Mike Stickler who spent 60 days in the Pahrump jail with Cliven Bundy where he gained Cliven’s trust and was authorized to write Cliven’s biograpy has been published. I received my copy two days ago. After reading the first 5 chapters I must say it is impressive and should be required reading for all Nevada schools for the amount of history, constitutional principles, Treaty of Hidalgo as related to Bundy’s claim to his family’s rights and where the jurisdiction lies and Cliven Bundy’s understanding of these principles.

The first five chapters lay out the Bundy family history in Nevada dating to 1847, thus having rights under the Treaty of Hidalgo, a lot of constitutional history and early Nevada territorial and statehood history as well as detailing some of Cliven Bundy’s early life. This sets the foundation for the remainder of the book which deals with the actual standoff

Monty, I've been to the beginning of this thread the last few days looking for who it was that did an investigation of the corporations, their satanic symbols and connections and the masons. On page 26 there is info about the masonic cave at Burns, Or. It was a pretty interesting thread and it still is when you go back and look. Funny we've both been going through it again in the last few days.

The court has ordered Todd Engel to pay over $1,000,000 in restitution. Todd Engel spent about 1 1/2 hours at the Topaq Wash. He is the man who spotted the snipers signaling with mirror flashes to the armed BLM agents on the ground. He alerted a deputy sheriff who immediately took action and got the situation de-esculated. Todd left the bridge and spent the rest of his time there assisting an NHP officer directing traffic because he new the snipers were targeting him. The man deserves a medal because it was him alerting the Clark County deputy that prevented bloodshed that day.
Todd was denied a decent defence. He was not allowed to present any evidence to the jury that would have exonerated him. After all the Brady violations were exposed the judge should have vacated his sentence because he certainly was denied due process.
It was brought out in testimony in the Bundy Trial that the snipers did have Todd Engel Eric Parker and the guy from Oklahoma I don’t recall his name, in thier sights, safeties off, slack out of the triggers waiting for permission to fire. Fortunately that permission was never granted.
Mike Stickler on Twitter said the Whitehouse ordered a copy of his book, “Cliven Bundy, American (terrorist) Patriot”. (The strike through seems to be missing in the editor) Hopefully this indicates they may be looking into a pardon for these other men whom were wrongly convicted and those forced to take a plea bargain.

Todd Engel Undergoes Diesel Therapy

Todd Engel was recently sentenced to 14 years in prison for his part in the Bunkerville standoff of 2014. He is currently assigned to spend that time in Lompoc prison in California, though he has requested a transfer to Sheridan Prison in Oregon.

Engel had a secondary hearing to discuss the restitution the court required of him. This hearing was originally scheduled for the first week in September, in Las Vegas, Nevada.
Just before this hearing took place, the Bureau of Prisons (BOP) decided he needed a couple of lessons in Diesel Therapy, so they moved him to Lompoc, from Pahrump, Nevada, just before his hearing.
This caused a delay in the hearing until September 20th, at which time he needed to be transported back to Pahrump, with a stop in Victorville, California, and then back to Lompoc afterwards.
Diesel Therapy is said to be the worst part of being incarcerated. It refers to a method by law-enforcement personnel to (allegedly) punish political prisoners, or troublemakers, by transporting them in horrendous conditions.
Prisoners can be transported to multiple destinations, around the country and back, under the guise of “destination errors”. But even a single transport can be dangerous and torturous to the prisoner.
I have talked to Engel about his treatment during these transports.
“So, the ride from Pahrump to Lompoc is a torture chamber,” Todd said. “Imagine being chained up, hands and ankles, to where you’re unable to even scratch your nose. They have this torture device known as the black box they place over your handcuffs.”

The Black Box is a handcuff cover which protects the key hole and prevents the prisoner from tampering with any parts of the lock. Although the Black Box is to ensure safe transport, if used incorrectly, it can cause serious injury.
Engel continued, “So then we were put on the bus and placed in a hard plastic seat where there is not enough knee room to sit normally. i have to sit sideways with my knees in the air and my feet off the ground, for 12 hours. My back seizes up from the stress and it took me two weeks for my knee to recover so I wasn’t limping. I have arthritis in that knee.”

George Hansen, has been referred to as “America’s most famous political prisoner”, according to the “U.S. Citizens Human Rights Commission.” The story of how Hansen ended up in prison is bad enough, and worth your time reading. However, while he was in prison, he was subjected to horrendous Diesel Therapy as well.
“The best thing you could do,” Hansen advised others, “is the Biblical act of fasting. If you don’t eat and don’t drink, you don’t have to go to the bathroom. They do this to you for four or five weeks at a time; they put you in chains about two in the morning, you get out about ten at night. And when you’re bigger than average [Rep. Hansen is 6’6”], you’re wedged in, sitting there twenty hours a day and you can’t move your legs. Because the shackles cut off the return blood flow from your lower extremities, soon your legs fill with blood, especially when you’re 63 years-old as I was then. Then you get to walk around with two barrels full of blood where your calves and lower legs should be.
Engel shared more with me about his transports through the BOP system:
“Victorville was on the way back here and they kept us in the holdover unit. They had had an incident in the main prison and they had the whole place on lockdown. We could hardly come out of our cells and were fed peanut butter and jelly for almost every meal. Also, no commissary to help with the hunger.”
Todd is an amazing person. He is serving his time, yet the courts have ruled that the prosecutors hid evidence that could have swayed the jury in his favor. The main defendants of the Bunkerville Standoff were released and their charges were dropped. Engel was not allowed the same benefits, and was even sentenced for crimes of which he was not convicted.
Engel continues to work on his appeal, and is hoping to gain the attention of President Trump.

