I disagree. This is a States issue. Congress doesn't have the authority to ban it,

10th Amendment -- "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

If Trump preemptively "bans" it, even if it doesn't hold up in court, then it won't have legs in congress because "its already banned" so new legislation will be pointless. It takes the issue off the table.

The point of the video is that the ATF relies on the definitions of weapons as defined by congress to determine whether or not something should be legal or illegal. In this context, only congress can change the definition, not the president.
