WASHINGTON (AP) - President Donald Trump is pardoning two cattle ranchers convicted of arson in a case that case sparked the armed occupation of a national wildlife refuge in Oregon.

Dwight and Steven Hammond were convicted in 2012 of intentionally and maliciously setting fires on public lands. The arson crime carried a minimum prison sentence of five years, but a sympathetic federal judge, on his last day before retirement, decided the penalty was too stiff and gave the father and son much lighter prison terms.

Prosecutors won an appeal and the Hammonds were resentenced to serve the mandatory minimum.

The decision sparked a protest from Ammon Bundy and dozens of others, who occupied the Malheur National Wildlife Refuge near the Hammond ranch in southeastern Oregon from Jan. 2 to Feb. 11, 2016.

The Hammonds are multi-generation cattle ranchers in Oregon imprisoned in connection with a fire that leaked onto a small portion of neighboring public grazing land. The evidence at trial regarding the Hammonds’ responsibility for the fire was conflicting, and the jury acquitted them on most of the charges.

At the Hammonds’ original sentencing, the judge noted that they are respected in the community and that imposing the mandatory minimum, 5-year prison sentence would “shock the conscience” and be “grossly disproportionate to the severity” of their conduct. As a result, the judge imposed significantly lesser sentences. The previous administration, however, filed an overzealous appeal that resulted in the Hammonds being sentenced to five years in prison. This was unjust.

Dwight Hammond is now 76 years old and has served approximately three years in prison. Steven Hammond is 49 and has served approximately four years in prison. They have also paid $400,000 to the United States to settle a related civil suit. The Hammonds are devoted family men, respected contributors to their local community, and have widespread support from their neighbors, local law enforcement, and farmers and ranchers across the West. Justice is overdue for Dwight and Steven Hammond, both of whom are entirely deserving of these Grants of Executive Clemency.

Congressman Greg Walden, in whose district the Hammonds reside, issued the following statement:

“Today is a win for justice, and an acknowledgement of our unique way of life in the high desert, rural West. I applaud President Trump for thoroughly reviewing the facts of this case, rightly determining the Hammonds were treated unfairly, and taking action to correct this injustice.

“For far too long, Dwight and Steven Hammond have been serving a mandatory minimum sentence that was established for terrorists. This is something that would ‘shock the conscience,’ according to Federal Judge Michael Hogan, who presided over the case and used his discretion in sentencing which later was reversed. As ranchers across eastern Oregon frequently tell me, the Hammonds didn’t deserve a five year sentence for using fire as a management tool, something the federal government does all the time.

“Moving forward, I’m encouraging the House Judiciary Committee to act on my legislation to prevent this situation from happening to other ranchers. H.R. 983 would ensure farmers and ranchers are not prosecuted as terrorists for using fire for range-management purposes.

“For now, though, I am pleased that Dwight and Steven Hammond will return to their families and ranches in Harney County. I look forward to welcoming them back home to eastern Oregon.”

The arson crime carried a minimum prison sentence of five years...

Bills of Attainder are prohibited by constitution. These type actions involve the death penalty but also prohibited are Bills of Pains and Punishments. These are are mandatory punishments, fines and sentences imposed by legislative action.

The reason these legislated minimums are unconstitutional is because there is supposed to be a separation of powers between the executive, legislative and judicial branches. Minimums imposed by legislature are interfering with judicial department powers.

Administrative law (per AmJur 2d) is the 4th branch of government that encompasses the other three in one branch. This doesn't happen when the U.S. constitution is considered. There are only 3 branches of government. Administrative law is as unconstitutional as Lincoln's war on the south and Harry S. Truman pretending to enact public law when Congress is on a major break.

The system we see evolving uses the tactic "Let's sling sh*t at the wall and see what sticks"

On President Trump’s Pardon of Dwight and Steven

Tuesday July 10, 2018–Diamond, OR. –


Today, President Trump issued an Executive Grant of Clemency, which is a full pardon, to Dwight and Steven Hammond. Our family is grateful to the president and all who worked to make this possible, and to bring this about.


From long before our family’s legal challenges, through the trial in 2012, the re-sentencing and return to federal prison in 2016, and the last several years while Dwight and Steven were in federal prison, Dwight and Steven and our family have done all we can do to demonstrate faith in our country and in principles of decency, fairness and justice. We have been a cattle ranching family dedicated to basic principles, and a basic life. With Dwight and Steven returning home we will continue on our path, continue ranching and continue believing in America.


