerous “F bombs”, cursing and cussing, violent threats and ultimatums. But the Shawna Cox video shows none of that except for her reference to them as “A..holes”.
Where Are The Body And Dash Camera Videos?
Conspicuous is the absence of ground level video coverage of the Finicum incident, from the first stop until the body and truck are removed the scene.
The University of Oregon Police Department Operations Manual (http://police.uoregon.edu/sites/police.uoregon.edu/files/UOPD_Operations_Manual_PUBLIC.pdf), which is consistent with and modeled after other Oregon police jurisdictions, contains many pages of instructions devoted to the subject of video and audio recordings.
Where dash cameras are not available, the personal body cameras should be used.
Over and over again, the operations manual stresses the importance of having a video record of the incident, the more serious the incident, the more compelling the need to have it recorded as evidence.
Given that video of police encounters are standard operating practice (SOP) in most jurisdictions, why are there no video recordings made by the dozens of officers and agents at the scene?
Here are some excerpts from the UOPD manual:
446.4.1 REQUIRED ACTIVATION OF MOBILE AUDIO VIDEO (MAV)
The MAV system should be activated in any of the following situations:
(a) All field contacts involving actual or potential criminal conduct within video or audio range:
1. Traffic stops (to include, but not limited to, traffic violations, stranded motorist assistance and all crime interdiction stops)
2. Priority responses
3. Vehicle pursuits
4. Suspicious vehicles
5. Arrests
6. Vehicle searches
7. Physical or verbal confrontations or use of force
8. Pedestrian checks
9. DWI/DUI investigations including field sobriety tests
10. Consensual encounters
11. Crimes in progress
12. Responding to an in-progress call
450.5 ACTIVATION OF THE AUDIO/VIDEO RECORDER Officers should activate the recorder during all enforcement stops and field interview situations when MAV is not used and any other time the member reasonably believes that a recording of an on-duty contact may be useful. Once started, recordings should continue without interruption until the contact ends, if feasible.
814.5.1 COLLECTION OF DIGITAL EVIDENCE Once evidence is recorded it shall not be erased, deleted or altered in any way prior to submission. All photographs taken will be preserved regardless of quality, composition or relevance. Video and audio files will not be altered in any way.
Conclusion
The only explanation for lack of video and audio evidence, contrary to SOP by LEO at the scene, would seem to be intentional and for the purpose of controlling the narrative and escape consequences for their actions.
In the 240 years since a paranoid group of the nation’s founders, highly suspicious and mistrustful of government, gave us the constitution and the Bill of Rights, we have seen a steady erosion of the very principles that they wanted to give us. Government, instead of being a servant, has become a fearful master.

They committed all the violations enumerated above…because they can.
Particularly worrisome are the many conflict of interest elements in any kind of federal trial with charges against the government who planned and executed the Finicum incident. Conflict of interest where a federal judge works in unison with federal co-workers: prosecutors, public defenders, law enforcement agents, bureaucrats and officials, all representing the same team and the same interests.
For non-government citizens to get back their rights and even the playing field, non-traditional candidates need to run for office, who are honest and full of integrity, just like our founders were.

Last week saw the indictment of FBI Special Agent W. Joseph Astarita for lying about shots he'd fired during the January 26, 2016 killing of Robert Lavoy Finicum. The Oregonian noted (http://www.oregonlive.com/portland/index.ssf/2017/06/prosecution_of_fbi_agents_for.html) that the prosecution of FBI agents for their official conduct is almost unheard of. The unusual charges were "devastating (http://www.oregonlive.com/oregon-standoff/2017/06/fbi_agents_indictment_resulted.html)" to the FBI, commented Danny Coulson, a former head of the bureau's Oregon office.
Well, maybe the indictment is so devastating because federal agents are rarely punished for brutal and dishonest behavior.
Interestingly, Coulson created and led the FBI's Hostage Rescue Team—the elite force to which Astarita belongs—during the bloody 1992 Ruby Ridge fiasco. He escaped prosecution (http://articles.latimes.com/1997/aug/16/news/mn-22926) for his conduct during that mess—for which the federal government paid out over $3 million (http://articles.chicagotribune.com/1995-08-15/news/9508160186_1_white-separatist-randy-weaver-ruby-ridge-vicki-weaver) in damages (http://www.nytimes.com/2000/09/23/us/us-settles-final-civil-lawsuit-stemming-from-ruby-ridge-siege.html) to survivors—though he spent two years on paid leave (read: vacation). Several other agents were disciplined (http://www.spokesman.com/stories/1995/jan/07/fbi-punishes-12-agents-but-sharpshooter-who/), though the only official criminally punished for Ruby Ridge was E. Michael Kahoe (http://www.cnn.com/US/9710/10/briefs/kahoe.sentencing/index.html?_s=PM:US), who destroyed an internal FBI report critical of the agents' conduct during the high-profile standoff. Anybody further up the food chain, Coulson included, was protected by a review process intended "to create scapegoats and false impressions," according (http://www.nytimes.com/1995/05/10/us/fbi-leader-at-1992-standoff-in-idaho-says-review-shielded-top-officials.html) to Eugene F. Glenn, the FBI commander at the scene, who publicly broke rank with his colleagues when he believed he was being set up to take a fall. So Coulson knows well that the rarity of prosecutions of federal agents can't be taken as an endorsement of their behavior—arguably, it could be interpreted as quite the opposite.
Prosecutions might be rarer still—which is to say, Astarita might be walking free and unconcerned today—if one Oregon sheriff hadn't become thoroughly bent out of shape over federal conduct during last year's Malheur National Wildlife Refuge standoff and then in its aftermath.
Deschutes County Sheriff Shane Nelson took on the investigation of the lethal confrontation resulting from what was, to all appearances, an ambush of armed Malheur protesters traveling to a public meeting to discuss their opposition to the treatment of local ranchers in particular, and to federal control of western lands in general. Specifically, Nelson tried to account for the eight shots fired in the incident—six by Oregon state troopers (including those that killed Finicum), none by the protesters, and two by… huh. Because the FBI agents on the scene all denied firing two shots at Finicum (and missing) as he exited his truck.
Nelson and his investigators quickly concluded that Astarita had fired the shots, and that he and his colleagues lied about it for reasons of their own.
"The actions of the FBI HRT in this case damage the integrity of the entire law enforcement profession, which makes me both disappointed and angry," Sheriff Nelson said (https://sheriff.deschutes.org/Press_Conference_June_28_2017.pdf) after the indictment was announced.
Nelson became even angrier when he presented his findings to FBI officials and they did…nothing.
"I was disappointed when I recently heard FBI HRT agents, associated with this case, were not placed on administrative leave after the briefing by our investigators to FBI Administration. Today's indictment will ensure that the Defendant and, hopefully other culpable FBI HRT members, will be held accountable through the justice process."
Nelson isn't exactly an antigovernment radical. He signed off on the killing of Finicum, saying (https://sheriff.deschutes.org/March_8_press.pdf), "Of the eight shots fired, the six fired by the Oregon State Police were justified and, in fact, necessary."
But the sheriff isn't on board with federal agents taking random shots that may well have inflamed the situation. That's a theory quickly embraced by the Malheur protesters and their allies. Finicum's widow, Jeanette, "said Astarita's early shots may have contributed to the firing of the fatal gunshots moments later by two state police troopers who killed her husband," reports The Oregonian. Unsurprisingly, she plans to sue.
Sheriff Nelson voices serious discontent with the FBI's conduct during and after the shooting of Finicum, but knowledge of the bureau's handling of the Ruby Ridge incident might have prepared him for disappointment. So might some familiarity with the federal government's handling of other incidents, such as the 1993 disaster at the Branch Davidian compound in Waco, Texas, during which more than 80 people died.
FBI agents escaped official discipline for their conduct at Waco, but not criticism. Rather than shred an inconvenient internal report, the bureau and its allies produced an exculpatory public "review" that the New York Timespromptly labeled a "whitewash." The newspaper's editorial board went on to note (http://www.nytimes.com/1993/10/12/opinion/the-waco-whitewash.html), "The report describes a litany of errors and blunders. Why, then, does it assign no blame?"
By contrast, the Bureau of Alcohol and Tobacco and Firearms fired two agents (http://articles.sun-sentinel.com/1994-10-29/news/9410280660_1_atf-officials-charles-sarabyn-two-federal-agents)who led the initial raid and siege to which the FBI joined its efforts when matters went lethally wrong. Chuck Sarabyn and Phillip Chojinacki lost their jobs over accusations of "poor judgment and lying to investigators" (a pattern with federal law enforcement agents, it would seem). Then again, we're talking about a federal agency; one year later, Sarabyn and Chojinacki were rehired with full back pay and benefits (http://articles.orlandosentinel.com/1994-12-23/news/9412231013_1_chojnacki-raid-standoff).
Years later, the Times again called out the FBI, asking (http://www.nytimes.com/1999/09/02/opinion/an-unbiased-inquiry-on-waco.html) "why the F.B.I. failed for six years to tell anyone, including Congress and the Attorney General herself, that it had used incendiary tear-gas canisters near the end of the siege—an important point, given the lethal fire in which the standoff ended. Soon, Assistant U.S. Attorney Bill Johnston, the prosecutor who belatedly revealed the use of those canisters, faced charges of concealing evidence. Texas Monthlyreported (http://www.texasmonthly.com/politics/the-case-of-the-persecuted-prosecutor/) that he was being hung out to dry so the consequences would reach no further through the ranks of federal officials because he was "the only guy who doesn't have friends in Washington."
If you're asking yourself why Astarita and company would have concealed the shots he fired during an incident that resulted in state police killing Finicum anyway, perhaps the answer is that lying and concealing information seems to be the bureau's go-to response.
The FBI almost screwed up what should have been the slam-dunk prosecution of Timothy McVeigh for the bombing of the Alfred P. Murrah federal building in Oklahoma City (a crime largely motivated, it's worth remembering, by McVeigh's outrage over federal misconduct at Ruby Ridge and Waco). Despite minimal doubt about his guilt (McVeigh wanted to plead "necessity") the FBI couldn't help putting its thumb on the scale. The bureau's crime lab was caught (http://www.cnn.com/US/9703/22/okc.fbi.report/) reaching "scientifically unsound" conclusions that were "biased in favor of the prosecution" according to the Justice Department's Inspector General. Then McVeigh's execution was delayed when it was discovered that federal officials concealed hundreds of documents (http://www.chron.com/news/nation-world/article/FBI-withheld-McVeigh-evidence-2013989.php) from his defense attorneys.
Frederic Whitehurst, the whistleblower who revealed the FBI crime lab's shenanigans in not just that high-profile case, but many others, was targeted by his superiors for retaliation for his troubles. He ultimately walked away with a $1.16 million settlement (http://www.cnn.com/US/9802/27/fbi.whitehurst/).
But back to the present.
Astarita "falsely stated he had not fired his weapon during the attempted arrest of Robert La Voy Finicum, when he knew then and there that he had fired his weapon," the federal indictment (https://assets.documentcloud.org/documents/3879758/Astarita-Indictment.pdf) reads. Astonished by such bold-faced dishonesty from a federal agent, and by federal higher-ups' seeming lack of concern, Sheriff Nelson became "disappointed and angry" and pushed the issue—resulting in that court appearance and the trial to come.
Good for Sheriff Nelson. Finding out that people and agencies you respect are thugs and liars is a rough wake-up call for anybody. Persisting in the face of that unpleasant revelation deserves praise.
But if this indictment is to be other than just another footnote to the history of checkered conduct by the FBI and other agencies, more of us need such wake-up calls. Then, maybe, we'll curb the behavior that leads, on such rare occasion, to "devastating" consequences for federal officials.