ST. GEORGE — Multiple agencies and water tankers responded to a massive haystack fire reported Wednesday in Bunkerville, Nevada, when hundreds of tons of burning hay kept firefighters busy for more than five hours.
Early Wednesday evening firefighters were dispatched to what was initially called in as haystack and structure fire at the Bundy Ranch on Riverside Road and Gold Butte, Bunkerville Fire Chief Mike Wilson said.
Fire crews found the large haystack engulfed in flames, while the residence located nearby had no signs of smoke or flames.
“Our main goal at that point was to keep the fire from spreading to the home that was in close proximity to the fire, as well as several other structures on the property,” Wilson said.
He said that 300 tons of hay was burning in a haystack that covered an area of nearly 900 square yards, with 300 one-ton bales stacked more than 20 feet high.
Bunkerville firefighters were soon joined by crews from Mesquite Fire and Rescue, Beaver Dam/Littlefield Fire District and Moapa Valley Fire District, which sent crews and trucks from both Logandale and Overton, Nevada.

The fire stations responded with multiple fire engines as well as wildland water tenders or tanker trucks capable of carrying up to 3,000 gallons of water, which was “critical,” Wilson said, adding there were no fire hydrants or external water sources available on the property, at least not initially.
“Once we got there we were able to draft out an irrigation ditch which provided water, once Moapa Valley Fire arrived with the equipment and crews,” he said.
Because haystack fires burn from the inside out, firefighters had to get to fire burning in the center of the pile. They disassembled the haystack and broke apart the individual hay bales.
While the method is effective, it requires large equipment capable of moving large, heavy loads that are typically burning, which can be dangerous, Wilson said.
Even then, the water tends to run off of the top layer of the hay before it reaches the center of the stack where the material continues to burn fed by the oxygen readily available.
“You have to work water into the hay to put the fire out, so we had to spread the hay out over a large area,” he said.
After more than five hours the fire was extinguished, along with any visible embers that could reignite at a later time.
The risk, however, isn’t over, as Wilson said there could be hot spots buried under the material that were not detected, primarily due to the enormous amount of material that was burning. The property owners and ranch workers will keep a close eye on the area over the next few days and were advised to call 911 if they see smoke or fire.
“They could see hot spots for days to come,” Wilson said.
The investigation into the fire’s origin is ongoing.
In some instances, the fermentation process can cause spontaneous combustion, which can occur when air and water cause microorganisms to feed and multiply, a process that generates heat until all of the moisture is gone, Wilson said. However, should the process continue for an extended period of time or at a higher rate, the heat generated can reach a level where it ignites without any external source.
Wilson said the success of the operation hinged upon the mutual aid provided by so many fire departments that responded so quickly, providing crews, large earth-moving equipment and multiple trucks that remained at the scene until the end of the call.
There were no injuries reported during the incident.

As I was reading through that article the thought came to mind that it may have been caused by fermentation as they mentioned near the end of the article. It happens occasionally in the area where I live too. People here generally let the hay sit for a month or two before stacking it for that very reason. I've seen steam coming off bales on cool mornings and later on seen smoke coming from them. It's a shame they lost so much hay after all the troubles they've already had. Most people in this area insure their hay because it's hard and expensive to replace it.

That really hit them hard this time of year. I have seen steam come from wet bales too. My family put up about 400 tons of alfalfa hay per year. We were very cautious about stacking any damp bales. But back then bales were only 100#, not these big one ton bales so it was fairly easy to tell if the bales were too wet to stack.

I didn’t watch the video that Ammon Bundy made blasting Trump for not allowing the hoard of ileagals to enter the USA. I did read an article in the St. George Utah newspaper where Ammon and Cliven Bundy both voiced their opinions counter Trump’s stance. After he postrd that video his followers have beeen abandoning him like rats leaving a sinking ship.
He opened a Twatter account a couple of days ago, then yesterday announced he was closing it. The heat must be more than he wants to bear.

