Update: January 29, 2016
In light of the events that have taken place in Harney County, Oregon over the last two days, the official Pacific Patriots Network statement is as follows:
PPN condemns the violent action taken by the Harney County Sheriff's Department along with the FBI in the shooting death of Mr. Lavoy Finicum.
PPN condemns the violent action taken by the Harney County Sheriff's Department along with the FBI in the execution of arrests associated with the people at the Malhuer National Wildlife Refuge occupation.
PPN condemns the DISHONEST tactics used to arrest Jason Patrick on January 28th. Mr. Patrick's safety, well being and emotional state were compromised when the FBI lied not only to Mr. Patrick but to PPN representatives trying to assist with the PEACEFUL removal of people at the MNWR. The FBI stated to Mr. Patrick and the PPN that he was “free to go.” Mr. Patrick walked 7 miles in sub freezing temperatures only to be arrested at the checkpoint north of the Narrows.
PPN condemns the false statements given to the public by the FBI, Harney County Sheriff's Department and the Harney County officials.
IN RESPONSE TO THESE EVENTS, PACIFIC PATRIOTS NETWORK
IS ISSUING A
CALL TO ACTION
Calling on any and all Americans to come to Burns, Oregon to come to the aid of the American people standing against these violent, malicious and deceitful tactics. Come stand together with other Americans, and express our Constitutional right to PEACEFULLY assemble and air our grievances.
This operation will demand the following:
- Immediate detention by Oregon State Police of the FBI special agent in charge along with all agents and LEO involved in the shooting death of Lavoy Finicum. A first hand eyewitness account presents reasonable cause for arrest while the investigation takes place.
- Immediate removal of all militarized FBI personnel and equipment from Harney County. All State and County Law Enforcement officers are not included and requested to stay and assist in the process to keep the peace.
- Immediate resignation of Judge Steve Grasty, Sheriff David Ward, County commissioner Pete Runnels, and County commissioner Dan Nichols.
In order to successfully accomplish our mission, we will need any and all Americans to PEACEFULLY assemble within Burns, Oregon immediately. The success of this mission depends fully on the number of people that will come to PEACEFULLY stand and demand the items above be initiated.
A letter of intent will be legally served on the FBI special agent in charge at the time of Lavoy Finicum's death, Judge Steven Grasty, Sheriff David Ward, Dan Nichols and Pete Runnels by January 29th, 2016. We will request to escort the FBI presence out of Harney County, Oregon and once complete, the attention will return to the resignation of the County elected officials.
PPN is dedicated to a PEACEFUL operation. If you have any ill intent, please do not come. We do not need you. Please come prepared with civilian attire and adhere to the policy of no long guns within the community.