I think they ought to teach this Lavoy Finicum legal case in law school classes. Every illegal thing that can be done in a case has been done and a few we are yet to witness. First you have crooked judges. Then you have crooked cops. It all goes down from there. Things are not at all working according to the Constitution. It seems that facts and evidence are not what matters at all, and if you establish much evidence, it will not be admissible.
Is there any wonder that we are all getting so cynical about law and government?

It is not verified, but it is possible that officials in the BLM in the Bundy and Malheur incidents will face RICCO charges. Trump might be looking at curtailing the BLM, pulling its pretense of LE authority, and maybe even dismantling it.
The DOJ and FBI, because of their own interests, did not release exculpatory evidence, nor did they seek the truth, but suppressed it, which would have led to investigations and likely indictments against Hillary and Reid!

These whole entire Bundy Hammond Finicum legal cases can be legally dismissed right now. There has been so many legal "mistakes" in the conduct of these cases that there is way more than enough justification to THROW THEM OUT - DISMISS THEM NOW.
1. We do not have an honest valid investigation
2. We do not know what really happened at the Oregon / Finicum shooting.
The federal agency people play all sorts of power games amongst each other and they know exactly what tools of leverage they have in these games. We have to realize, as I have so often said, that upper level people in all federal, state, county, and city governmental entities maintain their existence in the board game via leverage tools that work by BRIBERY, EXTORTION, and BLACKMAIL. One of the main or biggest or strongest tools is the pedophilia, child sacrifice and satanic ritual abuse facts. That is why I always try to remember and applaud the good government workers who were fired or stayed in low-level positions rather than take promotions higher level spots in the game. Those are the only people of whom it can be said "there are some good people at the _____fill in the blank___. There are almost no "good people" even in the lower level supervisory positions. You have to make a decision whether to be a low level, low paid, worker bee who is working way below their skills and capabilities. Skills and capabilities are not what is needed to run these governmental entities from federal to local. The game is to bride, extort, and blackmail or to just keep quiet about it when you see what is going on. Remember Seth Rich.
When Col. Potter spoke about, for example, Feds "putting pressure on" New York City police Dept. regarding Weiner laptop matter, that putting pressure actually means veiled or not so veiled THREATS of exposure for bribery, extortion, or blackmail. And really, these days, it is more than just threats of political disgrace of individuals on destruction via lawsuits in courts, it means that the person who is threatened may be mysteriously suicided or some of his immediate family members will experience harrassment and possible even death.

In line with my statement that there has been no real valid legal thoroughgoing investigation of Finicum murder, I wonder exactly about the gunshot wounds on Finnicum's body. Col Potter mentioned the side would was from the back. I also understand the kill shot was "in the back" and I usually take that to mean on the bad, not in the side. I also always understood that some of the shots that were fired by the HRT hit men were fired at Finnicum from the front or maybe from the side. Again we have no honest coroner or autopsy reports about number of GSWs and entry and exit wounds. The lack of that information sort of makes "the investigation" a total nonstarter, not that there are not many purchased liars, cheats and thieves among coroners.

During The Red Pill Expo in Bozeman, Jeanette Finicum came forward and made an incredibly emotional speech about the murder of her husband. There was not a dry eye in the room. While Josh had an interview planned with Jeanette, he couldn't keep it together enough for an interview, nor did he want her to be going through the story again and again in one day, so he chose instead to talk with investigator John Lamb instead who has been covering the story since day one.
LaVoy did NOT have his gun on him at the time of his death as the police continuously claim while not actually having a gun in their evidence cache. He was wincing in pain when his arm went down following being shot in the back. He was then shot a couple more times in the back until he was dead.
LaVoywas on his way to meet with the sheriff when the police ran him off the road and killed him.
The police and FBI have continuously covered the case up, not even telling LaVoy's wife Jeanette the names of the officers who killed him, nor giving back his truck which he had owed payments on.
LaVoy was simply standing for individual liberty at the Malheur National Wildlife Refuge in Oregon as the Bureau of Land Management (BLM) continued to seize land and bring insane charges against innocent farmers and land owners for taking the standard care a farmer does of their property including controlled burns.
Lawyers have treated Jeanette poorly and have deep-sixed the pro bono case. Jeanette is now broke and may lose her ranch. She needs people's help to keep up with the lawyer fees as she sues for the wrongful death of her husband.
The reality of this case is horrifying and needs more public attention immediately. What Jeanette Finicum is going through is unthinkable and people should be ashamed of themselves for turning a blind eye to this traumatizing turn of events.

John Lamb seems to me to get something wrong in this interview and I have to wonder why. I believe he's done it in other interviews too. He says Lavoy didn't have a gun and it's obvious he doesn't have the .44 revolver on his hip but he did carry a 9mm in a shoulder holster sometimes. That's the one I"m wondering about and if he had that one with him in the vehicle.
Another thing that just doesn't look right about the murder of Lavoy that was mentioned in the interview was the asshole that came out of the woods that they say had a taser but the proportions just don't look right. Peter Offerman in his analyses thinks he may have had a shotgun that they photo shopped out of the video and he makes a pretty good case for it at this link. Anyone know what the state of YouTube/Periscope/etc "Live Streaming" was at the time of the Malheur standoff? I recall Pete Santilli was doing some from the ranch, prior the ambush/Finicum murder event.
Coz they (Bundy/Finicum/Santilli & Co) needed to be running live-streaming continuously, most especially all during that ill-fated trip/ambush.
Coulda, Shoulda, Woulda... Hindsight = 20:20
Thing is though; I expect FBI had the foresight to turn off all mobile cell towers serving the point of their ambush/murder.

they did not have cellular service at the ambush location. Shawna Cox did record from inside LaVoy's pickup. Her cellular phone was consficated by the cops, but eventually returned to her with that video intact. That is the video that was later super imposed onto the FBI's video.

I am also confused about LaVoy having the 9mm inside his jacket. Even after listening to Jeanette Finicum it is not clear if he was carringy that pistol or not. I don't believe she knows either. She did say it was a gift from one of their sons/stepsons. There is much speculation that it was planted after the murder. LaVoy had a shoulder holster. It is impossible for me to believe he would carry that 9mm in a sloppy sewed in pocket inside his Levi jacket. That is pure bull$hit.
I am going to take another look at Offerman's analysis.

Since airing on May 16, 2017, the Frontline report, American Patriot, the reviews among the Bundy supporters include “had to turn it off”, “made me want to vomit”, “broadcast porn”, “made me sick, literally” and those were the kinder ones. PUTTING BIG BIRD OUT OF WORK
For many people, Frontline is the gold standard of objective and unbiased investigative journalism.