Ammon Bundy Leaves Militia Movement After Criticizing Trump On Immigration Policy

For more than six years Ammon Bundy and his family amassed hundreds of followers and supporters willing to pick up their guns at a moment’s notice and rally to their side for a confrontation with the federal government.
Bundy led two armed standoffs against the feds in Nevada and Oregon, and his family quickly became the face of a growing militia movement, bringing a national spotlight to armed groups eager for an armed conflict with what they believed to be an overreaching government.
The militia groups, with members carrying a mix of right-wing, anti-government, and conspiratorial views, had been growing since 2008 thanks to their heavy use of social media and binding opposition to then-president Barack Obama. The standoffs in 2014 and 2016 made the Bundy family, including Ammon, leading figures in the movement.
Bundy knew most of his supporters stemmed from the political right, so when he logged on to Facebook last week to talk to his supporters in defense of the Central American caravan marching to the southern border, he knew he’d face some criticism.
“To group them all up like, frankly, our president has done — you know, trying to speak respectfully — but he has basically called them all criminals and said they’re not coming in here,” Bundy said in the video. “What about individuals, those who have come for reasons of need for their families, you know, the fathers and mothers and children that come here and were willing to go through the process to apply for asylum so they can come into this country and benefit from not having to be oppressed continually.”
Bundy went on, dispelling conspiracy theories that billionaire George Soros was behind the migrant caravan or that terrorists were using the group to sneak into the US.
The reaction was immediate, with supporters instantly repudiating Bundy. People who traveled to his father’s ranch in Bunkerville, Nevada, in 2014 during an armed standoff with federal agents over unpaid cattle grazing fees, said they regretting doing so. Others claimed Bundy was being paid by left-wing “globalists” to switch sides. Some told him they wished him dead, or that militias had never supported his family.
Bundy had no idea how swift the backlash would be.
“I expected to get a decent amount of pushback, but I also believed that I could explain to them why I’d taken those positions and why,” he told BuzzFeed News. “But you know, I’ve always had these kinds of thoughts that people were not really listening to the principles of things, that they had aligned with me for some other reasons, and that some of those [reasons] are good and some of those might not be, but this last video kind of confirmed that.”

So on Tuesday, Bundy shut down his social media accounts and said he was stepping away from the public light and the “patriot groups” that had gained national attention for supporting the Nevada ranching family. The decision to quit wasn’t an easy one, Bundy said, but the movement’s unforgiving opposition to the migrant caravan and what he called a dangerous and blinding support of President Trump, left him with no choice.
“It’s like being in a room full of people in here, trying to teach, and no one is listening,” he told BuzzFeed News. “The vast majority seemed to hang on to what seemed like hate, and fear, and almost war mongering, and I don’t want to associate myself with war mongers.”
Bundy’s sudden exit marks a defining moment in the so-called “patriot movement,” one his family helped bolster over the past four years. Members of militia groups would talk about being part of the Bundy standoffs as a point of pride, a sort of street cred for militia.
While Bundy said he supports many of Trump’s policies and is grateful for his presidential pardon of the ranchers at the center of the 2016 standoff in Oregon, he disagrees with his depiction of immigrants at the border and his approach to governing.
“I believe President Trump, the best way I could explain it is that, he’s a nationalist, and a nationalist in my view makes the decision that best benefits the nation, not the individual,” Bundy said. “That is not freedom, and that is not what America was built upon.”

For those who have followed the Bundy clan and their clashes with the federal government, the 43-year-old’s defense of immigrants was not a complete surprise, even if it was to his supporters.
His father, Cliven Bundy, has previously defended immigrants from Mexico and Central America, citing their right to provide for their families as a human right — an opinion echoed by Ammon Bundy in his videos. Both Bundys have said they believe migrants have a legal right to apply for asylum, and that it is America’s duty to give them the opportunity.
And although the family has generated a mishmash of support from militias, conspiracists, sovereign citizens, right-wing politicians and critics of federal public lands, the Bundy’s ideology has always stemmed from their specific brand of Mormonism, emphasizing personal freedom, empathy toward the prosecuted, and conflict with the government.
“Fear is the opposite of faith, faith is the opposite of fear, and we have been asked by God to help, to be welcoming, to assist strangers, to not vex them,” he said in his video. “As we do that, the Lord is going to bless us and bless them.”
Religion has always played a central role in the Bundy family’s ideology, Mark Pitcavage, senior research fellow and an expert on right-wing extremism for the Anti-Defamation League told BuzzFeed News.
“Although their views are not orthodox, the Church of Jesus Christ of Latter-day Saints is pretty welcoming to refugees,” he said.
Yet many of Bundy’s supporters are not members of the Mormon church, and their views about immigrants are more closely aligned with President Trump’s.
“[Bundy’s] followers come from several places in the right, but they are almost all from the far-right,” Pitcavage said. “There are very few parts of the far-right that are welcoming toward immigrants. They tend to be nativist or xenophobic.”
Brian Levin, director for the Center of For The Study of Hate and Extremism, said far-right groups, including alt-right and militia groups, have begun to show divisions and fracturing since the 2016 election.