The original judge who sentenced Dwight and Steven, openly stated that the laws under which the prosecution took place, specifically the mandatory minimum sentences that were required – were unjust and shock the conscience. Yet, prosecutors appealed his ruling, and today President Trump accurately described that appeal as “an overzealous appeal.” We agree that it was overzealous and share the opinion that there is no place in our courts or anywhere else in the administration of our federal government for overzealousness, and the kind of animus that has been directed at our family by federal officers for years.


Again, we express gratitude for the support we’ve received from our local community, for all those who wrote letters of support, for those who worked behind the scenes, and for those who have stood by our family through these hard times. While we recognize that our path forward will still be difficult, like it is with virtually all ranching families, we are hopeful that this action by President Trump today, will also help signal the need for a more measured and just approach by federal agents, federal officers and federal prosecutors – in all that they do.


During this whole ordeal there has been a lot of false information in the media. Our family has already paid $400,000 related to the civil damages alleged by the government in this matter, in addition to the combine 7 years Dwight and Steven have spent in prison. We are hopeful that respected media outlets will use professional discretion and judgment before repeating false and misleading stories about the history of this legal ordeal. All of us have a duty to stand up for core American principles. Today, the President of the United States has blessed our family by doing so. As Susie said earlier this morning, “We’ve been waiting a long time” but today’s decision by the President, “is wonderful.” We are very anxiously looking forward to seeing Dwight and Steven home.

I wonder why he waited until to nominate Kavanaugh to pardon them? There is always a reason to his madness.

I doubt he would have pardoned them if the Wooten letter hadn’t surfaced. After Gloria Navarro found herself behind the 8 ball and dismissed all the charges with prejudece against the Bundy’s to save face for the DOJ prosecutors and to save her own hide too much of the abuse the western ranchers have been subjected to was exposed and Trump couldn’t ignore that.

A group by the name of Protect The Harvest was instrumental in the Hammonds’ pardon. They managed to get VP Pence to put the case in front of Trump.

A coalition of grassroots groups, trade associations and public officials celebrated Tuesday as President Donald Trump issued a full pardon for two Oregon ranchers convicted under an anti-terrorism law.

Dwight and Steven Hammond were convicted of arson in 2012 under a 1996 anti-terrorism law. The law carried a minimum sentence of five years, but federal Judge Michael Hogan cut each man’s sentence short on the grounds the minimum sentence was “cruel and unusual.” After the ranchers served Hogan’s sentence, the Ninth Circuit ordered the men back to prison in 2014 to serve out the rest of the five-year minimum. The ruling incited local protests and a movement to pardon the Hammonds.

Protect the Harvest (PTH), an advocacy group that pushes back against government involvement in agriculture and outdoor pursuits, lobbied officials as high as Vice President Mike Pence on behalf of the Hammonds. PTH pushed for Trump to commute the ranchers’ sentences, at least. Pence “100 percent” supported PTH’s position and set the Hammonds’ case in front of Trump, PTH national strategic planner Dave Duquette told The Daily Caller News Foundation in June.

National farming and ranching trade groups the National Cattlemen’s Beef Association (NCBA) and Public Lands Council (PLC) publicly supported pardoning the Hammonds. Both associations have headquarters in Washington, D.C., and lobby federal officials on behalf of the agriculture industry.

Oregon GOP Rep. The legislation would “ensure farmers and ranchers are not prosecuted as terrorists” for conducting controlled burns on private lands.

Oregon residents and out-of-state protesters have called for the Hammonds to be released from prison. Trump’s pardon was not universally well-received. Environmental groups slammed the announcement and the Hammonds in statements and on Twitter.

Center for Biological Diversity Environmental Health Director Lori Ann Burd called the Hammonds “child abusers and anti-govt zealots” and the pardon “a win only for those with no respect for life and basic decency.”

Western Values Project Executive Director Chris Saeger blasted the Hammonds and Trump and said the pardon would undermine the trust of federal employees in administration they are working for.

“President Trump is telling anti-public land zealots there are no consequences for undermining every American’s birthright to our shared public lands and national parks,” Saeger said in a statement. “What’s just as bad is that it shows Department of Interior employees who face serious threats from anti-government extremists like the Hammonds that the administration does not have their backs. This pardon is a direct threat to America’s public lands and our shared national treasures.”

