Webster faces charges of first-degree murder after deliberation with intent, first-degree murder with extreme indifference, first-degree assault and criminal attempt to commit a class 1 felony.

I suppose we should have expected this after Starbucks deviated from offering plain coffee and plain cappuccino. First degree murder is self explanatory. What does "with extreme indifference" and "after deliberation with intent" add to the equation?

How do you prove extreme indifference?

How do you prove he deliberated?

How do you prove he intended anything other than first degree murder?

I suppose this is all academic anyway. Likely he will plea bargain because while we may not understand the charges he will.

if you shoot at someone, is it attempted murder? local rag reported an african shot at people on multiple occasions -- got charged with deadly conduct or similar...no attempted murder

If you shoot and miss does that mean you intended to miss or just lack capacity to hit? If you intended to miss then the charge would be assault because you placed the other party in fear of being hit. You don't even have to pull the trigger for an assault. Every simple traffic stop could be an assault if the policy man is armed. You merely have to ask him if he has been trained in the use of his weapon. If he says 'yes' then he has admitted to being a paid assassin and if you have any sense you would be in fear (aka 'assault').