Frontline cannot help but be biased, given the source of its funding, which includes a big chunk of financial support from the federal government. During the presidential debates between Romney and Obama, the comment was made by Romney that government had no legitimate purpose to be funding PBS and that he would make cuts to PBS (https://www.washingtonpost.com/politics/decision2012/big-bird-in-the-presidential-debate-mitt-romney-advocates-cutting-funding-for-sesame-street-pbs/2012/10/04/f7f280ba-0e1f-11e2-bb5e-492c0d30bff6_story.html) including one of his favorite characters, Big Bird on Sesame Street, rather than borrow more money from China. Peeling away the humor, the dark side to this is that government, through its financial clout, has huge leverage over what PBS produces.
What is the main theme of the Bundy position? Federal government over reach, federal government abuses, federal government violations of the original intent of the constitution. Everything that the Bundys stand for are in direct opposition to one of the main supporters of PBS. The federal team (including Big Bird) have a vested interest in a big, federal government including the 12,000 BLM employees and their 100’s of thousands of brothers and sisters in the alphabet soup of federal agencies.

Like a blind person seeing the sun for the first time, a cursory reading of the Federalist papers brilliantly displays the obvious departure from what the Founders had in mind, including the most ardent advocate of centralized government of that time, and what we have today. So vastly different is the federal government today from what the Founders envisioned, that those who want to return to an originalist view of the constitution, like the Bundys, are considered “extremists” and “domestic terrorists”.
The Frontline report on the Bundys, was heavy on the theme of lawlessness and extremism. The good guys (well groomed, polished and official sounding government) versus the Bundys, represented as unhinged, fanatical, misguided threat to the American dream, a dream that included PBS and Big Bird.
THE FIRST CASUALTY OF WAR IS THE TRUTH
Frontline, drawing its name from a wartime analogy, the frontline of battle, implies that to get at the truth, one must be on the frontlines, where the action is. But, it depends on which frontline, the one drawn by the enemy or the one drawn by your sponsors?
There is no such thing as neutral, unbiased, war correspondents. A journalist can report on a controversial subject involving polarized parties, and the journalist will choose sides, the side that most favors the journalist’s own biases and ideologies. It is human nature. The bias is exacerbated by the pressure to conform to their financial supporter’s agenda, in this case, the federal government.

GREG BRETZING’S FATALLY FLAWED FRONTLINE FRAUD
Greg Bretzing, the FBI’s special agent in charge in Oregon at the time, was one of the most quoted in the Frontline report. Ironically, Bretzing, like Ammon Bundy, is a Mormon and both of them had given two years of their lives in voluntary missionary service. Both are clean cut, and well spoken. But, that is where the similarities end.
Bretzing, representing the arch enemy of the Bundys, the unconstitutional part of the federal government, where even the constitutional pedigree of the FBI is challengeable, toed the government line perfectly. Claiming that what Ammon Bundy did was clearly and obviously illegal, Bretzing came across as being “tactically patient” so as to avoid another Waco and Ruby Ridge. However, comments made by Bretzing in describing the shooting of LaVoy Finicum, betray his insincerity in claiming something that appears to be a flat out lie.
Bretzing, while feigning some kind of regret over the death of Finicum (another Mormon), explained that Finicum was repeatedly warned to “stop reaching”:
Bretzing (37:50 mark Frontline interview): “LaVoy Finicum immediately pops out of the car, law enforcement engage him and over a period of several seconds, give him commands to keep his hands up, to stop reaching, stop reaching but he reached several times in his jacket and was shot by law enforcement.”
The key to the government’s justifiable homicide, as cited by Bretzing, is the claim that Finicum was reaching for a gun in his left, inside Denham jacket pocket and was fatally shot after several warnings.
Bretzing’s claims are fatally flawed, claims that an objective Frontline should have been on top of:
The audio from Shawna Cox’s phone does pick up two warning orders from law enforcement officers (LEO) to “get on the ground” before they shot him. The voice of Finicum can be clearly heard as he moved away from the truck. The LEO were within a few feet of Finicum, so, if they told him to stop reaching or to put his hands up, why are their voices not clearly heard?
A lethal, high powered bullet came crashing through the roof of the truck and smashed the window where Finicum was standing, his left side parallel to the window. No warning could be heard prior to that lethal shot. The broken window was now open for better audio on Cox’s phone but nothing could be heard except the two warnings to “get on the ground” and Finicum’s voice and the shots that silenced him. Nothing could be heard through the now open window, that supported Bretzing’s claim that he was warned to keep hands up and to stop reaching. This is significant, because had Finicum been warned not to reach, then they can claim that Finicum had fair warning prior to being shot dead. The failure to heed the warning to “get on the ground” is not justification for use of deadly force.
The proof that the microphone was sufficiently sensitive on Cox’s phone to pick up voices is given when, after all the shooting, the surviving passengers are ordered out of the truck. Then the voices of LEO could be heard loud and clear.
Evidence has come out that the pistol that Finicum was allegedly reaching for, could have been planted (https://www.youtube.com/watch?v=FELmazWL4to) on him by the LEO after his death. While not conclusive, the evidence is compelling enough to warrant further investigation. None of that was mentioned by Frontline.
In the Bretzing Frontline fraud, he conveniently failed to mention the fact that the FBI special hostage agents at the scene were under investigation for firing unauthorized shots at Finicum and the vehicle, including the roof shot that broke the window, and that there was evidence of a carefully made cover-up by the same FBI agents. With almost a year and half since the shooting, the results of that investigation (http://www.oregonlive.com/oregon-standoff/2016/03/oregon_standoff_fbi_agents_und.html) have yet to be revealed.
The smooth faced, well-groomed, appearance of legitimacy, on the part of government actors, whether in the courtroom by dark suited prosecutors, or by Bretzing of the FBI, hide an obvious disdain for the truth and the need to lie on behalf of the greater good of the team, the federal government team in cooperation with Frontline (https://redoubtnews.com/2017/05/end-justifies-means/).

RELISHING AND RELYING ON THE IRRELEVANT RACIST COMMENTS BY CLIVEN BUNDY
To further support the federal government narrative, Frontline found it necessary to refer to the alleged racist comments of Cliven Bundy. Playing clips from various mainstream news commentators, Frontline said there was a “stampede away from Cliven Bundy” after he made comments about “the negro”.
One of the most common fallacies in critical thinking, the Red Herring fallacy, is where an opponent in an argument throws out something that is irrelevant, a red herring, in an attempt to distract the audience and make them discard the core argument.
Frontline was guilty of this egregious fallacy of critical thinking by reporting on Cliven’s alleged racism, unrelated to the core argument of BLM’s illegal practices at Bunkerville. Whether Cliven is a racist or not, is not relevant to the bigger issue of federal government unconstitutionality, overreach and abuse. But, the argument of relevancy is only applicable to the federal team if it promotes their agenda.
As one who knows the Bundy family, this writer can definitively say that Cliven Bundy is not a racist. When I was in Bunkerville, I met a black couple who were there to support the Bundys. That couple along with many other black people have been welcomed in the Bundy home. The Bundys are warm and generous people, making all visitors feel welcome, including blacks. To understand Cliven’s comments, one needs to understand the context.
In the Longbow film, Cliven said he has always been an outdoors person, not for recreation but for work. His sons talk about their dad’s work ethic, building many water installations that were later destroyed by the BLM. Cliven values hard work. When Cliven said it may be better to be out picking cotton than sitting on a porch in government housing receiving welfare, he was thinking of himself, that for him it would be a nightmare not to be able to work and to have to be dependent on government for support.
Cliven was not criticizing blacks, he was criticizing the federal government that makes it disproportionately easy for people of color to get welfare. The vast, government managed welfare system is one more example of how the federal government has exceeded its enumerated powers as found in the constitution.

DANIEL P. LOVE, THE LARGE PIECE OF THE PUZZLE FRONTLINE REFUSED TO SEE
The Frontline report, while focusing on Cliven Bundy’s alleged racial comments, failed to mention Dan Love (https://redoubtnews.com/2017/02/blm-daniel-love-named-investigation/). So conspicuous was the absence of Dan Love in the Frontline report, that it could be compared to Frontline claiming to have finished a 1000 piece puzzle while leaving out several hundred pieces. Dan Love had everything to do with the events of Bunkerville. His role in the events that shaped Bunkerville and its aftermath, was so glaring that it could be argued that his role was even more prominent than Bretzing’s, the darling of the Frontline report.
Dan Love was the special agent in charge of the BLM at Bunkerville. It was Dan Love that orchestrated everything. It was Dan Love who confronted Ammon Bundy and who confronted Pete Santilli (https://redoubtnews.com/2016/02/did-pete-santilli-have-it-coming/), both now in prison, without any verdict of guilt. It was Love’s testimony that was essential for the grand jury indictment. It was Dan Love who ordered the BLM agents to stand their ground, in opposition to orders from local law enforcement for BLM to stand down.
It is Dan Love who is being investigated for ethics and other violations. Those investigations are highly relevant to his credibility as a witness and for the opportunity to impeach his testimony.
But, true to its role in supporting the government narrative (https://redoubtnews.com/2017/04/love-testimony-blocked-judge/), Frontline must have read the order from Nevada federal district judge Gloria Navarro in which she declared that any testimony or contribution by Dan Love to the trial of the defendants, was not relevant. Such exclusion of Dan Love by both Frontline and Navarro is tantamount to excluding the testimony of law enforcement who confronted Lee Harvey Oswald in the Kennedy assassination.

