Read this excerpt from the Texas constitution
Sec. 1. JUDICIAL POWER; COURTS IN WHICH VESTED. The judicial power of this State shall be vested in one Supreme Court, in one Court of Criminal Appeals, in Courts of Appeals, in District Courts, in County Courts, in Commissioners Courts, in Courts of Justices of the Peace, and in such other courts as may be provided by law.
You might make a mental note that the full and only judicial power of the state is vested in ALL courts listed. Not one at a time. Not singularly. Each court individually doesn't exercise the judicial power. They have to be formed up in one location at the same time to exercise ALL of the judicial power of the state. Now if they don't do this I really don't believe they have any power at all because there is no established distribution of powers less than 'the judicial power'.