"Probable cause" generally refers to the requirement in criminal law that police have adequate reason to arrest someone, conduct a search, or seize property relating to an alleged crime.
The probable cause requirement comes from the Fourth Amendment of the U.S. Constitution, which states that:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be searched."
As seen in those words, in order for a court to issue a warrant -- for someone's arrest, or to search or seize property -- there must be "probable cause."
Police must also have probable cause to arrest without a warrant, and in many cases to search or seize property without a warrant.
Prosecutors must also have probable cause to charge a defendant with a crime.
Warrants and Probable Cause
Typically, to obtain a warrant, an officer will sign an affidavit stating the facts as to why probable cause exists to arrest someone, conduct a search or seize property. Judges issue warrants if they agree that probable cause exists.
There are many instances where warrants are not required to arrest or search, such as arrests for felonies witnessed in public by an officer. Here is more information on when warrants are not required.
If a warrantless arrest occurs, probable cause must still be shown after the fact, and will be required in order to prosecute a defendant.
Probable Cause for Arrest
Probable cause for arrest exists when facts and circumstances within the police officer's knowledge would lead a reasonable person to believe that the suspect has committed, is committing, or is about to commit a crime. Probable cause must come from specific facts and circumstances, rather than simply from the officer's hunch or suspicion.
"Detentions" short of arrest do not require probable cause. Such temporary detentions require only "reasonable suspicion." This includes car stops, pedestrian stops and detention of occupants while officers execute a search warrant. "Reasonable suspicion" means specific facts which would lead a reasonable person to believe criminal activity was at hand and further investigation was required.
Detentions can ripen into arrests, and the point where that happens is not always clear. Often, police state that they are arresting a person, place him/her in physical restraints, or take other action crossing the line into arrest. These police actions may trigger the constitutional requirement of probable cause.
Someone arrested or charged without probable cause may seek redress through a civil lawsuit for false arrest or malicious prosecution.
Probable Cause to Search
Probable cause to search exists when facts and circumstances known to the officer provide the basis for a reasonable person to believe that a crime was committed at the place to be searched, or that evidence of a crime exists at the location.
Search warrants must specify the place to be searched, as well as items to be seized.
There are many instances where a search warrant is not required. Common situations in which police are allowed to search without a warrant include:
- when they have consent from the person in charge of the premises (although who that person is can be a tricky legal question);
- when conducting certain searches connected to a lawful arrest; and
- in emergency situations which threaten public safety or the loss of evidence.
Police also do not need a warrant to search or seize contraband "in plain site" when the officer has a right to be present.
Questions often arise over the extent to which police may search vehicles. Here are some commonly asked questions and answers about vehicle searches.
Probable Cause to Seize Property
Probable cause to seize property exists when facts and circumstances known to the officer would lead a reasonable person to believe that the item is contraband, is stolen, or constitutes evidence of a crime.
When a search warrant is in play, police generally must search only for the items described in the warrant. However, any contraband or evidence of other crimes they come across may, for the most part, be seized as well.
Should evidence prove to have resulted from an illegal search, it becomes subject to the "exclusionary rule" and cannot be used against the defendant in court. After hearing arguments from the prosecuting and defense attorneys, the judge decides whether evidence should be excluded.
Conclusion
Probable cause refers to the amount and quality of information required to arrest someone, to search or seize private property in many cases, or to charge someone with a crime. Probable cause to arrest, search, or seize property exists when facts and circumstances known to the police officer would lead a reasonable person to believe:
- that the person to be arrested has committed a crime;
- that the place to be searched was the scene of a crime;

This is a video I've watched part of at a protest in Burns to get Grasty to resign and the FBI out of town. I think it's promoted by the militia.
Starting at 5:45 in the video he says he talked to an FBI guy that admitted that they did shoot at Ryan Payne when he stuck his hands and head out the window but "It was only with a bean bag round".
At about 8:30 minutes in one of them says he talked with a video analyst and someone involved with a sheriffs dept. that was in agreement with them that they shot Lavoy in the hip and then he lowered his hands to the wounds. He also said that two bullets hit the truck right before he took off.
That would explain why he took off and tried to put some distance between them. The SOB's were shooting at them. This is all hearsay but it does need to be investigated.
Also Victoria Sharp had said Lavoy was on his knees when he was shot but it may have only looked like he was because he was standing in deep snow and that's just my opinion about that in her story.