Many united in opposition to the Obama administration, and then in opposition of Hillary Clinton’s campaign, and then in support of President Trump. But Trump’s victory has left the groups without a target, and individual issues and topics have once again begun to split some of those groups.
“Once it changed from an insurgency into something else, once the left was thrown out of the hold of government the expectations for the far-right changed,” he said.
Simply put, he said: “Once they win, the bickering starts.”
Pitcavage doesn’t believe Ammon Bundy’s decision will split the militia movement, but the so-called patriot movement, which has for years pegged itself as an anti-establishment group aiming to curb the abuses of the government on its people, finds itself in a difficult position at the moment.
“The militia movement has been in this weird space, unlike anything its experienced in its previous history because someone they supported is the head of government,” he said.
The unequivocal support for the president is a big concern at the moment, Bundy said, and a factor in his decision to step away from the movement.
“Those on the right have been so fanatically loyal to him that any word of opposition to bring out light in what he might be doing that is incorrect draws hate,” Bundy said.
He then compared the support of Trump’s base to that of Hitler’s.
“The time we find ourselves in now that is closest found in history is Germany in the 1930s, and they had a leader that was loved, and it was the same kind of following,” he said. “I don’t want to say there is that extreme similarity, but it very well could go that way, and people just give up their thinking, their rights, and they give up their government because they were so willing to follow him.”
Other militia leaders who previously rallied to his side have called Bundy in recent days to offer private support and protection, he said, after his family received threats over the Facebook video. Some, Bundy said, told him they agreed with his critical views of Trump, but did not want to air their concerns publicly for fear of facing the same backlash.
For now, Bundy doesn’t want to be a figurehead for the militia movement and said he was considering writing a book about his experience.
“I think they have their leader,” Bundy said. “I think, you know, President Trump is clearly their leader, and I think wherever he tells them to go, they’ll go.”

On the 29th, you put up a petition to sponsor a REFUGEE family, posted a news clip about Cliven's thoughts, your NPR interview, your second segment on the Liberty Effect, and a post about how "Hate is easy. Love takes courage" You ignored what everyone was screaming about. Take care of our own FIRST. It really is hard to hear someone set up a sponsorship for others when our own fellow Americans aren't or can't even be helped. I'm not sure why you can't understand this.

We held auctions to raise funds, people were making and selling things to earn money to be able to give to it all. We were bled dry. Do you know why?!!! Because most of us were barely making ends meet ourselves! We have families, jobs, needs, and lives of our own and ON TOP OF ALL THAT, we went even further in order to support all of you guys. YOU DEPENDED ON US and it took everything we had-or didn't have in most cases-to meet YOUR NEEDS. Did you catch that? It took 1,000's of us just to cover the needs of 50 men and their families!! Your fellow P3's, many times, told us to give the money we raised for them and their families to YOURS. Did you know that? So, to hear you say that you started a petition to help FOREIGNERS, rather than those who stood with you and your family, our own homeless, veterans, or moms with kids, right here in our own backyard, who are fleeing domestic violence situations, felt like a slap in the face and people reacted to that. Are you kidding me? Get out of the bubble you live in and take a look around! Things aren't the way they used to be. They aren't even close to how God intended them to be. People are living and dying on the streets in every city and town accross this nation. People aren't helping their neighbors like they used to because THEY CAN'T!!! Do you understand that- at all? “I really question his doctrine ever since he started it about building a wall,” Cliven said. “I don’t like walls. I think we oughta be able to get along with neighbors … Trump’s wall never did sit very good with me.”
With regard to the migrant caravan, Cliven said it’s hard to tell what the truth is. If the people coming are looking for refuge, as Americans, Cliven said people should have a heart and try to help.

Bundy prosecutors throw “Hail Mary”
Federal prosecutors aren’t giving up on their case against Nevada rancher Cliven Bundy. On Wednesday they filed opening briefs in their appeal of a judge’s dismissal of felony conspiracy and weapons charges against Bundy and others.
The case was dismissed a year ago by U.S. District Judge Gloria Navarro, who found “flagrant prosecutorial misconduct” by prosecutors against Bundy, his sons Ammon and Ryan, and independent militia member Ryan Payne.
Assistant U.S. Attorney Elizabeth White asked the 9th U.S. Circuit Court of Appeals on Wednesday to reverse Navarro’s decision, defending the Justice Department’s actions at trial.
“Any missteps were inadvertent (or at worst negligent), and those errors did not merit the court’s strong condemnation of the prosecution team,” White wrote, according to reports by the Las Vegas Review-Journal.
Navarro initially granted a mistrial after finding that the federal government improperly withheld evidence. She said video surveillance, maps and FBI interview information were willfully withheld by the prosecution in violation of due process required by the U.S. Constitution.
Cliven Bundy’s lawyer, Larry Klayman, responded to the government’s brief in a separate filing, calling the appeal “unprofessional and grossly unethical.”