THE WHEELS OF JUSTICE
In its final display of rampant bias, the Frontline report ends with the words, “For the Bundy family, the wheels of justice had finally started to turn.” The assumption being promoted by Frontline, was that justice was finally being served. Justice is defined as, “fair play, correct, aligned with truth, lack of bias”. The Frontline report is based on a false assumption that the federal team was employing principles of fair play and impartiality. Like a wolf disguised as a sheep, the Frontline report portrays that which is good as being bad and that which is bad as being good.
The wheels are intended to take one to the truth, extracting the truth like a miller’s grinding wheel extracts flour. The wheels go where ever the truth takes them in order to meet the ends of justice.
A more correct comparison would be, “the wheels of Catherine”, also known as breaking wheels where an accused criminal was placed on the wheel and their bones broken. In early courts, an accused’s guilt was often determined by how well they endured the pain or how fast they healed from the test of torture (https://wccshoeing.wordpress.com/2011/11/08/trial-by-ordeal/). A presumption of guilt was used by subjecting the accused to torture in an attempt to confirm guilt or in the much less likely event, innocence. It was this horrific practice that led Blackstone and Franklin to declare that a presumption of innocence was the bedrock principle of jurisprudence.
In courts today, accused, but not guilty, are placed in prison where they endure torture until they finally confess their guilt through a plea deal. Such is the actual real life experiences of the Bundy family and their supporters, who, just like the victims of the dark ages, must endure pain, humiliation, sexual abuse and denial of constitutional rights such as a Speedy Trial and the right to a presumption of innocence until proven guilty.
Proving that the atrocities of the dark ages are not extinct, Prosecutor Myhre, in a display of Orwellian double speak that would make Orwell blush, openly declared that the government had 5 years to delay trial and still be considered “speedy”. Frontline failed to go there.
Wheels of injustice indeed, wheels that will come off the federal government’s wagon if justice is ever allowed and things as they really are, are exposed. Until then, Frontline moves along its wheels lubricated by Federal funding, supporting their sponsor’s agenda.

BLATANT LIES IN FRONTLINE REPORT
The report is being recirculated on FB and its time to call it what it was: media bias.
For me, the lies told by Bretzing, the FBI special agent in charge of the Finicum murder, especially shock the conscience.
In his interview, Bretzing tells Frontline that Finicum was told to "stop reaching, stop reaching" but he refused to stop reaching for his gun on his left side so they were justified in shooting him. The truth is, Finicum was never told to "stop reaching". He was told to get on the ground but nothing was said about reaching.
Why is that significant?
Because "stop reaching" can justify homicide. Not getting on the ground cannot justify homicide. It can barely justify tasering.
A simple matter of Bretzing getting confused? Not on your life. Bretzing knew exactly what happened, he was in charge. This was not an unintentional confusion of words, it was an intentional lie, to look good on national TV, to promote the government agenda of respectability, legitimacy, dignity and decorum.

When I first received a letter in the summer of 2015 asking if I'd like to interview a local author about his new book, I almost passed on the opportunity. That all changed when I was speaking with the author on the phone and he mentioned that he too had been at Bundy Ranch on April 12, 2014.
I knew I needed to hear about his experience and so I welcomed him on my radio show.
From the first time I shook his hand, I knew LaVoy Finicum was a great man. There was an authenticity and spirit of goodness about him that was unmistakable. I came to appreciate his ability to speak truth to power in clear and unequivocal terms.
His love for liberty was second only to his love for God and his family.
On more than one occasion, LaVoy spoke of what an honor it was to stand for liberty and he punctuated this statement by enthusiastically reminding me that, "We were born for this time!"
Over the next few months, I had LaVoy on my radio show several times. In the middle of the occupation of the Malheur National Wildlife Refuge in Oregon, LaVoy surprised me by driving to Cedar City and joining me on my show yet again.
Later that evening, following a meeting with a number of friends and area ranchers, I gave LaVoy a hug goodbye and urged him to come home sooner than later.
I didn't want to admit it at the time but I felt finality in that hug and I genuinely feared for his safety.
Less than two weeks later, my friend was shot to death in an ambush set up by frightened enforcers acting under the color of law. I managed to keep it together until my little girl asked me why I was sad.
Over the next two weeks, I was approached by numerous people who had heard LaVoy on my radio program and who felt the power of his message. Their sorrow was palpable.
Interestingly, during that same time period, no less than 4 different individuals--all unknown to each other--comforted me by reminding me that I "was born for this time." By about the third time I heard this phrase, I sensed that the Universe was sending me a message of reassurance.
By the fourth time, I was certain of it.
LaVoy Finicum's earthly journey may have ended on that snowy roadside but I have no doubt that he is still very much a part of the eternal battle for freedom.
RIP, my friend, and God bless and keep your loved ones until the day you are all reunited.

I don't think Lavoys murderers were frightened. I think they were filled with hatred and a desire to kill him and everyone else in his vehicle. There was no justifiable reason to ambush and murder him.

More information has been released on the fateful day that LaVoy Finicum was murdered on a lonely highway north of Burns, Oregon.
In January 2016, a Dead-man’s roadblock was set up on Hwy 395, seemingly by order of the Federal Bureau of Investigation (FBI) top agent in Oregon, Greg Bretzing.
The Oregon State Police (OSP) were called to assist the FBI’s elite Hostage Rescue Team (HRT). However, even though they planned to treat the passengers of 2 vehicles as extremely dangerous, the day did not end as expected, even for the FBI.
FBI Supervisory Special Agent W. Joseph Astarita is facing 5 charges for his actions during the incident, including obstruction of justice and giving false statements to investigators.
Astarita’s trial is expected to begin this month. His attorneys have asked that at least 4 of the 5 charges be dismissed. In a 32 page response to their motion, the government released more information than anticipated.
The motion outlines the government’s version of events on January 26, 2016. It also states that the FBI requested the State police were not to wear their standard body cameras.
This is a highly unusual request, especially in the current societal climate. It generally benefits officers to have their actions recorded during potentially dangerous events.
To have the FBI’s elite Hostage Rescue Team specifically request assisting officers not wear them does not bode well for the expected outcome for the civilians involved.
In an additional apparent lack of transparency, they FBI also asked that subsequent interviews with agents not be recorded. This was, again, unusual as questioning is normally recorded, as the FBI well knows.
It would seem that the FBI had planned from the beginning to attempt to hide many of their actions, relying only on the long-range cameras from overhead planes.
It brings up many questions, such as whether or not the HRT team was instigating fear in the OSP officers with their shots, attempting to get them to murder the occupants of the truck?
As many questions as there are, the Federal prosecutors are not attempting to have them all answered. They have only charged Astarita with lying to investigators. No one has been held accountable for the death of LaVoy or for Ryan Bundy being shot in the arm.
The civil rights (https://redoubtnews.com/2017/07/evidence-multiple-illegal-acts/) of all of the truck’s occupants have been violated, yet the Federal prosecutors have not yet shown concern for these issues. They have, however, shown great care (https://redoubtnews.com/2017/06/fbi-privilege-keeps-defendant-jail/) for the rights of Astarita. He has not been held in jail, has not been required to provide extreme bail, and has not been relieved of his position within the FBI.
The trial is sure to be a model for justice in America.

Larry Wooten is the whistleblower that came forward during the Bunkerville Standoff trial in Las Vegas last year and revealed the atrocities being committed by the Bureau of Land Managment (BLM) and the Federal Prosecutors in the case, headed by Steven Myhre (https://redoubtnews.com/2018/01/nevada-bundy-prosecution-collapses/).
Wooten was the lead investigator for the Bureau of Land Management’s investigation into the Bunkerville/Gold Butte operation that went bad for them in April of 2014.
The disturbing information revealed by Rep. Matt Shea (https://redoubtnews.com/2017/12/shea-exposes-blm-atrocities/) was enough to have the entire indictment (https://redoubtnews.com/2018/01/bundy-indictment-dismissed-prejudice/) of these defendants set aside.
However, there were other defendants affected by this information that have not been allowed the same benefits, including Todd Engel.
Engel was convicted of the lesser charges against him during the first trial in Las Vegas. During that trial, Engel was forced to represent himself due to ineffective counsel.
Additionally, Judge Gloria Navarro consistently ruled against the defendants (https://redoubtnews.com/2017/04/judge-openly-laughs-defendants-rights/) and held they could not question the main accusor against them, BLM Special Agent Daniel P. Love.
Love has since been fired (https://redoubtnews.com/2017/09/dan-love-out-blm/) for his actions by the BLM. Yet, Engel still sits in prison, waiting his chance for justice. Engel has not yet been sentenced on his conviction, with a new date for the sentencing being July 19, 2018.
Engel has obtained a new attorney who is fighting for his release, or at least a new trial. Among their arguments are the Wooten memo, which was the catalyst for the release of Cliven Bundy and the defendants in that round.
If the Wooten information was enough to set aside the indictment (https://redoubtnews.com/2017/12/rep-shea-reveals-breaking-news-blm/)for some of the defendants, it should be equally available to all of the defendants in the case.
The prosecution, lead by Steven Myhre who has since been relieved of his supervisory position (https://redoubtnews.com/2018/04/bundy-prosecutor-myhre-out/), argued that the Wooten information did not apply to previous defendants, and also that the information was not true. In other words, Myhre called Larry Wooten a liar.
Wooten doubled down on his information after that and wrote a second memo with even more revelations. The letter was sent directly to the Department of Justice in Washington D.C., headed by Attorney General Jeff Sessions.
This second memo has been kept under very strict lock and key, with no one being allowed to read it until recently. The only ones allowed to even view this letter have been under strict observation at the prosecutor’s office, hence the defendants themselves have not been allowed to see the evidence against them.
Engel’s attorney, who has viewed the letter, is fighting for it’s release to the public, describing the new information akin to The Amityville Horror Story.
Warren Markowitz, Engel’s attorney, would like to have Larry Wooten testify in a deposition, the costs of which could have been prohibitive at roughly $10,000. However, supporters of Engel rallied this weekend and raised the needed funds.
It is time to get this done.