"On Sunday evening, January 31, 2016, I interviewed Shawna Cox on The Common Sense Show. Her conversation with me was filled with exuberance, the same kind of exuberance that one would experience from a traumatic “fight or flight” experience.
After being shot at over 100 times, and lucky to be alive, Shawna was taken into custody. Shawna addresses the question posed and listed above, as she revealed to my audience some very detailed information which is also confirmed from the public accounts of 18 year old Victoria Sharp.
This may be Shawna Cox’s final interview to the media. During the course of the 30 minute interview, she told me she fully expected to be the victim of a gag order issued by a federal judge when she appears in court on Monday to face federal charges of impeding federal officers.
Shawna Cox, working through the health reporter of The Common Sense Show, Katy Whelan, reached out to me on Saturday evening. The interview, itself, was primarily about the harrowing events on January 26th in which LaVoy Finicum was executed by the FBI.
The Purpose of the Trip
Ammon Bundy and his companions were on their way to meet with the Sheriff from nearby John Day and commingle with local ranchers who stood in support of their cause. Music and festivities were also the order of the day. This is why 18-year-old singer, Victoria Sharp, was accompanying the party as they tried to make their way to John Day.
First Encounter
As the two cars, comprising the caravan, were making their way to John Day. they were pulled over at the first roadblock. At first, neither side did anything in what could be described as a silent stand-off. The occupants of the vehicles were not given any instructions (e.g. to exit the vehicle, etc.). Finally, in an attempt to show peaceful intent, Ryan Payne put both hands out of the truck through the open window, to show he was not armed, and he was promptly shot at with the bullet striking metal of the truck between the window and the mirror.
DAVE HODGES QUESTION: DID FEDERAL AUTHORITIES EVER GIVE THE OCCUPANTS OF THE TRUCKS A CHANCE TO SURRENDER AT THE FIRST ROADBLOCK? DID THEY ISSUE INSTRUCTIONS THROUGH THEIR PA?
SHAWNA COX ANSWER: NO! THEY JUST OPENED FIRE ON US AS WE SAT THERE. THEY NEVER GAVE US THE CHANCE TO SURRENDER.
A Fateful Decision
At that point, the driver of the first vehicle, Lavoy Finicum made a fateful decision to escape the gunfire and reach the protection of the Sheriff waiting for them at John Day.
As Finicum sped away, federal authorities were in pursuit. Very quickly, they came upon a second roadblock. Cox stated that it was at that point that Payne begged Finicum to pull over and he kept saying that we have to reach the Sheriff.
The Second Roadblock
Upon reaching the second roadblock, Finicum attempted to swerve to the side of the road and the truck was stuck in a snowbank.
According to Cox, Finicum exited the vehicle with his hands up and said:
“We have women in the car don’t shoot!:
According to Cox, and her account is backed up by Victoria Sharp, Finicum had his hands in the air as he faced the FBI agents who were stationed in the trees and said:
“We are going to the Sheriff….well, just go ahead and shoot me.” This was all said with his hands in the air. Finicum (was) immediately shot upon exiting the car, several times, and was, again, shot at repeatedly while he lie in the snow dying.
Attempted Second Degree Murder of the Occupants in the Truck
Immediately, the occupants had red lasers on their bodies as the scurried for cover in the truck. Immediately after Finicum was killed, the truck came under fire. No orders were issued to the occupants, and as it was at the first roadblock, firing bullets at the occupants of the truck was the first order of the day.
Cox believes that the vehicle was struck at least one hundred times. Both women were hysterically screaming to “please stop shooting” as the two women were begging for their lives.
This entire event, complete with two roadblocks, unprovoked gunfire and FBI agents in the trees could only be described as an “old west ambush”.
With no movement in the truck, and after firing over 100 rounds, the FBI finally issued its first order to surrender. They ordered the male occupants out of the vehicle, followed by the females.
The Arrests
I have had multiple law enforcement personnel write to me and express shock and horror that the FBI never attempted to check on the status of Finicum.
Victoria Sharp was not charged and arrested and was dumped at a Safeway parking lot with no money and only the clothes on her back. Shawna Cox was charged with impeding federal officers (I am still scratching my head on this one trying to make sense of the charge.
As a footnote, and as a precondition of her release, Shawna Cox was ordered to have all guns at her Utah home removed. After the guns were removed, her son-in-law, sitting in close proximity to the guns was suddenly and mysteriously caught in a fire in which all the guns and ammunition went up in smoke. Shawna’s son-in-law was killed in the event.
Conclusion
Please consider the fact that Victoria Sharp is an 18 year old kid who was not even part of the dispute. She was there to musically perform in John Day and the FBI attempted to murder this girl without so much as an opportunity to surrender peacefully.
What did these seven occupants do to warrant a “shoot first order”? They did nothing, but they were never given the opportunity to surrender before being fired upon, on two different occasions. And as Shawna Cox put it “Lavoy was murdered in cold blood by the FBI, he had his hands in the air until he was shot”.
Shawna added, as a footnote, that when the last man was taken into custody, they were asked if there were any others left in the truck. They responded that they were the last. The FBI promptly proceeded to fire over 100 more rounds into the vehicle after the vehicle was vacated.