This past week prosecutors appealed to the 9th U.S. Circuit Court of Appeals the decision by a Nevada federal judge to dismiss with prejudice all charges against Bunkerville rancher Cliven Bundy, two of his sons and a self-style militiaman from Montana because the government failed to disclose potentially exculpatory evidence to the defense.
Knowing the track record of the liberal 9th Circuit, odds are the court will order the defendants back to face charges.
The Bundy family has grazed cattle on public land in Clark County since the 1880s, but 25 years ago the Bureau of Land Management told the family it could no longer graze cattle in the spring because they might harm the hatchlings of the threatened desert tortoise — a contention range biologists say is bogus. Since those months are the only ones in which cattle gain weight on the desert range, Bundy refused to comply and stopped paying the BLM its grazing fees.
In April 2014, saying Bundy owed more than $1 million in grazing fees and trespass fines, contract cowboys backed by heavily armed BLM and FBI agents started rounding up the Bundy cattle. In response, armed men from across the West gathered for a face-off with the federal agents.
To avert a potential bloodbath the agents backed down and left, but Bundy and others were later indicted on charges that included obstruction of justice, conspiracy, extortion, assault and impeding federal officers.
Two of three scheduled trials took place, but a year ago during the third trial of Cliven Bundy and his co-defendants Judge Gloria Navarro abruptly halted proceedings and ruled that the prosecutors had willfully and flagrantly failed to disclose evidence that could have been used by the defense, including information about an FBI surveillance camera, documents citing the presence of snipers, certain maps, FBI logs, threat assessments that showed the Bundys weren’t violent, documents reportedly showing that no threatened desert tortoises were ever found to be harmed by Bundy’s cattle, and internal affairs documents detailing possible misdeeds by the Bureau of Land Management agent in charge, who was later fired.
The judge ruled the dismissal was with prejudice, meaning charges could not be brought against them again.
Curiously, most of that information cited would have allowed the defense to argue the defendants were provoked and were acting in self-defense, arguments the judge previously ruled were impermissible. The appeal goes into excruciating detail about this seeming contradiction.
In response to the appeal, Bundy’s lawyer Larry Klayman asked the appellate court to dismiss the prosecution’s appeal because it had missed the filing deadline. Though the prosecution asked for deadlines extensions, the court has not yet granted such an extension.
According to press accounts, Klayman also called the appeal “unprofessional and grossly unethical,” adding, “They are apparently hopeful that this court, if an appeal is heard, will relieve them from the prospect that their careers at the Department of Justice are over, much more the potential for disbarment. Given the record, this ‘Hail Mary’ attempt to skate from their own liability is destined to fail.”
But the appeal, penned by Nevada Assistant U.S. Attorney Elizabeth White, argues, “Any missteps were inadvertent (or at worst negligent), and those errors did not merit the court’s strong condemnation of the prosecution team.”
White also argued that court precedents show the appropriate remedy for failing to disclose would be either the dismissal of some charges or a new trial, not outright dismissal.
In arguing that disclosure of evidence might jeopardize the safety of witnesses and agents, the appeal dredged up a long-discredited base canard.
The brief stated, “Its goal was to produce all relevant information while protecting victims, witnesses, and law enforcement officers from harassment and threats, and from the violence that had already taken the lives of two police officers and a civilian at the hands of two of Bundy’s extremist followers.”
This refers to the fact that in June 2014, Jerad and Amanda Miller, killed two Las Vegas police officers and another man before being killed in a shootout with police.
What was not mentioned is that the Millers were a couple of leftist lunatics who showed up at the Bundy ranch standoff but were told by the Bundys to leave because of their “very radical” views. They were not Bundy’s “extremist followers.”
Despite this error, the appellate court is likely to look favorably on the prosecution’s appeal.

Reporters Committee secures FOIA win in case to uncover details on FBI impersonation of documentary filmmakers
Q&A: What the Reporters Committee’s recent FOIA win means for the public and journalists