It is also time the crooks in the Las Vegas U.S. Attorney office, starting with Steven Mhyre be prosecuted. Then onto the BLM and FBI right on up the ladder to the Washington D.C. offices. Trump’s, as pResident, most important duty is to “take Care that the Laws be faithfully executed”. But he is more interested in making Israel great tweeting about what great a job he is doing. Both he and his feckless AG Jeff Sessions are in violation of their oath of office by allowing these goons to go unpunished.

Finicum Family’s Wrongful Death Lawsuit
Moves Forward In Federal Court
(East Oregonian (http://www.eastoregonian.com/eo/local-news/20180719/finicum-familys-wrongful-lawsuit-moves-forward-in-federal-court)) – Lawyers for the family of Malheur National Wildlife occupation spokesman Robert “LaVoy” Finicum have 15 days to confirm they served dozens of defendants in his wrongful death lawsuit.
Magistrate Judge Patricia Sullivan handed down the directive Wednesday in federal court in Pendleton during a conference with the lawyers representing the Finicum family and a host of defendants. Sullivan said she wanted to meet the lawyers “because I think we may be spending some time together.”
The lawsuit names the United States as a defendant, along with the FBI, federal agents, the state of Oregon, Oregon Gov. Kate Brown, Oregon State Police, Harney County, and more — including 100 law enforcement “John Does.” The suit seeks more than $5 million in damages for Finicum’s estate, his wife Jeanette Finicum and each of their 12 children.
Attorney Morgan Philpot of Utah represents the Finicums and told the court all of the defendants have been served.
But attorney Thomas F. Armosino of Medford said he represents Harney County and its officials and none of his clients received notices of the suit. And Leah Taylor with the U.S. Department of Justice said defendant Greg Bretzing, former head of the FBI in Oregon, also has not received notice.
Philpot stressed his side has met the legal obligation to serve the defendants. Sullivan said he had 15 days starting Wednesday to deliver documentation of that service and she would not grant him one day more.
“Just give me a report,” she told Philpot.
Sullivan also questioned why U.S. Sen. Ron Wyden, D-Oregon, and former U.S. Sen. Harry Reid, D-Nevada, are among the defendants.
“Well, either get them served or get them dismissed,” she said.
Likewise, Sullivan noted she did not know why the suit includes the Center for Biological Diversity in Portland. David Campbell, Portland attorney for the center, said “I agree, your honor.”
Philpot said he would get the judge the report and added next week’s scheduled criminal trial of FBI agent (https://redoubtnews.com/2018/02/fbi-body-cams-fatal-roadblock/) W. Joseph Astarita in Portland could yield more names for the defendant list.
Astarita faces federal charges of making false statements and obstruction of justice. The government alleges Astarita lied about firing at Finicum moments before state police shot him dead on Jan. 26, 2016, when he bolted from a pickup at a roadblock on Highway 395 in Harney County.
The trial might not be such a boon to the Finicum side. James Smith, with the Oregon Department of Justice, represents the state and its interests. He said law enforcement officials testifying during the trial will use pseudonyms out of concern for their safety. That will make them difficult to serve notice to at the trial, he said.
Sullivan said she will handle pretrial matters, motions and expected discovery — the gathering of documents, evidence and facts — to start this year and last into 2019. She told the lawyers she will hold future hearings in Portland to make it easier for them to attend and because the federal courthouse there can better handle security. But nothing gets moving until parties receive notice about the lawsuit. The deadline for that report is Aug. 3.
Sullivan also dealt with a separate lawsuit seeking millions of dollars in damages from Astarita, Gov. Brown and others for the events that led up to Finicum’s death. (https://redoubtnews.com/2017/12/lavoy-finicum-kill-list/) Shawna Cox of Utah filed the lawsuit pro se — that is, for herself — on Jan. 26, two years to the day of that fatal showdown and just as the window to sue was closing. Cox later added Ryan Payne, Victoria Sharp and Ryan Bundy as pro se plaintiffs.
Sullivan said Cox is not a lawyer and cannot add anyone else to a complaint. And no one, she said, signed the original complaint itself. Instead, they signed other documents and included those with the lawsuit. Sullivan even held up the last page of the complaint to show it was bereft of any signatures.
Attorney Roger Roots of Rhode Island represents the plaintiffs in this case. He said Cox, Bundy, Sharp and Payne agreed to sue, and Cox rushed to file the complaint before the deadline expired. He joined the case later and amended the complaint because “the first had a lot of flaws.”
Since then, Cox and Bundy sought to withdraw from the case. Sullivan grant that and denied a motion to file an amended suit.
“To me this is a pretty straight forward legal rule — a pro se plaintiff can’t sign for other pro se plaintiffs,” she said.
Roots said there are cases addressing the purpose of such rules. Sullivan told him to “dig into it” and file an objection to convince her. Roots has until Aug. 20 to provide that, and the defendants have until Sept. 4 to respond.

W. Joseph Astarita, a member of the FBI’s Hostage Rescue Team (HRT), is on trial in Portland charged with lying and obstruction of justice in connection to the events culminating in the shooting of Robert “LaVoy” Finicum on January 26, 2016.
The jury of 9 men and 3 women were seated on Tuesday with opening statements this morning, Wednesday, July 25th.
The prosecution put forth strong arguments against Astarita, with the defense following up by grasping at straws in their strategy to show some reasonable doubt for their client.
To begin with, according to the prosecutor, there were eight (8) shots fired with only two (2) shell casings being recovered. The prosecution suggests that Astarita collected the missing six (6) casings.
Included in the defense opening statements were that their client could not have fired at the vehicle because he is one of the finest shooters in the world and, therefore, would not have missed his target. They contend that this should prove his innocence. They did not address the fact that he may very well have hit his mark exactly, if he were attempting to provoke the Oregon State Patrol (OSP) into shooting at the truck.
The defense has also attempted to cast doubts on the trajectory analysis for varying reasons, including that the snow may have melted enough to change the position of the truck, thereby invalidating all of the analysis.
Additionally, the defense team talked about the Federal agents picking up the shell casings. Claiming that these men are trained to pick up all of their equipment, they said that the agents could actually have been picking up LIVE ROUNDS from the ground, as they were concerned about militia members possibly coming to the scene. This is apparently a new protocol, as I have never heard of the regulations being to clean up the crime scene before the investigation has concluded, or even begun.
Another bombshell statement was made that an agent from the first stop called ahead to the agents at the second stop after Finicum sped away in the truck. The first agent made remarks that Finicum refused to stop and therefore they would have to “shoot him”. These statements go to their justification defense. The law is clear that they are only justified in firing their weapons for self defense or defense of others, so this explanation is another desperate attempt by the defense.
We are waiting to see how the trial attorneys deal with the issue of the FBI ordering the OSP not to turn body cameras on.
Finicum’s vehicle will be brought to the courthouse for the jury to examine, as well. It is unclear if the public will be able to view the truck.
After the opening statements this morning, the prosecution began calling witnesses. Former Special Agent In Charge Greg Bretzing took the stand and his testimony will resume after lunch.
The court has said this trial may last 3-4 weeks.

Multiple Brady Violations in Malhuer trials revealed . . . Also Bretzing revealed there was a contingency plan for a full assault on the refuge. During the Malhuer trials the prosecution denied there were any such plans.:mad: :mad: There were over 300 FBI agents in the area. ???

The rest of the contingency plan was in multiple parts, with one part being an ambush of the leadership while they were on the road. This was accomplished on January 26th. which in my mind they admit it was premeditated murder and all who were involved are accomplices.

