A man who unsuccessfully appealed his fine for possessing paedophilia magazines says he'll take his battle to the High Court, arguing freedom of expression.
Colin Nugent, formerly Harry Holland, was
convicted of possessing child pornography after a trial in June last year and fined $3500.
Nugent had admitted to having two copies each of three separate editions of Rockspider magazine, which depicts sexual relationships between adults and children.
But he appealed the conviction, complaining about a pre-trial ruling that excluded "expert" evidence he sought to cite at trial.
On Tuesday, his appeal bid failed in the West Australian Court of Appeal.
Speaking outside court, Nugent said he would take the matter to the High Court.
It wasn't a matter about clearing his name but rather
standing up for the principle of freedom of expression, he said.