The Hammonds, once they are released from prison in California, will be flown back to Oregon in a private jet provided by Duquette’s boss, PTH founder Forrest Lucas.

“There are departments within our government which have basically been weaponized in a way that they are actually scary to deal with for [people in the West] and put a lot of people out of business,” Duquette told TheDCNF in an interview Tuesday. “This [pardon] going to send a message to those agencies that they can’t do that anymore. This kind of stuff is not going to be tolerated.”

Today I was wondering what Oregon, Utah hand Nevada ranchers who regularly posted here might have to say about this lockdown situation.

One of the first posts I saw is on rancher’s property rights.

E. Wayne Hage, Cliven Bundy and Lavoy Finicum all realized they owned their grazing rights and refused to renew their grazing permits with the BLM. I am not sure if Bundy was first or if it was E. Wayne Hage. I am thinking it was Hage because his estate’s lawsuits have been ongoing since the early 1970s.

I was also told the reason we had to fight against acknowledging that ranchers have property rights is because “we have jobs to protect, if ranchers knew they had property rights they wouldn’t need us”.


"When I realized ranchers owned their allotments I asked “if ranchers owned their allotments, how can we make them do anything?” The response was: “you get them to sign something! Then, you got em!”


"Whoever is paying the bill for Hammonds lawyers is either getting ripped off or is playing right into the hands of the enviros.


If the USFS or BLM cancels your “permit” you should write them a thank you letter. You are no longer obligated to manage your Allotment as they dictate.


Your range Allotment is private property. The “cooperative permit agreement” is not necessary for you to use your range allotment (Curtin v Benson 1911)."


The point is they don’t NEED a “permit”! The property is the “Allotment”!


The “permit” is just a piece of paper, a cooperative agreement between the allotment owner and the federal agency in which the agency provides a “service” (fire fighting, Range management advice, cost share on improvements etc) in return for a fee.


If the agreement is canceled then no “fee” is due since the agency will no longer be servicing you. It’s not that complicated."

Possession and improvement of thousands of acres as a cattle range gave color of title or a claim that removed the land from the class of “public lands” and therefore the enclosure of such was not a violation of the Unlawful Occupancy act of 1885."


By a series of statutes beginning in 1853 Congress granted surface land rights to settlers occupying the “mineral lands” and “desert lands” West of the 100th Meridian.


State or territorial stockwater rights were validated by the Acts of 1866/1870 and 1877, (Basey v Gallagher 1879, United States v New Mexico 1978),


State or territorial surface range-grazing rights by the Acts of 1875, 1880, 1885 and 1890 (Griffith v Godey 1885, Cameron v United States 1893, Curtin v Benson 1911).


These rights being legislative grants, no patent was required, only an official government survey showing the boundaries of the Range Allotment (St Louis Land & Livestock Co v Jones 1914). The Grazing Allotment Map is a “title” document as valid as any “patent” (Shaw v Kellogg 1898)."

The Chinese, by financing this cap and trade program, will be rewarded with ownership of energy facilities subsidized by our tax dollars. They will also be indirectly financing the Democrat Party of Oregon. As the money that the state receives from China would be allocated to agencies who have public unions, who then collect union dues and donate those dues exclusively to the DPO and politicians like Kate Brown.

This is all a slush fund, a Chinese funded Democrat reelection system. We the people CANNOT stand for this treasonous behavior. Treason is defined under Oregon law as giving "aid" or "comfort" to an enemy of the state of Oregon. That is exactly what cap and trade does! Gives aid to an enemy of the state of Oregon. China is an enemy to the state of Oregon, an enemy of the United States.

Mark Esper, Defense Secretary in the Trump administration, says the threat of the Chinese meddling in the USA is the "highest priority" of the Pentagon. The feds will drop the hammer on "Commie" Kate in due time.

E. Wayne Hage, Cliven Bundy and Lavoy Finicum all realized they owned their grazing rights and refused to renew their grazing permits with the BLM. Are grazing rights deeded or only permitted?
On USFS roads around here, sometimes USFS demands that you get a permit to plow snow even if you have legal access.

The old grazing rights that were granted by legislative acts were deeded and recorded at the county recorders office.

I think any road in existence before the Federal Land Policy & Management Act of 1976 is in the public domain where no permit is needed. Either Ron Gibson or Hal Anthony from the JeffersonMiningDistrict.com know the laws. I believe their contact information is on the website.