Greg Bretzing, the former Special Agent in Charge during the Malheur Protest (https://redoubtnews.com/2016/10/verdict-not-guilty-malheur-7/) in January 2016, was the first witness to testify in the trial of W. Joseph Astarita (https://redoubtnews.com/2018/07/astarita-opening-statements/).
Astarita, a member of the FBI’s Hostage Rescue Team (HRT), is accused of lying about firing his weapon on the day that LaVoy Finicum was killed, as well as obstruction of justice.
During his testimony, multiple points were revealed that were never disclosed to the defendants in the two Malheur Protest trials, of which this trial centers around. This information could be considered ‘Brady’ material, which would have been required (https://www.law.cornell.edu/wex/brady_rule) to be turned over to the defense (https://redoubtnews.com/2017/02/malheur-protest-trial-2-jury-selection/).
Bretzing explained that there were 2 surveillance planes flying, one at night using infrared cameras, after the shooting. This video will be played in court later, possibly as soon as tomorrow.
The infrared video shows someone wandering around after the shooting kicking the snow looking for his shell casings, then bending over and picking something up. The prosecution has suggested that the person is Astarita and that is when he was picking up shell casings.
The defense, on the other hand, believes that the FBI have a protocol in place to clean up their equipment even before an investigation commences. They have even suggested that there was live ammunition on the ground that needed to be secured before any ‘militia’ members showed up.
Bretzing also revealed that they had over 300 agents in the area. Additionally, the HRT members had been in the area for 2 weeks, staying at a motel in Boise, ID.
Further, Bretzing stated on the stand today that there was a contingency plan for a full on assault on the refuge. This is important because in the previous 2 trials, it was stated that there was no plan.
The rest of the contingency plan was in multiple parts, with one part being an ambush of the leadership while they were on the road. This was accomplished on January 26th.
Another part of the plan was to place roadblocks all around the refuge, believing they could starve everyone out. They would then arrest everyone individually as they exited the refuge. This was to be the next step if the traffic stop had not worked.
Astarita’s defense team chose not to cross examine Greg Bretzing.

The next witness was Travis Hampton, from Oregon State Police (OSP). He was the highest ranking OSP officer on the scene.
Hampton testified that OSP learned about Ammon Bundy’s occupation at the rally, not before.
The defense questioned Hampton on his relationship with “Officer 1”, the man that fired 2 of the 3 fatal bullets at Finicum.
The defense made a big deal of Hampton’s testimony, with lots of cross examination, as they are trying to show that Hampton and “Officer 1” are good friends and that Hampton may very well have covered up any mistakes that “Officer 1” committed. This is one of the multiple defense “theories” of the case.
The final witness of the day was Scott Ward, the Senior HRT member, positioned at “Stop 1”.
The basics of Ward’s testimony were that he gave a command after the shooting to have the road closed. The only vehicles allowed were Law Enforcement or ambulance. The purpose of this testimony was to show that random tires did not pick up the shell casings, which is another of the defense “theories”.
There were no random people walking around picking up shell casings because it was sealed off to everyone other than law enforcement.

I've been looking for Peter Offermans site again and it doesn't have the information that was on there when I first saw it. It was in-depth and very thorough and I don't think the murderers in the government would want to many people looking at it.

Bretzing’s testimony the first day almost admits it was premeditated murder. Then the agent BM’s testimony backs up what Kelli Stewart believes. After listening to what Jeanette Finicum and Kelli Stewart reported I am of the opinion these bastards are well coached and setting the jury up for enough reasonable doubt that the guy will walk.
The only good I see coming from this dog and pony show is information that will help Jeanette in her wrongful death trial.

The trial of FBI agent Joseph Astarita began yesterday. He is charged with lying under oath and falsifying an FBI report. The FBI has accused him of discharging his firearm during the shooting of my husband while Mr. Astarita is taking the position that he never fired his gun. The jury will get to the truth.
What we do know from opening statements is that the FBI didn't follow its normal protocols and procedures the day my husband was shot and killed. The crime scene was not preserved, official reports were not prepared and the firearms used in the shooting were not properly secured or inspected. It's almost as if the FBI didn't want to preserve the evidence.
I am here in Oregon and will be attending the trial of Joseph Astarita. I want to hear what happened that day. I want to see the faces and hear the voices of those involved in the killing of my husband, LaVoy. I am here to see that justice is done.

The son of a bitch shot an 18 year old kid in the woods of Oregon that hadn't done anything wrong. It was night time when Codding and two other SWAT team members were sneaking up on his house to serve a warrant on two others they were looking for. Sam Mullane was innocent of any crime, he heard something outside his home and he stepped outside with his flashlight and rifle to see what it was. The SWAT team told him to drop his rifle, he didn't and he turned to walk away and all three of them shot him because "they were afraid" of him.

The trial for FBI Special Agent W. Joseph Astarita continues (https://redoubtnews.com/2018/07/astarita-opening-statements/) in Portland.
The biggest news this week was the accidental naming of the officer that fired the fatal rounds (https://redoubtnews.com/2017/07/evidence-multiple-illegal-acts/) into LaVoy Finicum.
Though the judge has stated that the officers involved will be referred to by euphemisms, Officer #1 was named on the stand by SWAT officer, Bob Olson.
This information was picked up by Social Media, the two most prominent postings were by BJ Soper and Ammon Bundy.
The reasoning was clear in that they were sharing the information for transparency. In spite of that, they have now been accused of multiple nefarious acts, and it has even been suggested that they are trying to have the man hurt.
However, the MSM, specifically the Oregonian (https://www.oregonlive.com/oregon-standoff/2018/08/state_police_officer_who_fatal.html), have also reported on this issue, though they seemed to have found another way to spin the story. They could have just reported on the slip up in court, but they chose to turn this against anyone that posted about the released name. This certainly gives them the chance for more headlines. Though they did not name the officer involved in the shooting, they were very clear in making sure that everyone knew how to find the name of the officer.

This all suggests that the MSM not only likes the controversy, and perpetuates the controversy, but might even be encouraging violence, just to get a headline. What other reason would they have to print a provocative article of over 1000 words like this one?
I would never want the man hurt. Yet, I also do not want the people who used his name hurt either. The actions of the Left are exactly as they are accusing others. They are suggesting that anyone naming this officer is threatening.
So, is their article, in which they will tell you how to find the name of Officer #1, as well as naming the people they feel are threatening him, considered threatening as well? Did they go too far just for a story? Or is this just another case of accepted Media Bias?
If something vicious should happen to any of the officers involved, or if something should happen to BJ Soper, Ammon Bundy, or anyone else that used the officer’s name, the blame will not automatically go to the Patriot community. It could very easily be placed at the feet of the Main Stream Media.

I have sort of run out of steam watching this play out. I feel that those US Citizens on the jury will probably side with the authorities and let the crooks off scotfree. The amount of brain dead fellow citizens knows no bounds. They always continue to surprise me by their ignorance of the extent of the crime, of the worlds largest crime gang, the govt of USA INC.

That's why the prosecutors choose the jury, usually dumb fuck idiots that only MSM penetrated their minds. This case has went way beyond what it should have and stiil the verdict is known before they even decide.

I ran out of steam early on when I saw it is a dog and pony show to appease the public. As I stated earlier in the begining of this trial the only good I can see coming from it is testimony the Finicum family can use in their wrongful death lawsuit. I will post Jeanette’s videos too keep whomever is interested informed. The ignorance of the U.S. Citizens was planned many years ago, that is the purpose of the unconstitutional Dept. of Education.

The criminal trial of FBI agent Joseph Astarita is coming to a close. I have been here each day, listening to the testimony. Watching the witnesses and wondering what the jury is believing and rejecting.
After approximately one week of testimony one of the biggest messages I walk away with is that the FBI treated the crime scene -- where LaVoy was shot and killed -- much differently than they had been taught and trained to. They walked all over the crime scene picking up pieces of potential evidence, ordered the Oregon State Police to turn off their body-cameras and refused to give individual statements to the criminal investigator assigned to learn the truth about the events leading up to the shooting of my husband. I wondered quietly, how many of us would have been allowed to write our own rules, not any one of us would be allowed to throw out the rule book without explanation or reason.

This comment was written by a friend of mine and I think there is a lot of truth to it. Maybe we should really understand what Lavoy stood for. Did you know Lavoy was the first cowboy after my father to notify(I think this should be "nullify") his grazing contract with the BLM and stop paying grazing fees on his own ranch? Lavoy was a man of principles and he was willing to defend those principles with his life.
“They are completely changing who LaVoy was from the public’s perspective. I see it every day. It makes me not want to hear another word about him other than from the videos which can’t be twisted or water down. Sean told me that at the meeting with the ranchers, LaVoy had to step outside because he was so angry over the apathy and fear he was hearing. Sean quoted LaVoy saying, “I HATE COWARDS!”
Now everyone speaks of him like a man who was soft and timid and warm to anyone and would never offend someone with harsh truth. The police told him to stop and he yelled “YOURE WASTING YOUR OXYGEN SON! YOURE GONNA HAVE TO SHOOT ME!”
That wasn’t a soft man of fear .. that wasn’t a man of compliance. That was a man of great courage and a stubborn man at that! I know it cost him his life, but that’s what makes him the hero! At the end of every western movie the cowboy dies and the people remember his strength and courage. Not his passive compliance.
I never met him and I know he is being watered down into something he wasn’t.
Maybe it’s the law suit that’s driving this need to rewrite history. I don’t know. But I know it isn’t setting well with me. The LaVoy I hear about today would not have moved me to show up in Portland and speak out.”