The U.S. District Court for the District of Columbia has ruled the Federal Bureau of Investigation must search for and produce records related to the agency’s impersonation of documentary filmmakers during investigations in response to a request from the Reporters Committee for Freedom of the Press for more information about the practice.
After learning the FBI impersonated a documentary film crew to investigate Nevada rancher Cliven Bundy and his followers following a 2014 armed standoff between Bundy and the U.S. Bureau of Land Management, the Reporters Committee requested access to records related to this practice under the Freedom of Information Act. The FBI issued what’s known as a Glomar response, refusing to confirm or deny the existence of records responsive to the Reporters Committee’s request. The Reporters Committee challenged that response, arguing that it was improper, and the D.C. District Court agreed.
Jennifer Nelson, a litigation fellow at the Reporters Committee who has worked on the case, discusses the events that led the Reporters Committee to bring this lawsuit, the importance of the D.C. District Court’s ruling and the negative impact that the FBI’s practice of impersonating journalists has on newsgathering.
What prompted the Reporters Committee to file this lawsuit against the FBI?
The Reporters Committee has been interested in the FBI’s impersonation of reporters generally for a long time. Before we brought this case, we were already litigating against the FBI along with the Associated Press regarding the FBI’s impersonation of an AP editor in 2007.
After we learned that the FBI had impersonated a documentary film crew — Longbow Productions — to trick Nevada rancher Cliven Bundy, his sons, and a few of his supporters to give on-camera interviews, we knew that we wanted to learn more. Documentary filmmakers are also members of the news media, and the FBI’s impersonation of filmmakers is just as troubling as the agency’s impersonation of newspaper journalists. We filed a FOIA request in order to learn more not just about the creation of Longbow Productions, but also about other instances in which the FBI has impersonated documentary filmmakers in criminal investigations.
This lawsuit was filed in 2017. How has it played out thus far? How did we get to this point?
We filed the lawsuit after the FBI did not release records in response to our FOIA request. The FBI has since released a small handful of records specifically related to the FBI’s policies and guidelines surrounding the impersonation of documentary filmmakers. After the FBI issued a Glomar response to the portion of our FOIA request related to other instances where the FBI has impersonated documentary filmmakers in criminal investigations, the parties agreed to separate the issues and present the Glomar issue to the court for a decision now.
What is a Glomar response?
A Glomar response is when an agency refuses to confirm or deny the existence of materials responsive to a FOIA request. An agency’s argument when it issues a Glomar response is that even confirming or denying that records exist in response to a FOIA request would cause a harm that falls under one of the exemptions to FOIA.
In this case, the FBI argued that confirming or denying the existence of records related to other instances where the FBI has impersonated documentary filmmakers would cause a harm under Exemption 7(E) — meaning it would disclose secret law enforcement techniques or reduce or nullify the effectiveness of those techniques.
When agencies like the FBI issue a Glomar response, or when they don’t comply with FOIA, how does that affect the public?
The whole purpose of FOIA is to provide public records to the public. When you have an agency taking a position that is overly broad, withholding documents or issuing a Glomar response when they shouldn’t be doing so — which the court found was exactly what happened in this case — the public is harmed because it is not getting the information it’s entitled to.
When the FBI impersonates a member of the news media, such as documentary filmmaker, how does it affect the public’s access to information?
In our lawsuit, we submitted affidavits from two documentary filmmakers who detailed the negative effects they experienced due to the FBI’s practice of impersonating documentary filmmakers. This included situations where sources of theirs would ask them, “Are you actually an FBI agent?” Their sources implied that they could not trust the filmmakers because they didn’t know if they were FBI agents or actually journalists. If you have instances where journalists — such as documentary filmmakers — are not able to get the full story, that trickles down and limits what information is able to be provided to the public. There’s a chilling effect, and the result is not just harm to the journalist and their work, but also to the public, who is denied information it would otherwise receive.
This case was a win for the Reporters Committee because the court ruled the FBI couldn’t refuse to confirm or deny the existence of the records. Why is this win so important?
The FBI will now actually have to search for those records. It’s extremely important that we have an understanding of how often the FBI engages in this practice and when else they have used this tactic because it really has a harmful effect on journalists. It has a chilling effect on their work. Understanding how often this tactic is used and being able to report on that and give an understanding to people so they know what’s going on is really important. It’s very much in the public’s interest.
That being said, any responsive records that the FBI may release are still subject to redaction under the various FOIA exemptions, so this ruling doesn’t mean we’re going to get every document without redactions from the FBI. We’ll still have to see what they produce to us, see what those redactions are, and then decide if we want to challenge those redactions in court.
Does FOIA guarantee public access to these records? Why is it so hard to obtain them?
The answer to that is complicated. Certainly, we have the ability to request these records, and the FBI is supposed to search for, process and release those records that are not subject to certain exemptions that are lawful under FOIA. FOIA has a number of exemptions that permit an agency to lawfully redact or withhold some information as needed. This is done to protect, for example, as with Exemption 7E, legitimate law enforcement interests. We didn’t believe that was the case in this matter, which is why we challenged the FBI’s Glomar response.
When an agency claims information is protected under an exemption — even if it’s believed there’s no reason for it to be — how difficult is it to convince the court this information should be released?
It varies based on the exemption. Some exemptions are more difficult to challenge than others, so it’s on a case-by-case basis. We have to take a look at the records when we get them, see what the redactions are and if we’re going to challenge them and adjust our arguments accordingly. Also, the case law has developed differently for each exemption, so different standards can be applied. So it depends a lot on what’s being withheld and why the agency is arguing it’s withholding the materials.
Since this case fell under Exemption 7(E), why did the Reporters Committee argue the FBI’s response was inappropriate?
We had a number of different arguments. Our first was that the impersonation of documentary filmmakers is an investigation technique that is already well known to the public. As such, the FBI should not be able to issue a Glomar response, because the interest they’re seeking to protect — the secrecy of the tactic — is inapplicable. Courts that have analyzed withholdings under Exemption 7(E) have looked at whether the technique at issue is well known to the public and whether releasing information about that technique would reduce or nullify the effectiveness of that technique. The idea in a challenge is that if the technique is already well known, then the FBI shouldn’t be able to argue under Exemption 7(E) that confirming or denying the existence of records related to the practice would harm their ability to use it. The FBI argued that confirming or denying the existence of records regarding the FBI’s impersonation of documentary filmmakers would reduce or nullify the effectiveness of this technique. That argument doesn’t make much sense, and the judge picked up on that. The judge held that because impersonation of documentary filmmakers is a law enforcement technique that is commonly known to the public and simply acknowledging the existence or absence of records related to it wouldn’t reduce or nullify the effectiveness of the technique, the FBI could not issue a Glomar response.
We also argued that the FBI’s Glomar response was inappropriate here because the agency has officially acknowledged the existence of records. The court didn’t have to reach that argument because it held that the FBI had failed to justify its Glomar response under Exemption 7(E).
The third argument we made was that allowing the FBI to issue a Glomar response in this situation would cause First Amendment harms. The court acknowledged we made that argument but didn’t have to reach it because it was able to deny the FBI’s use of a Glomar response based on our first argument.
We touched upon how the FBI’s impersonation of journalists and documentary filmmakers can negatively affect the public, but what overall impact does this technique have on newsgatherers?
Journalists and documentary filmmakers are often asked to go into dangerous situations. For example, with this case regarding Longbow Productions, there were documentary filmmakers conducting interviews and research, and practicing journalism during the Bundy ranch standoff. There were armed militias present and violence occurred.
Journalists are putting themselves into dangerous situations all the time, and if you have a source who does not know if you are a journalist or an FBI agent, and they incorrectly conclude the latter, it can be dangerous for the journalist who does not have access to backup or a weapon or training that would allow them to defend themselves if needed. One of the two documentary filmmakers who submitted an affidavit in this case, Abby Ellis, talked about how nervous it made her to have some of her sources question her and say, “I don’t know if I can trust you.” The FBI’s sting operation using Longbow Productions has made her nervous going into some of these dangerous situations because she can’t predict if someone’s going to assume she’s a government agent and perhaps turn on her. In these current times, where there are many threats of violence against journalists, having the FBI engage in this practice causes a significant harm and threat to journalism and the trust that sources have to place in journalists who are recording and telling their stories. It negatively affects a journalist’s ability to gather the news if they can’t gain the trust of their sources.