According to the Pacific Patriots Network, the serial number of the 9mm gun the FBI claimed was found on LaVoy Finicum came up STOLEN over 2 years ago.
That serial number is 54119868.
Barbara Davis on facebook said LaVoy was shot 9 times, and his body is back home now, but the funeral will be closed casket.
Barbara was the one that put out the call for the serial number according to the post on Facebook, which they are saying has now been removed.From: Joanne

Cliven Bundy is encouraging the four individuals still known to be at the Malheur Wildlife Refuge to stay put and keep fighting, according to a report from Oregon Public Broadcasting.
OPB is reporting that Bundy wrote to County Sheriff David Ward and Oregon Gov. Kate Brown that "We the People of Harney County and also We the People of the citizens of the United States DO GIVE NOTICE THAT WE WILL RETAIN POSSESSION OF THE HARNEY COUNTY RESOURCE CENTER."
In what OPB identified as a "notarized" letter, Bundy also demanded that all "state and federal" law enforcement agents leave the area. Bundy's letter ran counter to the message coming from his detained son Ammon Bundy who led the initial takeover of Malheur, but since his arrest has called for the remaining occupants to give up and leave the refuge.
Cliven Bundy became a household name after a high-profile standoff against the Bureau of Land Management in 2014. Many of the same individuals who stood with Cliven Bundy then participated in the Oregon refuge standoff.

E-5 Allen Lardieri spoke out concerning the FBI release of the video of the murder of LaVoy Finicum... in his estimation, the video was not recorded according to anything that those who would have been engaged in, and he confirms that it was not drone footage, but was, in fact, a manned aerial vehicle. Lardieri says the system that recorded the murder of Finicum is known as an Orion ISR (Intelligence, Surveillance, Reconnaissance) platform.

Lardieri confirms that this particular platform is found "consistently on manned aerial vehicles, not drones." So, we discover that the footage is not from a drone, but there is a person operating the vehicle and the video capture on board. The person that relayed to Lardieri that the Orion system was the one used in this operation said that he had viewed the same screen for 506 hours of combat.

Lardieri, he told Freedom Outpost that thermal imaging would have shown every shot fired and that had the pilot been flying at an altitude of 10,000 feet or higher would have rendered flawless video and given a better picture of what took place.He told us that according to a proper procedure, the quality of the video would have been at 96 megapixels, which would have allowed for determining people inside the vehicle.
This, along with thermal imaging, would have shown not only the people inside, but also any and all gunfire that took place. According to Lardieri, the operator was knowingly engaging in a flight pattern at an altitude that would not provide the best video coverage.So, the only reason for the release of the video by the FBI is that it was meant to conceal the reality of what took place, and make things appear different than they really were. I'll leave it to the reader to determine whether or not the pilot was knowingly engaged in a coverup of what appears to be an FBI ambush of LaVoy Finicum and those with him, which resulted in his murder.
Personally, I think we can conclude that if basic operation procedure was to operate at higher altitude and use thermal imaging, then we can conclude that this pilot was acting under the order of the Justice Department, under criminal Attorney General Loretta Lynch, who is under the direction of the criminal-in-chief Barack Hussein Obama Soetoro Sobarkah for the express purpose to put down those who dared to call the government in DC to account regarding the Constitution."

The Citizens for Constitutional Freedom Support Group is reporting on their Facebook page,
Nevada rancher and father of Ammon and Ryan, Cliven Bundy, has sent a legal notice to Sheriff David Ward of Harney County.
The notice informs the Sheriff that the citizens of Harney County and the people of the United States will continue to retain the Harney County Rescource Center, also known as the Malheur Wilderness Refuge, as a a resource for the people rather than a resource for the federal government.
The notice demands that the Sheriff remove all federal and state policing agents from the county. It also demands that a guard from the Sheriff’s department be posted at the entrance of the refuge to stop people from entering or exiting “for a time”.

Another video here by "call of duty goddess" where she points out what looks like three muzzle flashes at the rear of Lavoys truck just before he took off. If you start at the 9:00 minute mark she points them out. If they are muzzle flashes it would confirm what Victoria Sharp and Shawna Cox have said about them shooting at them while they were sitting there.

If the body has been released the family will have ample opportunity to get the word out there, along with the supporting facts, to show how many times this man was shot. The government says 3 times....we'll see. As far as the serial number of the 9mm, let's take it one step at a time