The 37-year-old married father of two from a Portland suburb said he pulled no punches when he filled out the juror questionnaire from federal court.
Would he give more credence to a law enforcement officer's testimony?
Officers are "heroes" as far as he's concerned, he responded. "I will always tend to give them the benefit of the doubt,'' he wrote.
So he was surprised when he was selected as one of nine men and three women to hear the case against W. Joseph Astarita, the FBI agent accused of lying to conceal that he fired two shots at refuge occupation spokesman Robert "LaVoy" Finicum.
He volunteered to be the presiding juror to help direct deliberations. No one else did, so the job was his.
Hours after he and the others voted Friday to acquit Astarita (https://www.oregonlive.com/oregon-standoff/2018/08/jury_returns_verdict_in_case_o.html), the juror described his experience to The Oregonian/OregonLive -- from his changing thoughts about Astarita's honesty to his handshake with the agent after the trial ended.
"Let me be clear, the judge ordered us to set aside our prejudices,'' he said. "I feel I did that.''
One of the things that troubled him, he said, was the apparent "us vs. them'' tension between the FBI and Oregon State Police that pervaded the 2016 confrontation with Finicum and the aftermath. The animosity came out in the trial testimony, he said.
"I feel it's possible someone is lying," he said. "I don't know which side, or who, or it could be both. There's still two unattributed shots, and I feel like we're never going to know for sure who took them.''
He also said he "felt like a pendulum going back and forth during the trial -- from 'oh man, he definitely did it' and then 'well, maybe, he didn't.'''
The juror asked that he not be identified by name, concerned about facing potential backlash over the trial's outcome. He also didn't want to talk about the views of other jurors.
In the final analysis: With no direct testimony from a witness or damning physical evidence that definitively tied Astarita to the disputed shots, he believed more than one person could have fired them. Not knowing who fired, it was impossible to conclude that Astarita's denials were lies, he said.
"It's not my job to know who shot," he said. "It's my job to find out if these facts were proven beyond a reasonable doubt, and they weren't.''
Prosecutors had argued that Astarita, 41, was the only officer at a roadblock on U.S. 395 who could have fired a bullet that pierced the roof of Finicum's truck on Jan. 26, 2016. The shot came as Finicum was stepping out with his hands in the air after swerving into a snowbank at the roadblock north of Burns. The other shot missed.
They maintained that Astarita, a member of the FBI's elite Hostage Rescue Team, panicked and took those shots, but when he missed his target, he told his supervisors and investigators that he hadn't fired.
Two and a half years after the shooting, no one has acknowledged taking the shots.
Astarita's lawyers argued that the government's forensic analysis of the bullet's path, which included a 5-degree margin of error, was flawed. They had their own expert present a much wider range of potential bullet paths, showing two other officers who could have taken the disputed shots.
The presiding juror said he believed the trajectory fell somewhere in the middle of the two analyses.
"I was a little bit more comfortable with presenting the trajectory as a range,'' he said. But he felt the defense depiction was far too expansive.
He was impressed by a demonstration from the government's expert, Michael Haag, showing his method for determining the bullet's path, despite defense attempts to debunk it.
Haag, he said, came across as knowledgeable and "super confident'' as he climbed a ladder and knelt on top of Finicum's truck, which had been towed into the courthouse loading dock one day.
Haag placed the tip of a yellow rod into the "lead-in'' point where the bullet first struck the roof's metal, rocking it until it fell into place, securing it with tape and a clamp and then measuring the horizontal and vertical angles.
The presiding juror asked to climb the ladder beside the truck and see the bullet hole himself. Four other jurors followed suit.
"I'm really glad I looked at it,'' he said. The photo presented of the bullet hole, identified as "Impact W'' by investigators, was taken at an angle, he said. "I wanted to look at it directly from the top and see how symmetrical it was.''
He felt the defense did succeed in casting doubt on the work of a state forensic scientist in arguing that she failed to consider the settling of Finicum's truck into the snow between the time the shots were fired, the time photos were taken and when she measured the truck's angle in the snowbank.
"In this kind of case, you have to be sure,'' he said, noting that any slight deviation "could change who the shooter was.''
He said he placed less reliance on the circles that FBI Hostage Rescue Team agents and two state police SWAT officers drew on still images of the shooting scene projected on a computer monitor at the witness stand.
The circles were supposed to denote their general locations at the time of the disputed shots. But the stylus used to mark their spots appeared to be extremely sensitive. As a result, several witnesses had to erase their initial circles and try a second time.
"Nothing drawn on the screen was precise,'' he said, echoing one of the defense arguments made repeatedly during trial.
So the juror instead put more weight on the video images taken from two FBI surveillance planes to determine the officers' locations.
"If I look at the freakin' video and see where people were standing, I felt there were three individuals that could've taken that shot: Officer 1, FBI agent B.M. and the defendant,'' he said.
He said he also found Astarita more credible than Officer 1, a state police SWAT member. Authorities haven't disclosed the officer's name for security reasons. In the courtroom and in court documents, he was referred to only as Officer 1.
The turning point for the presiding juror came when defense lawyers countered Officer 1's testimony on how he may have loaded his rifle magazine.
Officer 1 said he routinely loaded the magazine to capacity and then stripped one round out, leaving 29 bullets in the magazine. The prosecution presented evidence that the officer's two spare magazines held 29 rounds that night as well. When his rifle was examined after the shooting, his magazine had 24 bullets remaining.
That accounted for the three shots he fired into the front of Finicum's truck as it barreled toward the roadblock and the two shots he fired later, striking Finicum in the back and killing him. The fatal shots came moments after the disputed shots as Finicum walked away from his truck and reached into his inner jacket pocket where police said he had a loaded pistol.
Yet the defense showed that when Officer 1 used a handgun, he usually "topped it off" - meaning it was filled to capacity with one more round in the chamber. Then they produced an investigative report that found the capacity in Officer 1's rifle was 31 rounds, suggesting that the rifle magazine had 30 rounds with one in the chamber.
With 31 rounds in Officer 1's rifle when he started that day and 24 remaining at the end, that could have allowed for a total of seven shots taken, including the two disputed shots, the juror said.
The defense also raised questions about Officer 1's truthfulness on the stand, the juror said.
While Officer 1 said he told investigators last year that he had been startled by a noise to his right at the time of the disputed shots, the lead detective for the shooting investigation testified on cross-examination that neither he nor other investigators had heard Officer 1 mention the noise until a month before trial.
In contrast, the juror found Astarita poised, articulate and credible as a witness.
"You could tell that he was very prepared,'' he said.
But he said he saw an unguarded moment when Astarita was handed his Colt AR-15 rifle by a prosecutor during cross-examination. Astarita immediately turned back with a quizzical look, "Can I just ask why the safety's off?''
"He was really extremely concerned. He snapped out of anything that was rehearsed,'' the juror said.
As Astarita was asked to demonstrate how he holds his rifle at a low-ready stance, the juror felt Astarita clearly knew what he was doing and astutely articulated each step of his decision-making process in deciding whether to shoot in a given situation.
"That made me feel more strongly that he just might not have been the shooter,'' the juror said.
But the flippant remark Astarita gave his supervisor at the scene when asked if he had shot his gun disturbed the juror. Astarita responded: "You don't get to ask me that bro,'' others testified.
That certainly raised suspicions about Astarita, the juror said, yet he felt "that little piece of information alone is not enough."
He also thought the infrared aerial video that caught figures scouring the ground and looking under trucks after the shooting might have shown officers trying to pick up bullet casings to hide their tracks or might have been a standard check for sensitive items or lost gear as FBI agents testified.
But it was impossible to identify who the figures were on the video, he said.
In three weeks, the jury listened to 11 days of testimony from more than 40 witnesses.
The presiding juror admitted that it was sometimes challenging to stay focused through repeated showings of FBI aerial videos of the scene and the testimony of a defense witness vacationing in Spain whose phone disconnected every 15 minutes,. He could be seen occasionally drinking from a can of Monster triple-shot espresso. Another juror had brought in a 12-pack of the drink to share early in the trial.
This was the presiding juror's first time serving on a jury. While he said he's now eager to return to his technical support job in a large law firm, he came away impressed with the lawyers on each side.
"I think the prosecution built the best case that they could given what they had to work with,'' he said.
After the jurors returned their verdict and left the courtroom, U.S. District Judge Robert E. Jones thanked them. The defense team, along with Astarita, soon afterward entered the jury room.
Astarita and his four lawyers shook each juror's hand, thanking them for their service.
Astarita addressed them briefly. He reiterated how passionate he was about serving as an FBI agent. He spoke of how he never thought he'd be accused of a crime and described how he lay in a fetal position after learning he was going to be charged, the presiding juror recalled.
Tearing up, Astarita said "how we'd given him his life back, and he was grateful.''