Canadian records reveal that the company’s chairman used his own family foundation to make four donations to the Clinton Foundation during that time, resulting in a sum contribution of $2.35 million. Secretary Clinton approved the deal for Russia soon after her family’s slush fund received the donations. Now, Vladimir Putin controls 20 percent of all uranium production capacity in the U.S.
Undisclosed contributions made to the Clinton Foundation
These contribution were not made known to the public by the Clintons, even though Hillary Clinton made a deal with President Obama to disclose all the donors. Other individuals associated with the company made donations too.
Furthermore, after Russia declared that it was taking over Uranium One, Bill Clinton received $500,000 for a Moscow speech from a Russian investment bank, which promoted Uranium One stock.
A gold mine for uranium
It is not known whether the donations were responsible for the uranium deal, but the timing is suspicious. Since Hammond Ranch is a gold mine for uranium, it’s unsurprising that the Clinton Foundation would want to lease the land to Russia through donors.
This would also explain why U.S. authorities have been coming down so hard on protesters. Officials aren’t prosecuting individuals because of the Hammond controversy. Officials are coming down on protesters because they are occupying a valuable piece of land; a piece of land that was promised to the Russians.
According to The New York Times: “Whether the donations [to the Clinton Foundation] played any role in the approval of the uranium deal is unknown. But the episode underscores the special ethical challenges presented by the Clinton Foundation, headed by a former president who relied heavily on foreign cash to accumulate $250 million in assets even as his wife helped steer American foreign policy as secretary of state, presiding over decisions with the potential to benefit the foundation’s donors.”

I’m not sure how many of you were there in the courtroom when the case was dismissed. The room was packed. Her words and language were strong as to the irresponsibility of the prosecutor’s and how they mishandled our case. The fact is, the grand jury was lied to, as to many of the facts that got the men indicted to begin with. The lies were exposed in those first few weeks of evidentiary hearings, jury selection, and trial. Facts about our men, and their non-violent nature were withheld from the evidence they turned over. Facts about cameras being trained on the ranch home, along with facts about there being snipers and surveillance, on the family and home were not only withheld, but openly mocked when they were inquired about by my husband. When Ryan Payne called for protection from militia…it was because snipers were trained on the protesters and family…they denied it, but it was factually true. All of that came out with court proceedings, along with a ton of secrets, that we would all get kicked out of the courtroom for. To re-open our case is a long shot, but our judicial system is corrupt. However, Judge Navarro is a Harry Reid appointee….she’s in no way our friend, but her tongue lashing to the prosecutors was strong. I have serious doubts her decision could be overturned.
So, am I worried? No…however…we still have Greg, Todd, and Jerry still incarcerated over the lies that were told to the jury and the grand jury. Could another trial help them?? If it could, then it’d be worth it. The truths that already came out in our hearings should logically set them free already. But it hasn’t, so we watch and wait. It is my hope and prayer that there is some truth to the trafficked children and pedophiles lurking around the New York City tunnels and Comfort and other Navy vessels docked there are the poor children are actually being rescued and the pedophiles there are being apprehended by surprise operation of Team Trump, rather than the cover story of the activity there being for the purpose of medical care for the Covid 19 cases. That will exonerate Flynn forever and may also blow the lid off the DOJ deep corruption. and I think that would also end the going after of Bundy Ranch forever.

Most of the nation is now entering at least their third week of government-mandated stay-at-home orders. Many folks are doing just fine during the crisis, but others, especially those who had their businesses shut down or lost their jobs, are not doing fine. As the government continues to tell people to remain calm and wait it out, as the following case illustrates, others are bucking the system.
In Boise, Idaho last Friday, a few dozen people violated Gov. Brad Little’s order to avoid group gatherings, and met inside an old factory building to discuss how to move forward in these uncertain times.
Led by Ammon Bundy, meeting goers were given information on and discussed how to create a network of people ready to come to the aid of those who have been affected by the government’s shutdown of the economy.
“It really doesn’t matter what numbers there are when it comes to the coronavirus. It really doesn’t matter if it’s real or not, if it’s rampant or not, whether it’s a pandemic or not,” Bundy said during the meeting in Idaho. “Because it still does not give government officials the right to infringe upon on our rights. And that’s what matters.”
“I think people are very interested,” Bundy said in response to whether he envisions a national effort pushing back against restrictions on businesses and large gatherings or other efforts intended to protect public health.
“I think we have to think about if we were successful here, spreading it, at least the knowledge and things we learn, way beyond even the state of Idaho,” he added.
Bundy urged attendees that it was not at all time for a violent uprising and told them to remain peaceful. However, he noted that if it gets bad enough, this network, which would essentially be a militia, would take a stand.
“If it gets bad enough and our rights are infringed upon enough that we physically stand in defense in whatever way we need to — but we hope we don’t have to get there,” Bundy said.
During the meeting he made sure to dispel any calls to violence and encouraged fellow Idahoans to use restraint and not “instigate” situations.
“You have to make sure that every effort has been taken to try to resolve it in a peaceful manner, in a prudent manner. That is what we have to do to be right with God and to be right with our fellow man,” Bundy said.
Bundy said this entire resistance to government imposed economic devastation is dependent upon unity of the people.
“People will stand if they have confidence that there’s others who are going to stand with them,” Bundy said.
Bundy’s comments and support did not go unnoticed and received criticism from the community.
“There are a lot of people that listen to those voices around here,” said Dr. Hans Hurt, an emergency doctor at Bonner General Health, a medical center in the town of Sandpoint, 45 miles north of Coeur d’Alene, according to the NY Times. “Even if it’s just a small group that wants to exercise their right to assemble, it puts the community at large at such a high risk.”
But it wasn’t all negative feedback. According to the Times, Bonner County Sheriff Daryl Wheeler posted an open letter saying that the public had been “misled” by public health officials’ dire predictions and called on the governor to convene an emergency session of the Legislature to debate his stay-at-home order.
“In the spirit of liberty and the Constitution, you can request those that are sick to stay home,” Sheriff Wheeler wrote. “But, at the same time, you must release the rest of us to go on with our normal business.”
For those who may not know who Ammon Bundy is, he is the man who along with his father and brothers, helped spearhead the massive act of resistance in Oregon against the Bureau of Land Management that garnered world wide attention.
Before that, the Bundy family initially made headlines in 2013 when the Bureau of Land Management brought armed agents in to seize rancher Cliven Bundy’s cattle after his refusal to pay federal authorities a massive debt – which he claims is illegitimate.
In response to the militarized response in Nevada by the BLM, militia from across the U.S. mobilized and coordinated a response which saw hundreds of armed Americans stand up to what they perceived as vast federal overreach. It happened again in 2016 as another armed group of militiamen took over Malheur National Wildlife Refuge, in rural Oregon.
They have proven on multiple occasions the ability to organize large and heavily armed protests — and get away with it.
The group of men who seized the refuge, in rural Oregon were found not guilty in 2016, vindicating brothers Ammon and Ryan Bundy after the 41-day standoff that brought nationwide focus to long-running dispute over federal control of rural land in the Western United States. However, the charges from the 2013 incident were still pending.
In 2018, however, Nevada rancher Cliven Bundy and his sons were released by a federal judge in Las Vegas, after she dismissed with prejudice all charges against them. Prosecutors’ failure to disclose evidence had led to a mistrial.
US District Court Judge Gloria Navarro ruled on January 8, 2018, that the government committed “flagrant prosecutorial misconduct” in the process against Bundy and his sons in relation to the 2014 armed standoff with federal agents over grazing rights.
It is important to point out that TFTP is not advocating a stance on this issue, however, love them or hate them, the Bundy family has proven time and again that when a well-armed and organized resistance is mounted against a perceived injustice, the government listens.

As a defender of the Constitution and Bill of Rights I personally applaud his taking a stand. After being held in jail for 2 years without bail I am sure he is well aware of the consequences he may face.

Pete Santilli is writing a book. After Sept. 9 he says he is free to speak with Cliven Bundy and his co-defendants to begin interviews for his book.
When Santilli took the plea bargain I got a feeling he was/is a fed snitch and no longer trust him so I no longer watch his videos or listen to what he has to say. Once in a while I receive an email from his company mostly soliciting funds. This one came today. I really wonder if Cliven Bundy & family trust the guy.