I saw this on John Lamb's facebook site and thought is was pretty good on cops. Jeanette Finicum may think it's wrong to hate but I don't. God said he would put hatred between the seed of the woman and the seed of the serpent in genesis 3:15 so there's nothing wrong with feeling it in my opinion.
“The problem is not just a few bad apples in law enforcement. If that where the problem this would be so much easier. The problem is the system is bad, the training is bad, the spending is bad and the laws have become corrupted. Those that may be good in law enforcement won’t stand up against it, making them bad. They are either ignorant, too afraid or will not take the chance of losing their pension. Most of the wickedness originated from federal training and funding, until now you see it all the way down into the little towns. They are the standing army that the founders warned us so clearly about.
If I am not obedient to what those in power tell me to do, then who comes and kicks in my door, drags me out of my own house, terrifying my wife and children? Who stops me on the side of the road, puts a gun to my head, drags me out of my car and off to prison, leaving my little family to fend for themselves? Who shoots me if I do not comply? Who takes away my guns leaving me defenseless? It is not the director of the BLM. It is not the Mayor or the Governor. I is not the legislatures. It is those who call themselves law enforcement officers. They do what they are told. “It is just my job” they say. This is what is so dangerous about the current system of law enforcement officers we have today. Most of us agree on either side that the laws have become corrupted and the courts have become corrupted. SO, we are okay with men pointing guns and killing people to enforce corrupt laws? How does that make sense? Those who call themselves law enforcement officers need to take a honest look at who they have become...

Yes, some may be kind from time to time. I have experienced kindness when in prison by a certain officer and then this same officer force stripped me with four other men, because he was told to by his supervisor. He whispered to me that he was sorry before he did it and then again after. He truly felt sorry. But after thinking about it, I have concluded that he was the most wicked one of them all. He knew what he was doing was wrong and he did not want to do it. He anguished before and after he did it, but he said nothing to stop it. He even participated in it. I forgave him before it was even over, but he is the one that will be held most accountable.
If officers of the law are good then they will not do bad things, they will refuse to enforce wickedness. Just because someone is an officers of the law does not justify hitting someone, making someone bleed, arresting someone or killing someone. God’s laws apply equally to everyone one no mater their position. God is no respecter of persons. The current law enforcement system is bad and those that are being paid to enforce the system are by the very act being bad.
Do not mis-understands me- No man has a right to take life, liberty or property and if someone tries to take life, liberty of property then then those defending their life, liberty or property have a right to use force in that defense, even lethal force if necessary and even against those that call themselves law enforcement officers. This right belongs to every person equally. If someone uses force for any reason other than the defense against their life liberty or property then that person will be accountable to the Maker of the supreme law of every land. This goes for officers of the law or anyone else. This is the equality of God. If an officer of the law acts outside this equality then he is like salt that has lost his savor. He becomes good for nothing but to be trapped under the foot of men. All people are important and all people are equal. This is the true and complete definition of Freedom.”

Correct. Jeanette Finicum and the Finicum family is also careful not to allow others to post anything on their social media that might cast them in a bad light. I believe honor is the compelling factor but another factor may be to preserve the integrity of the wrongful death lawsuit. I had the opportunity to meet her. She is a real lady.

That verified indictment was filed by the Liberty Alliance “Unified New York Common Law Grand Jury” in New York. It is not recognized by the DOJ Admiralty/Equity courts and will be ignored/dismissed.

Today is the 3rd anniversary of the murder of Robert “LaVoy” Finicum. The persucution in the Bundy Trials has been given permission to appeal the not guilty verdict of Cliven Bundy and the others who were in that tier with him.

A wrongful death civil suit can proceed against state police in the 2016 fatal shooting of Oregon refuge occupation (https://www.oregonlive.com/portland/2017/02/oregon_standoff_timeline_41_da.html) spokesman Robert “LaVoy” Finicum, but allegations against the FBI, (https://www.oregonlive.com/oregon-standoff/2016/10/15_confidential_sources_fed_fb.html) U.S. Bureau of Land Management, the governor and Harney County should be thrown out, a federal judge has recommended.
U.S. Magistrate Judge Patricia Sullivan made the findings in a 73-page ruling (https://www.documentcloud.org/documents/7008305-FINICUMFINIDNGSJUDGEJULY24.html) that now goes before a district judge, who can accept the findings, reject them or issue a separate decision.
Jeanette Finicum filed the lawsuit against the FBI, Oregon State Police, the Bureau of Land Management and others in the fatal shooting of her 54-old husband, a rancher from Arizona who became the spokesman for the armed takeover of the Malheur National Wildlife Refuge in southeastern Oregon.
He was shot Jan. 26, 2016, by two state police officers after he fled a police stop and emerged from his truck at a roadblock. The FBI and state police initiated the stop to arrest organizers of the refuge occupation. Police said Finicum reached inside his jacket for a gun when he was shot. Police later said they recovered a loaded 9mm handgun, according to the investigation.
The suit alleges that Finicum, 54, was shot “assassination style'' by “one or more militarized officers of the Oregon State Police and/or FBI'' as he was trying to drive “across the county border'' to seek the protection of Grant County Sheriff Glenn Palmer.
The suit contends police and the FBI set up a "Deadman's roadblock'' on rural U.S. 395 where Finicum was shot and killed. It accused the FBI, Oregon State Police and Bureau of Land Management of negligence and failing to properly train and supervise its officers.
The suit followed an indictment against FBI agent W. Joseph Astarita, who Oregon investigators alleged lied about firing twice at Finicum's truck. Astarita's bullets didn't hit Finicum, investigators said. They concluded that one of Astarita's shots hit the roof of Finicum's truck and that the second shot missed.
Seconds later, state troopers shot Finicum three times after he walked away from his pickup and reached for his inner jacket pocket, where police said he had the handgun, according to the investigation.
Finicum was shot in the left upper back, left shoulder and right lower back. A bullet pierced his heart, an autopsy found.
An investigation by local law enforcement authorities found the state police shots that killed Finicum were justified.
Astarita was acquitted (https://www.oregonlive.com/oregon-standoff/2018/08/jury_returns_verdict_in_case_o.html) of all charges after a jury trial.
The magistrate judge threw out allegations that Gov. Kate Brown was in any way liable for Finicum’s death, finding that the governor did not participate in the encounter at the roadblock or the shooting.
The suit alleged that the governor was the “proximate cause” of the allegedly excessive use of force because she disseminated information about Finicum in an effort to “control the narrative” and authorized the January 26 stop and the state police participation.
But Sullivan found that wasn’t sufficient, finding no “integral participation'' to hold Brown liable for an alleged excessive force claim.
The judge dismissed other defendants named because of the plaintiffs’ failure to properly serve them with a summons.
Lawyers for Jeanette Finicum have two weeks to object to the findings before a district judge makes a final ruling.

Happy 2022! We hope that 2021 has treated you all well. There is a quote in my Mom's office that shares an important concept. It says
"Sometimes life is like running through rose bushes, you can feel all the thorns all the way through, but when you look back all you can see are the beautiful roses."
To me this is a good reminder (especially with where we are now in our country) that life is meant to be hard and sometimes painful. But even in the hard times we are meant to find joy. So, as we enter 2022 I hope that we all will look for the joy in our lives, and not just focus on the negative.
I feel like my dad, LaVoy, was an amazing example of this. Find Joy in the journey.

This January 26th marks the 6th year anniversary of the murder of our beloved husband, father, and son, LaVoy Finicum. I don't know why, but this last year has been the most difficult year for me. Maybe because Covid and our world circumstances has forced me to stay at home here at the ranch and finally deal with his lose and begin anew.
LaVoy was an amazing man and possessed a strength of character more than most. LaVoy was very aware of his God, and very aware that he had a responsibility, a duty, as a citizen, to stand up for freedom, for personal agency, for the principles enshrined in the Constitution. He knew that if he did not stand for life, liberty, and personal property, that he would be held accountable to God. He knew that the Government needed to be reminded that they had exceeded their authority and that they needed to be put back within the confines laid out in the Constitution. Our family feels the same as our dear LaVoy and will continue to stand and fight to preserve freedom of this Great Nation.
Freedom is an eternal principle. The right to choose, agency, is a gift from God. It’s not a uniquely American value. People all over the world yearn for the right to be free and to be left alone from burdensome government rules and interference. To live life the way they choose. To make their own decisions and the right to make their own mistakes.
There has been so much our family has gone through, and even though it has been hard, and frightening at times, I have seen Gods hand in this amazing journey, guiding so many of us to fight His battle of Liberty, especially these past 2 years. Our family is still committed in standing for our Country and resolutely committed in seeking Justice in LaVoy's murder.
I have seen unconditional love and support from so many of you across this country. Thank you so very much! We love you! We Pray for you, we pray for our Country, we pray for continued strength to Stand! As LaVoy said, "It doesn't matter how it ends, it matters how you stand." May God Bless you all. Nearly a decade after Robert “LaVoy” Finicum was shot and killed as state and federal police moved to arrest occupiers of the Malheur National Wildlife Refuge, the FBI’s new director has honored FBI Hostage Rescue Team members involved in the chaotic operation.
Director Kash Patel in July presented the team members, including agent W. Joseph Astarita who was acquitted on charges related to the showdown, with the FBI’s Shield of Bravery at a ceremony at the agency’s headquarters in Washington, D.C.
Patel, in a post on X last month, described the medals as among the highest awards for FBI members — “reserved for nominees recognized for acts of bravery, heroism and valor in service of the country.”
The honor revives a long-simmering controversy about what happened that day as the FBI and Oregon State Police cornered occupation leaders on a snowy highway outside Burns in remote southeastern Oregon.
